ongoing investigation. i can't release the details of that. so as soon as we're able to, we will yes. like what? we're working closely with the district attorney's office. and just because of the i can't compromise an investigation, so when we're able to, we will give that information out. mean, additionally, just what i shared this afternoon that earlier this morning i made an error in how i reported out the dissidents. and so i clarified that today, but as soon as we're able to, um, i know that community wants to know more. and as soon as we're able to, we will transparency is important to us, but we also need to, uh, to secure the investigation as well. sure challenges with law

the pumpkins. and ignore the farmworkers. not today. we are not ignoring anybody. kristen: of support for community touched by tragedy. another deadly mass shooting. larry: seven people were killed in yesterday's shooting in two locations in the coastal community of half moon bay. thanks for joining us. i am larry beil. kristen: i am kristen sze. we are learning new details about the information -- the shooting a suspect. the 66-year-old suspect chunli zhao targeted the victims in what they are calling an active workplace volume -- violence at half moon bay. chunli zhao use the semiotic semi automatic handgun legally purchased. there were eight victims, six men and eight women.

the mexican consulate confirms two of the people are mexican nationals, so is the man who was injured in that total. the low survival remains in the hospital with what officials say are life-threatening injuries. larry: we have team coverage with reporters digging up information on the suspect as well as the victims and investigation. let's begin with stephanie sierra who is live on the scene with the latest on the investigation. stephanie:piece together new informationo about 66-year-old chunli zhao. we are told from several sources that he not only worked here and mountain mushroom farms but also resided here. he's been working as a forklift driver for several years. this is the location we are at, off of highway 92. we're told from multiple investigators that uncho

targeted all eight victims believed to be coworkers. it appears chunli zhao you had built up anger in what is described as an ongoing feud with these victims. aside from a prior restraining order with a former roommate, the tech to say the suspect had no significant criminal history or no known mental health issues. >> all of the evidence points to this being an incidence of workplace violence. >> there were no specific indicators that would have led us to believe he was capable of something like this. >> we never had one of this county of this many deaths at one scene. the semi-automatic handgun he used was legally purchased and owned. there appeared to be a language barrier between chunli zhao who speaks chinese and some of the victims who mainly spoke spanish. the i-team learned first responders witnessed chunli zhao

leaving the first shooting location in a maroon lexus suv before heading to concord farms, three miles away, where the second shooting took place. now, shortly after the i was able to confirm, investigators did ping chunli zhao's phone. sources are looking into whether chunli zhao sent a text to his wife, shortly before he was arrested at the sheriff's office, substation in half moon bay. a lot of questions that have yet to be answered. i can show you mountain mushroom farm's behind me. is taped off. this is an active crime scene. it's expected to be closed, as investigators case this area, continued to talk with coworkers of chunli zhao as well as family members. at this point, as far as what is next, we heard from d.a. wagstaff, that the sheriff's

office has filed the case with the office and his arraignment is scheduled tomorrow at 1:30. at this point we do not know that the charges that have been filed against him yet, we will learn that tomorrow. we'll keep you posted as new information comes out. we're life at half moon bay, stephanie sierra abc7 news. kristen: there a hearing tomorrow. as were investigators there combing the scene. what else is coming up in the process? development the investigators we spoke with on the scene, it's so early, a lot of the details are being sorted out. what i can tell you, there's a lot of concern about the potential language that i mentioned a moment ago. it sounds like chunli zhao and

the victims targeted communication but certainly with the fact that it was targeted. i asked detectives some of -- whether some of these victims there was not enough evidence to suggest this was a targeted attack. kristen: thank you so much. larry: the i-team has been busy looking into the suspect. according to documents . it >> it look like chunli zhao has a history of making threats, it turns out in 2013 chunli zhao had a roommate, they worked in a restaurant in cupertino. he lost his job and the roommate says that chunli zhao threatened him.

