we are following breaking news this morning, behind bars and held without bail after nearly seven weeks on the run, eric frein just made his first court appearance in the murder of a pennsylvania state trooper. this is video police leading him into the courthouse for his arraignme arraignment. he was transported from the correctional facility where he spent the night to the courty courthouse for this morning's hearing. what can you tell us? >> reporter: well, i was there as eric frein was taken by state troopers from their vehicle into the courthouse. there were cheers from the

public as he was walked in handcuffs into the courthouse. troopers very deliberately walked him in front much our cameras both into the courthouse and then when he exited. in fact, after his preliminary hearing, state troopers stopped him on the courthouse steps for at least 30 seconds, then slowly walked him around the side of the building before driving him back to the pike county jail. they want people to see the man who is charged with killing corporal bryon dickson in september. frein is also charged with attempted murder for shooting another trooper at that scene. he spent the last seven weeks on the run surrounding the pocono mountains, alluding police until last night. he was found in an abandoned airport hangar in tannersville by a group of u.s. marshals helping the search. >> this was not a result of a tip or a sighting. this was a result of the ongoing pressure put on frein by law co

house to house, cabin to cabin, as a result of that, one of the teams in this case, u.s. marshals, located him as part of a routine sweep through the woods. >> reporter: we are told 31-year-old eric frein surrendered without a struggle. he had several weapons on him. they found additional weapons inside the hangar where he had been hiding out. you saw in the video he had cuts to his face, across his nose and across his left cheek. we asked about that. state police say he got those during his flight over the past seven weeks. live in pike county, katey zachary, nbc 10 news. >> those little boys have no fathers. >> angry onlookers shouting at frein. in this video showing frein

being walked out of the police barracks in blooming grove and he was taken to jail this morning. u.s. marshals arrested him around 6:00 last night in an abandoned airfield in tannersvil tannersville. here is a photo of the airport in tannersville. this is where he was captured. it opened as a resort and the air park was added in the 1960s, but it closed in 1998. following frein's capture, we were on the scene in tannersville as police set up a roadblock there. that's less than a mile from the abandoned hangar. they found at knife and a hunting rifle. it's unclear just how long he was there. but police will be back out there again today looking for more clues. now that eric frein has been captured life can get back to normal for the people of monroe county. the search for eric frein has gripped the community there. they had several sightings in the area. state police spent the last

seven weeks combing the dense woods, telling people they couldn't leave their homes. school was canceled for a bit. hunting season was delayed and halloween was canceled. >> i was very happy. nobody got hurt. you know? they caught the guy, you know. so they can go home and be peace and quiet. >> the police did a great job. i knew they would get him. i felt he was still in the area. >> for the kids in the region, there's a special treat, halloween is now back on. this morning, many are remembering the state trooper who died in the attack. corporal bryon dickson was killed as he walked out of the barracks. he leaves behind a wife and two young sons. he used to work in philadelphia. last night when they cuffed frein, they used his handcuffs. the other trooper shot during

now. what is out there, that's a storm developing, a coastal storm. that eventually is going to pull moisture back in. we have moisture from the west that's going to be moving here. 49 chilly degrees right now. 46 in allentown. 47 in mount holly. warm spot, 51 degrees. it's a chilly start to the day. our futurecast shows clouds thickening up from the east and eventually, as we go into the night tonight, some of this moisture comes in with some showers. but this is later on, during the evening hours, and especially overnight tonight, after, let's say, 11:00. so the early trick or treaters, it looks like a pretty sure bet that it's going to stay dry. but as we go toward the latter portion of the evening, there's a chance of light rain or sprinkles. temperatures dropping into the low 50s. we are expecting very light

report for us in the next half hour. dozens of people were forced out of their apartments this morning after an overnight fire in west philadelphia. nbc 10 was at 62nd and chestnut shortly after the fire started. this was around midnight. firefighters battled smoke and flames for more than an hour. investigators believe it started inside a third floor apartment. you see residents ran from the building with just the clothes on their backs. some had to be rescued. we spoke to one of the people. >> smoke. i had to run back into the apartment, close my door. i had to go out my front window where the balcony is at. >> you went out through the balcony in. >> yeah. >> two people were hurt, one a firefighter. they are expected to be okay. the red cross is helping residents who now have no place to live.

