>> this is cbs-3 "eyewitness news". nearly two years after boston was rocked by an explosion, one of the two men accused of crime goes on trial. this morning live report as jury selection for dzhokhar tsarnaev gets underway today. good morning monday the fifth of january i'm ukee washington. >> i'm erika von tiehl. first we start things offer with a check on traffic and weather together with katie and jessica good morning ladies. >> good morning, katie i'm not jealous you're outside not jealous of you to be outside actually, so how does it feel? >> definitely chilly start to the morning out here, jess, you know after i think specially coming off of what was a relatively mild weaken, you know it was raw chilly, but more after raunchily necessary that would you feel toward say early spring. now, we're just seeing the dead of winter settle in. january is our typically coldest month of the year. but, right now at least say storm scan3 is generally empty. that's certainly some better news, as compared to what we were just dealing with this weekend. thirty-one how it feels at the airport, i can tell this much, as the winds has pick up, it is knocking your feels like values generally back, about 10 degrees plus, throughout the day. feeling like the 20's, like the teens depending on your location bottom line is it is definitely chillier than the thermometer reads outside right now. as the day progresses, we are spec to go see skies brighten up at least. we can expect some sunshine, temperatures we're showing you what we are expect to go hit at about 9:00 a.m. as we go off the air here on the "cw philly". so, they will only be

temperatures that decline with time. and eventually by tomorrow, you might have heard rumors about snow, they're true, we'll talk about how much, who gets it, all of those details little later in the show. jess? >> and you duck the winds this time perfect. good morning, just little bit after 7:00. we go outside check out how things are doing with a accident scene here on 95 around bridge. i wish we could just move this camera up just little bit we can see exactly what's going on, but you can see some police activity on the scene trying to get the accident cleaned up and out of the way as it is pushed over into the left hands shoulder, partially blocking out the left-hand lane everybody we squeezes on by to the right-hand side. using northbound lanes of 95, see you most of the delay. now over on the boulevard things moving along okay. this camera seems to be freezing and starting again. so you can see it is frozen at this time. nothing actually stopped. but the southbound lanes are moving a little bit slowly toward the schuylkill expressway. now, the lansdowne doylestown regional rail line suspended due to overhead problems due to septa. we do have accident out in lower merion, east montgomery at schoolhouse lane, push over to the shoulder so use some caution. erika, back over to you. >> thank you new this morning, nine people are left homeless after fire rips through their north philadelphia home. the fire broke out just after 11:00 last night in this home along the 3,000 block of north lee street, in fairhill. all nine residents were able to escape the flames unharmed. the cause of that fire remains under investigation. >> well the man who spent seven weeks on the run after allegedly shooting two pennsylvania state police troopers has a preliminary

hearing. >> eric frein is due inside pike county courtroom this morning. "eyewitness news" reporter justin finch joins us now in the cbs-3 sat center more on that justin, good morning. >> good morning, yes hearing set for 9:00 a.m. we could see the state call several witnesses before the judge. and also, present evidence, they say links frein to the deadly ambush on state troopers last fall. all of this an effort to move frein closer to a trial. accused murder err eric frein returns to court monday where pike county prosecute letters level their case against him before a judge. they are seeking the death penalty. in his hearing we should learn more about the events leading to up and after his capture, back on october 30th. >> he has been stripped every his guns, his bombs, and now his freedom. >> court documents allege that on the night of his capture frein acknowledged that he shot troopers because he wanted to make a change in government. a statement that reportedly led to additional charges of terrorism, prosecutors note frein's statement was made after he was advised of his constitutional right to stay silent and request a lawyer. now, at issue will frein's confession hold up in court and was he denied initial access to an attorney? on september 12th, 2014, prosecutors say frein using the high powered rifle, opened fire outside state police barracks in pike county killing corporate brian dixon wounding trooper alex douglas and spark ago multi agency manhunt. >> this attack was an ambush. our troopers were leaving the barracks and were shot without warning and had no chance to defend themselves.

