noelle bellow that breaking news rescue efforts are underway along niles canyon road after an ace train was struck by a mudslide. here's a look at a map showing the route that train was taking when the mudslide blocked the tracks. thankfully, no injuries have been reported. joining us now on the phone division, chief randall west with the alameda county fire first and foremost, chief west, there were 200 people on board and it's true, no injuries or any issues of the sort due to this correct. >> get i guess i should say good yes, you are you had about 220 passages, not injury. the men and women of alameda county fire fire department and cal excellent job mitigating the scene very quickly and safe. >> and now that the train was derailed, correct, it was just stalled by them. and can you explain a little bit what happened here? >> from from my knowledge, the train was not derailed. the

train actually had to stop because of the mudslide that had already taken place. so that's why we was called out the make sure that we cannot mitigate seen safely. >> okay. this stretch of road now canyon road. it's been dealing with flooding and mudslide issues for the last couple of weeks. it is closed to drivers last week was an issue with the train tracks at all expected here. >> again, yes, know what? the was only of a major impact on this mudslide last week's week. couple weekends. so what you need to did turn into incident. thankful for that. and again, everyone did it very well. one of the job and working together, making sure everyone was safe and not a thing. coach. >> explain to me just a little bit. what are crews doing right now and where are passengers being taken to?

>> all right. thank you to everyone and thanks for having us. >> we'll continue to follow developments of that story as the day goes on. another big story we are following residents of a belmont neighborhood are going to be without a place to live for 2 more weeks. that's the latest from officials after a mudslide hit homes there over the weekend. kron four's charles clifford joining us live from belmont with a look at the damage there. charles. >> yeah, well, right now i'm standing along san juan boulevard here belmont. this road has been closed for several days because of a mudslide, which is right behind me is little tough to see in the shadows. let's going take a look at some video. give you a little closer look here. now. this slide, we understand started on saturday. the city came in close down the roadway. the slide has continued to grow. since then, it is now undermining the coroner's the foundations and are 2 different homes on the hillside city came inspected these homes and has red tag them. there's no one allowed to live in those homes. i know the residents in at least one of the its daily staying with

family nearby the homes on other sides of those. those residents have been told to be prepared to leave on short notice if the slide were to get any worse. fortunately, the weather has dried out. that may have happened just in the nick of time to give these folks a chance to clean up here, assess the damage, maybe do some repair work. i talked to one neighbor nearby who says they've been worried about this hillside for a very long time. and he said with the recent rain that we've had, it got even worse. and he's concerned that it could take a long time to fix this damage. we've trees and things like that fall into the street. >> with earlier storms over the years. but for the this storm right here, it been incredible that the water that this rain and the wind has brought down the number of trees in the amount of soil that has. >> yeah. now the city has come in. they've done an assessment here and determined that they're going to need to keep san juan boulevard closed for at least 2 weeks. that is a major inconvenience. this is a very busy route. a lot of

folks who live behind me here going to take the long way around to get to their homes and to get the schools that are in this neighborhood. for exactly what they will need to do, weather building retaining walls are what they're going to just able to help stabilize the hillside. that is still to be determined. but for now in belmont, charles clifford kron, 4 news as we continue to dry out. this is definitely one of the biggest concerns is land and mud giving way. charles, thank you for that live report. >> president joe biden plans to travel to california central coast thursday to observe storm damage and, quote, assess what additional federapport is needed while exact details aren't final. the president plans to meet with first responders, state and local officials and communities in several areas affected by these devastating storms. they've left at least 20 people dead here across the state. the president already issued an emergency declaration for california and declared a major disaster in merced said sacramento and santa cruz counties. we want to get you a check of the forecast today. taking a live

look outside coit tower there. nice blue skies today. we have not seen blue skies like that in quite a while. crime for meteorologist kyla grogan standing by here with more details that we've been talking a lot how wonderful it is to have the sunshine. but as we've seen those last couple of stories talking about the mudslides and landslides, kind of the aftermath bracing for here now. right? and the problem is that we're not going to be completely dry this week. we've got a shot of rain coming our way wednesday night. so right now i'm happy to say we are dry. we've got beautiful blue skies out there. not just here, but as you can see, a good portion of >> of california, including the central coast, which also has been very hard hit. a live look outside here shows your beautiful vistas are back. no doubt about it. as we take a look at the golden gate bridge, temperatures are a little cool today below average. so we're sitting in the low 50's right across everywhere, right? so 56 in san francisco's a little bit warmer. oakland, 53 52 in san jose in livermore 50 in concord and santa rosa city

