2:08 pm
don't have an issue with the under lying expense here remember a question when the police requests were before us. am i'm concerned see similar here with d ph that is noncompliance with the administrative code section 3.17b. requires that any department that is propose to spend more on over time. than the amount that is appropriated for that first obtain an appropriation ordinance for this purpose. here we are looking at as of the -- from budget status report. 6 mont status report d. public health deceded has over time budget. as of december 31st. >> 2022 the supplemental was
2:09 pm
introduced march 7 of 23. will interested to hear from d ph and or the controller about why this is happening >> the other departments over spent by march a couple weeks after introduction. may be they have come sooner. issue was raised by pd and here with d ph appears to be like nothing close to compliance with the code provisions and i want to under score like there is a reason for that provision and because we may be fine with the deappropriation and reappropriation and over time. we are not in a position where we have a choice and noose not how the charter is structured. supposed to be brought before when you say we have a time to weigh in on these things. so -- mr. president interested to hear from d ph or -- the
2:10 pm
controller with an explanation on the d ph one. >> your point is very well taken. start with the control and a representative from the department of public health available remote or in the chambers we will proceed. mr. controller. to your question. we talked about earlier on the police item our office has a limited ability to control salary spending once authorized. we try to keep the mayor and the board of supervisors aware of trendses with coordinating respecting. you are correct to note in this cycle a couple of departments xeez the budget for the full fiscal year. police and public health.
2:11 pm
we talked about this with the controller's office about who provide earlier notification tell be choice to bring forward supplements. we can provide earlier notice. next year at the first quarter mark. not a period we issue budget status reports. we issue in a notice the mayor and board should we detect over time in any department at a level exceeded by the time of our 6 month report. >> offer those comments in general public health can speak to that. supervisor preston, follow occupy that? >> i want to emphasize that happening earlier. i don't see yet budget chair, board president. these -- like to get to the points where we're already fully over spending the year's budget. the both of the department and the controlary office has known
2:12 pm
for months we're head in the that direction and there has to be a striger early in the process to get this before the board >> i share your concern and appreciate your point of chair chan? >> thank you, president peskin. i think during the first of all, the budget and legislative analyst report has done a report on this. some of the city departments you look at the department emergency. lists the department with the exception of rec and park. they're all mostly because of the storm. and they -- and the december and also throughout the first few months of the year that the over time accrued is the explanation of the city d. i think that if there are not because these types of emergency that add to the over time spending. i agree and concur with
2:13 pm
supervisor preston's assessments how do we can have these information earlier rather than later. especially not during the like -- late couple months before the budget i want to flag for colleagues and everyone should then and there, in the supplemental it is different from the police is the police supplemental was dipping in the way they were paying for the supplemental from the general reserve this is from the staff hiring cost saving plus the ambulance service revenue able to pay the 66 million dollars. i want to flag for when i talk about the rec and park department as an exception on this one, is really out of that a little less then and there a million dollars over time spending. againful majority garner and staff tree down during the storm
2:14 pm
time and reason why they came late in the game so to speak to talk about over time spending or asking for the over time spends to be allocated for them. out of which 1 upon 37 thousand dollars is for park ranger for special events like 420 that require the additional staffing for the events i have asked all the city departments to anticipate, for example, you know natural disaster. while fair is emnanlt and how do we prepare for staffing responding disaster unplanned for in our staffing time i think they hrdz usllow and clear with director dooning from the budget and office. of the mayor's office. and i think they will evaluate that in upcoming budget. and the same for the ask that
2:15 pm
went to sxrek park asking about park rangers and the special per mitt event to participate over time for park rangers. i hope that helped but i think that the budget and legislative analyst is here to able to answer the questions, too, in terms of what this spending over time spending is being spend on. thank you. >> thank you. >> why don'ts we go to department of public health. >> throughout chair. chief financial officer for d ph. i'm just joining -- don't [inaudible] restating the question [echo]. >> thank you. the question is given that d ph have already spent its full over
2:16 pm
time budget for the year, by the end of december. why this there was no supplemental introduced before we reachd that point and not until march this was introduced? when the charter requires advanced president trump if you exceed over time budget. >> supervisor, trendses were not clear to us -- as we moved forward. by the time we working with the mayor and controller's office during our regular schedule to work with not -- go through the city process, it was to the point where our trendses exceeded our budget time.
2:17 pm
we will make to e view this to the supplemental if necessary. >> supervisor preston. >> may be the controller like how is this supposed to work? what point when they hit what percent of over time budget are they supposed to seek your council or come before the board? i mean. supervisors. in typical years the way i expect this to help we issue budgetary reports to the mayor and booshd projecting how departments are looking as a whole and pacific low on over time. in normal cycles our first report is at the 6 mont or halfway through the fiscal year and another at 9 months.
2:18 pm
my expectation would be that if we sought over spending at the 6 month mark that would be followed by a supplemental that would move forward. i note that neither our office nor departments have the appropriations only a mayor or board member. a mayor or board is required act had they see this over spending. you are right at least for me the unusual thing is the 6 month report we use as a trigger, was too late this year. because of the level over spending on over time in public health and police. we walked about creating an earlier notice to the mayor and the board. the first quarter mark i would hope that no department valid over spent. the fiscal year will be adequate and provide notice in the mayor and the board to act on these
2:19 pm
things before departments are secret row active approvals. >> thank you. look forward to getting clarity on how that will work and i think we should have a commitment from departments to come forward and not dom i can't believe i say it. a violation of the charter. a reason it is written a certain way you will over shoot your over time. you seek a supplemental and approval of the board. the budget committee did their job and locked at expensesace budget chair chan said. i share the view they do look like i don't see the legitimate expenses. nor should this be in a position the charter is violate exclude asked months whether to approve temperature you will approve people have been paid. and my understanding is that the
2:20 pm
controller they are legally required pay it if folk authorized to dot work. a mockery of the process to come to the board latest. i'm looking forward to the changes and think we gotta change the culture in the departments. does not make sense you know you are on track whether you are a d ph, sfpd the 2 worse. you know you are on track to exceed over time before it gets to this point. follow the charter provisions and file your is up elemental. simple. thank you. >> thank you. i associate myself with your comment and concerns. on item 19 a roll call >> item 19 supervisor engardio. >> aye. >> supervisor mandelman. >> aye. >> supervisor melgar. >> aye. >> supervisor peskin. >> aye. >> supervisor preston. >> aye. >> supervisor ronen. >> aye.

