department mishandled 2 incidents of misconduct involving one particular officer. our car for sarah stinson spoke with the civil rights attorney who has been working to reform the oakland police department for over 2 decades. she joins us now live in the studio. >> kind of break this all down for us. >> yeah, that's exactly right. after learning about this report, of course, we checked in with attorney with our civil rights attorney that we know john burris, you may know him. he's worked in from 2000 until now trying to work on corruption within the oakland police department and he says he was stunned when he read the report today. >> jackie, jackie, but though the crimes and police often commit crimes should be held to a high standard. understand that everyone attorney john burris says he was just months away from a judge issuing a final order on a reform case involving the oakland police department hoping police officers who were >> members of the community

constitutional violations such off the grass, perjury, beatings, etcetera, 9 greatest issue has exploded. >> front of us that the city of oakland hired an outside law firm to investigate alleged misconduct of personnel within the police department. its report reveals alleged misconduct surrounding one police sergeant and the overall department's failure to hold that officer accountable. report pretty scathing, certainly disappointing for because it contradicts a lot of the work that we've been involved the first incident explained is one that took place in march 2021, the law firm says the sergeant was driving in opd chevy tahoe with another officer when he hit a parked car in a garage recovered video shows the officer left the scene of the incident without ever getting out of the car and didn't report the crash to the police department. the documents also say internal affairs conducted an investigation. >> and concluded the sergeant had not violated the department's rule requiring

obedience to laws about a hit and run game, hit a car getting run. >> you've got to if you count doesn't stop. and, you know, it really raises question about that person. judgment. and we've in commitment to the rule of law. >> the law firm also says they found out the sergeant was dating the officer who was a passenger during the crash. and the 2 failed to report the relationship to the department. it later came out that the investigator presented findings and recommendations out a weekly meeting with the chief in december 2021. 8 months after the crash, the report states the officer did receive counseling and training. then one year later in april of 2022, the report says the same officer fired his gun inside a freight elevator at the police administration building in oakland. investigators say he removed evidence of the discharge and then fail to reported for over a week. the independent law firm concluded the department has a lack of commitment to hold its own members accountable for violations of its own rules. this uris what burst thinks the

city can do moving forward. take a real close look at what happened, why it happened. >> and what can be done to fix it because at the end of the day, it's not a day that has happened is what happens tomorrow and whether or not we have something in place that will prevent this from happening tomorrow. unfortunately thought we did. but obviously we didn't. >> the mayor's office says they received this report yesterday and they expect more findings to be released later while police chief armstrong remains on administrative leave as assistant chief darren allison will serve as acting chief. reporting in studio. sarah stinson kron. 4 news. >> and the oakland police officers association responded tonight today saying despite the decision to place chief armstrong on administrative leave, oakland residents can be sure that it's dedicated police officers will continue to respond to their calls for help. >> oakland mayor shane cow also releasing a statement saying in part the decision was not taken lightly, but we believe that it is critical

for the safety of our community that we build trust and confidence between the department of the public. we must have transparency and accountability to move forward as a safer and stronger. oakland councilmember rebecca kaplan said tonight the independent monitor's report proves. >> that investigations of police misconduct should be handled independently and by civilians. opd should not be in charge of investigating themselves. council has previously voted for that change. >> new at 9. take a look at this video from san jose. firefighters rescued a woman who became trapped in the mud slide along coyote creek crews say the woman was living at the homeless encampment on a road nearby. the a woman was taken to a hospital with non-life-threatening injuries. >> also in san jose, the city is opening transition facilities for unhoused evacuees who had to leave encampments along riverbanks and elsewhere as water rose because of all the recent rain facilities will be available

