see more of the rain move to the north. from now until 7:00 p.m., we stay windy. winds gusting near 25 miles an hour. rain stays to our south, 7:00 to 9:00 p.m. tonight, stays windy, rain mainly in delaware at this point. but continuing to move to the north from 9:00 p.m. to 11:00 p.m. tonight. winds increase as we get closer to midnight, especially along the share and that rain continues spreading to the north. by tomorrow morning, heavy rain around for the morning commute. i'll show you the timing of that coming up. >> thanks, sheena. the rain could impact the morning commute. count on us to help you get to work on nbc 10 news today. you'll find weather and traffic updates beginning at 4:00 a.m. tomorrow morning. tonight at 6:00 -- >> why did she have to die like that. >> heartbreaking. a mother's anguish, her daughter shot to death while eight months pregnant. and now we've learned the baby's father may have been the intended target and he could be connected to another murder that happened hours earlier.

nbc 10's lu ann cahn live at philadelphia police headquarters. did the family know they were in danger? >> reporter: the family says that they knew jasmine williams' boyfriend was talking about turning himself in to police yesterday. they believe if he had just done that, she might still be alive. >> they just took an innocent life. she had nothing to do with whatever was going on. >> reporter: monique williams moore says she saw her pregnant daughter jasmine and her boyfriend together last night. it was hours before jasmine was shot in the head, killed in this car in west oak lane. razir was shot multiple times but survived. >> did you worry her life might be in danger with him? >> all the time. yes, all the time. he had such a hold on her. >> reporter: she says razir is the father of her 6-year-old grandchild and jasmine's unborn child that died.

police sources confirmed they were looking for razir in connection with a murder/robbery on north broad street yesterday. he has not been charged. >> there were a whole bunch of shots lake a cowboy movie. >> reporter: neighbors from blocks around this corner in west oak lane say they heard more then a dozen shots at 1:00 in the morning. one witness afraid toç show hi face say he heard an argument first. they believe razir was targeted and it was retaliation. >> they were after him and she happened to be there with him or he dragged her with him and they took her. they took her. they took my baby. they took her life. >> reporter: i just spoke to the sister of razir. she says her brother remains in critical condition and that he didn't murder anyone but he was involved in a fight yesterday and that he called his probation officer to turn himself in and tried to clear his name. and, again, that he just didn't make it there.

there is a $40,000 reward in this case for information leading to suspects that were involved in this case. live at police headquarters, lu ann cahn, nbc 10 news. this is the second time in ten days that a pregnant mother has been shot to death in philadelphia. 25-year-old megan doto and her unborn baby both died after she was shot in the head on adams avenue in frankford. the suspect in that shooting, 27-year-old devon guisherd still has not surrendered to police. officers don't believe got toe was his intended target. they think he was shooting at a car driving down the block. a shootout in the streets in front of a school, tonight, a man is dead in a gun battle that ended with an innocent bystander getting hit by a car. this gunfire erupted in front of the pan american academy charter school in west kensington. that's where nbc 10's christine maddela joins us live. what's happening there right now. >> reporter: about ten minutes before we went on air, police

cleared out much of the area here on cam berea street in front of that school. right now, the police activity is limited right here to one block of cam berea where two men were shot and one innocent bystander was hit by a car. >> no! no! >> reporter: nbc 10 was at the scene when this woman ran to police trying to find out if her son was involved in the incident. it was a scary afternoon for other parents, too. shortly after the shootout at 1:00, police put pan american academy charter school on lockdown. >> it's very scary. >> reporter: lopez tried to make it past the police tape to pick up her children. >> we got the phone call to pick up our children. >> reporter: what's going through your mind? police say this is the second shooting near a school in as many weeks. >> it just shows these guys really don't care about what's going on. they have no concern for the public, the safety, their environment. it's all about themselves and the criminal lifestyle they're leading, you know?