about 53 degrees. wind is relatively calm as well. about 40 miles per hour out of half. moon bay is all i have for you. and today we'll see those temperatures basically kind of hovering into those mid 50's. so a few spots will get a little bit warmer up in the north bay. you can see 10 rows expecting up to about 57, but about 55 in san francisco and same story as we head down south. but here's what's coming our way. and the reason we have a little bit of concern in the 24 to 40 hours with all of that saturated ground today. gorgeous. but notice as we get into tomorrow morning, clouds roll in and by the afternoon, i think between that 3 to 5 o'clock time range, we're going to start to see those showers roll through the north bay. i'm going to back a little bit later to tell you a little bit more about kind of exact timing on that and totals. but meanwhile, we'll take a beautiful look at half moon bay. i'll be back. the extended forecast in just a bit. back to you. >> kayla, thank you. the san francisco fire department says one of its ambulances was carjacked last night. the department says it happened around 6.15, as crews are responding to a medical emergency in the 47th and

irving that's in the outer sunset neighborhood. paramedics were in the process of transporting a patient. chp followed that ambulance through san mateo and alameda counties before the suspect abandoned it in oakland. no one has been arrested. no one was hurt. a popular faab restaurant in oakland was burglarized. police want your help figuring out who was caught on camera. take a look here. monster fa posted security video of the alleged break-in. police reported folks broke in around 9.30 yesterday morning. restaurant owners say the crew was in and out of the building within just 2 minutes. they posted a list of what was taking on social media as well. the burglars took i pat a laptop, the cash drawer and restaurant merchandise like hats and other. they say no one was at monster fot the time no one got hurt. but if know anything about this or similar break-ins, oakland police want to hear from you. coming up.

>> the 45 year-old is now a free agent. several teams are rumored to be interested in brady if he does decide to keep playing, including the raiders. new york jets and even the niners. to some tech news. now, elan musk's trial over his tweets about tesla set to begin today. the company's shareholders are suing him because they say tweets he wrote in 2018 misled them. this is a federal lawsuit over tweets that impact of the shareholders. bottom line, class action lawsuit alleges musk's twitter activity caused stock prices to roller coaster back in 2018 when he implied he was going to take the vehicle company private. here's a look at those original tweets back from august of 2018, he says, quote, and considering taking tesla private at $420 funding secured. more tweets followed, implying the alleged deal. what's going to happen? the deal, however, never happened. the securities and exchange commission ended up getting involved in musk had to pay a

what's gotten him in deep, dark water both as the ceo of twitter, but also as the ceo of tesla. and i think it's really fascinating that he continues to say i don't care, right? he's going to tweet and do whatever he wants you know, all the results. whatever it doesn't matter. >> all right. i mean, what does this say about the fact that someone's personal tweets can also be used in a court of law sometime later? >> well, that and that part is not new we've seen numerous examples that we've heard about and seen it over the years where tweets have been used, particularly defamation trials and stuff like that. and these in lawsuits, right? and and you know, whether or not they've always been able to secure an actual a decision is another story. but we do know that when you make statements in public, the that stuff can be used against elon musk's certainly likes to say that stuff in public so much

so that at one point, the securities and exchange commission tried to make him have all these tweets edited by someone on the board to make sure that they were kosher. and he's he basically refused to do that. >> well, right, i mean, he even wanted to move this trial to texas because he thought he'd get a better jury pool. he was claiming people here in area have negative views of him due to media coverage, which just kind of gives me the sense he's not totally aware of the weight of own tweets and words. >> definitely. it seems as though he he doesn't fully understand the impact of what he does and how he tweets and part of what the criticism of him has been is that he doesn't have enough people who stand up to him around him. right? there might be debate within the elon musk's circle, but he does not handle the scent very well. might we seen him fire a number of twitter employees. we seen him go up against journalists and very aggressive ways kicking some of them off of twitter. and coming up with weird pretenses for doing that. and so in the

end of the day, yeah, that there's definitely a sense that he's not fully tethered to what the reality is around him. and that means that this trial may end up going sideways in a way he didn't expect. well, i guess we'll have to wait and see. it did this afternoon. so we will continue to follow it in. sure. thank you for joining us. >> thanks for having me. let's talk now a little bit about your forecast. taking a live look outside at the embarcadero. we've got to the flag there. kind of a weapon in the wind a little bit. it is chilly out there across from meteorologist kyla grogan here with more details on that eye walking into work this morning. i was like i wish i had brought in clubs >> yes, a little chilly out there. and i think cool temperatures are going to hallmark of our weather this week. you can see a lot of the dramatic weather. we have this kind of moved off to the east of us. and so we're certainly looking out for those beautiful skies today. that is going to change, though, as we get into tomorrow evening. but today, yeah, it's gorgeous out