at 3 of san jose's existing quick build housing communities. those are at ferrari, monterey highway and bernal road and off maybury road. the tr nsition facilities will accommodate about 130 tents on wood pallets at the quick build communities, bathrooms and handwashing facilities will be available. unhoused people staying in the transition facilities will also have access to support services, including job placement assistance, mental health counseling and assistance applying for permanent housing. >> another big story we're following for you tonight. president biden stop in california today to survey damage left by the relentless atmospheric rivers coming off air force one. president biden officially arrived here in california just before noon at moffitt airfield in santa clara county. and from there the president to attract south to santa cruz county touring the coastal town of capital and then meeting with impacted business owners. there. >> the people in california, i say it again. the country is

here for you. and with you. we are not leaving until things are built back and build back better than they were before. >> president biden says building back stronger will be possible in part to the major disaster declaration that he's signed for. the storm ravaged parts of our state. the bad weather is really hurt. san mateo county, hundreds were displaced and the major highway near half moon bay. it's still only one lane because of a sinkhole. there. this conference, theresa reports tonight. a local official says federal dollars that will help but note the need is immense. >> at double slide, a giant boulder came crashing down, blocking southbound lanes on highway one. a few miles away. a sinkhole on highway 92 continues to create hardships for residents and businesses. mobile homes flooded open up the san mateo county event center. we had cots and were able to to help people that way. >> hotels we had to open up.

there are homes that fortunately wreck that we the brunt of it. it dave canada or supervisor was san mateo county says recently announced federal dollars will certainly help the county and its damaged infrastructure. you know, it's our whole. we've got a lot of damage on the coast and a site. our whole is those dollars will really a move us forward direction were able to repair cannabis as well. fema money will mend a lot. there are still many and funded problems. mistake about it. i hear all the time from a residence. small business owners. your insurance may not cover everything or some don't have insurance one of the things that you're always hopeful for. hopefully the administration will do this going forward is to see what we can do to help them with federal dollars. he also adds long-term fixes are needed to address chronic flooding. we

know flooding is going to happen. we know a climate change is real. so we need to really look at it. how are we going to make it resilient through the right infrastructure to protect us and those those expenses are of their early, a costly, but well worth it in the long term projects or we're going to protect us. cannabis. as in the meantime, county crews continue to clean up and brace for the next storm. theresa kron, 4 news. tonight. there's a 3.6 magnitude earthquake near lake sonoma happened just after 5.15. >> and there are 2 other quakes in northern california today morning about 8 miles from hollister near where president biden was serving some storm damage. first quake measured 3, 5, that was followed by a 3.3 aftershock. no damage reported for many of these little quakes as we turn our attention to the 4 zone forecast to get a live look out here at san francisco city hall. clear, cool night. beautiful night city hall lit

up in red and gold for the niners clear meaning no rain. but boy, it's chilly out there. i was outside of yeah, it is. temperatures going to be cold out there. this last front that came through came from the gulf of alaska. so bringing that cold, alaska air into the bay area. and yeah, it is going to be chilly out there. >> and that around the bay, are these temperatures probably going drop below freezing, at least in some of the valley's outside. so numbers getting cold already. check out redwood city inside the bay. 39 degrees. 41 in concord. 38 in fairfax now. 35 in calistoga and 36 for friends and kelsey bill. so get cold out there around the bay area tonight and skies going to stay mostly clear throughout the night tonight that allow these temperatures. well, the drop down below freezing in some spots. so freeze warnings have gone up all the way from healdsburg down in the petaluma cross the snowmen app and well, the east bay to look at some very cold temperatures. freeze warnings all the way into the tri valley down now into parts of the south bay, including san jose to so very cold out there overnight. tonight here, the expected lows for tonight about 31 below freezing in

