junk science that was pu forward by antiabortio opponents that contradicts the 20 plus years of safe access t mifepristone that women have relied on two and pregnancie safely it just is really a crisis o democracy and it's a crisis of health care. >> right after the, texa ruling a judge in washington state ordered the fda not to rollback approval of the drug. however, that ruling only flie to the 17 states in washington d.c. where democratic's tierne general made the challenge meanwhile, national outlet - after two black lawmakers rose expelled from the tennesse house after protesting gun violence in the chamber. their white colleague wa spared, msnbc's simone sanders sat down with the legislator in an interview later today. >> this whole process has been a farce of our due process it's been a farce of our constitutional system of

government and so everything about this, even the trial tha they had, it was when -- the verdict was decided before we even started talking. >> we're not gonna qui fighting and that's the reality, if w believe it is still possible even in a state like this that real gun reform legislatio that protects communities, tha protects schools, it i possible >> former president donald trump's attacks on the judge and prosecutor in this cas raised questions over with h could face a gag order it would fall right into trump's playbook - >> i think donald will do is have his counsel file for claim or make a motion for a violation of his first amendment constitutional rights he will then use it to try t have judge martian recused and try to come bound hi nonsensical request to have th

case moved to someplace else someplace that he deems to b more favorable >> or on donald trump in a bit first, a number of reporters i place from washington to tennessee covering all the due developments as i welcome you all will be i with and bases, monica alba, a the white house. monika, how is the biden administration reacting to these conflicting abortion rulings? >> they're responding quit forcefully, alex this was to be anticipated the white house was bracing fo this texas ruling for sometime and really, the person who has been one of the most outbursts broken voices for th administration on this has bee vice president, kamala harris. who was, really tasked wit tackling the abortion rights issue from the president and who had been leading groun tables with activists and thos affected, most of over the course of the last year ever since, of, course the suprem court overturned roe v. wade this is something they wer watching with a very close eye and when the ruling did come
9:04 am
down last evening, we did hear from about the president and the vice president who was traveling in tennessee at th time, and she was very definitive about her take on this, calling it a quote dangerous precedent. here's more of what she had to say on the tarmac. >> there is no question that the president and i are goin to stand with the women of america and do everything we can to ensure that women hav the ability to make decision about their health care, their reproductive health care in manner that is what they nee and what they decide, not thei government >> this is an fda approved - 20 years ago and has been proven to be safe for 20 years so this is a dangerous precedent and i'll have more t say after i review the decisio in its entirety. >> the fda has deemed it to be safe and effective for man
9:05 am
decades as the vice presiden said president biden said they will fight this ruling and that's why you saw the department o justice almost immediately filing an appeal so now it goes to the fift circuit for a decision, but it is likely according to legal experts gonna go all the way u to the supreme court to be decided. alex >> it's something we wil follow carefully with your help thank, you, monica for that. for more on the rulings let' bring in msnbc's contributor april ryan april, welcome giving a sense of what thi means politically by challenging these suspensions. it's going to be a dogfight al the way to the supreme court and how might that end >> dogfight might be soft fo what this might be , alex in this moment, you hav democrats very upset, callin this devastating, even befor this ruling came out it was considered devastating but now, when you look at. it - there is a mass search for a

lot of people in states who ar looking for some kind of reproductive health. this is what the vice presiden was talking about. and these democratic states, these texas rulings do not impact it. if this does travel through th united states supreme court, we've already had the suprem court rollback roe v. wade where they took away the federal limit as to when a woman can receive an abortion. the limit as to what term or timeline she can have an abortion now we're in this moment where this pill, this pill deemed safe by the fda is now going back to the supreme court. they just rollback roe v. wade so we can't assume but the president is already been se about this what this supreme court thinks about abortio issues >> hey, look deemed safe by th fda and a news for 20 years, i mean, we it's as if that was
9:07 am
forgotten. but let me ask you a questio -- >> and there's a - >> let me ask you, question if it gets to the supreme court what they view it differentl than they did roe v. wade? where will they rule against abortion rights? >> you have a conservative court that has mad unprecedented decisions to rollback roe v. wade think about it right there this could go right along with rolling back abortion issues for this court the issue i what the fda said about th safety versus what texas i deeming not safe the question is what is safe and what is not? say that's what the suprem court wants to contend wit with the texas ruling if i indeed goes to the supreme court. >> to go too far, april, for all of you april we'll be righ back with me in just a few minutes to react to th explosive report about supreme court justice, clarence thomas and the calls for reform on th high court >> - vice president kamala harris

