divers are entering the submerged parts of the boat, firefighters go in parts above water. they are scheduled on 6 hour shifts. the ship started to tip friday night when it hit a rock that tore a 160-foot hole in the hull. costa cruise lines, ceo says the captain miscalculated. >> we believe, it has been human error here, the captain did not follow the authorized route. >> reporter: he faces several charges including manslaughter, and abandoning ship. monday, prosecutors said, they jailed the captain, because they were concerned there may be an attempt to tamper with evidence. there are growing environmental concerns crews are laying floating pipelines in case 500,000-gallons of fuel onboard

>> it all started with a bowl of rice crispies in california. now a husband is under arrest after allegedly trying to poison his wife's breakfast cereal the 51-year-old wife was rushed to hospital after she felt sick and noticed her meal tasted horrible. tests on the cereal found it was mixed with a poisonous chemical her husband, 43-year- old fernando perez is being held on suspicion of attempted murder. terminally ill woman dies just days after her husband shot and killed their son, her two sisters and himself in ohio. cancer patient, 59-year-old darlene was not hurt in last week's rampage, police say the

shootings apparently stemmed from family tension over the care of the cancer stricken woman. two officers opened fire after scuffling with customers outside a diner in denver. they originally lost their jobs but, that is now changing. >> reporter: it was outside the denver diner, july 12th, 2009 where video captures officer nickson, macing a woman while she is on her knees, that woman is anna or they gay. >> i was the person who was grabbed and maced in the face. >> reporter: then the officer turns on by standers spraying them with mace and then throws down handcuffed suspects the second officer to arrive on scene, gets into it with the crowd trying to pull on one woman and shoved her friend to the ground. >> i've stated all along, that when you look at the facts of this case it never warranted termination. >> reporter: it is unclear if the officers knew a city halo

cam was recording them but sources close to the case said when the officers wrote their reports they left a lot out. april last year the then man in injury of safety, charles garcia fired the officers for description and excessive use of force. >> we police ourselves if we have some body bad amongst us we want them out these guys didn't do anything wrong. >> reporter: this isn't over yet, anna ortega and three other women have filed civil suits against the city of denver. >> now i am hoping a jury of my peers will serve us justice myself and the other women involved. >> reporter: as for the officers this city can still appeal this decision. the victims are filing civil suits city of denver can appeal the decision to rehire the officers. a cyprus tree collapses, now all that is left of the 3500-year-old tree is a stump. the famously tall cyprus named the senator was part of a property donated by a florida

because there is another storm coming our way. we will get to that in a moment. before we do this is where we started out the day this is lower than average in the teens outside, take a look where we have recovered to this afternoon 39 degrees baltimore, upper 30s to 40 degrees cooler than 33 in cumberland. now the winds have turned to the south that will bring even warmer air our way but we topped out so far today at 40 degrees you can see there is that average of 41. very close to it. we are going to go above this average tomorrow but we are coming back down second half of the week. roller coaster will continue we will take you through that now. these are southerly winds bringing up the warmer air it does factor in for wind chill. winds have been up a little, feels like 33 baltimore, 30 hagerstown. 32 ocean city. down to our south, there is warmer air, however you notice just behind that there is another round of arctic air starting to come down from the north that is going to follow this next storm clouds start to

come in today, rain will arrive, rounds of rain all because of this in here going to pick up a lot of moisture, that passes along the gulf coast states and moves in our direction when it does it will have enough warm air it will be in the farm of rain for us. then it gets out of here wednesday, at that time, winds turn back around to the northwest, colder air starts to arrive thursday into friday when the colder air is in place there is another disturbance that will come by. a chance for rain or snow showers as that happens the forecast comes together like this on the waters we will see small craft advisories. tonight overall we are not going to drop that much 35 our low but rain arriving, then tomorrow, 53 for our high, so the rain is going to come with a push of warmer air. rain and drizzle on and off during the day. when this rain leaves us that is when the colder air comes for the second half, up and down, up and down continues, the good news for everyone who

>> it is 4:29 a.m., 39 degrees partly sunny thanks for staying with eyewitness news, i am denise koch former penn state football coach joe paterno finally speaks out. paterno said he had no idea of a possible dark side to jerry sandusky. >> i called my superiors, and i said hey, we got a problem i think. >> reporter: in his first interview since the penn state scandal broke, joe paterno told the washington post he is

shocked and saddened at the child sex abuse charges. the 85-year-old is currently under going chemo therapy for lung cancer, sitting in a wheelchair he told reporter jenkins, after informing two top university officials, after a 2002 shower locker room incident he did not follow up more aggressively out of fear of influencing any internal investigation >> i didn't know exactly how to handle it and afraid to do something that might jeopardize whatever the university procedure was he said and so i backed away and turned it over to some other people. if there was a problem they would follow up on it. those other people were former athletic director, tim curly and school vice president, gerry schultz both now charged with lying to a grand jury. >> i had never had to deal with something like that. >> reporter: in addition he told jenkins even if former assistant coach had been more

graphic in his description of the alleged 2002 shower room rape, it may not have registered. to be frank with you, i don't know that it would have done any good paterno said because i never heard of rape in a man. paterno said he is reserving any judgment of sandusky, charged with more than 50 counts of sexual abuse and school officials, preferring to let the legal system run its course. >> sandusky remains free on bail while awaiting trial later this year. >> one of the men making sexual abuse allegations against a former syracuse assistant basketball coach said he made up his claim. he said he wanted to get back at the coach because fine didn't help him fight a criminal conviction. fine raised him after his parents died in november, two former ball boys for the syracuse team accused fine of abusing them as children. fine denies the allegation. >> dangerous search and rescue

mission continues off the coast of italy where a cruise ship ran aground, and flipped on its side. kai. 4200 people were onboard when rocks tore a gash in that ship. 6 people died 29 are still missing including a couple from minnesota. cruise officials said the captain made an unauthorized change of course and there is increasing concern the wrecked ship could spill fuel into the water so crews set up a barricade earlier today the area where the ship crashed is part of a protected dolphin sanctuary. the ship's captain is under investigation for manslaughter abandoning passengers and crew and causing the ship wreck. >> maryland natural resources police are investigating a body found in chesapeake bay the body washed up along chesapeake harbour drive, so far investigators have not been able to identify the victim the medical examiners office is trying to determine cause of death.

