hospital. we are told all of the injuries are minor and they have now been released. the driver of the s.t.v. was taken to shock trauma. -- the driver of the suv was taken to shock trauma. a driver of a third vehicle was also taken to the hospital. jennifer franciotti has more on the family who is suing the school district for bullying. >> according to the lawsuit is three counts of negligent of rights and two counts of grossman -- gross negligence. a sixth grade student at the middle school was bullied by a group of students starting in december 2007. it states he suffered violence, including being stabbed and stuck with pencils and drumsticks, and being pushed into -- pushed and slammed into lockers and other such

intolerable cruelty. the incidences of bullying have become more widespread around the country. baltimore held a conference on it this week and touched on the issue of how it affects their schools and policies. >> we have a positive approach to problems such as bullying. we look at problems in a three tier fashion. >> the problem -- the idea is to action before it escalates. >> before there is an anxiety disorder or traumatic disorder or depression. >> the faculty -- the lawsuit alleges that the faculty did not step in and that the boy suffers from post-traumatic stress disorder and had to be placed in a different school as a result. >> a spokesman from the howard county school system said they just got a caught -- a copy of

the lawsuit, but cannot comment on the investigation. 19-year-old martez tyrell brooks is accused of shooting a man and a woman in front of greenmount cemetery monday night. the male victim is in critical the condition after being shot three times in the chest. the woman was shot in the leg. an unidentified male victim was shot around 10:00 a.m. yesterday in front of a home on the 1500 block on north broadway. he was taken to hospital, but did not survive. a search has been ongoing since the first assault in june, but now police say they have found the man responsible, 24-year- old lamont harazin. >> detectives had an interview with him a week ago, but did not have enough evidence to charge him. however, dna swabs were taken

and those were compared and the biology of our unit determined that he was, in fact, the one involved in those crimes. >> there are other crimes that could be connected to him. about $100,000 in the settlement of the crash of the chesapeake bay bridge in 2008. a man died while his tractor- trailer -- while his tractor went into a barrier and then into the bay to avoid a car that swerved in his direction. 29-year-old lieutenant brendan maloney was one of nine u.s. personnel killed in the chopper crashed on tuesday. federal services will be held next thursday at st. john the baptist catholic church. a week will be held at the church that night before. -- a wake will be held at the

>> in this afternoon's health alert, a diabetes drug called avandia will no longer be available. the fda says it will only give it -- only be given to type do diabetes patients and only -- type ii diabetes patients and only after they have run out of other options. it has been linked to cardiovascular problems. meanwhile, the drug maker has stopped production altogether. glaxosmithkline has released a statement saying that it is still a good drug for certain types of diabetes and is working with the fda.

it looks like tropical storm matthew is going to take a turn to the north. something tells me it developed and there -- something else may develop down there. tropical storm ely's is way down indialantic. here is what -- is way down in the atlantic. here is what happens to matthew over the next five days. it does not move much at all. it is -- it just gets stuck over the yucatan peninsula, diminishes in strength. it maybe not you or something else that comes up the eastern seaboard in more than seven days. we will see how that plays out. to the west of us, this front, not much rain with it as it approaches this evening. by tomorrow morning we may just have a band of scattered clouds as the front goes through. but the key is the humidity will

rehab, it is déjà vu for lindsay lohan, who was ordered to appear before a beverly hills judge this morning for violating her probation. last week she admitted on twitter to feeling a court ordered the drug test. she wrote, "regrettably, i did feel the drug test and i am prepared to appear before the judge next week." this after tmz reported that she tested positive for cocaine the judge said she would be sent to jail for 30 days if she missed or failed a test. what punishment she gets is up to the judge. >> if someone relapses, they need more treatment. they do not need more jail time. >> the start of the movie machete was released last month after serving time in the rehab