he did not get his job back, he would kill him, is what was said. chunli zhao held a pillow over his face trying to suffocate him. the application for a restraining order says that mr. zhao came out and said he wants to work. if this cannot be done, this will be a bigger problem which will not be good or pleasant for everyone. this seemed to be a threat to me in the restaurant i worked at. he said, don't be a victim of this. he said he will use a knife to cut my head. a judge heard those words from his roommate and granted him a restraining order then also extended it a second time. that is the history here of chunli zhao, making threats associated with his work. kristen: are dan noyes learning about the suspect. we're learning more about the victims, including some of the names. marciano martinez was killed at concorde farms, josé perez was

also killed. larry: pedro felix from as defra mirrors was killed at mushroom farm. zach fuentes at half moon bay with more. zach: it is those hearts and minds of everyone at half moon bay which is the reason for these memorial -- this memorial we are standing over. it says as a community we grieve. this is a community in grieving. everyone is trying to process what happened in the last 24 hours including local leaders who have been out here not just offerings -- offering emotional support but doing what they can to make changes at the legislative level to help prevent another tragedy from happening again. as the investigation to the tragic half-moon bay tragedies continue. assembly member says he was on the vigil for members in the moderate park shooting. >> here we are 24 hours later, i am in my district in a impacted

by mass shooting. it's hard to believe. it's real. it's happening in communities all around the state and country. it's devastating and senseless. zach: governor newsom and other leaders, and more, and a nonprofit dedicated to helping the local nonprofit community. the organization providing support to those impacted, including those displaced by the investigation, many of whom are farmworkers. >> we have thousands of farmworkers here. we have nonprofits that we are working with. zach: local politicians like the communities they represent are frustrated. >> this seems to be workplace frustration. down in monterey park, it was frustration with family and people that the gunman knew. that happens all over the world. that happens all over the world on a minute by minute basis. what doesn't happen is mass shootings. we in california, obviously

internalize this. we need people across the country, are supreme court, to understand it is in their hands to save life -- lives. zach: even though he has been part of gun legislation, he plus a look at the governor to look at further action. >> we will be going back to the drawing board to see what we can do. zach: a feeling echoed by berman. >> if you look at the average gun death per capita versus the average state, we save 1800 to 2000 lives per year. that is a massive amount of life that is not lost. obviously there is the loss of life happening. we need to do more. we need to figure out how to get guns out of the hands of people who are unstable and should not have access to them. zach: it is worth repeating and bringing up that the same local leaders have been throughout the area touring, following the floods that the storm brought. this community has been through a lot. leaders tell me it is a resilient community. they will move ahead.

the loss of life and hurt being experienced today is going to remain. live in half moon bay, zach fuentes abc7 news. larry: it has been difficult. a news conference at half moon bay, a few minutes ago. kristen: liz kreutz was there. she joins us with the latest on the outpouring of support, including from the governor. liz: hi, larry, governor newsom wrapped up his press conference on main street at half moon bay. it was what you would expect to hear. he is angry, mad. he says he did not want to be here today. he kept talking about how repetitive this is for him. this is the second time in 48 hours he has had to sit with the families of victims, console them because of a mass shooting. again, he talked about the need for gun control and he called out, republican lawmakers who he said are just not doing enough,

including the republican speaker of the house from here in california, kevin mccarthy. >> you have to call folks out. i'm still waiting for kevin mccarthy, the leader, of the house of representatives, who is supposed to represent the people of california, a proud and remarkable district. we have not heard a word from him. not since monterey park. not what happened here. not one word. i want expression, condolences. nothing. in a surprise no one. where has he been in gun safety reform? whereas the republican party been on gun safety reform? they have blocked it. one state cannot do it alone. shame on them. shame on those that perpetuate that to be rewarded politically. shame on them. shame on these judges, that are rolling back the laws that we have established in the state of california. shame on them.

you deserve better. we deserve better. so, i am here, all of us, the absurdity, the theater. look around, of absurdity. only in america. i will close on this. it really hit home to me today, meeting immigrants from china. their translator did not even know how to translate these words. when the gunfire occurred, they were witnesses, their friends got shot, killed. they went over, people have been shot, and they thought they were acting. they had never heard a sound like that. they had never seen a scene like that. they do not even comprehend a gunshot wound. that is not something they have experienced. they don't know how to comprehend that. only in america do we see this

kind of carnage, this kind of chaos, this kind of destruction of communities and lives and confidence. and a sense of safety and belonging, which we all yearn for, regardless of our political stripes -- strifes. liz: you can hear the pain and anger in his voice. speaking of the farmworkers, the governor wished he could see -- people can see the conditions many of the farmers were working in. he was speaking to the victims, the families of the victims, and they were living in shipping containers. many, making nine dollars an hour which is less than california minimum wage. he was talking about the inequality in they shooting. again, saying, this continues to happen not only in california but across the country. calling for gun reform. he said, california's more gun laws than any other state in the country. it has to come at a national,

