>> and then there were two, it is now the biden versus trump campaign for the presidency, the challengers dropped out of the republican and democratic primary today, nikki haley took one-state last night before dropping out today and phillips took absolutely nothing as expected before dropping out of the democratic primary. the campaign was run exclusively on the assertion joe biden is too old to be president. they unanimously agreed that biden is not old enough to be replaced by phillips. the chair of the biden harris campaign, after serving as the campaign manager four years ago, released a memo on the state of the race and if you choose to pay attention to one campaign operative this year, it should be her, she was right

about everything she said about the biden presidential campaign last year, today she said upwards of 10% of voters remain undecided, much larger than the current margin between trump and biden in pulling and they are highly supportive of the policies of the biden in harris administration like protecting abortion access and defending the affordable care act. the undecided voters are also the least tuned in to politics of any group. as the election ramps up the campaign will aggressively engage the undecided voters highlighting the stakes of this selection to secure their votes in november. a significant share of moderate and hilly voters across the country are saying trump cannot count on their votes in a general election, so far, 1-3 republican voters think trump would be unfit of the presidency if convicted of a

crime. there is nothing more important this year for the democrats and democracy itself then winning the presidency. the next best thing, the next most important thing is the united states senate. i for one do not believe trump will take the presidential election but if you are one of the millions that is worried that he will, you should find ways to help elect democrats to the senate. the senate should be campaign objective two, if democrats control the senate they can stop every single thing that donald trump tries to do legislatively. they can stop every presidential appointment trump makes that requires senate confirmation so, with democrats in control of the senate trump

40. california's population is 40 times larger than the population of each dakota. because democracy was not the first principle in the design of the u.s. senate or presidency, the people in california are stuck with only two senators and the presidency is winnable by the candidate that gets the least votes because the electoral college formula is based on the same anti-democratic formula that has given us two senators per state. for most california voters that i know, it has never been more painful to be stuck with only two senators as it is tonight. that is because in california, in the senate campaign there were three democratic candidates running for senate against each other for the same senate seat and democrats had to choose. the choice was difficult and

confusing. many voters believed the candidates who lost the senate race would remain in the house of representatives, they did not realize that other candidates were on the ballot yesterday for the house seats currently occupied by adam schiff, katie porter and barbara lee. each of those candidates made the all or nothing decision to go for the senate knowing they could not legally at the same time run to keep the house of representative seats just in case. each of those candidates would have taken this race if the other two were not in the race. the last polls before the election showed adam schiff in first place with republican steve garvey a former baseball player for the dodgers who has never held a elected office. katie porter in 3rd and barbara in 4th. that is what the polls show. almost every democrat i talked to about this wanted to see the

democrats take first and second place because the top two democrats face off in november and there would be no worries because a democrat would win. i knew some voters that had their minds made up easily for adam schiff, katie porter or barbara lee. my daughter loves katie porter so it was easy for her, of course most democrats always want to see republican candidates crushed at the ballot box in california, they did not want to see steve garvey in the top two but that is not what happened. adam schiff who had nancy pelosi's endorsement and by far the most campaign money came in first and steve garvey the republican came in second. so it will be adam schiff versus steve garvey in november which means in reality tonight, the campaign is over. no republican has been elected statewide in california in over 30 years who did not fully support the weight of

>> both times he was the best person for the job. >> when they tell us who they are, we need to listen. steve garvey is too conservative for california. >> the ads helped adam schiff and at the same time steve garvey. republicans solved the ads and decided they wanted to vote for steve garvey and katie porter thinks the ads lifted steve garvey to second place. strategically the democratic party and i mean this strategically, is better off having one democratic candidate facing one republican in california where the republican is guaranteed to lose as they always do. if two democrats were running against each other for the same senate seat in california, the biggest state and the most expensive state, it would be the most expensive senate race

in history, that title currently belongs to pennsylvania with the sender race for john federman in 2022 cost 373 million. that money was used only on the senate race and none of it was available for any other campaign. pennsylvania has two expensive media markets, philadelphia and pittsburgh and neither of the markets are as expensive as the three big california media markets, la, san francisco and san diego are the campaigns have to purchase tv ads. a hard-fought senate campaign can cost half 1 billion in california and with two democrats on the ballot, all of the money would be coming from democratic party donors and none of that money would be usable for the presidential campaign or other crucial senate campaigns. adam may not want you to know this but according to recent precedent, he does not feature money anymore.