this morning in kansas, crews will begin recovering the bodies of the four people who were killed when a small plane crashed into a building. this was breaking news we brought you yesterday on nbc 10 at 11:00. one witness said it looked like a giant fireball when it hit a building in wichita yesterday morning. a federal investigator says the pilot reported a problem with the left engine just after takeoff. the plane was back -- was on its way back to the airport when it crashed. those who died are believed to be the pilot and three people

who were in a flight simulator inside that building. in illinois, three members of a family are dead after their suv was hit by a freight train. this collision happened in a town of vandalia, it's a block away from where the halloween parade was about to start. a woman, boy and girl were killed. two other people in the suv were hurt. the cause is under investigation. officials believe the bars and lights at the crossing were functioning properly. this morning police in washington, d.c. are searching for a man who tried to attack an officer with an ax. they say the man hit the officer's car window around 3:00 this morning. the officer attempted to tackle the attacker. but a struggle -- the man got away. the officer was not hit by the ax but he did hurt his shoulder during the struggle. this comes two days after new york city police officers were injured in an attack by a man there with a hatchet.

now to ebola concerns and new information. maine health officials have asked a court to limit the movement of nurse kaci hickox who defied a voluntary quarantine for medical workers who have treated ebola patients. officials filed documents yesterday. the judge issued a temporary order until a ruling expected today. police are monitoring her but they can't detain her. she returned to the u.s. last week after treating ebola victims in west africa. two days in a row, she defied the state's ebola quarantine, including taking this bike ride with her boyfriend just yesterday. she says she tested negative and is not a threat. she says her rights are being violated. of course, count on nbc 10 for information on the ebola outbreak. go to nbc10.com for a section dedicated to the virus, including the symptoms. remember to use #ebola to get the latest information straight from us.

on hawaii's big island, dozens of national guard troops are helping to provide security near the lava creeping closer to homes there. the l the lava is on course toward a downtown area. part of the flow is now within 100 feet of a house. so far, the lava has burned a shed, tires and vegetation. the colder air started moving in yesterday. it is a chilly day. but we also have rain on the way, some of it starting tonight. the timing, of course, is going to be critical because of the trick or treating. a rainy saturday, especially in the morning. and a windy sunday. windy and cold. we have some high clouds increasing across the area right

now. it's only 49 degrees with that high. only six mile an hour wind. seven degrees colder than this time yesterday. we are only in the 40s, mid to upper 40s in most places. 42 in mount pocono. 49 in dover. atlantic city international 49. it's a very chilly day compared to yesterday. yesterday was colder than earlier in the week. we are five to seven degrees cooler than we were at this time yesterday. you can see the high clouds increasing from the south. there's not any rain close by. but it's building up off the north carolina coast. another coastal storm develops. it's going to provide a lot of that wind. we have rain back to the west. that moisture is moving eastward. it's even snow on the back end of this. chicago got the first snowy halloween ever recorded this morning.

futurecast around here shows dry conditions this afternoon. the early trick or treating looks fine. and then here comes the moisture. the later you stay out tonight, the better the chance is there's going to be rain, at least light rain or a little drizzle. we're not talking about anything heavy before midnight. and then well after midnight, that's when the more significant starts to come. so as we go through the halloween night, it starts off dry. it's chilly. but it's not bitter cold, and it's not going to be windy. it also looks dry until perhaps later in the evening. that storm will develop out offshore. the northwest wind, that is going to really be howling as we go into sunday. sunday we could see gusts over

that way whatever wires they have can stick out. >> reporter: they are made by volunteers, including this 13-year-old angela. >> we did "frozen" and minions. >> reporter: she loves imagining the babies in the costumes and meeting parents whose lives are touched by her work. >> i know i did something right. to put a smile on their faces, because i know they are going through a difficult time. >> reporter: erica edwards, nbc 10 news. while kids seem focused on the andy,candy, most say they w rather get cash. they found 53% of parents say their children would rather get money. etiquette experts say some people might not have candy, so they give out dollar bills instead. i don't know any of those people. parents should teach kids not to expect that. that's good.