livermore. 31 also in santa rosa. but i think in some of the areas in and around the city, there are probably going to get a little bit colder than that, maybe into the upper 20's as you make way toward the coastline, not as cold but still chilly. 42 for low temperatures. go about 40 and half moon bay. all right. big change in the weather pattern. finally after a week's of rain continuously, well, high pressure building in now. and you can see kind of that arc here that clockwise rotation. and that's orms. well to the north, the jet stream finally making its way all the way up into canada now. so that's going to keep us high and dry and a little bit of an offshore wind out there, too. so because we get in toward the latter part of the week, especially will be breezy at times as we head into the first part of this week, too. but looking at some nice, dry weather. the one thing we've got to watch out for still the possibility of some more flooding. and that's because we've got the king tide rolling into town again. and they'll the right around the through the weekend to probably into monday as well. these are some pretty large tides. these are 6, 7, foot tide rolling. in fact, the

tides getting higher as we head in toward the weekend here. so even tomorrow of the high tide coming in 9.22, in the morning. so watch out for that. that is commute time. so be careful where you park your car tomorrow. that tide is going to be a 7 footer. that is a big tied saturday. probably the largest of the king tide rolling in at over 7 feet and sunday. also 7 footer that occurring but large tides continuing in the next week, too. but here's the good news. high pressure looks like it is finally going to build in and that ridge is moving that jet stream to the north so returned some dry and some sunny weather around the bay area. something we really have been able to say since the end of december, but looks like we're going to get a nice, much needed break in the stormy weather pattern outside. so enjoy it. while we tomorrow. the temperatures warm up a little bit more 50's almost 60 degrees in some of the valleys as we head through the next couple days. more sunshine on the way, keeping it dry through the middle of next week. >> all right, lawrence, on the peninsula. the search continues tonight for a swimmer missing off the coast

of san mateo county. police say that 3 people went into the ocean this morning at esplanade beach in pacifica. but one did not make it back to shore. first, dan thorn has more on the search in that missing man's connection to a local university. >> the u.s. coast guard searching from the air and on the water for a missing swimmer. >> pacifica police say the man was in the ocean with 2 friends before he was struck by a large wave and pulled away from the shore thursday morning. on-lookers embracing one another as the search was underway at esplanade beach, got a rogue wave caught him. and that was that. >> when the tight, i don't come out here, it says dangerous beach. locals and emergency crews tell us the 3 swimmers were likely unaware of the dangers of the water and the steepness of the beach. as soon as you get out, just maybe 15, 20 feet drops off and it's like a big washing machine. just tumbles back and forth. so good, knock you off your feet. >> and then you can become disoriented. and that rip

gets. >> it's real tough to swim. and kron. 4 has learned the man who was swept away is a student at san francisco state university. the school says the entire sf state community is hoping for a safe recovery. our thoughts are with the student's family, friends and classmates. a neighbor saddened by the tragedy leaving behind flowers. and it just seems like a very sad situation. >> and i just wanted to somehow. do what i can. so that makes it family. feel better. for a moment. >> well, that missing swimmer has not been identified by authorities. safety crews warn the water in this area can be treacherous and they stressed to never turn your back on the ocean reporting in pacifica, dan thorn kron. 4 news. >> and san francisco mayor london breed in board supervisor hillary ronen introduced legislation that would overturn a city law allowing nonprofits to set up safe injection sites under the supervision of workers trained to prevent overdoses. the

sites would facilitate people injecting drug sunday, but they call hygenic environment with clean needles. sits a plan. they say, well, not require taxpayer money, but opponents say the sites would not only increased drug use but would also cause big problems for people involved. >> anybody in will be is that because such a site can be subject to, you know, prosecution because this a foundation also just a little as well as the federal law. >> last year, governor newsom vetoed a bill that would have allowed some cities, including san francisco and oakland to set up supervised drug consumption sites were still herring. a strong reactions after a san francisco art gallery owner was arrested for using a water hose. >> on an unhoused person outside of his business. call your going facing charges for misdemeanor battery for the alleged intentional and unlawful spring of water on and around a person

experiencing homelessness. but the president of the san francisco branch of the naacp explains why he believes the law enforcement response is misguided. in this case. >> no, i don't know what happened, but i'm saying is couple billeted on both sides of the lake. this was an in which a man with garden hose most of did. michael the late it will walk out the call seen alston and he has admitted that he was wrong. and i think that he deserves restored justice and not punitive. just okay. >> advocates for the unhoused to say they disagree and say these kinds of acts against the unhoused community are more common than we might think. collier gwin posted $2500 bail and is currently out on custody. forty-niners ticket prices. boy, they're soaring ahead of sunday's game against the dallas cowboys. yeah. you got to have some cash to get and kron four's.

