truly how insane this is, let me show you an example of palm beach real estate and i know for most americans this sounds crazy, but this is the price of real estate in palm beach, florida. just minutes down the road from mar-a-lago, this is a vacant lot, a 2-acre lot, this property, right there you can see the vacant lot listed for $150 million, another lot ne nearby, but just an empty plot of dirt, and listed for $200 million. mar-a-lago on the other hand is an iconic 60,000 square-foot residential property, and by the way it is stark property with other buildings on the property, it is a landmark and has a beach club that is associated with it with a whopping 58 bedrooms, some 33 bathrooms sitting on 20 plus acres of land, uniquely positioned both on the intercoastal waterway and the oceanfront beach. and they you to believe that this is worth a fraction of the smaller empty dirt lots.

not to get to this judgment, the judge pushed this insane valuation throughout the entire case, why? to justify this insane judgment. the judge is far more guilty of phony evaluations than anyone in this case, and is this justice in america? really? if you are a liberal, do you have an open mind? can you not add the money up here and see what is going on? no of course in new york i'm sure people are not too interested in facts, they are interested in a politically motivated takedown. and here is the real question could who is the victim here? because nobody got hurt. no bank got hurt, no insurance company ever complain. none of them. all loans were replayed on full from time. and one deutsche bank executive testified in his defense telling the court that bankers new client reports of their network was subjective or subject to estimates. and took their own such financial statements all lenders

and all insurance companies, they all have a fiduciary responsibility to do so. no company will lend or ensure hundreds of millions of dollars without doing their due diligence, that's insane. and on top of that, every single contract that donald trump had with these lenders and insurance companies, they all included a disclosure with a very specific bit of language and it telling them, use your own appraisals. don't use ours. so i ask again, where's the victim here? that's right, there isn't a victim. there's never been a case like this a totally victimless political witch hunt which a civil trial, as they called it. this is what we talk about a dual justice system and weaponization of our legal system in america. they had to take back to bring their claims forward, and now here we are years later, letitia james feels the need to bring the case against the runaway favorite for the republican nomination. heading right into an election

particularly under the system of equity with a jury trial, if there is no harm, no foul, no harm, no crime, but when you have no damages at all, usually you can do a multiple. say this a million dollars of damages, you can get $3 million of fine. but when you have zero damages, no matter how many times you multiply it, zero plus times whenever it is all still 0. so it's outrageous, now i don't know whether it's going to be hers in the appellate division, that's also elected judges, mostly by democrats in a county which is 85% democrats, the new york court of appeals which is the highest court may indeed, give justice, generally finds like this are reduced considerably, and that may very well happen in this case, but this tells us so much about the politicization of our justice system. the weaponization of our system. and it's so dangerous, because it will mean that businesspeople are not going to want to run for

office, because they know if they run for office, partisans are going to go after them and investigate them, figure out some way of getting them like over evaluating. this is a judge which over evaluates when he wants to burn no damage, then under evaluates when he wants to, mar-a-lago, $18 million. he's just willing to manipulate the numbers to get them to the results he wanted. i hope the courts will look at this with a very, very, very stringent guide. >> sean: let me stay on the issue of valuations, because they are very subjective, the deutsche bank executive was 100% right. any lending institution, and the case of donald trump, you are talking about deals that are hundreds and hundreds of millions of dollars. nobody is going to lend you that much or ensure that much of a property without doing their own valuation. they have a fiduciary responsibility to do so.