conducts military drills throw taiwan, just as u.s. lawmakers left the island. today dozens of chines military aircraft crossed th median line at the taiwa straight in what taiwa believes to be an active retaliation for a meetin between their president an house speaker, kevin mccarthy. and bases, courtney kube joins us from taipei, taiwan courtney, welcome. how is the u.s. interpreting and responding to this escalation >> right now it is with a show of defiance. so we heard from members o that delegation before the took off from taipei late this afternoon, specificall chairman of the house foreig affairs committee, mike mccaul who led the delegation here he said that the u.s. and taiwan will continue to stan as a united front, despite these chinese military drills. in addition to those aircrafts that you mentioned, alex, whic is about 71 according to taiwanese government officials that cross this median line so that that line that define where china airspace and taiwa

airspace meet. in addition to that, according to taiwanese officials, ther are nine chinese ships are now surrounding the island almos simulating a naval blocking, which is an extremel provocative act. the that earlier today wit taiwanese presidents who i freshly back from her trip fro the u.s., two of the message we heard from them was tha they're gonna continue t deliver weapons to taiwan an that they're going to try to d more training of the taiwanese military here's what we heard fro congresswoman mcconnell abou that earlier today >> as the house foreign affair committee chairman, i signed off on all foreign sales including weapons to taiwan. i promise you, madam president we will deliver those weapons. we are doing everything we can in congress to speed up th sales and get the weapons that you need to defend yourself. we will provide training t
9:15 am
your military, not for war but for peace. >> you heard him talk abou that they would speed up the u.s. sales there is 19 billion dollar that are backlogged in sales from taiwan. those are specific systems tha the u.s. has approved to sen and in most cases contracted but they are being delivered for years and these are weapons, that according to taiwanes officials in these continuin meetings that have occurre between the u.s. and taiwa over the last several days these are weapons that taiwa needs in the immediate futur in order to really defend an deter against any potentia chinese invasion, alex >> there's a lot to keep track of thank you for doing so in taipei joining me is mill illinoi congressman, a democrati member of the house of - how should the u.s. respond to the unfolding situation with china and taiwan this weekend?
9:16 am
and how concerned are you, generally, about what's goin on when >> i'm very concerned but we need to set up foreig policy based on our ow principles not the principles of th chinese communist party. obviously they were upset when the taiwanese president me with the delegation run by speaker pelosi the meeting with speaker mccarthy, jared's recent trip, i understand that part of my response to th chinese government is, i hav traveled to china, most member have trouble to china at one point in time. we're gonna set our own, policy's not gonna bedictate by you i think the second thing tha we are going to do that is ver strong and reinforcing our support of allies is we have seen how unified we have been. they have we been steadfast in our support for ukraine. that was probably the most important thing we could do it
9:17 am
because it shows what ou concerns are >> that's a good point you make, let's talk about what is happening with regard to ukraine because the pentagon as you well know i investigating along with the doj. the alleged leak of classified u.s. documents about ukraine's war effort and military. it is unclear yet whether th documents or real or whether they're altered, forged, potentially and who is behin it how damaging could this be and do you think it is real? or do you think it's a disinformation effort? >> i think this is the time on of spoken to you that we kno the least about an issue we've been out of congress for a, week were gone for another, week i suspect we'll get som information. but obviously the department i investigating this and we just don't know is it a leak is it a hack how did it happen? how do we prevent it fro happening again? obviously leaks we - if that's what, this i horrific to hack that succeeds it's extremely dangerous it puts ourselves at risk, i
9:18 am