there. and i know a lot of you going through cleanup are very thankful to have that so many take you into tonight. show you that we stay nice and clear all day. tomorrow morning. we'll start to see some of those clouds move in and taking into the afternoon. this is about 3 o'clock. you start to see this line of showers rolling through from north to south. this is a very quick mover. so this is 7 o'clock. we'll have some of those heavy showers will certainly be in this. but by the time we get to say 10, 11 o'clock tomorrow night, we're looking really good. and then it sets us up for a really nice thursday and frankly, a really great rest of the week. it's not going to be a huge hit of rain. of course, any rain in addition to what we've gotten such saturated ground is going to make some problems for some out there. but it looks about a quarter of an inch in the north bay. everyone else looking out for about a 10th of an inch of rain. wait, we get rain, sera get snow. and that's certainly what happened. as you can see, it kind of piled up here. taking a live look right now at diamond peak. people out there enjoying the blue skies, but they, too, will be looking out for a little more snow as we get into wednesday evening. and then clearing out again on thursday. so probably some really nice you know,

conditions either side of that wednesday evening. so looking at about 6 to 12 inches of snow gust to about 35 miles per hour. so certainly not as ferocious as the last system that we had up there. but you want to be prepared if you need to travel during this time is 04:00pm wednesday through 04:00am thursday. so essentially wednesday evening, it's going to be rough ride there. a live look outside and you can see those blue skies but notice on the camera here, a little moisture. i was talking about this noel and saying i have a window like that at home. i think a lot of people probably figured out some things about their windows that weren't properly sealed. may be after all, this rain came through, but today thankfully are going to stay dry tomorrow. we do have the showers and then we stay dry through the weekend into monday. as you can see in your extended forecast, you're looking great. we are, however, going to be cool. >> so our tempecatures are highs are going to be low but notice our overnight lows, particularly inland are going to get down into that frost freeze in category as we head into our wednesday night thursday, friday, even towards the weekend. we'll see a little bit of a warm-up there. but the sunshine looks good. noel, back to you. yes, it

toks code the chooses which videos users see the proposals, part of an attempt to show the u.s. government china is not using the app to spy. other news this afternoon. thanks. all the recent storms, california's drought situation has drastically improved in just a matter of weeks. but researchers stress the state's water worries are not yet over. capitol correspondent eytan wallace explains. >> well, no doubt as it pertains to the drought. the storms are welcome news in california. but researchers emphasize they only mean so much without long-term consistency. >> all of the new rain and importantly. all of the fresh snow made a huge difference in california's drought situation since the start of the new year. a look at the most recent drought monitor update on the right side of the screen. dated january. 10th shows all of the state is now out of the exceptional drought category. and most of the state is out of the extreme drought category. still as indicated by the orange much of the state remains in severe

drought. short term is very important. yes. >> well, long term is very important as well. that's the message weather specialist researcher and meteorologist jason farhang says california should take away from the recent storms. we definitely got to have consistency. >> for the next several winters. the storm track focus on california and the western u.s.. it's. we do not see that then everything that we've seen is going to be a temporary fix, only a fix that so far is looking good for the state. the total sierra snowpack for this time of year is up more than 200% of average. well, key reservoirs, including oroville, could chuma. >> and millerton are above 100% for this time of year. most of those are probably in a better position than they were before christmas. if similar patterns continue. this is a great start to arrive. king our drought. still the department of water resources are dwr makes clear its message to californians

of cleaning up and trying to >> get back to normal. we do have our beautiful. this is back today as we take a live look from the east bay. just gorgeous blue skies so hopefully can get out. enjoy that. i want talk about rainfall since our water year started october. 1st, just to see where we're at for some of our totals. you can see santa rosa at 154% of normal. my graphics barely fit all of these numbers, right? we're getting so high. 205% of normal in san francisco meeting we've gotten just under 22 inches of rain twice as much as we would normally get in this time frame 244% in oakland and hayward, 289% of normal. so needless to say, we have gotten a lot of rain. we are sitting right now about 56 degrees in san francisco. 53 in santa rosa. 54 in fremont's are a little cool today. running a little bit cooler than we were this time yesterday. in fact, napa right now, fairfield, napa, 5 degrees below fairfield, 5 degrees above says you head inland, getting a little more that sunshine. so as we look ahead taking the long view. so there is that wednesday evening coming in between about 03:05pm, to the north bay. but then notice that high