>> baltimore police looking for three people who stole equipment from sinai hospital they drove a rental truck up to a loading dock at the hospital, january 6th, they loaded a large piece of medical equipment on to the truck and drove away. anyone with information on this theft is asked to call city police. >> from coast to coast americans paid tribute to dr martin luther king junior on what would have been his 83rd birthday, danielle nottingham reports with a look at ceremonies, honouring the legacy of the civil rights leader. >> reporter: these three friends brought their sons from new york, to rkmartin luther king day at the monument dedicated to his life and legacy. >> see all the generations and faces and nationalities come together. >> reporter: crowds packed the dr martin luther king junior memorial on the first king holiday since it was dedicated and opened to the public. earlier in the day reverend al sharpton helped lay a wreath to honor dr. king. other cities did the same, with

marchs, and parades. ♪ [ music ] >> reporter: in atlanta, thousands gathered at the church dr martin luther king junior once lead for a service that focused on the best way to carry on his legacy. for many the holiday is not just an occasion to visit the monument, honouring dr. king it is an opportunity to give back to the community. the first family spent part of the morning with a group of volunteers working at a washington dc school. >> let's see how this works. >> reporter: the president helped assemble new book shelves later he joined first lady michelle and daughter melia to paint some of the famous quotes on the wall in the library. >> there is no better way to celebrate dr. king than to do something, on behalf of others. >> reporter: that message reached the three families who made the trip to the king memorial,. >> he got white people and black people to come together

to be here for his birthday. >> reporter: bringing history to life, for the youngest member of the group. in washington, danielle nottingham, wjz eyewitness news. washington national cathedral hosted the special service this afternoon to celebrate king's legacy he delivered his final sunday sermon in the cathedral before his assassination. a warning for all diet soda drinkers a new study suggests it may have unintended consequences mary. >> according to a new study in eating well magazine diet sodas could cause you to gain weight. research which ares at university of texas looked at people who drank two or more per day over a ten year span those people had an increase in waist circumference, six times larger than those who didn't drink diet soda. doctors say the sweeteners can cause the body to crave more sugar, leading to a greater appetite. denise. >> interesting thank you mary.

>> previous studies found drinking diet soda may lead to higher risk of heart attack and stroke. more than 220,000 americans have weight loss surgery every year, there are two common types of procedures but a new study shows one may be more effective. randall pinkston reports for wjz. >> reporter: lynette trotman decided to have weight loss surgery after being diagnosed with high blood pressure. i was so heavy no scale could tell me my weight. >> reporter: she chose gastric banding doctors put a band around part of the somic limiting how much she could eat. she thought it was the safest option but three years later after complaining to her doctor she had the band removed. >> i told her, like what is going on you know, i am not losing any weight i am gaining weight still. >> reporter: her experience is not unusual, nearly half of

patients who chose gastric banding were still obese after six years according to a new study in archives of surgery. patients had more long term complications and follow up operations than those with gastric bypass where doctors use staples to create a small stomach pouch. the study found those who had gastric by hass lost weight more quickly and kept it off longer than the bands. there is a reason bypass patients may have better results. >> when we remove parts of the stomach we change hormones that control hunger and fullness and really change people's relationship with food. >> reporter: trotman regrets choosing the gastric band >> it was an experience i learned from but a very big mistake. >> reporter: she under went and had the gastric bypass in the fall and shed 77 pounds with diet and exercise she plans to lose even more. in new york randall pinkston

the procession saw it happen in his rear-view mirror he ran over with multiple patriot guard riders and busted out the window offs the jeep as it went up in flames they quickly pulled a mother and her 6-year- old daughter from the vehicle. a grandmother and 6-year-old boy were also rescued the woman and her young daughter were air lifted to hospital in chicago. denise. >> thank you adam other victims were taken to a nearby hospital with minor injuries. >> investigators learning more after searching the home of the iraq four veteran accused of murdering four homeless men in orange county. >> why did this happen? why did this young boy, 23 years old, do something so horrific, and just ruin his whole life. >> reporter: ron short lives across the street from accused serial killer. the man police say fatally stabbed four homeless men in orange county. >> horrible. >> reporter: he went by the

name izzy and mostly kept to himself until one day she called campo to rescue a baby bird that had fallen into a drain. >> he came over and she said how focused he was on that little baby bird. >> reporter: we now know he was an iraq war veteran enlisted in the marines in 2006 after graduating high school but was discharged in 2010. according to associated press his father, who happens to be homeless says his son came back from war disturbed. >> there is something wrong with that individual. i mean to pick on someone or pray on someone who is a homeless person is just wrong, barbaric. >> reporter: police arrested him friday night after by standers chased him a quarter mile down the street from where police say he stabbed his latest victim, a well liked homeless, vietnam veteran, john barry today a growing memorial