>> police caught to up frein in a old airport hangar in pocono township. now, frein has been jailed since his arrest, on october 30th, and he will be in court today with his new legal team, which has entered not guilty plea for him. he is facing 13 charges. we are live in the sat center, justin finch "eyewitness news" on the "cw philly". >> justin, thank you. also, happening today the trial begins for the surviving suspect, in the boston marathon bombings. >> dzhokhar tsarnaev faces 30 federal count including four murders, using weapons of mass did he struck shown. his brother died several days after the bombings. don champion joins us near the courthouse in boston where security is very tight. good morning. >> reporter: good morning, the pursuit for justice in this case will be a lengthy one prosecutors have warned that this trial could go on for about four months. >> potential witness list about 700 names long. >> twelve jurors, six alternate, will be chosen to determine fate of the surgeon vying suspect in the boston marathon bombings. the process of choosing jurors from a pole of more than a thousand people, could take weeks. the trial that will follow will certainly open old wounds for bombing survivors including heather abbott. >> certain it will bring up a lot of what happened, obviously two, years ago and a lot of emotion. >> two pressure cookers packed with nails, ball bar innings along the finish line near the attack killing three people, injured 260 others. prosecutors allege 21 year old dzhokhar tsarnaev and his brother 26 year old tamerlan

tsarnaev planned and carried out the bombing in retaliation for bombing in just lynn countries. >> defensor attorneys have tried to delay and mover the case from boston, claiming, their client could not get a fair trial here. now the relationship between the brothers. >> what this defense wants to show is whether or not this was a young man who was influenced, and under the influence, of his older brother who was the masterminds. >> dow could face the del penalty. during the trial jurors are expected to be shown videos that apparently shows him placing one of the bombs next to the attacks' youngest victim. and as we mentioned earlier security is already very high in and around the federal courthouse here in south boston. there is already a number every federal officers stationed outside of the building, also the media social security kept about a block away. and definitely will be the new norm here during this trial. ukee erika? >> now defense attorney rather familiar with high profile cases like this, correct? >> reporter: that's right. defense attorney judy clark very experience in the representing the high profile notorious clients, if you will, she did represent the unabomber and most recently she did represent laugh nerve the man who killed six people and injured 13 others including congress woman gabby it giffords. in those cases she was able to spare the lives of her clients, we'll certainly be interesting to see if she can do the same this go around. >> for sure, don thank you for. that will we'll get back to you on that. >> $20,000 reward is being offered for information leading to arrest following

the execution style murder of a limousine driver in west philadelphia. it happened saturday night on 54th and delancey in cobbs creek. police say 24 year old rodriguez ramirez found slumped over in the driver seat of the car. had he a gunshot wound to the back of his head. philadelphia police need help finding a missing woman. sixty-eight year old woman disappeared after leaving temple at cottman avenue and shush letter street. we are told she has altzheimer's and it is not speak english. if you see there woman you are asked to call police. >> family every shane montgomery tells us autopsy results conclude his death was an accident. divers pulled the west chester university student's body from the schuylkill river on saturday. the discovery ends add heart wrenching five weeks of waiting and hoping for his family. twenty-one year old dis a periods thanksgiving morning after night out with friends in manayunk. funeral arrangements now set for shane. a viewing will be held at saint john the pap business church in manayunk thursday night 5:30 until 9:00 and friday morning before the funeral mass at 10:00. donation this is his name may be sent to the garden state un water recovery aoun knit milford, new jersey or the friends of saint john the baptist. 7:09 right now. a fire breaks out at the home after former coach for the philadelphia eagles. that story is coming up next. >> and also ahead soul survivor, seven year old wakes away from a plane crash that killed the rest of her family. we'll have more on who she is, and about her mile-long trek to find help. >> and, an explosion so powerful, people and debris go

