to vote after florida voters overwhelmingly passed a constitutional amendment to restore the voting rights of convicted felons in 2018. the amended, however, made exceptions for those convicted of murder or felony sex offense is. but for those who arrested. their intelligibility was not being clear to them. even more chilling. the video published today shows heavily armed officers arresting two men. you can see, in this video here, when was forced out of his home only in his underwear. he walked out of the front door to face officers on the scene holding semiautomatic weapons and handguns. another man was handcuffed in his underwear by armed officers after being who woken from sleep. the two men in these videos, ronald miller, and robert wood had their cases dismissed last year has was the third last month. but state prosecutors plan to appeal those rulings. because of what the dozen cases would ultimately stick governor desantis got what he wanted out the situation. in the confusion and fair for ex violence might want to vote.

and of course, a press conference. that is it for us tonight. now it is time for the last word, lawrence o'donnell. good evening lawrence. >> good evening alex. we now have to special counsel investigating a former president and a current president. the reactions from the two subjects of these investigations are very different though. as the man themselves and the top detention itself are totally different. so too has been the reactions from president biden and former president trump. >> gonna get into it right here. >> today, the president called the special counsel appointed to investigate his possession of classified documents after leaving office, a thug. he then attacked the special counsel's wife and said, his quote, friends and other family members are even worse. he called the special counsel, now investigating him, and unfair savage. who, quote, may very well turn

out to be a criminal. and then, he added, his conflicts on fairness and mental state of derangement make him totally unfit for the job. president said that today. the president said the special counsel's investigation of his handling of classified documents, quote, must stop now. the president i'm talking about, is of course, the one who has retired to florida. where he spent some of his day today writing those attacks. on special counsel, jack smith. who was investigating donald trump's possession after leaving office of over 300 classified documents. and thousands of other government documents that donald trump was not authorized to legally possess. what has president biden had to say about the justice

department's investigation of his possession of what may be, about, dozen documents marked classified? after he left the vice presidency? >> i do not know what is in the documents. my lawyers have not suggested i asked what documents they were. i have turned over the boxes. they've turned over the boxes to the archives. and we are cooperating fully. we are cooperating fully with the review, and which i hope would be finished soon. and will be more detail at that time. >> i also sidewalk operating fully. and completely with the justice department's review. now is the moment where we should pause. just once, pause, to consider just how special the rules are for donald trump's public discourse in the news media. this is a day when the washington press corps did their thing about trying to pick apart every word said by joe biden. or the white house press

secretary. about the classified documents found in joe biden's private possession. while completely ignoring the blaring outburst of pathological lies by donald trump about the special counsel who is investigating him. donald trump does not know anything about special counsel jack smith. who's investigating donald trump. not one thing. and that no one at fox he's ever going to ask donald trump what he meant when he said this today. the special prosecutor assigned to get trump case. jack smith is a trump aiding bud, whose wife is a serial unopened trumpeter whose. friends and other family members or even worse. and as a prosecutor in europe. according to requests now. but a high government official in prison because he was a trump positive person, smith is

known as in on their savage. donald trump then demanded that the special counsel's investigation of him stop right now today. that of donald trump said today. you don't have the reach far to get the comparisons between how donald trump is reacting to a special counsel in his case. and now joe biden is responding to a special counsel in his case. joe biden, says, he is cooperating fully and completely. that is what you were supposed to hear. from presidents, and other public officials. who are under investigation. cooperating fully. that is what you are supposed to. here that is what you heard from joe biden, today. the white house press secretary today. and that is what you have never ever heard from donald trump when he has been subject to an

investigation. and so, going forward, get used to it now. the washington post core is going to play the old standard rules with joe biden. and try to pick apart every word he says, or doesn't say, about this investigation. and they will completely ignore the poison menace that will continue to emanate from donald trump about all of the investigations in which donald trump is no target. another way they will play by the trump rules. well the trump investigation is ongoing. and basically ignore everything he says. then they will play by the old washington rules. with joe biden. that is just the way this is going to be done. get used to it now. today in a written statement. the lawyer for joe biden said we are fully cooperating with the national archives.