you can send it to other senate campaigns because the last senate campaign in california cost the winner $4 million. the winner is someone most people, even in california have not really heard of. senator alex padilla, senator padilla did not have to spend real money in his reelection campaign to take 61% of the vote against a republican because that is what happens to republicans running statewide in california. no matter how much money you spend and that is what is going to happen in steve garvey in california. as to adam schiff's campaign's strategic choice of attacking steve garvey in campaign ads, ask yourself, would it have been better if the democrats attacked each other in campaign ads? they did not do that.

in a fair world, barbara lee would have become a senator a long time ago but that would have required diane feinstein to decide not to stay in the senate for 30 years. in a fair world kitty porter would be moving up to the senate this year and adam schiff would be moving up to the senate this year and in a really fair world, california would not only have two senators, this year's california senate election is a another hard reminder that life is not fair and politics are not fair, it does not feel fair sometimes. it also reveals a problem that only the democratic party has, the problem of more political and governing ability and people like katie porter and barbara lee vendor is currently room for an elective office. you can hope the biden and harris administration puts katie porter's skills and

know it is california and i know what will happen to steve garvey. so here we are. that moment and those days on the senate floor at the impeachment prosecutor in trump's first senate impeachment trial, how much did that come up when you were talking to voters in california, i remember thinking at the time how powerfully you were delivering the prosecution, how prophetic it turned out to be and how it must have been registering in the minds of people watching. >> lawrence, i found on the campaign trail up and down the state, really two things motivating voters, the first was, yes a deep concern about the direction of the country, even the potential, the prospect or possibility of returning to the madness of donald trump and they wanted somebody in the senate that knew how to fight him and

defend the democracy if the worst came to the worst. i also found more prevalent a desire among californians that like senator feinstein they wanted somebody that knew how to get things done and take on the big fights but also knew how to work with others and deliver more affordable housing, bring down childcare costs, make sure people can afford healthcare and access it. so does bread and butter issues any desire for someone that can deliver, that was also or maybe even more a potent message in more resonant with voters than the democracy issues. >> steve garvey your opponent has admitted to voting for trump twice. what else will california voters learn about steve garvey between now and november. >> a great deal, he has been unwilling to say much about his

abuse because he knows they are out of step with california but we know he shares the views of border crisis and demonizing immigrants, we know he will not defend reproductive freedom or seek to restore it. this is somebody in the past who supported a constitutional amendment to ban abortion. we know he will not stand up to the nra and fight for common sense gun safety legislation. he is happy with the minimum wage being seven dollars, we know he will not fight for a economy that works for everyone so the contrasts will be sharp for california voters and we will do everything we can to make sure voters know this and while i appreciate your optimism, my view has always been, run scared or run unopposed and i am not running unopposed. >> i get it. so, in that senate, and discussions with chuck schumer

and sherman, and up with committee assignments which are much more stable in the senate, they do not kick people off committees in a partisan way in the senate the way they have done in the house. would you want to go back to the intelligence committee in the senate where you served as chairman in the house? >> i would love to but what i want to do also because of the phenomenon you mentioned, as big as california is we get the same number of senators as every other state, i want to talk to the senator and compare with what committees he is sitting on and determine where i can add the most value for californians if i am lucky enough to emerge successfully in november. i want to make sure i am in a position to deliver for the country but i love the issues and the intelligence committee

and i am a senior member of the house judiciary committee and want to play a role if i have the opportunity to make sure we restructure the supreme court, that we have term limits, a enforceable code of ethics, there is a lot i know i want to do. >> as the biden campaign looks at the country for democratic president campaigns, california is a place you go to raise money, it is not a place you have to go to campaign and it is not a place you have to spend money on tv ads because joe biden will take california easily. what are the lessons of political concern in california that you translate to other states that the biden campaign should be thinking about and other senate campaigns should be thinking about. >> real quality of life issues. you are right, in a normal