but, they are pretty shaken up. now, riviera just won big playoff game saturday. he spent five seasons in philadelphia, coaching the eagles linebackers. ukee? >> divers near the site of the crash of airasia flight 8501 will fly again to try to recover victims and wreckage. so far teams have recovered 34 bodies from the java sea. the crash killed 162 people, more than a week ago. now, with the weather clearing up, divers will try again to find large objects, on the ocean floor believed to be the fuselage. >> the national transportation safety board at the site of small plane crash in kentucky. a seven year old girl is the lone survivor of that crash that killed four member of her family. investigators hope that she can help them. >> the national transportation safety board has started gathering evidence from the wreck, pieces of the plane removed for the investigation to continue off site. >> we've all thoroughly examined the air frame and the engine of the airplane. >> officials say they'll have preliminary report red any ten days but an official announcement on what caused the crash could take up to a year. investigators will be looking at everything from weather conditions to a distress call from the pilot moments before the crash. but the best information could come from the crash's sole survivor pilot's seven year old caughter. >> having someone that is a witness, always helps us in the investigation it gives us kind of a story line. >> kentucky state police say the girl was able to free herself from the wreckage, despite having broken arm. >> so she just started walking to find help. she could not see any light. >> wandering nearly mile in

dense woods before coming across the home. >> she actually probably went the best route. >> brave little girl. >> kentucky state police say that little girl is now back home with family in illinois. ukee? >> men and women in blue including many from the philadelphia area joined the grieving family after fallen new york police officer. detective wenjian liu remembered for his devotion and on and off the job. jessica snyder from our sister station ccbs television was at the funeral. >> a day of sadness and silence. (taps). >> broken by the familiar scene for an officer mourns. an entire department alongside dozens of others, saluting the man whose family and fellow officers respected him so much. >> the caring son, a loving husband, and a loyal friend, you are an amazing man. >> detective wenjian liu's wife of just two months spoke eloquently of his love for the job and his devotion to family. he began as a volunteer auxillary cop in the aftermath of september 11, and joined the nypd in 2007. >> although he walk often he would always make sure to take time for me, his number one fan. >> his young widow wiped and wore white in her hair the sign of her mourning, an officer presented her with the nypd flag, while her husband's colleagues saluted and choke back tears. detective's father spoke

saying this is the dad he is day of my life. my only son left me. he went onto talk about how his son would often meet him at the garment factory where he work, to walk him home, and after every shift he would call his dad, i am coming home today. you can stop worrying now. on december 20 that call never came. he was killed alongside his partner, rafael ramos. >> all of the city feeling the pain right now and all of the city want to lift up the wenjian liu family and the rafael ramos family. detective lou, and brothers and sisters in blue, the thousands of you were lined up in those rainy street outside i'm so proud of you. >> a department proud of those they lost, in brooklyn, jessica snyder, cbs-3 "eyewitness news". and hundreds show their support for local officers at two separate rallies they gathered with signs in west chester, clearing on the men and women in blue, while a line of support stretched for blocks down baltimore pike in delaware county, a direct show of appreciation on the same day the nypd police officer was laid to rest. >> every law enforcement agency is represented here, because we all worked to the. >> people put their lives on the line, very important to come out and show your support. >> t-shirts, which red all lives matter, were also sold at yesterday's pro cop rallies, money raised will be sent to the families of the two officers, assassinated in new york. 7:21 right now. and still ahead this morning you just might call this perhaps the strangest story of the day. >> a burglar caught pam herring himself with a hot

>> goods morning i'm uecker wash, let's get your forecast and throw it over to katie in the weather center. >> winter is making a come back, delivering colder air initially, also eventually deal us lil rounds of light snow for tomorrow. that comes courtesy of clipper system. this is actually just lake effect snow that's still basically moving into the poconos, few flurries and up to the central pa mountains otherwise just dealing with few clouds out there. we expect more sunshine as the day goes on. temperatures as they stands you got to knock, i would say anywhere from five to 10 degrees off the values. that's how it feels any time the winds blows generally blustery day. so that temperature of 37, we expect to hit about 9:00 a.m. it will continue to decline through the day. light snow, coating to inch, or up to two for some of you. across the board tomorrow. jess? >> thanks, katie. coming up on 73 we start things off right now out on 422, where we can see some delays here around trooper road, so trooper road moving little slowly, kind of wraps around eastbound toward the king of prussia area. see some slow going, brake lights, there and an accident out on 95, tying things up in the northbound lanes at bridge street. that's actually have police activity on the scene trying to get that cleaned up and out of the way. ukee, back over to you. >> jess, thank you. next update at 7:55, up next