federal level, not just california anymore, especially as he mentioned, the federal judges. the supreme court in many federal judges seem to be targeting gun state laws. because of that he says california can continue to do more. we no 23 laws, this legislative session has been introduced for this coming year. he said california will continue to do more but it has to come at the federal level. he is calling on republicans to do it. live in half moon bay, liz kreutz abc7 news. larry: one of the things that resonated was the governor meeting a mother of three kids. her asking, can you console my kids? he said, well things will get better. but almost didn't believe it himself. more to come. including the questions raised once again about u.s. gun policy. kristen: next, the show support for oakland police chief. later the 49er arrested.

i will not pick a fight but i'm not running from one. larry: new details with oakland police chief armstrong speaking at a rally with his supporters held by the naacp. he is on administrative leave on claims he mishandled two investigations. kristen: they placed armstrong on leave last week. he is aggressively fighting back. larry: ryan curry was at the rally today where people demanded armstrong's immediate reinstatement. >> i am from west oakland. i will not pick a fight but i am not running from none. >> pack fight -- with dozens of community leaders, he says he will not stop until he is restated as oakland police chief. >> as a kid born and raised in oakland, single mother, no father, to work to get to this point, and have it taken away from you hurts. >> the mayor placed armstrong on leave, following a report on

misconduct in the police department. armstrong failed to take action over incidents with the police sergeant, wielding signs of support those in tuesday's rally says armstrong was working to make oakland safer. >> we need a strong leader. we need to put him back to work. >> at a separate media event, the mayor chose not to comment on the calls for reinstatement. >> i have not seen a request from the naacp, they have an ongoing media thing going on right now. at the end of the date as a personnel matter. wwe will -- we will leave it at that. >> many are calling for an outside investigation to review the monitoring of oakland police, including the city council. >> why don't we sign the attorney general to do an evaluation inspection in overseeing, to make sure that we are in compliance? >> other say the rally has united the community and says the mayor has the opportunity to reverse her decision. the chief has been leading the effort.

>> this is evidence of that. this is exactly what women working towards. the community has faith and confidence in the leadership of the police department. larry: teacher in richmond has been fired after a video went viral showing him slamming a student to the ground and shoving him out of the classroom. kristen: police are investigating the incident with the possibility of charges being filed. our senior education reporter has the details. >> i'm not playing. >> the video substitute teacher exchanging words with the student before grabbing and slamming him on the ground. as other students watched in disbelief. the teacher forces the student out of the classroom. according to the west contra costa unified school district, prior to the incident, the student had made a racial slur. >> there is no justifying it. i just think he could have taken

better precautions, like calling the principal or authorities. i just -- it was a bad move. >> this parent, irma, found the teacher's actions disturbing. >> i'm feeling angry. >> the incident has rattled richmond high. abc7news was given cellphone video of a gathering organized by the black student union. they addressed other students, denouncing the use of any racial slurs, and also asking the school to ensure everyone's safety. those who had been taught by the substitute teacher say, he is liked why students. >> he was a very cool guy, from when he subbed in my classrooms. >> he was a normal teacher. he was there. he was there if we needed him. >> the school district fired the teacher and issued the statement, the student essay for their family and are schooled district is investigating the incident. richmond police is also

these tragic events continued to show us, there's more to be done to keep our homes, schools and communities safe. >> was after 10:00 p.m. on saturday night when the shooter fired into a crowd of people at the star ballroom dance studio. 11 people died. >> we are trying to understand what occurred, many of us are in disbelief. >> the mayor taking part in a moment of silence in today's order of supervisors meeting they were there to honor the victims of this horrible shooting. >> we are not alone. we are just one human family. let's remember that. there will be a long road and recovery but we will not be doing this alone. >> it took five hours to alert the public that the gunman was on the loose some are a bit critical that it could have been done sooner. the sheriff stands beside their decisions.

can. larry: it seems as though gun violence is on the rise. over the last 10 years, they'd analysts have said it has gone up. it's not just the number of mass shootings. the number of victims has increased. melanie woodrow digs into the data. melanie: there've been five mass shootings in california this year. three in the last three days alone. mark bryant is the executive director of the gun violence archive. researchers log gun violence incidents. bryant says gun violence is up by 25%. >> the numbers have gone up. the number of people killed, injured, mass shootings have gone up dramatically. >> he says the numbers peaked in 2021 for the last two years he says they have been flat so far. >> we are right on the same level as we were last year. melanie: while the overall number of shootings is the same, he says the number of victims per shooting has increased. >> their getting louder, bigger.