it's a shame. it really is. femme in this neighborhood deserve better, police tell us it all started when two men got into a shootout. one man was walking, one was driving this car. they fired several shots at each other. after the driver was shot, police say his car hit an innocent man on the street. >> he was crossing the street? >> he actually works here at the garage. he was out doing his job. and he gets hit by a car. >> reporter: the driver of car was pronounced dead at temple university hospital. police say the two other men are both in stable condition at hahnemann hospital. christine madella, nbc 10 news. >> thank you. now to the ongoing casino crisis in atlantic city. the failed revel casino was supposed to be auctioned off today in new york. it didn't go as planned that has serious allegations flying tonight. florida developer glenn straub hoped to leave the auction today as the new owner of the revel. instead, his lawyer said after six hours of waiting, revel

would not reveal how many bids were being considered, who had made them or for how much. he calls the process tenanted it and is accusing revel's attorney of conducting closed-door deals. >> process is not çtransparent. it's not fair and open. >> you have to have a proper bid procedure. they're obviously not following that and saying they can do whatever they want to do. that's their exact words, they can do whatever they want to do. >> straub bid $09 million for revel which was built for nearly $2.5 billion. with no outcome today, those vying to own the defunct resort are set to return to new york next tuesday. we called revel's lawyers for comment. we have not yet heard back. three suspects wanted in the beating of two gay men are in police custody. nbc 10 got these mug shots of the suspects a short time ago. philip williams, kathryn knott and kevin harrigan turned themselves in this morning. they are facing assault and other charges in the september 11th attack that left two men

injured. attorneys representing the three says the crime was not motivated by hate or the victim's sexual or yenati orientation. they said both sides are responsible after an altercation turned from words to fists. >> this was not a gay bashing. it had nothing do with anyone's sexual orientation. >> they released surveillance video in hopes of identifying those responsible. although a large crowd there that night, the three charged are the only in the group they expect to file charges against. tom corbett sign a cigarette tax law to help fund philadelphia's cash-strapped schools. the state senate passed the $2 a pack tax yesterday. this bill is expected to bring in about $49 million for the school district this fiscal year and $80 million in following years. the tax will only apply to cigarettes sold in philadelphia. and a big win for supporters of legalizing medical marijuana in pennsylvania.

legislation that would allow several forms of the drug pass through the state senate today. nbc 10's keith jones live in our digital operations center with more on what's next for this bill. what about it, keith? >> the bill crossed a huge hurdle. it may face an even bigger uphill battle when it crosses the house. under the proposal, state residents would need an access card from the health department. they have to prove they have a practitioner/patient relationship. and written confirmation of a qualified medical condition. if the bill makes it through, a tough battle with house republican leaders, it could face more opposition if it makes it to governor tom corbett's death. more than 30 other states, including new jersey, delaware have legalized some form of marijuana. a handful of drug delivery methods have been approved that doesn't include smoking. it includes ointments, edible products and extracted oils.

reporting live, keith jones, nbc 10 news. thank you, keith. pennsylvania lawmakers passed a bill today that would protect people who try to help someone who overdosed on drugs. the bill would also make the drug naloxone, also known as narc narcan. it's used to counter the effects of an overdose. new at 6:00, an arrest in the shooting of a philadelphia police dispatcher last month. investigators say allen stokes shot and critically wounded edward lynn at a bodega in west philadelphia. lynn was hit six times, once in the spine. he's still recovering from those injuries. police say surveillance video helped lead them to the suspect. a berks county theater director is accused of sexually assaulting a teenage boy. 55-year-old mark drei of exeter township turn himself in to police yesterday.

police say he and the now 15-year-old boy had sexual contact inç a dressing room at least twice earlier this year. investigators say the two also exchanged nude photos. the manhunt for the suspected trooper killer continued for a 12th day now. pennsylvania state police say they continue to find evidence that suggests eric frein has been in the dense woods of monroe county. officers say they saw a man believed to be frein as recently as yesterday. the rugged terrain made it difficult to identify him. investigators say it's the type of evidence they're uncovering that's giving them reason to believe they are closing in on this trained sniper and survivalist. >> we continue to find evidence of frein's presence and have found several items he's abandoned or hidden for possible future use. some of those items include serbian cigarettes and soiled diapers that we have found in the area. among many other things.