put our allies at risk, it put our sources methods at risk. we simply don't know enoug right now other than thi investigation has to take plac and be successful right away >> okay, julie noted on that front. let's turn to the new report from the white house about decisions during their withdrawal from afghanistan. that report largely blames the trump administration for the chaos as american troops lef in the taliban took over take a look at what th spokesperson said about. it >> the decisions made in th lack of planning done by the previous administratio significantly limited option available to him the presidents transition team asked to see plans for tha removal, they asked to see plans for a security transition to the afghan government, they asked to see plans to increase the processing of specia immigrant visas. none were forthcoming. transitions matter, that is th first lesson learned here.
9:19 am
>> transitions, matter tha word over three times in tha statement. the fact is donald trump - we know that donald trump wa railing about the fact that he lost the election, he didn't want to admit it and was reall obstinate in his departure fro the white house. so, when you think about tha in total, do you agree wit john kirby's assessment? >> i do, but i want to be fair first of all, they are accurate there was no traditional transition as we go from one administration to another. there's a big price to pay, fo that and that rests with the former president that is a travesty and we need to be mindful of that i do think the biden administration took some of it own blame for what took plac in that withdrawal i think we have to keep in min something else too i think this was also dramatic failure i don't know how you split hairs, not so much intelligenc but assessment i never saw anything from th
9:20 am
status of the army o afghanistan that told me tha they were capable or had any desire to fight. i guess maybe it is ou generals wishful thinkin because we port so much mone into that, that because he put so much effort in it's going t succeed. but i never thought that the were capabilities there and ou thoughts that they would giv us enough time for a northerly withdrawal were just high in the sky. i want to make the point, doin the math, the bide administration was an office for seven. months those shortcomings, tha you are outlining could have been addressed perhaps durin that time. let me go with another story with regard to the republica colleagues of, yours led by ji jordan they are attempting to investigate the case against donald, trump da bragg calls the efforts unprecedente campaign of harassment and intimidation how do you see it >> look, when chairma
9:21 am
jordan went to law, school never practice law and it' showing. we should still know better. it's not within hi jurisdiction they are playing with the rule of law and if they are really concerned about something like this, i would be more concerne with the president, the former president creating the risk of violence and threats, usin virtually the same language watched january 6th a couple years ago which led to a violent insurrection i was in the, room i thought firsthand. nearly brought our democracy down but it's not something that we are focused on right now keeping in mind that as yo know, who knows what's going t come out of it the georgia investigation, which in my min could be far worse or it could be the january six investigation. isn't this a little surreal fo all of us? i was part of thos investigations they are fa more important when you thin about how it affects our country.
9:22 am
he extorted an ally fo political gain in ukraine. he incited a violent insurrection which almos brought down our government. maybe it is appropriate, wit this kind of man, presiden trump, that maybe his finall being held accountable o something. for something so petty and unseemly about of an affair or cover up an affair >> context, sobering thank you, mike. when michael cohen said this morning about the impact o donald trump's rhetoric, he' gonna tell a story about a interaction he had with a gu driving a bmw with new jerse plates stay tuned for that. stay tuned for that. weeks. legal theories underpinning th manhattan da's case agains donald trump the indictment runs into skepticism this week including from trump critics and the legal community in congress. some questioning how the judge was able to -- move that requires evidenc that trump had to conceal second crime -- catherine christian joins. me washington post reporter an msnbc contributor, carol, good to see you both. catherine, you first falsifying business records is typically a misdemeanor in the state of new york. it can be upgraded to a felony what are the hurdles the d bragg faces proving that trump