finally got the chance to use them. after 48 days, finally a reason to cheer in northeastern pennsylvania. state police in full gear walked accused cop killer eric frein into the pike county courthouse this morning where he stood before a judge and was formally charged. >> based on the facts and evidence, we have charged mr. frein with murder in the first degree. >> reporter: prosecutors will seek the death penalty. more than a thousand officers were a part of the manhunt for frein. he hid in the back woods for more than six weeks before he was captured by u.s. marshals near an abandoned airport in the pocono mountains. >> this was the result of the pressure put on frein by law

developing storm off the north carolina coast. we also have moisture out to the west that is trying to move in as well. 49 in philadelphia. 50 in wilmington. 50 in wildwood. 51 in georgetown. it's not very mild anywhere in the area. the futurecast showing dry conditions through much of the afternoon. and then tonight, we start to see the moisture coming in from the ocean. the later you go at night, the longer you stay out, the better chance of light rain or drizzle. the more significant rain does come during the day on saturday. along with increasing winds. for halloween, it's going to be chilly, but it's not going to be very windy. it should stay dry at least until later on during the evening. a chance of light rain or drizzle by 9:00. a lot higher chance of rain as we head toward the rest of the

weekend. i will talk more about the timing with that and the rest of the seven-day in a few minutes. now to the possible septa strike. the union and septa are scheduled to resume talks in less than a half hour from now. monique braxton is live in old city. a decision could come later today? >> reporter: that's what we are hearing. they will gather here at noon. i reached out to a septa spokesperson to ask about the service interruption plan. she doesn't want to reveal any provisions at this point because both sides are due back here to talk at the bargaining table. we did go over to community college of philadelphia to talk to some of the 34,000 students who take classes there. the students we spoke with are freshmen and sophomore who travel across the city. one told us the difference between paying to park in a lot and riding public transportation could be as much as $10 a day. here are a few of their comments between classes.

>> i drive and park in the residential area and walk over. >> it's going to be hard to get to college and all that. it's going to be difficult. i think they shouldn't do it. >> reporter: have you thought about your alternative plan? >> yeah. i could try to get a ride. >> i'm going to try to get a ride. then it's hard for people who have kids to take to school. >> i'm going to have to walk from 2nd and morris. i got to get to class. i can't miss class. >> reporter: they told us, it would take two hours to walk to ccp from south philadelphia. ccp employed 1,500 faculty and staff. we asked administrators what their plan is. they told us that classes will go on as planned. they also said they have set up a carpool internet website for students to try to catch a ride with someone else. we will monitor the situation

for you here. the bargaining talks between septa and the union and have an update in our evening shows. live for now in old city, monique braxton, nbc 10 news. the sorn sons of a local hl executive have hired an expert to investigate the death of their parents. john sheridan and his wife were found dead in their bedroom of their home back in september. after a fire was reported there. authorities said the fire was set on purpose but have not said what killed the couple. the prosecutor's office says it's waiting for the results of laboratory tests before it can determine what led to the deaths. according now to the philadelphia enquirer, the couple's sons have recruited a pan pathologist to help in the investigation. maine health officials have asked a court to limit the movements of nurse kaci hickox who defied a voluntary quarantine for medical workers

who have treated ebola patients. a judge granted the order yesterday. it limits her travel and requires a three foot buffer if she encounters people. it bans her from public places until there's a further decision today. for now, police are monitoring her but they can't detain her. she returned to the u.s. last week after treating ebola victims in west africa. two days in a row she defied the state's ebola quarantine, including taking this bike ride with her boyfriend yesterday. she says she tested negative and is not a threat. she says her rights are being violated. the world health organization say the reason some healthcare workers have contracted ebola is that they failed to use protective equipment properly. the director for service delivery and safety says the problem was with how the medical staff put on and took off the equipment, like goggles. the director added that difficult working conditions could explain the misuse. a new lawsuit says one

day." it was published under a pseudonym in 2012. he blames his first attorney forrefor ed advising him he didn't need to submit his manuscripts for review. he has apologized for not having it vetted by pentagon. rescue crews in missouri came to the aid of a parachutist who got stuck while base jumping. they found him hanging 155 feet in the air last night. he got hung up on a tower's spo support wire. it took two hours to get him down. he was not hurt. the search continues for the parents of two toddlers who were found around a busy intersection in california. this is video showing the two boys after people noticed them walking around without supervision yesterday morning. folks say the younger child is no more than a year old. the other is about 2. one woman says they are brothers. she baby-sat the boys not long

