starting tomorrow at 3:00. at the stadium, eye witness news, back to you on tv hill. >> funeral services are expected to be saturday in mississippi. wjz 13 is always on. check in with eye witness news for complete coverage, for updates on the investigation and more reactions and to e- mail us your thoughts or read what other fans are saying go to wjz.com. updating another breaking story an apparent drowning in baltimore county where the man dives into the water off a pier, but never resurfaces. eye witness is live. kelly? >> reporter: denise, everyone here says something went terribly wrong when a group of people went swimming but it's still unclear what that was that happened. you can see from sky eye chopper 13 that emergency responders were here just before 4:00 jumping into the water to try to find a 22 year old man. the search lasted for about a half hour, they did pull the man out who friends call rick. we spoke to people here at the

house where rick would stay and they explained to us what happened as they went swimming. >> the kids were going to race and see who got to the other side of the creek fast enough, and we all got, we all started getting across and then we looked back and rick said "help" and we all tried to swim towards him and amber said, i'll get him, you go call 911. >> amber was holding him, and she couldn't hold him anymore and he got from me to you and he went down. >> he was foaming at the mouth and that's why i thought maybe he had a seizure or something and by the time i got there i could not see him. she tried her best to hold on to him. >> police have not confirmed how this man died or given us his full name yet. we do know from friends he died at bayview medical center a short time ago and they say before they went into the water he told them he was a good swimmer. wjz eye witness news. >> thank you very much, kelly. we also have new developments tonight in another story in baltimore county after

two teenagers are found along the light rail tracks. tonight both teenagers are now dead. sky chopper 13 is over the scene in lutherville with the investigation into what continued or what happened is continuing. let's go live on the scene with more and she has new insight know what may have happened. >> reporter: light rail investigators and passengers have a long list of questions after a train employee made a gruesome discovery sunday afternoon. >> it was an inspector that just happened to be looking out of the window and saw two bodies lying inside the southbound track. >> how did they die, right? was he shot? thrown on the tracks? >> transit authorities say one teenage boy died sunday evening and the other who was clinging to life through the night died monday afternoon. they were found just 100-yards away from the lutherville station, and mta is confident the teens were not riding the rail. >> they were found lying inside of the tracks and so generally when someone is truck by a train they are either knocked

aside or whatever else. we are still trying to understand the circumstances that got them in the middle of the tracks. >> late monday evening an mta spokesperson says they have new information on what may have happened. they say they have preliminary evidence a train may have struck one of the teenagers, no information on the second one. >> i feel like it was foul play and somebody just drop them off back there. >> others think the boys were playing off the tracks. >> i have seen a couple of kids going down and walking up and down that way. >> michael says eight years ago, someone he knew was run over by a moving train. >> you win or you lose and unfortuntely, they lost their lives, and that's that a price that you want to pay. >> from a distance they don't look like they're moving that fast but they really are. >> exactly why mta police urge everyone to stay away from the tracks. >> and it was a lengthy investigation all day and the mta wants to say even though they may have found markings on one of the trains they have not confirmed a cause of death.

they have released the victims name, both just 17 years old. live in lutherville, wjz eye witness news. >> live for us tonight, thank you. mta police are calling this investigation very preliminary and are asking anyone with information to come forward. a 5-year-old little girl still clinging to life, just days after she was shot in the head in southwest baltimore. today, her alleged shooter appeared in court for the very first time. mike helgren is at the scene of the shooting. mike? >> reporter: the prayer vigil is just getting under way here. so many prayers going out across this community, across this city for this little girl who is just clinging to life. now, the 17 year old suspect is staying in jail for now. >> lemont davis faced a judge this afternoon who ordered the 17 year old held without bail for shooting a 5 year old in the head last thursday in the 300 block of south pull ascii street. court records obtained by wjz, police say witnesses picked

davis out of a photo line up and they say they was fighting with another teen, grabbed a semiautomatic handgun and started firing and little raven was hit seconds later. >> we need to speak out strongly about what has happened in our community and say enough is enough. time for us to turn it around. >> the baltimore sun reports davis was placed on home monitoring one day before the shooting. the sun says davis was charged as a juvenile with robbery and in a rare move, a juvenile master allowed him to go to his house in cherry hill until sentencing. the paper reports davis may have cutoff his gps equipped monitoring device and police say he has a long juvenile record. >> this really comes down to criminals, to thugs, to maniacs on the street, on our streets with little to no parental supervision. >> the victim, little raven is still clinging to life and her family requested the hospital not release updates on her condition. many of her neighbors are still

outraged over the crime. >> i think that it's just sad that kids can't really play and just have fun and just be kids without things happening in life, you know, school about to start, so that's just sad. it's real sad. >> and this prayer vigil is growing out here, the 300 block of south pull ascii street, just getting under way now, we'll be out here for some time to come. wjz eye witness news. >> thank you very much, mike. well it wasn't a bird and it wasn't a plane so what shot across the sky up in hartford causing a rumble that felt like an explosion? that is a question that a lot of people want answered. so let's go to sally live in the news room with more on this mystery. >> reporter: hi, adam. the 911 call center was flooded with calls very early this morning from people who said they saw the flash and felt their house shake. most of the calls came from northern hartford county but some people in northern baltimore county also felt the rumble. the hartford county sheriffs department is still puzzled.