justin campbell is live outside levi stadium. >> with how much it it's going to cost. if you plan to see the game just to keep going up. oh, that's right. grant. it's a lot of money and they have to take some of my paycheck. but i don't know if i can afford these tickets. i spoke to a ticket price company today. they tell me that average price. >> today, $750 and they expect that to go up before kickoff sunday. >> the excitement is growing for sunday's nfl playoff game. the forty-niners versus the cowboys and so are the ticket. price is still an additional about. kyle zorn with take pick a ticket. sales website says the much anticipated game. >> will most likely be sold out the cowboys, the forty-niners to very passionate fan bases, 2 bases that travel well into damages that are willing to spend. >> money forty-niners tickets were around $250 sunday, but they jumped to 750 after the cowboys clinched a spot in the divisional round sunday night.

extraordinary measures as the federal government hit its debt ceiling today, treasury secretary janet yellen sent a letter to congressional leaders urging them to act to raise the limit. a political fight is now underway and the clock is ticking on a compromise. >> there will not be any negotiations over the debt ceiling. it should not be used as a political football. i think it's a sign of arrogance. if you would say he wouldn't even discuss it. >> congress is expected to continue working on the issue when it gets back to work next week. there's finally some good news for bay area. home buyers prices actually are going down. that's according to the latest national housing report from home prices in our region experienced the largest year-over-year decline in the country. according to the real estate company, fremont led the way seeing a 10% decrease in home prices followed by san jose decreasing by almost 9%. san francisco saw a 4% de decrease in prices and prices in mountain view or just below that home sales are also down.

the bay area saw a 41% decrease in home sales 2022. compared to 20. 21, the san francisco ferry building is getting a facelift. the plan includes an expansion of indoor seating outdoor canopies along the embarcadero. >> and they'll have space for at least 2 new waterfront restaurants when they're done with the project. there are also plans to repair the 50 year-old ferry plaza and improve pedestrian walkways that the terminal, the projects will begin late this year will take about 2 years to complete. up next, after cleaning up. >> with this big storm, we just had bunch of them. actually. east bay regional park are urging caution. 2 visitors is they are still trying to pick up debris and see which trees are safe. we'll also take a look at the most recent drought map. yeah, dry, california, past 3 weeks, how good things are looking now and then we continue our coverage. the latest

for opd. tough job over the last decade. many people chosen to be chief of lasted. >> only a short time kron four's also the money and takes a look back it all the people who held the position and the challenges involved with the job. >> the role of oakland police chief has historically proven to be a challenge. at 1.0, 3 different chiefs eat resigned within 9 days. former mayor libby schaaf was once forced to get her city administrator involved. here's a closer look at the tumultuous time line in the last 10 years at opd. that includes 8 police chiefs in 2010. anthony batts join the force after for opd officers were killed in a shootout. yeah, he quit abruptly the following year saying the job had changed, claiming he had limited control but full accountability that was proving to be difficult to implement his vision for reform. howard jordan, a career opd officer, then stepped in dealing with the scandal where opd officers were accused of having with an underage girl. yet 2 years later, he claimed he needed to leave for medical reasons.

then there was anthony toribio, another longtime opd officer. well, a nationwide search took place. he stayed for 2 days until sean whent slid in when to lasted 3 years as chief. he was known to work weil with the federal monitor, charged with overseeing the department yet faced increasing criticism, but some saying he was not aggressive enough on those thought to have been having inappropriate relations with the teen. his departure led to the most problematic period to date for the department in the space of 9 days. the most important city administrator sabrina landreth took over between 2016 2017 and after a long search and kirkpatrick was sworn in in 2017, only to be fired after 3 years on the job following a vote by the oakland police commission for kron. 4 news. i'm ella sogomonian