ago and believes they may have escaped from their home. >> the 2-year-old opened the door and was able to walk out. so i'm assuming that's probably what happened. >> typically, children of this age, we would have already received a call from a frantic parent saying, i lost my 1 or 2-year-old. so far, nothing. >> the boys are now with child protective services. we know more about the funeral for former boston mayor thomas menino. he will lie in state sunday. it will people the opportunity to go pay their respects. a private mass is scheduled for monday. he served as mayor of boston for more than 20 years. he was diagnosed with advancedsr leaving office. he died yesterday at the age of 71. now to decision 2014. we are four days away from election day.

were 22. then you abandoned the race -- i think mid season. the next year you come back. tell me -- it's almost defiant on your part that you came back and attacked the disease and decided to race when others could have given up. >> i wasn't going to let something like diabetes get in my way of living my dream. when i was diagnosed, i didn't know what would change or what, if anything, it would mean for my racing career. i was able to work with my healthcare team, use the modern devices out there, meters, monitors, insulin, all of those things that allow me to manage my diabetes. when i'm in the car, i think about driving. >> tell me about that. i mentioned during the break that my brother died from the effects of diabetes a year ago. i remember shots. on a day-to-day basis, how does it affect you. >> i check my blood sugar, four, five, seven times a day depending on the day.

i take insulin multiple times a day. i use a new device that has come out. i used it since '07. all of those things work toward keeping my blood sugar managed the way i want so i can train, i can prepare. i put my helmet on. it has tools in my car. i wirelessly monitor my blood sugar. i have oil, speed, blood sugar. >> that's a lot of things to keep track of. tell me some misconceptions about diabetes. >> there's a lot of challenges to diabetes. you have to keep it above a certain range but also below a certain range. you are working within a window. all of these different things affect your blood sugar from eating carbohydrates, drinking so soda, fruit juice, working out, any fitness, walking. it's all part of a healthy lifestyle. then for me adrenaline makes -- has an affect when i'm in the car. >> you mentioned the car.

others during the day on saturday. it's not going to be real pretty. prepare for rain and the cold and the wind. the rain starts tonight, especially late tonight. a rainy day on saturday and a very windy day on sunday along with even lower temperatures. clouds continue to increase here across the area. they are generally high clouds. they're not going to bring any rain here in the next few hours. 49 degrees, the wind is six miles an hour. it's going to be a lot different than that as we go through the weekend. one other thing that's going to happen this weekend is get an extra hour of sleep before you go to bed sunday morning. turn your clock back one hour and get to sleep an extra hour. the sun will set and rise an hour earlier starting on monday. you can see the temperatures are in the mid to upper 40s,

touching 50 in wilmington. it's even colder than it was yesterday. there are the high clouds coming up from south. the nearest rain is far away. but it's getting closer and closer. eventually, as the storm strenstren strengthens, it will pull moisture from the ocean. it's not coming from the west, generally speaking. this is mostly coming from the east. after 9:00, 10:00 tonight, the chance of rain goes up and up. it's all goes from west to east. for trick or treating, the earlier, the better chance of staying dry. it's chilly throughout, but there's not going to be much wind. there's a chance of rain by 9:00. there's the storm developing. here we are this afternoon. we're dry. at 10:00, this particular model keeps us dry. not by tomorrow morning. the northeast wind is here bringing the rain back in.

there's 1:00 in the afternoon, it's still rain across the entire area. it's only breaking up saturday evening as the storm moves offshore. it's getting so strong, that the winds behind it are increasing. so it's going to be pretty windy weekend overall. these are the future wind gusts, according to one computer model. it tends to overdo the gusts, but there's -- to give you an idea, 20 mile an hour on saturday afternoon. look what happens on sunday. it goes to 30, even 40 miles an hour for gusts, especially toward the shore. now for football. temple university playing. looks wet, especially around noontime. it should be the heaviest rain and the coldest temperatures. during the day today, we expect the clouds to continue to thicken up. temperatures in the mid to upper 50s for the high.