intended to commit or concea another. crime first, let me say it i often upgraded to a felony s it is nothing unique about thi case it is a stop white collar crim and when i was in that offic it was prosecuted routinely, i you're investigating a organization that is corrupt you are looking through thei books and records and you ar finding false business entries they're usually doing it wit the intent to commit or concea another crime. tax, fraud insurance, frau whatever in this case a da bragg and hi press conference is stating th facts. he wasn't very specific, h outlined for possible crimes that he is alleging that mr. trump intended to commit o contended to conceal the new york state election law, which is a misdemeanor, whic you conspired to promote a candidacy by unlawful means. it is the federal campaign finance law by exceeding the contribution limits. it is the ami, which is th

9:30 am
alex i'm so glad you referenced thi because the secret service sources that i speak t regularly had a first earl reaction to former president trump saying he was gonna be arrested on tuesday. one, wasn't my, goodness i hop he's not gonna try to ge handcuffed or some kind of dramatic gia theatrica purpose. the other one was wow, we have to get ready for bringing hi in for arraignment if this really happens however, this claim that the secret service argued an advocated for delaying the arraignment because they couldn't, quote unquote, get ready or prepare quickly enough, my sources say that is not true they feel as though th president's lawyers made tha claim to a judge but the weren't making at themselves they have plenty of preparatio that they wanted to do there was plenty of worry abou making sure that he entered th building in a non public and secure way, that other regular
9:31 am
members of manhattan couldn' just walk alongside him. but there was not an argumen on the part of the secre service that we can't make i happen on a dime because they do that all day long >> i was gonna, say they mus not appreciate too much from the former president throwin him under the bus an undermining their abilities. that, said i know that carol the indicted hasn't stoppe donald trump from railin against bragg as well as whe -- the family and his family, they've received dozens of threats over the past few days on msnbc this morning, michael cohen said that he frequentl gets threatened by trump supporters take a listen to what he had t say. >> a guy in new jersey license plate with, brand-new bmw, h stopped his car, leaves it i the middle the, street gets ou and he wants to engage in physical altercation i asked him to get back into his car because i won't back
9:32 am
down and so we had a standoff, literally in the middle of the street with horns honking an so on. this is the level of insanit that donald trump brings to th table. we >> are you concerned more inflammatory rhetoric insanity as he describes, it from donal trump, we could potentiall keep the court from conducting a fair trial is that out of the question? we >> yes. i think if you are talking about january 6th -- no, go ahead >> first you, then kathryn >> i think in the wake o january 6th we all need to recognize the kind of violence that donald trump's rhetoric conspired. i'll never forget a secret service agent describing to me her desire to cross a rubico for, her which was to publicly say that something was wrong
9:33 am
and dangerous about what donal trump was saying on th campaign trail she saw the violence ramping u at his campaign events based o him saying to his supporters you know, beat him up, i'll pa for your lawyer, get him out o here he was encouraging people to violence even from the day before he was president. so i think we all need to keep this in mind secondly, i would, say alex an catherine, i know you know thi well, i covered a federal cour for many years every lawyer tells their clien be quiet, don't say a thing. but they don't think they have to warn their client not t attack personally the judges family you don't mess with the judg who is overseeing your case. you don't mess with the judg when he says sit down, pleas be quiet, in totally just self preservation, donald trump should be listening to the person that tells him, sto doing this >> i know you agree with, that kathryn, but that is just plai logic, right there
9:34 am
the concern about getting fair trial, kathryn, the question i asked about the view what is your reaction t that the fact that donald trump i wrapping everything up >> well he's, impeding his own ability to get a fair trial. so it's not just talking about this attorney, bragg, and th judge, they're grown-ups they're in this. the judges child, the wife, if i had a client like trump would read to him a penal or crime, it's only a misdemeanor when you intentionally engag in conduct that serves n legitimate purpose, it i directed at a specific person, that you should know i reasonably likely to cause tha person reasonable fear for their physical safety or har or an immediate family member, that is a crime. so i would be reading that section to him it's a misdemeanor it's a low level misdemeanor but i would be reading that to him.
9:35 am
it's coming very close so you don't feel that you hav to tell your client, pleas don't trust the judge and hi daughter in the da and his wife but clearly in this case the have to. i want to make it clear, the defense attorneys have not don any of this they have not said any of this the very competent attorneys they are not talking the, judg they're not crushing the da. we >> quickly, to you catherine, give me a sense after readin the indictment, do you sense all the evidence is out there? or do you think the da i withholding some it's not appropriate to do tha to withhold evidence at this point? >> definitely, i wouldn't call it withholding you don't put every single piece of evidence out in the public that statement of facts is a good road map of where the intend to go during trial. the proof that they say proves that mr. trump tried t undermine the election b falsifying business records. you're not compete every singl piece of evidence in there you'll find out more during the trial if there is a

