lawyer has receipts, and that special counsel jack smith has them too. the guardian reporting trump's lawyer evan corcoran warned trump about retaining classified documents, which could be significant in the probe. corcoran memorialized the warning in nearly 50 pages of note described to the guardian with three people with knowledge of their contents. the notes being produced to a federal grand jury after an appeals court allowed the attorney/client and work product privileges between corcoran and trump to be pierced because judges believed trump might have used corcoran's legal advice in furtherance of a crime. prosecutors have fixated on trump's valet, walt nalta after he told the d.a. trump told him to move boxes out of the storage room before and after the subpoena. that does not look good for trump. meanwhile, trump's legal team is thinning out. one of his top lawyers, tim

parlatoe resigning, and siting problems with lawyer boris epshteyn. epstein is particularly close to trump, reportedly talking to the former president multiple times a day. parlatore said interference from epstein made his job too difficult. . there are certain individuals that made defending the president much harder than it needed to be. boris epstein, who had really done everything he could to try to block us, to prevent us from doing what we could to dede fend the president. he served as kind of a filter to prevent us from getting information to the client, getting information from the client. >> joining us now is -- excuse me, and the mar-a-lago documents probe is not the only entanglement keeps trump on his toes. "the new york times" reporting e. jean carroll who recently won $5 million in damages from trump for her civil suit for sexual abuse and defamation is now

seeking a, quote, very substantial additional amount in response to his insults during a cnn town hall made just one day after she won her case. trump's attorney responding saying carroll's quote 11th hour attempt shows her, quote, true motivation. joining me now for all of this, hugo lowell, political investigations reporter for the guardian, who broke the story on the notes revealing trump was warned about retaining classified documents, and neal katyal, former acting u.s. solicitor general. hugo, neal, glad to have you guys here tonight. hugo, i'm going to start with you. 50 pages of notes. that's a lot of self-preservation by evan corcoran, right? >> yeah. and it's what's in the notes that piqued the interest of special prosecutors working for the special counsel. at least two points in particular, according to our reporting. number one, that corcoran informed trump in no uncertain terms that he cannot retain any of the classified documents that have been subpoenaed chen trump

asked if he had to give everything back. and second of all, trump and trump's valet walt had unusual detailed knowledge of the subpoena response. they knew when corcoran was conducting his search, where and when he was searching, and all of that seems to point to involvement from people at the heart of the obstruction investigation having unusually high levels of knowledge of what was going on when corcoran was trying to complete that search. >> you know, neal, evan corcoran warning his client donald trump that he could not retain any classified documents. does this evidence make jack smith's case on obstruction a layup now? >> i think it does, katie. i've thought for a long time this was the strongest potential case against donald trump. and it gets stronger and stronger every day. it's always been clear and easy. and, you know, remember, we've always known that trump had

these highly sensitive documents long after he was subpoenaed. so the current investigations is not as much about did he have the documents. they know trump kept them. but whether he knew he was doing something illegal when he kept them. now in an obstruction case, a target wants to play dumb. he wants to convince prosecutors look, i didn't know i was doing anything wrong. and normally, katie, acting dumb isn't shall we say the highest of hurdles for donald trump, but in this case, his own lawyers' notes show he needed to hand the documents over, and that it looks like he was manipulating them, according to hugo's phenomenal reporting. and if true, it makes the obstruction case as you say pretty easy. >> so hugo, you're also reporting, quote, the notes revealed how trump and his valet had unusual detailed knowledge of the botched subpoena response, including where corcoran intended to search and not search for classified documents at mar-a-lago, as well as when corcoran was actually

doing his search. so, hugo, how much do you think jack smith would need trump's valet walt nalta in building his prosecution of trump? >> look, the doj's theory, at least in the obstruction case, the obstruction strand of this investigation with respect to the subpoena response has long been trying to find out whether trump effectively arranged for boxes of classified documents to be removed from the storage room so that the lawyer would not find them when he was doing the search. i think what the notes kind of snow is a timeline where whether it was nalta or someone else had the means or the ability to take stuff out and conceal them if they so wanted. i think the evidence needed to get to that point is a high threshold. i think to make an obstruction case here, you basically have to show that trump and/or nalta