2:37 pm
i'm calling 2 hears to be heard. first which i'm co sponsoring with supervisor mandelman. vice chair of the committee is a hearing. both of them. i'm coporns cosponsoring. the first a hear to discuss the department of homelessness strategic plan and to understand how that plan will or will not address street light conscience. and finally, understand um how the current wait list and initial people on the coordinated entry system relates to the plan and how they will or not be housed. >> secondly. requesting a hear to describe d ph behavioral health system

units the behavioral health units system of care. and specifically when talking about the system of care we want to understand how the individual contracts this we approve in committee will relate to the whole. you know what is the system of care look like if you had a hypothetical with substance use or a severe mental ill knows or sike emergency services or leaving jail house services had happens? walk us throughout system of care that person enter in and how they are or not kept within this system of care and y where they may finds roadblocks and the level of those roadblocks. we talk about in behavioral and homelessness we talk about individual wonderful programs serving the residentses and never understand where they fit in to a whole. when we see is people falling
2:39 pm
out of the system of care or not being helped by it or -- it not working for so many people in san francisco. in order to understand how to fix it we have to understand how the department itself see this is system works and for machine had worked so long on the issue. supervisor mandelman can say the same. we are confuse today is unclear there is a system. we are looking forward to getting to the bottom of this. and want to thank president peskin for creating this mittee and asking us to serve on it. >> you supervisors who are willing to serve on it. >> thank you. >> [laughter] this is not a laughing matter. i have memory today for a bernal