world, someone with biden's record should be coasting to reelection, he has done more than any president in my lifetime to address fundamental inequities in our economy but nonetheless there have been problems that are decades in the making in which people continued to work harder than ever but many struggle to get by and these very down to earth issues, how to afford a place to live, why do i have to commute two hours to get to work, is there a better way to do this? on the campaign trail i talked a lot about my dad who was a traveling salesman and made 18,000 a year and my folks purchased our first home for 18,000, it shows you how much life has changed. no president has done more to try to address that but i think he needs to acknowledge what he has done and he has a lot to brag about but also the work ahead and how he will fight to make the economy work for everyone were as trump who we saw in those four years will fight to make the economy work

in ohio tonight, republican candidates competing in the primary for the honor of running against democratic senator brown in november have their final debate tonight in which they were once again out of step with the majority of the people of ohio on a issue of freedom. >> let's get to a 15 week standard or after 15 weeks there is common sense restrictions so in this country, the greatest country on earth, we do not have elective late

it's conservative. people in ohio voted to protect constitutional rights for women and the constitutional rights to abortion and still these rich guys running against each other all think they know better, they called for a abortion ban and they dance around it but fundamentally they are for the abortion ban in direct opposition. to what the voters of ohio said. clearly we will make that contrast on that issue and the contrast on their daily work, i watched all three of the debates and never a talk about workers were keeping description drug prices down so workers can afford prescription drugs. growing prices at the grocery store but there is one time they talked about workers, all three agreed they should get rid of the minimum wage. they are all fighting with each

issue after issue because as you and i have talked, most voters in ohio and elsewhere do not see this left to right move and trying to get to whatever the middle is, they look at who's side you are on and people know when they go to the grocery store a big part of the grocery bill goes to stock buybacks and excess profits of corporations who have done very well during the pandemic. they know the reason democrats stood up and capped the price of insulin is because i stood up and others stood up against drug companies, against what norfolk southern did in east palestine, standing up on issues and keeping wall street accountable. so voters understand, they do

time. even with that there is a lot of material that is hard to understand if you are not a lawyer. we were really trying to make sure the public will understand what is about to happen in new york on march 25. it is so important that this not be something people just get through filtered newspapers or this show. you want people to actually understand the charges, the decisions that were made, the language that is used in as melissa said, we tried to put it in context in terms of other charges and globally because we are not the first country doing this. there are many countries that have done this and have done it better than we have. we are not looking good right now. one of the main things we wanted to point out in the introduction is how people should see this historic time

in terms of global history. >> global history meaning the criminal prosecution of former presidents, it is something the world knows how to do even if we never have. >> that is right, when all of this started in the first indictment was announced, people talked about are we deciding to a banana republic but as we show in the book it is quite consistent with democratic principles and the rule of law to hold former leaders accountable when there has been profound his conduct and other systems have done it, south korea, italy, france, all over the world, it is just unprecedented for us, that bit of america exceptionalism is anomalous, everywhere around the world it is quite common to hold your former leaders to account. >> there has been almost a kind of royalist strain that is still there that says we must never treat the head of state

this way. >> that is the perfect analogy, we have seen trump use the louis xiv, i am the state, we cannot be touched, we are about to have a supreme court argument about whether the president is accountable to the rule of law, the fact that that is happening in democracy, if you compare it to argentina, they have been through this and countries we think of as not necessarily as advanced as we are but other countries said of course not, that is what it means to be a democracy. the main goal here is to try to make sure the public has the tools to be able to decide this for themselves and this is not something they see in cynicism and trump can say do not trust what is going on, we want people to understand it for themselves as if they are a juror in the courtroom.

>> on april 25 when we are listening to the supreme court, the indictment in here is at issue. i will be flipping open the pages on the sofa at home listening to the supreme court argument, trump's lawyers will misrepresent what is in the indictment to varying degrees. jack smith will be pulling them back to what is actually charged. >> that is right, we are not about to have this spring court argument, the sense of urgency around this question if trump is immune to criminal liability does not seem to be urgent for the supreme court so we will hear it a month and a half from now and we will not know when the decision comes out but in that moment we will hear where the court is on this. we heard a little bit from some of the justices in this disqualification opinion that came out, three of the justices in a fiery occurrence essentially calling trump a oath breaking insurrectionist