corporal brian dixon and douglas, frein led police on 48 day manhunt after the ambush. >> and jury selection begins in the fraud trial of don tollefson, former philadelphia sport caster charged with stealing more than $300,000 by selling sports theme trips he said would benefit various charities. a bucks county judge is allowing him to represent himself with the help from an attorney. >> in a courtroom today the fight continues over the old revel casino in atlantic city. a bankruptcy court judge will decide if develop fresh florida should get $8 million business count on the property. glenn straub lost the original auction with $95 million bid. but the first fire backed out. now straub says the auction was not run fairly and the price should be cut. well, back to work this week for president obama and congress. >> republicans will control both the house and the senate for the first time since the president took office. michael bert with more now on how the pour shift in congress could affect the president's final two years in the oval office. >> president obama returned to the nation's capitol sunday, trading in the warmth of hawaii for the partisan chill of washington. his agenda for the final two years in office will largely be shaped by how much or how little he and the new gop controlled congress can work together. the president has already drawn a line in the sand on key issues. >> if republicans seek to take healthcare away from people who just got it, they will meet stiff resistance from me. >> republicans bolstered by

chilly meanwhile, numbers finding for your daytime highs, what we are expecting around 9:00 a.m. and those temperatures will gradually just decline as the day progress, erika mentioned the snow. here's what's up. dealing not only with temperatures dropping today with time and pretty vicious windchill to go with it but snow coming in by tomorrow, talk about and the, timing little later in the show, but bitter cold is also going to be reinforced. so if you walk out the door and you think man it is cold now, it is only going to get colder. so talking temperatures throughout the morning as well. jess, over to you. >> thank you katie. morning, everybody, just little after 73 we have some construction out on the vine street expressway, around 24th street, tying things upright here in the westbound lanes towards the schuylkill. blocking out one of the third lanes over. lose that middle lane right here, everybody casino every splitting n through, to head toward the schuylkill. no problems really on the eastbound side ben franklin bridge flood philly side so headed into new jersey ongoing construction right, there taking out the right-hand lane. everybody kind of two lanes squeezing on by headed eastbound into new jersey, headed into the sit now problem. but typical morning volume. now an accident on 95, northbound, at bridge street, with police activity on the scene there. that's pushed over on to the left hand shoulder. a disable car out in lower salford, harleysville pike at meeting house road. that is pushed over to the shoulder there, as well. and there is an electrical fire out in west pottsgrove high street at south gross town road. so you can expect fire police

activity on the scene and lansdale doyle towns regional rail line suspended due to overhead problems. erika, back over to you. >> thank you, if you are driving the pennsylvania turnpike today your right just got little bit more expensive. tolls on the turnpike increased by 5% yesterday. the rate hike is the same whether you pay with cash or e-zpass, extra mondayly help pay for road construction project. move comes just days after the state's gas tax also jumps by 10 cents per gallon. >> time now 7:36. let's get check on business. >> money watch's jill wagner joins us from the new york fock stock exchange, jill, all enjoy low low gas prices but hearing it could be changing, what's happening? >> reporter: that's right, good morning ukee, erika. this has nothing to do with supply and demand, which is what we usually talk whether we river to gas prices, now we can thank taxes congress may consider raising the federal gas tax in order to fill huge budget hole in the highway trust funds. right now the federal gas tax is 18.4 cents per gallon. and it hasn't been raised since 1993. ukee erika. >> jill, also hearing starbucks is look to go gain back some coffee credibility. what's that all about? >> yes. after years of frappuccino's pumpkin spice latte's, nothing wrong with those, the coffee chain adding something a bit more sophisticated to its menu, a flat white. so it is two shot of expresso and steamed milk, this drink has been available in the uk since 2010. and it is apparently very popular. sounds good. what do you guy think? >> i'd girl it awhile. >> i would give it a taste.