melanie: what is it that that tells you? >> people are using high-capacity magazines. it tells me people are using semiautomatic assault type rifles. melanie: he says that the weapons perpetrators use speak to their crimes as well. >> while the guy in monterey park used an extended magazine, he killed more people faster. he killed more methodically. melanie: as compared to the rest of the country more than a third of the individuals killed in mass shootings this year have been in california. when accounting for california's population, bryant to the per capita ratio is low. number still part of the story, they do not capture the individual lives taken or the toll on the victims families. >> gun violence is not one issue. it's about different issues. we have to start looking at it like that. melanie: for the i-team, melanie woodrow abc7 news. kristen: despite calls for

tighter gun controls, some of california's gun laws can come under the microscope. >> those gun regulations are increasingly finding skepticism in the federal courts. supreme court has expanded the second amendment protections in the past year. some of california's most aggressive gun safety reforms are likely to be called into question. kristen: adam winkler is a ucla law professor who specializes in gun policy. he says california has the strictest gun laws in the nation. those laws are more lenient than many of those other countries. japan, england, france, or is more like you have to be able to get an exception to get a gun. where it is like you can get one, unless there is an exception unless you can get one. larry: whether you've lost a loved one or been a victim to gun violence or nor fueling the emotional weight of these incidents, which never stop, we have ways to stop. go to abc7

larry: 49ers defensive lineman charles omenihu. he is accused of pushing his girlfriend in an argument in san jose. he's posted bail. dustin dorsey has details from the south bay. dustin: days before the san francisco 49ers play in the nfc championship game, charles omenihu was arrested and booked

into santa clara county jail on suspicion of misdemeanor domestic violence. >> a female survivor who called, alleged and reported, that her boyfriend charles omenihu, pushed her to the ground during an argument. >> of the event took place after 4:30 in his apartment, as the team had the day off. when police arrived, the girlfriend declined medical attention despite pain reported in her arm. the woman showed no visible injuries. but the 25-year-old charles omenihu was arrested and served temporary restraining order. he has posted bail. >> there many different factors, money include what the relationship is. to their children together? with -- this would be classified as a misdemeanor. this -- there was no visible injuries, just a complaint of pain. >> he has been part of the defensive line rotation for the

49ers during the plan front. the team provided a short statement saying" we're aware of the situation and inner in the process of gathering more information". we reached out to ray soto. he intends to clear the air and get the story straight. we have not heard back. >> the investigation started yesterday. it's going to go over to our family violence unit, where detectives and investigators will continue the case. the case will be presented to the santa clara county da. they will make the deciding decision on whether or not charges will be filed against charles omenihu. we have been in contact with the santa clara county district attorney's office who tells us no charges are expected. kristen: if that is the you would assume he will play? larry: i would think he would. from the leak perspective, the nfl will not -- league perspective the nfl will not hand down sanctions, until the legal process has taken place. the 49ers could decide

- okay you know what? that's mine. - [buzzed guy] i'm gonna need that back. - [kevin] nope. - [buzzed guy] kevin. larry: some discouraging news for the oakland school district. thef school districts budget certification has been downgraded from positive to qualified. the district may not be able to meet its financial obligations. kristen: this comes after the school board reverse the plan to close five school board -- schools. leanne melendez was able to obtain the report. reporter: this is the analysis report on the financial impact on keeping five oakland elementary schools and a middle school open. the schools were directed to shut down next school year, august 2023. that decision was recently overturned by a new school board. now, to keep the support staff at those schools, it is estimated it will cost the district or than $5 billion a

year ash more than $5 billion a year. closing the schools would have saved on the routine maintenance across the district. the districts school improvement efforts will become more challenging. >> this report talks about oakland having upward $3 billion in need to improve its building. these schools are old. reporter: all of this as the district admits declining enrollment will continue and may accelerate. because oakland is in partial receivership, the alameda county superintendent of schools overseas oakland finances through a test -- trustee. now that the school board decided to keep the schools open, their budget status was downgraded. based on uncertainties yet unresolved, we have determined, the district may not meet its financial obligations in the subsequent fiscal years. >> that finally gotten the positive budget report. now, they make this decision and boom there downgrading. reporter: we reached out to the