4:47 pm
shoots somebody over trifrngets and the security guard does not state they need to carry a gun or weapon. not fair to shoot somebody over trifrngets over somebody's life this is horrible. and it is horrible when jenkins said. it states black lives, black translives don't matter in san francisco. it does not matter over several things you don't shoot somebody over material things over propertiful he deserveed have a full life. and this type of justice is
4:48 pm
horrible and should be ashameed in to cut come and tell throughs is no charges this is absolutely horrible. thank you for your comments this afternoon. mr. lamb any other callers in the queue? this was our last caller. mr. president. public comment is closed. clothesil rerefer to roll call for introductions. criminaling yesterday is not my area of expert ease and prit and apart from the public comment we heard today. in so as far as everas far as the kellying of banco brown. occurred in the third supervisor district at 825 market street last week i'm familiar with a
4:49 pm
number of the details of that case. obviously the loss of life is tragic. but i'm deeply concerned based on my conversations with law enforcement by the district attorney's decision not to charge. at least manslaughter. i think it is important that the members of this board as well as the public know the details that i know at a minimum that should be subject to public knowledge and scrutiny. and i am inclined to have this board through formal action ask the district attorney to reconsider and reexamine that decision which i was struck i know various individualos this board were taken aback by my staff was quite taken aback by last night. it is very river that
4:50 pm
legislative branch weighed in individual case by case decisions of the district attorney. but if you hear the details i heard, at a minimum this appears to be a man lawsuiter case to this non[inaudible] and if i did practice luit would be criminal but i don't. i will be calling for that and that will come before the board in a form or fashion. but i appreciate the expressions of heard from every one. you and does bay reexaminingation by the district attorney and i am submitting an memory for banco brown. >> supervisor walton. >> thank you, president peskin. i do want to state for the opinion that to everyone who came in and gave public comment today. this you don't have the right to
4:51 pm
execute someone because you have i gun. and you don't have the right to execute someone for shop lifting. and so i stand behind president peskin's statements. the da should be charging in this case. because this person from everything that we know as of now was not threatening or in a position to harm -- the security guard this had a gun. and -- you cannot go around shooting people just because you don't like an okay they may have taken. we don't need those folks work nothing our stores or businesses. and this is not the first time where someone cowardly shot someone unarmed. we cannot accept things like that happening in our city. i hope we get the release of the
4:52 pm
video. as soon as possible. but i do stand by the fact that -- you don't have a license to kill machine because they shop lifted. if this is even what has taken place. >> supervisor ronen on rereferral. >> i wanted to thank everyone who came out and -- thank the young women's freedom center and give them my deepest condollence and love for this huge loss. and just say how much we are grieving with you i know that banco was a beloved member of your organization. you are an organization that i worked with so close low and i have so much deep respect for and i want you to know we heard you. we were all listening all of us.

4:54 pm
and joined with the protesters. the comments that were meated today you know so many levels the folks speaking out are correct. 91 of this makes sense. 91 of it adds up and i want to echo the comment supervisor walton made arnold releasing the vo tape. it makes no sense when the district attorney is making charging decisions around a radio and making public statement when is is in a vo tape. the district tournament has this tape. as a lot of speakers noted. there is all kinds of wild claims on orb media and the media as often happens with really aloment of claims around the victim. and alop of things that could be resolved by public low release
4:55 pm
that tape. i extend my condolences to banco brown's friends and family and our office stands red to take what steps are necessary not to just address this killing but make sure this kinds of killing does in the occur in the future. thank you very much. >> supervisor safai for rereferral. >> i wanted to say quick low if i could be added to the memory and make it from the full board. >> yes. you read my mind and thank all the commenters for coming out today and dpifing an opportunity for them to express their concerns and condition dolenses to the family. >> would you read the adoption referencical dar >> 41-45 introduced for adoption

>> the bicycle coalition was giving away 33 bicycles so i applied. i was happy to receive one of them.
4:59 pm
>> the community bike build program is the san francisco coalition's way of spreading the joy of biking and freedom of biking to residents who may not have access to affordable transportation. the city has an ordinance that we worked with them on back in 2014 that requires city agency goes to give organizations like the san francisco bicycle organization a chance to take bicycles abandoned and put them to good use or find new homes for them. the partnerships with organizations generally with organizations that are working with low income individuals or families or people who are transportation dependent. we ask them to identify individuals who would greatly benefit from a bicycle. we make a list of people and
5:00 pm
their heights to match them to a bicycle that would suit their lifestyle and age and height. >> bicycle i received has impacted my life so greatly. it is not only a form of recreation. it is also a means of getting connected with the community through bike rides and it is also just a feeling of freedom. i really appreciate it. i am very thankful. >> we teach a class. they have to attend a one hour class. things like how to change lanes, how to make a left turn, right turn, how to ride around cars. after that class, then we would give everyone a test chance -- chance to test ride.