respiratory virus data has many health experts feeling a little relieved now u.s. centers for disease control reports the number of flu-like illnesses, illness cases are down for a 6th straight week. experts feared holiday gatherings would actually create another tripledemic of high flu rsv and covid cases. but it didn't actually happen. the cdc says there not sure why another surge didn't occur. 36 states do still have high or very high flu activity. another spike could be possible. but for now, we're sitting pretty good. and a new report found cancer death rates are down significantly from the peak in the united states. back in the 1990's. >> the peak of cancer death rates, which happened in this country in 1991, we're now reporting a 33% decline in cancer mortality. >> they american cancer society expects to see nearly 2 million new cancer cases and 610,000 cancer deaths in the

united states this year. we have some positive news for coffee lovers. doctors say coffee is proving to be a good remedy for patients with liver diseases. coffee helps with alcohol, associated liver disease and fatty liver disease, both cars, excess fat, to build up in the liver and it can lead to liver scarring, cancers and the need for a possible liver transplant. doctors recommend 2 to 3 cups of coffee per day caffeinated or decaffeinated. they say drinking it. black is best avoid heavy cream and sugars. of course, coffee can only do so much. so make sure you're staying healthy, otherwise as well. there's a recall out for wet, dry vacuums made by bissel due to a potential fire hazard. it's according to the u.s. consumer product safety commission. they say the battery packs and bissell cordless multi-surface products may overheat and could start smoking. the company is already 66 reports of smoke coming from that

vacuum. 5 reports say the battery pack caught on fire. one of them caused a burn injury. consumers should immediately contact bissell for a free battery pack replacement. in texas. a 3 d printing companies taking a creative approach to solving housing issues for the first time the united states a 3 d printer is building a 2 story. home reporter stephanie haines takes a look at what could someday be housing of the future. construction crews in houston are getting ready to power up a massive 3 d printer. >> it will spend the whole day laying concrete for this 4,000 square foot. 2 story, 3 bedroom home. >> and that the signing of this we not only think about the general floor and, you know, you but we also designed the actual print pass like how departure will print. we're start and we're stops. >> it's a project 2 years in the making by 3 companies. design from hannah perry, 3 d

>> in hayward, there are questions today about what's next following a mudslide that caused extensive damage over the weekend. mud and debris flow down in the city's fairview neighborhood, destroying a home and damaging others. kron four's dan kerman has details. >> it was saturday afternoon when this hillside broke free,

sending water, mud and debris directly into this home on fair cliff street in hayward. >> it's pretty because it happened so within like 3, 4 minutes it took ot. have the house, your creek like cracking. >> okay. shape through the destroyed home was red tagged and those living nearby, we're told to evacuate during the storms. think i'm in shock. well, a bit. >> we're getting through day trying to figure out a shed at the home. next door was also destroyed. >> and sunday night, the storm sent more water and debris into this home on the other side and now concerns the city isn't acting fast enough. but some little. >> sandbags. and they thought was going to hold something, you know, there was putting on randomly in spots where they thought it was going to hold. sanders. going to do anything. >> city crews were on site doing debris cleanup on monday and more is planned were

working on getting geotechnical experts out here and an earring experts out here who can take a look at the soil. take a look at the hillside and engineer a proper drainage, you know, reengineered drainage flow that handle this. it's unclear when a hillside fix will be in place. that worries those who live in the area with more rain forecast for wednesday. like to stay in my house, i will not put my family in danger. city officials say once they figure out what to do, the likely put in the short term fix to get through the rest of the winter. >> and then a longer term fix will get under way sometime this summer. in hayward, dan kerman kron, 4 news. >> east bay residents pittsburgh had to be rescued from their homes via boat harbor street from yosemite drive to greystone place was flooded yesterday morning. residents in about 12 homes and 3 apartments had to

evacuate. >> folks in the neighborhood we spoke with say they had never seen anything like this. one woman saying she was thankful crews were able to get to her in time. >> the house, my house it go. that was bay. out of here was and i think they're a bite out here. >> city officials say the overflowing water levels in kercher creek are now receding. they hope it will continue to go down to a safer levels of these folks can get back into their homes. the road does remain closed today on the peninsula. a massive boulder temporarily blocked off highway one in pacifica for several hours. the boulder since been removed and the highway is back open. but there's some concerns more debris could come crashing down. kron 4 sarah stinson reports. >> this massive boulder came crashing down from this hillside and into the southbound lanes here on highway one, blocking the devil's slide, north parking