knew they were removing boxes that they knew actually contained classified. and i think that's where the hurdle has been for the counsel. that's certainly been what the special counsel has been asking witnesses when they appeared before the grand jury. we don't know obviously everything on all the evidence that the special counsel has, but that seems to be at the crux of the obstruction probe here. >> you know, neal, what's really critical in this issue, as far as i'm concerned is that piercing of attorney/client and work product privileges. you and i as lawyers, we normally would have the conversations between clients and ourselves disclosed to a federal grand jury or federal prosecutor, and we certainly wouldn't have our work product in terms of our notes. in this instance, not only was it a trials court judge but an appeals judge said you know what? there is enough evidence of crime fraud here to be able to sustain piercing those particular privileges. considering all of that, do you think we're at the point where an indictment should be about as imminent as possible? >> i do, katie. and you've hit it exactly on the

head. so when a client comes to talk to me, let's say a criminal defendant facing jail time, normally those conversations are privileged because i need to be able to defend that person, and that person needs to be able to talk to me openly and honestly. and that's one of the oldest privileges in american law is that you can talk to your attorney and not have to worry that it gets out into open court. the exception, and it's a really narrow one, i've almost never seen it actually applied in practice is when the lawyer is party to the crime in some sense. and here, as you say, it's not just the trial judge, but the court of appeals, our nation's second highest court said yeah, it looks like a crime was committed, and it looks like this evidence is material to it. and that's why the information is coming out in this criminal investigation. that, to me, as your question indicates, says this is a crime. it's a very high threshold. the judges have already determined it to be a crime. now the only question is whether

it's trump or someone else that the attorney-client privilege was pierced for, and i suspect there is one probably pretty answer to that question. >> so hugo, let's take a quick listen to some more of what former trump lawyer tim parlamore had to say. >> in my opinion he was not very honest was. there are certain things like the searches he had attempted to interfere with. as we put together our defense strategy to help educate merrick garland as to how best to handle this matter, he was preventing us from engaging in that strategy. >> hugo, it sounds like boris is running interference or serving as a buffer between trump's counsel and trump himself. can we anticipate trump maybe using this as a defense in a special counsel prosecution as in if trump claims look, i wanted to do the right thing, but boris didn't let that happen?

>> i think it's difficult to say where this goes. parlatore resigning, this is more of personal differences with epsheyne. it started off, the disagreement started off local legal policy. we heard that epstein tried to interfere with searching bedminster when he was doing his second round of searches because the doj thought donald trump was still holding on the even more classified documents even after the fbi searched mar-a-lago. i think trump is going to keep all of his options available until the last moment. that's how he has been in his playbook all the way through other criminal investigations and civil litigation as well. but i think the reliance on counsel defense is always a favorite for trump. he has deployed that elsewhere, or he has tried. to and it wouldn't surprise me down the road if things are looking really hot, he might try that but i'm not sure if

parlatoore's resignation is tied to that. that is more a personal issue he had with boris. >> that's some dirty laundry being aired between the trump counsel. neal, last to you. former trump lawyer cobb, trump is going to be jailed over this. >> all they have to do is show that trump moved these documents at various times when doj was either demanding them or actually present. i think this obstruction case is a tight case. and yes, i do think he'll go to jail on it. >> i mean, neal, ty cobb joining former attorney general bill barr in this assessment as well as former trump fixer michael cohen. now parlatore saying peace out. i'm note going toby involved in all this. sounds like he knows when to abandon ship. >> i agree. it's never a good time when your legal team is falling apart

before things have been filed. things are looking particularly bad when one of your own former attorneys is predicting you're going to go to prison which is exactly what happened here. and as well as former attorney general bill barr. so i think that's a pretty telling sign. i do want to push back a little bit on what hugo said, because i don't think one of his attorneys resigning, parlatore can be chalked up to personal differences. that strikes me as highly unlikely. lawyers are used to working with all different people and all sorts of different judgments. you don't walk out on a case like this for something like that. so i think really, trump loses a lot of lawyers. the only thing he loses more than elections is his legal representation. and he loses them because they're either going to jail or indicted or worry that they will, or something pretty serious. and so i don't think that the explanation that's been given, and of course hugo is right, that's what they're kind of trotting out, personal differences and stuff, is enough. it may be they triering to set