there was a disclaimer that said, don't trust our valuations within the application. it was in every single one. nobody was hurt. nobody was hurt. they all got paid back on time with interest, that they had agreed to. the only one really most guilty of valuation problems was the judge. the judge to take a billion-dollar property and stick with $18 million valuation, please, i will buy that right now. i will find $18 million and i will buy mar-a-lago for 18 million and put it on the market tomorrow for a billion. i would like to be a billionaire one day. >> you might get a porta potty for 18 million and palm beach. the damages here like the judge are daft and asinine, because under the law, damages must always reflect the measurable harm coming here there was no

harm. and they were injured, just looking at the huge profits. so how can consumer protection statute be used to hold liable a businessman for a consumer harm that does not exist is one of the great legal mysteries. so i think at the very least, the new york's highest court should knock it down even though the entire court is composed of seven justices by democrats, but latetia james knew she was playing with house money here. liberal courts and a liberal child judge who wore his anti-trump bias on his sleeve, arrogant smog, and guilty of fraud, ignoring completely all the bank executives that said we weren't too defrauded or deceived, he said they falsified visual statements ignoring that it never prepared the financials, and hire top lawyers, accountants,

ultimately the u.s. supreme court has to get involved, because donald trump has been denied fundamental due process and in my experience, this is how republics fall. and this is where we are as a nation. this is any republic time, and this is the kind of law fair and outcome based prosecution that is just going to doom us. so we need good people. statesmen and states women up, and say it is not fair, this is not america. >> sean: really isn't, i really worry about the future of the country. pam, how do you feel, new york is what it is, and extremely deep blue state where you have radicals in government and you have radicals on the bench. i've said this before, i don't care if it's a civil trial or a criminal trial, i do not believe donald trump can get a fair trial there. what you can in new york city? 12% of the total votes? it's even worse in d.c. coming

>> sean: i agree with that, what would you advise, matt whitaker, the trump attorneys to be thinking about tonight. >> well, first of all, keep fighting. this is a righteous fight, it is good versus evil, and so, this is something they need to make sure that they are ready at every turn, but at the end of the day, they need to make sure that they are making these arguments and this is one of the things that i thought they did a really good job even after this despised judge issued a judgment on the liability phase and then just the damages phase they were able to get a lot of facts and they rolled in college professors that suggested that this accounting was proper and were able to get in experts on valuation and able to get in the banks that you mentioned in earlier today and able to say we weren't defrauded. we would loan him more money if you wanted it. i think they need to make a good record, because at the end of the day, it matters with the court of appeals does. it matters with the supreme court does, but this is also the court of public opinion, and the american people are going to issue the final

they have a lot of explaining to do. here's a statement from senator charles grassley as he released the report at the time and this is about the fbi informant that is now being charged. he said the informant behind the fd 1023 was indeed a long serving trusted fbi source used by the agency for criminal investigations since the obama administration. 2010 to be exact. in fact, he was so trusted that to the provided him authorization to "engage in illegal activity for investigative purposes. but when presented with information from a source that the agency so trusted for what, now 14 years? the fbi is exposed by senator grassley, they sat on that 1023 document and did so for years. still working for the fbi and without any performance of any due diligence, they never looked into it. so it's clear that only after

a long overdue visit to east palestine in ohio today, so nice of him. over a year after the disaster's train derailment that spilled toxic chemicals into that city, remember, where was joe last year when the people of east palestine needed them most? the president had an excuse claiming he just did not have time or break in his busy schedule of going to the beach to visit the ailing community. sara carter, she was in east palestine today where she spoke with residents about the long overdue visit. take a look. >> what was your first impression when you heard president biden was coming to east palestine? >> i laughed, and said why. why. he probably does not even want him here anymore. >> is it too little, too late? >> of course it is. he is only here because it's election year. obviously. >> how does that make you feel? >> he does not care, he does not care about the little people. >> this is a political stunt. all of a sudden a year later,

resting. his very light schedule every day. he does next to nothing most days of the week, because he is not capable of it. so what was this all about? >> well, three days this week alone to your point, the president had no public appearances on his schedule. tuesday, wednesday, and thursday, and whoever is advising the president, public appearances lately when he actually makes them really should be updating their linkedin page and get that resume ready, because they should be fired. an overwhelming number of east palestine residents did not want this president to come at this point. almost 380 days later. let's think about what that means. the kansas city chiefs have won not one, but two super bowls since this toxic derailment happened. so this has zero upside at this point, and only reminds people, those that were impacted on eastern ohio and western pennsylvania to this point, that donald trump was there shortly