lot. this is all right before the tunnel. >> well, caltrans work to move the boulder in debris. the north and southbound lanes on highway one temporary closed on and off monday afternoon. this caused the backup in both directions. chp and caltrans work to guide traffic. while crews worked to clear the road. >> people hiking in the area were fascinated by the scene. >> came to hike devil's slide and we've got to see a slide. >> fascinated by geological events and it's part of living on the coast. >> there's a concrete retaining wall covering most of the mountain side. but it stops right before the trailhead parking lot. and that's where the boulder fell from. caltrans says this is an example of effects we're seeing from the constant storms. we get a lot of rain. >> in that area and we get a lot of water seeping through that on out with just a lot of water in that mountain. and so that brings down the earth and

the rocks caltrans is now faced with making sure more debris doesn't come down onto the bike or car lanes. >> in this area on highway one, that was jala just looking at it. and we're big trying to make a decision on how we're going to shore up that slow. so it doesn't come down again. there's a part of this still overhanging. >> cons of in place along this stretch of road on highway one to make sure that drivers don't head into this area. the north parking lot of double slide, caltrans still working on a solution for this area so that more debris does not fall into the roadway or the bike lane. meantime, pacifica police saying the extra careful when you're driving these north and southbound lanes. i'm sarah stinson reporting in pacifica. back to you. >> with that one final check of your forecast this hour. taking a live look outside at the golden gate bridge towards the north bay. again, it's a really nice day for us. good time for folks to continue their cleanup efforts as there is still a lot of debris, mudslides, landslides, all

across the bay area. kron 4 meteorologist kyla grogan here. we do have rain tomorrow night. it's not going to be like what we've been seeing that right? you know, it's not now having said that anyone going through clean up or even you can see some of these crews that are trying to keep people safe. it's going to make things a little bit more difficult. but the good news is on the other side of that, we have a nice dry stretch coming our way. so let's start off with a look outside. beautiful blue skies today. no doubt about it. if you walk outside, you can definitely see them right away. >> wind is calm so you can see the highest number here. half moon bay, about 13 miles per hour. and temperatures are little cool. so right now saying about 51 in hayward, berkeley about 52 degrees, low 50's also in san francisco. same story as we head up to the north bay. if you head inland spots like fairfield in pittsburgh, they're starting to seek some of those upper 50's. but that's about it. so as we track this through, we're basically going to stay mild and dry today. but these storms ahead of a cold front that pass through very quickly are going to come through wednesday afternoon, probably about 3, 4 o'clock in the north bay and then be done by the time we get to late wednesday evening by about 11,

11 o'clock. and you can see expecting about a quarter of an inch of rain, maybe a little more, a little less right. depending on where you are. north bay will probably get some higher totals. but all together, it's going to be a very fast mover and it shouldn't be high impact. and frankly, i wouldn't think much of it if it weren't for the fact we already have such saturated ground out there and certainly so many creeks and streams that are at capacity or above. but because we're in that space, we do have to be mindful of that. so again, the timing for that's going to be wednesday. late afternoon into the evening and then by thursday, we're nice and clear. beautiful sunshine cooler temperatures in the other side of this, including our overnight lows which could get down to that freezing or below mark up in spots like the north bay, some of our inland valleys. and then we do pull up a little bit as we head towards the weekend. but more importantly, we stay dry right through the weekend and right into monday and that is some good news. back to you. kyla. thank you. >> and indiana father has been arrested after a viral video was shown on live tv of his 4 year-old son waving a loaded handgun. that video captured by a neighbors. ring camera

was aired by the reels series on patrol live during a broadcast over the weekend. the video led to the arrest of the boy's father who was also shown on television. police say a 9 millimeter handgun matching the one the boy was seen playing around with was found inside the home it had 15 rounds in the magazine, but no rounds in the chamber. the father has been arrested for felony child neglect meanwhile, authorities in texas are launching an investigation after a second fence was cut at the dallas zoo clouded leopard escaped last week after a hole appeared to be intentionally cut in its enclosure. now, a second hole has been discovered in the fence around a monkey exhibit reporter markie martin has more. >> a bit of a jurassic park outbreak. the mystery at the dallas zoo continues. not just one, but now 2 different habitat found with the same

intentional cuts in the wire mesh yeah. >> it was clear that this opening was not habitat. failure was an exhibit failure. >> and it wasn't keeper where it all started friday morning when nova a female clouded leopard with missing for several hours. the zoo shut its doors issued a code blue and warned the public not to approach the this is intensely frustrating. this is a cat of conservation concern that is not up nova was found that evening unharmed on zoo property but her habitat toward open and this weekend, the same intentional tear found in the langur monkey exhibit both now being treated as criminal the incident. not keeping holiday weekend crowds from coming to some of my kids. it's about the taser and visiting nova sleeping on trees. and it's not the first time a resident of the dallas zoo has made a break for it.