it is breaking news. but knowing what we know so far about jack smith and what he is doing, the fact that the subpoena is maybe looking as far back as 2017, what does that tell you what jack smith might be trying to link up in terms of the classified documents investigation? >> well, katie, just about ten minutes ago, on air i said to you that the stolen documents case against donald trump is his biggest threat, and that it gets stronger with every passing day. i guess it's getting stronger with every passing minute. because in the last ten minutes, it appears to have gotten even stronger. now this is a new story in "the new york times." i'm just reading it in realtime with you. but i think to break it down, basically, the background here is the prosecutor's sphere, the public's fear that donald trump monetizes everything. he monetized january 6th, of all things. he monetize his impeachment and the like. so i think the prosecutors' concern here has been when he took these highly sensitive classified and other documents,

was he trying to monetize those as well? now the prosecutor jack smith doesn't need this for the mar-a-lago case. stealing classified or sensitive information is enough. it violates the espionage act. and obstructing justice is enough. what we were talking about before about hiding the documents. but what this says is perhaps there is an even more -- there is even more. there is a whole another set of potential criminal charges. of course, this is just early reporting. but basically, what this reporting is saying is that since 2017, that the prosecutors were looking at trump's conduct while in office while president and after he left office. so they're not just looking at the stormy daniels kind of time period, which is before trump took office, or the inflation of real estate assets, which was before trump took office. they're looking now at presidential and post presidential conduct. it looks linked to the mar-a-lago investigation, but it may be that they'll also uncover things related to that entirely.

>> yeah, and neal, to emphasize something that you just said, which is important for people to understand, even though the investigation being done by jack smith right now may be focused upon or looking at the classified documents case, if you uncover evidence of a crime, or if you uncover fruits from a crime that's been committed, you're still allowed to investigate this as a federal prosecutor. you're not just limited to what you think is kind of your mission statement when you look into this. and to be clear, it looks like this subpoena has been directed to the trump organization. so it's actually not even directed to trump himself. it's directed to the company proper. and it's looking at his business dealings or the company's business dealings in seven different countries, including china, turkey, saudi arabia, kuwait. and we also know that jack smith has already issued a subpoena concerning trump organization and liv golf with its dealings with saudi arabia. so we shouldn't be surprised, right, neal, that we're seeing

this kind of roll-out of information including something like a subpoena that guess back as far as 2017 for things that may not be directly focused on the classified documents. or maybe they are. maybe it's directly related to documents that were found during that execution of a search warrant. >> right. you got it exactly right, katie. you stated the law perfectly. so basically, they're seeking these documents. they may be related to mar-a-lago. even if that is the initial reason for the search, if jack smith and his prosecutorial team uncover evidence of another crime, then that is totally fair game for prosecutors. that's how they operate every day of every week against other criminal defendants. that's because our criminal justice system is really does have a strong set of safeguards for criminal defendants. you've got to be indicted by a grand jury. you've got to be convicted unanimously by a jury. you have rights of legal representation and all sorts of things like that. so prosecutors are given a wide birth in the investigative

phase. >> neal katyal, i want to thank you for joining us for this breaking news. i know it was kind of johnny on the spot for you. but always, you did such a great job. i appreciate you. and meantime, president biden, top house republican kevin mccarthy meeting literally right now in the oval office as the country is facing the urgent threat of a default. the two leaders speaking to reporters moments ago. >> i'm glad the speaker is here today. we're optimistic we may be able to make some progress, because we both agreed that the fall is not really on the table. we've got to get something done here. >> i think at the end of the day we can find common ground, make our economy stronger. take care of this debt, but more importantly get this government moving again. >> mccarthy and biden trying to hammer out a deal and avoid what the treasury secretary is calling a financial catastrophe. the deadline june 1st, just ten days from now. in recent days, house republicans reportedly making new demands, including, quote,