>> all right. good news here. according to the most recent drought monitor map, there are currently no extreme drought conditions in california. this new map released just today. she is a whole lot of yellow and some are engine there. not great, but much better than what we have been seeing. no red. that's great. red signifies those extreme drought conditions for perspective. here's a look at where we were just a few months ago. this is in october, october, 11th a lot of red and even exceptional drought that room there in the central valley. so back to last week after we had a bunch of storms, there are hardly any extreme drought conditions. just a little bit of red up there near siskiyou and modoc counties. but again, today. we're free from the red. doesn't mean we're out of the drought entirely. but great progress and a fantastic start to 2023. >> the east bay regional park district is urging caution to visitors. the parks were hit really hard after a series of

intense storms and as our kron four's gayle on reports tonight, there may still be hazards out there. >> here at coyote hills park in fremont. this is normally walking entrance to one of the hiking trails. as you can see, all the standing water blocking that entrance. and this is one of the reasons why several east bay regional parks are closed now happy that this while the a free month says she has never seen the water this high at coyote hills. she normally hikes this park a few times a week instead or biking and she's not aloee. this man was surprised when he showed up to his daily running trail inundated with water. >> but others made it work. we're going to run through this one. and then there's another giant puddle that within that road open. so. >> so for me, i live pretty close by this is like daily to get ready for the appalachian trail. >> other parks and trails around the east bay are closed due to d.mage from this series

of intense storms falling trees, mudslides, dave mason, public information supervisor with the east bay regional park district urging caution when visiting some parks. the ground is highly saturated. >> and there's some potential safety hazards that remain that predict along the mlk shoreline in oakland, the rain washed up so much trash. the park district held a post storm cleanup thursday with volunteers giving a helping hand. we love to open our parks as soon as we can. but we want to make sure that they're safe. public safety is our top priority. >> and if you want to head out to any of these parks, the east bay regional parks department, highly urges that you check their website for updates on closures and reopenings. you can find a link on our website. kron 4 dot com reporting from fremont gayle ong kron. 4 news. >> thank you, gayle. happening now, the federal government is directing 930 million dollars toward reducing wildfire danger in 10 western states. >> including california. the investments are part of a strategy now entering a second year to prevent fires that

start on public lands by clearing trees and underbrush to try to protect surrounding communities. the sites targeted for spending this year cover much of southern california along with the klamath river basin on the oregon, california border. officials say wildfire prevention efforts could be affected negatively by budget cuts floated by republicans who now control the u.s. house. >> thousands across france today marched against the government's plan to raise the legal minimum wage pension age from 62 to 64 french president emmanuel macron had made pension reform a centerpiece of his presidential campaign. a recent poll in the country suggest that 2 thirds are against raising the pension age. every union in the countries participating in the march is in the protests and they hope to get 1 million people out there on the streets. trains metro's buses,

airports in schools everywhere, you affected by today's demonstrations. >> now to seoul, south korea, where a huge fire spread through a village where they had a lot of densely. constructed, makeshift homes destroyed at least 60 homes, forced about 500 people to flee. photos from the scene showed firefighters fighting the flames under thick white smoke covering the villages. helicopters sprayed water from above. officials believe the fire started at one of the homes made with plastic sheets of plywood. the cause is still being investigated and they're continuing to sift through areas affected. but amazingly, they believe everyone was able to get out safely. >> still ahead, a legendary singer and songwriter has passed away. remembering the music life and legacy of david crosby. >> properties fairytale ride will coming up against the cowboys pressure that defense can get to the quarterback next. in sports, we'll hear