>> we were able to confirm with the faa that there wasn't a plane in the area, wasn't anything related to any seismic activity, we've checked with mema, so we don't believe the anything landed or struck anything in our county. again we don't know if maybe perhaps somewhere close but we had numerous calls about it. >> so for now they are continuing to investigate. we should know no actual damage from a meteor has been reported anywhere. adam? >> a lot of people heard that, sally. thank you. police in fact fielded reports from as far away as lancaster county in pennsylvania. in the sky tonight a few scattered clouds, a live look outside where it's an absolutely gorgeous start to the work week. we have first warning weather complete coverage, our meteoroligist is in the outback but we start with bob in the weather center. >> the weather has been so beautiful the start of this past weekend and really for days now. it will continue a little longer. right now 84 degrees, west

winds at 6 around here pretty quiet, nothing going on, there is a weak frontal boundary across michigan and you see it to about buffalo up toward new hampshire, vermont. that front up there will be actually headed down to the south toward our region so we may see a few clouds, a slight chance of a shower, very slight chance in a few spots and most places stay dry and it kind of reinforces the beautiful weather we've been seeing, we take a look on what's the pattern causing this nice weather around the region with low humidity and a bright sunshine. >> reporter: well there's a front coming in tomorrow and that's what we're going to deal with for tomorrow and because of that additional clouds will come in and a chance for a couple of showers but not much moisture with the front as bob was showing you and very dry on this of us right now but behind that there's another round of cooler air and as long as we continue to pull from that direction it will remain cool, however as we head toward the end of the week doesn't look like we'll be pulling from the north anymore. there is a warm upcoming our way and we'll have that forecast shortly.

>> thank you. well it's kind of a case tonight of washington d.c. council member marion berry is fighting criminal charges after a woman claims he talked her. her and her attorney denies the charge and says he intends to fight it but in a new twist the woman he is acused of stalking says she didn't intend for him to be charged at all. for now the investigation does continue. back in 1990 while mayor of washington the fbi caught him smoking crack and he served six months in jail. months of speculation have come to an end as baltimore county executive jim smith says he will not run for state comp proaler. he made the announcement today in a written statement and he does not indicate why he decided against running except to say he's confident he is making the right decision. smith's second term as baltimore county executive expires in 2010. by law he cannot run for a third term. well we have a lot more coming up on wjz's eye witness news including the hottest ticket in town, fans getting

a celebration set to get under way tomorrow for the king of pop michael jackson, but before thousands of fans stream into the city of los angeles, the court has issued a major ruling on what should happen next with his estate. tonight karen brown reports on what happened today. >> reporter: lucky michael jackson fans are getting outfitted for his public memorial. >> i will wristband you now. they are waterproof. >> they've been driving by the carload to dodgers stadium to pick up the wristbands for tuesday's service. >> i've never won anything in my life and i've won these tickets. >> more than a million and a half fans registered for a chance to attend. this is one of 8750 names randomly chosen. >> i think it's going to be a phenomenal experience. >> los angeles police are urging those without a ticket to watch the service from home. all five television networks will broadcast the memorial at a monumental effort is under

way at the staples center to accommodate all the media. in court, it's just begun over jackson's estate. >> we have no reason to believe this is going to turn into a nasty fight. >> jackson's mother filed to oversee her son's estate but today a judge ruled the singers long time attorney and family friend should be in charge as jackson laid out in his will. over the weekend, cameras caught up with jackson's ex- wife, debby rowe outside her california home, the mother of jackson's two older children is still deciding whether to fight for custody. rowe will not be attending the service at the staples center to include mariah carey, jennifer hudson and stevie wonder. jackson's family will hold a private funeral at forest lawn cemetary beforehand. >> there was so much demand for tickets to jackson's funeral that people entering their names had a better chance of being struck by lightning than winning a ticket. >> the chance is there. don't forget wjz will bring you

doors to baltimore hotel rooms. future conventions are booking record numbers. >> we've opened up a lot of new hotels including the hilton, our convention and tourism product is better than its ever been before. >> for fiscal year 2009 over 500,000 future room nights have been booked and that covers a period from 2010 to 2016 for planned conventions and events, lured here in part by the four to 5,000 new hotel rooms which means baltimore can host 75% of large city conventions. >> that deserves a round of applause. >> with the prospect of hundreds of millions of dollars in convention sending. >> it's a great source of tax revenue and has a ripple effect over all of the restaurants, other venues around, it has a great effect on me drawing visitors is a high stakes competition even in the best of times and now it's even rougher. >> this time when the economy is down it's even more aggressive and more cut throat than it normally is. you may have to cut deals you

wouldn't cut during normal times. >> making baltimore a bargain built around a water view. >> and if the reservations hold so will a lot of others. wjz eye witness news. >> now if the bookings remain strong, it's projected that the economic impact of the convention visitors will top $700 million over the next 10 years. this is the kind of weather they love at the tourism department. >> it's like this all summer. >> yeah. >> every day is perfect. >> last year it was a beautiful summer. >> so, a few spots this week, saw a little rain, not in the baltimore region but let's take a look at temperatures right now outside, very comfortable because the due point is very low at 52 degrees, humidity only 32% and 84 degrees out in the west northwest winds 6 and coming back to take a look at tuesday and the rest of the week right after this.