more rigid demands on work requirements for food stamp requirements, while adding i know immigration provisions from their recent border bill. at the same time, they're refusing to raise taxes on the wealthy or corporations, all the while accusing biden of being inflexible. >> we've only got ten days to go. we've got start moving. >> but look, there is no agreement. we're still apart. >> it seems as though he wants default more than he wants a deal. >> the underlying issue here is the democrats, since they took the majority has been addicted to spending, and that's going to stop. >> okay. let's be clear about what's happening here. republicans are preventing the government from paying its own bills. bills for money that's already been spent, including money spent by republicans themselves. and of course under former president trump. that's what the debt limit is. not only that, mccarthy himself used to explain it that way. i mean, listen to mccarthy talking about the debt limit

we're back now with katty kay, u.s. special correspondent for bbc studios. katty, as always, thank you for being here this evening. look, the hypocrisy by the gop isn't anything new, but there is some very real economic impacts that can affect all americans regardless of party affiliation if this debt ceiling agreement isn't reached. right? >> look, it's quite possible we're already feeling those impacts. because anyone who has a government contract and that contract has been put on hold because of the uncertainty about the debt ceiling negotiations, they're already making negotiations. i've got a bit less money coming in. so i'm going to spend a little less money. you're starting to see the rim effects already, let alone to america's national security, where president biden had to cancel that trip to australia and papua new guinea, key partners in the battle with china at the moment. so i think anyone who thinks that this is just a feint really

needs to look at the very severe consequences to the u.s. economy. you can see the dollar tank. people's -- the stock market could tank. you'll see the global economy impacted by this. so this is something that i think no one thinks that america should be playing with. >> kevin mccarthy got that speakership by the skin of his teeth. do you think he is willing to allow this country to get into a state of default on its debt just to appease the hard-right freedom caucus which refuses to move? >> look, the words coming out of the oval office just a few minutes ago that we heard, that you just played, katie, i thought they were quite optimistic. both sides talking about the fact, they said default is not really on the table. that's very important if they both mean it. both sides saying they have to look at some kind of deal that is acceptable to each republican and to democratic bases. so that was more optimistic than i've been hearing during the course of the day. i was having conversations with somebody up on the hill earlier today, and they said listen,

many fear over the course of the weekend really grew we are looking at a default, precisely because there is nothing kevin mccarthy can actually sell to the conservative base of his party. and there are people within the republican party who just want the blow it up, who want the blow it up for the sake of blowing it up. and they are convinced that president biden will get the political blame for this. so let's see. i think we have to try and dismiss some of the rhetoric that we hear about this and see whether they actually come to watch the negotiations themselves and see whether we have the makings of a deal that is acceptable to both sides. >> my concern is mccarthy and biden. that's one thing. mccarthy going back to his party is a whole other situation. katty kay, we're going to keep on watching it, but the time is ticking. i appreciate you joining us tonight. thanks. still to come, the naacp just issued a travel advisory to black americans warning them about ron desantis's florida. i'll talk live to the president of the naacp. plus, republican senator tim scott announces for 2024 as a different republican senator says on camera that trump can't even win.

here to break this down. tim scott's message is the following. i choose freedom and hope and opportunity. how does that kind of sunshine and roses platform resonate with deep maga supporters who live for trump's hate-based politics? >> it worked great for marco rubio in 2016, right? look, this is a party that has changed fundamentally. they're not about the uplift. they're not about compassionate conservatism. they're not about this idea that you're going go and inspire republican base voters. what do they want now? they want to be fed bucks of chum off the dock so they can circle around it and eat it like sharks. that's what they want. they want the spectacle, the craziness, the ugliness, the cruelty. that's what they want. and tim scott, his message today in another world, in an alternate universe, he would be the front-runner. but unfortunately, he can't get past a republican base that is dedicated to something very, very different than what he is preaching today. >> molly, campaigning in early states, it's all about retail