>> in national news, florida governor ron desantis is administration has blocked a new advanced placement court, a course on african american studies from being taught in

high schools. the state education department did not specify exactly what content they found incorrect but say it violates florida state law is historically inaccurate. the pilot program is still debuting at 60 schools across the country before it expands to additional schools. according to the college board, they have been working on the course for more than a decade. >> the supreme court issued an investigative report today announcing it has yet to determine who leaked a draft opinion overturning it's roe v wade decision to the media. last year. the court said at least 90 people had access to the document at one point and it could not identify. >> who is responsible in a statement? it also said it is unlikely the leak resulted from a computer hack. investigators say some of the staffers did admit to telling their spouses about the decision. but that everyone denied leaking the draft. the leak, the worst breach of confidentiality in the court's history prompted chief justice

pretty well. >> as we're going to see a dry weather pattern kind of just settled in now. and nice clear skies out there right now. beautiful look out towards coit tower after the storm clouds have cleared and left some sunshine behind today. it looks like they're not going to come back for quite a while. so let's enjoy this high pressure building in now and that ridge is going to send those storms well to the north of the bay area. see the storm that affected the bay area now making its way into parts of utah and also in arizona. but we are free and clear of the raindrops right now. for a good reason. we have historic run of some rain. one of the a period since 18, 62. so yeah, but you to break coming our way. doppler radar scanning your skies showing some dry conditions out there right now. couple high clouds continue to drift overhead, but that ridge of high pressure going to build in overhead for tomorrow. and that is going to send that that storm in the well, to the north, that's going bring lots of sunshine in the bay area and some dry conditions. in fact, that looks like it's going to last for a while.

we've got those storms kind of person off the coastline, but as that ridge kind of settles in along the west really a block. so storms transition well to the north. and that's exactly what we need. we need a nice little dry spot here. and i think that may hold well into next week. maybe in the early part of february 2. looks like to the weekend. we're looking good as we see that ridge holding on to say those storms well to the north, all the way to the following weekend. so keep your fingers crossed for that. we definitely need that break in the weather. storms, though, off the coastline, still generating some big-time swells. you combine that with the king tides and now the national weather service has issued a coastal flood advisory that will continue all the way until 3 o'clock in the afternoon on monday. not the biggest well as we've seen, but the combination of those high tides and some of those waves running 10 to 12 feet. a concern for some localized flooding along the coastline. all right. let's talk temperatures around the bay area for tomorrow. it's going to start to warm up a bit plan on highs in the 50's. maybe some upper 50's near 60 degrees in some spots inland.

and then as we look out over the next few days, here's the good news. high pressure builds in. i think we start to see some of those temperatures stick into the 60's on saturday and on sunday the following, we could see a lot of sunshine but breezy conditions on monday, but plenty of sunshine tuesday through wednesday and thursday and probably even longer than that. if you do plan to head to the game, i grab a jacket. if you're headed out, skies should be mostly sunny. those temperatures. as we head in toward the afternoon, probably upper 50's. but it should be a little bit cool. but a beautiful day for the forty-niners versus the cowboys. a classic match-up this weekend. >> 3 more days until the forty-niners take on their rivals. longtime rival dallas cowboys at practice today and this week players have said that while they appreciate the rich history, there are more motivated by the recent past their win over dallas at atnt stadium. a very close game in last year's wild-card round.

now there's one big difference last year. the forty-niners didn't have brock purdy playing quarterback. it will be the second playoff start for the rookie qb and his first one was good. he went 18 for 30 with 332 passing yards, 3 touchdowns and a rushing touchdown. perhaps most impressively. he overcame a rocky start and finished with some absolutely electric place to help his team win. now we've seen some emotion from him after big plays. but for the most part, pretty remains incredibly even keeled. and today's practice, he explain what drives him when he's on the field. >> if you come here and look at it, look at football it's a which some parts it is. but if you have that love and that drive to, you know, play this from playing since you're a kid, you know, i think it helps you the center. so set yourself up for because you love it. you're willing to do it takes to make yourself better, make the people around you better to win have that will to win. and that's