>> upwards of 1,000 law enforcement officials have been involved in the search for frein. police have the authority to kill him if he doesn't surrender. she says her professor offered her an "a" in exchange for sex. tonight, this former university of delaware student is only telling her story to nbc 10 news. plus, an update on a case that made national headlines. a local mom facing jail time for bringing a legally owned gun into atlantic county. why the prosecutor has had a change of heart. i'm tracking rain that could impact the morning commute. how much rain to expect and how long it will last in my exclusive nbc 10 first alert forecast. coming up, what the feds have to say about the reality of any threat posed to any of us from isis or this new terrorist group.

new at 6:00, for the first time we're hearing from a university of delaware student who says her professor wanted sex for an "a." it's a case that led to protests on that campus. tonight she's telling her story to tim furlong. >> he told me what specific sexual acts he wanted to perform with me. >> reporter: this university of delaware graduate doesn't want her name or face on tv but she's the student who says sociology professor, eric tramby, offered her an "a" in exchange for sex.

he told her he had sex in his office with other students. >> we cover up the webcam and pull the blinds down. >> reporter: when she said she wasn't going to do it, he sent her this e-mail. >> he begged me not to tell, i would ruin his career and he'd give me the "a" anyway. >> reporter: in a statement to an education website and delaware student newspaper, tramby reportedly denies the allegations. university of delaware officials say this is a private, personnel issue they handled appropriately and tramby is no longer at the school. in tramby's statement he says the university investigation never found that he actually did anything wrong and in a letter to his colleagues, he says he was choosing to take a leave of absence until he resigned at the end of the year. all of this by the way comes as news to the accuser. the ambiguity of the investigation is really what has so many students and faculty members upset. tramby's accuser says the school

didn't dig deep enough in their investigation, didn't keep her in the loop. she says the school wanted it to go away. she says the school let her down. >> you realize that, hey, they're not doing anything for me. or if they are, i don't know about it. i don't know what's taking place. it needs to stop. somebody needs to do something and it needs to stop. >> tim furlong, nbc 10 news. now tonight, to a developing story. a philadelphia mother facing prison time forring before her legally registered gun into new jersey will now be allowed into a pretrial intervention program. shaneen allen's case captured national attention after ray rice was allowed into this same program. the atlantic county prosecutor says allen's case was reviewed after taking a closer look at a 2008 law that allowed people with similar charges into the program. allen will be in court for a hearing tomorrow. happening now, a celebration

to kick off the jewish new year known as rosh hashanah. an outdoor concert host kicked t 5:00. rosh hashanah makes the year 5775 on the hebrew calendar. now your nbc 10 first alert weather with meteorologist sheena parveen. >> well, a cloudy, windy day today. it's all ahead of rain as we go overnight tonight and some of the rain yofr night will be on the heavy side. tomorrow morning for the commute this rain will be continuing. a rainy start to your day tomorrow for your morning drive, really depends how early you leave. we'll show you timing in a minute. it's possible to see 1 to 3 inches across the area. now, a big flood threat is not going to be expected, justç because we haven't seen much rain in the past 30 days but as far as localized flooding and poor drainage areas, that's certainly possible with some of the heaviest rain. to our south now we see light

rain moving into parts of sussex county, delaware. as we zoom in here, we see them moving into the beaches in parts of sussex county. it's pretty consistent, getting close to cape may county now. zooming out, it all extends to the southeast and this rain will all move up. through the area before we actually dry out. it's slowly moving from south to north. closer to the shore, winds are expected to increase as we go overnight tonight. as that area of low pressure gets closer, along the shore, winds gust to 40 miles an hour. high surf of 7 to 10 feet. winds right now close to the shore are gusting near about 25 to 30 miles an hour. inland, more like 15 to 25 mile-an-hour wind gusts and these winds will be increasing overnight tonight, too. future weather here keeps us cloudy for the next couple of hours but then by midnight we start to see more rain moving into delaware and south jersey. some of this could be on the heavy side. overnight we continue to see heavy rain move through.

this is 7:00 in the morning. the oranges, reds and yellows shows us the heaviest rain. give yourself extra time in the morning. we could see quite a bit of rain falling at once. 10:00 in the morning it slowly shifts to the north. through the afternoon hours, the heavy rain continues north. the rain -- the shower chance at least stays in the forecast through the evening hours. we're not really going to get rid of that cloudy pattern until we go into friday. temperatures now dropping into the 60s for much of the area with the wind and the clouds. for tonight, the wind and clouds continue. the heavy rain moves in from south to north. tomorrow we'll be in the mid to upper 60s. heavy ran in the morning. it stays windy in the morning, too. as we go through the afternoon, after the heavy rain leaves we have a chance for showers. friday, more sunshine. 77 and over the weekend, sunny. there's the warmup temperatures in the low 80s. >> thank you, sheena. the eagles are not happy with the nfl's ruling on the nick