more now on the breaking new today, conflicting court decisions leave an uncertain fate for abortion access first, a texas judge blocked the fda approved abortion.

pill that ruling is on hold fo seven days minutes, later a judge i washington state ordered the fda not to rollback it approval of the drug the ruling only applies to 1 states in washington d.c., which were involved in tha challenge. joining me now is texa congresswoman, jasmine crockett, a democratic member of the house oversight and agricultur committees welcome, back to see you again how concerned are you this weekend over the uncertainty over access to the abortio pill >> good morning, alex. let me say, first, before we begin this conversation, there is nothing that has been banne as of yet. i do want to make that clear if there is someone that i still seeking access, that access has not gone away a this point in time it is very disturbing as i sit and i look at my student loa debt that comes from actuall getting a lot agree and i' wondering, why did i ever go t law school if these are the kinds o opinions that we're gonna? get this is literally holidays
9:42 am
it's an opinion. it is not an opinion that hi base in, fact it's not a opinion that is based in the law. it's a slap in the face to anyone who ever cared abou jurisprudence. if this judge was at least creative in the way that h went about, this i think tha some of us would maybe scratch our, head maybe be upset and say okay, but when you are writing in opinion, talkin about unborn humans. and you don't understand how contradictory that language in and of itself is i just don't know what to say. i want people to understan that even if you disagree, wit abortion access you should b alarmed by this opinion. this is just the beginning it is not a carve ou specifically for abortion. this means that if, for some reason we were to go ahead and go forward with this type of precedence they could go after any fda approved medicatio that the far-right just things
9:43 am
is problematic, whether it's vaccines, anything else. >> i love the way you're describing this, it make perfect sense. what about what you and your colleagues have done, which is sent a letter to the biden administration acting them t ask on the decision? what do you want to see them do >> you know what? this is the time where we have to use every tool in the too box. most people came to know me in the texas house when i was trying to stop a terrible vote suppression bill we decided that it was time to leave the house. that is something that is no done every single day. but basically, what we are saying is that we're bringin the alarms i don't really care how fa we've got to go. we've got to protect women we've got to protect healt care we have to protect anyone that has a uterus this is a crisis in our countr and considering how extreme th far-right has gone to go ahead and banned our access, i think that we have to be willing t go toe to toe and that i exactly what i'm encouraging

the president to do. any and everything that they can do >> do you think this heads all the way to the supreme court if it does, what do you thin the outcome will be given what happened with roe v. wade last summer >> it's going to the supreme court. there is no question about it we have got to trial judges that have delivered completely opposite opinions. it is absolutely having their. it's also the same supreme court that said we're gonn leave it up to the states, yet we have a district court judge in the state of texas saying nationwide this has to b banned but we all knew that that wa the writing on the wall. we knew that the republicans were pushing for a nationwid ban. so will be interesting to se how the court wiggles an twists to now try to justify why it should be nationwid when not even a year ago the said that it should be left up to the states. so if they follow their ow precedence, they will say, listen, this still has to be a