he is a special counsel to president biden. that statement says the president's lawyers have searched the presidents -- delaware residents. the other locations where files from his vice presidential office may have been shipped. in the course of the 2017 transitional lowers competed that meeting last night through interview. lawyers covered, among personal and political papers. a small number of obama -- all but one of these documents were found in storage space in the presidents wilmington residents garage. one document consisting of one page was discovered among stored materials in an adjacent room. no documents were found in the rehoboth beach residents. today, attorney general merrick garland restored a tradition and standard practice in choosing a special counsel to investigate a president of the united states. the attorney general very

deliberately chose a lawyer from the opposite party of the president. that is the way special prosecutors were all was chosen until donald trump's turn came. when a republican attorney general or. rosenstein told a republican special prosecutor, robert mueller. to investigate donald trump. the tradition of making sure special prosecutor was not a member of the presidents political party was a way of trying to add credibility to special prosecutor's investigation. donald trump has tried to turn that principle on its head. and there's always argued that anyone who didn't vote for donald trump should never be allowed to investigate donald trump. he spent virtually every day, the mueller desiccation, attacking every known member of robert mueller's prosecutorial team, including andrew weissmann who will join us tonight.

today, merrick garland, -- has the special counsel investigating president biden. robert herr is a 2001 graduate. from stanford law school. then, was a clerk for two judges appointed by republican president, ronald reagan, including the chief justice of the united states supreme court. william rehnquist. then, the most conservative member of the supreme court. robert her, has made this three political contributions to republican candidates going to john mccain's losing republican campaign in 2008. >> mr. her, has a long and distinguished career as a prosecutor. because of some three, he joined the departments critical division where he worked on counterterrorism, corporate fraud, and appellate manners. from 2007 into 2014, this to her served as an assistant u.s. attorney for the district of maryland and prosecuted manners

mr. her was the u.s. attorney in maryland. what was your, and experience of his work there? >> it's good to be with you. he was appointed, as you know, by president trump. i supported his nomination. i had a chance to work with him when he was a principal deputy u.s. attorney. once he became the u.s. attorney we had frequent opportunities to work together along were major issues. the cooperation. i found a relationship their professional. i have a great deal of confidence and his professionalism. and i think he is qualified to do this particular work. >> donald trump said tonight on a right-wing radio show that the special counsel investigating joe biden should be someone who hates joe biden. that is what donald trump considers the necessary qualification to do this. >> you pointed out so many difference between president trump and president biden.

and the way they handle this. you all saw that president biden, once you discover these documents. did what was right. turn them over to the archives. president trump's case quite a subpoena in order to be up to get documents. also, president biden's case, we didn't have very few number of documents but in those boxes in regards to president trump. so the contrast air can be greater and it is very disturbing to see the former president use that type of language. and we have confidence in our system. and i think that merrick garland is doing the right thing. and appointing a special counsel. i think rob herr is qualified to carry this out. i think he will do it promptly. and we need transparency in this investigation. >> this to her i used the word swift in his description of the way he wants to carry out to this job. what do you expect from him in terms of a timetable here? >> i think it's gonna be terribly complicated.

on jack smith today, on the very same day that president biden is saying, once again, publicly. that his approach is to cooperate fully. what are those two reactions by the subjects of these investigations mean to you? >> i think that you're pointing out the double standard that is used so often in evaluating people. it is completely the right one. you have donald trump, who, today. his still, two years later. not answered any questions about why those documents are at mar-a-lago. what he was doing with them. why on god's green earth were they there? and why he didn't return them. and when it was required for the fbi to conduct a search,

precisely, because he wasn't cooperating. so the way in which the two presidents have handled this, to me, is a sign of why you will end up with very different recommendations and results, i think. with respect to what will happen to them, criminally. but i do want to say one thing which is even though donald trump is often held to a different standard. it doesn't mean that we are not entitled to the truth, and transparency. from the current president. the one thing which is again will end up being relevant to the criminal investigation. is it i do think that the calm strategy has been a disaster it shouldn't be the case that things leak out drips and drabs. i think the president will be much better served to be up front with what happened. frankly, the only fact that

looks suspicious is the way that the calm strategy has played out. where it is sort of death by 1000 cuts. i think it is unfortunate's and it is a self inflicted wound. but i think if you look at the dispassionately. i think it is going to be completely irrelevant to the issue of whether anything was done here intentionally by the presidents, and again, we have to wait for the facts. but so far there's not a single fact the suggest this was anything but with the president said. a mistake. >> do you share the attorney general's confidence and senator cardin's confidence and mr. her as a special counsel? >> i do. i don't know mister her, personally we both resistance united states attorney at the same time in different offices. it's possible or offices interacted. but he has a long career as a federal prosecutor. he has also spent time at the

main justice. the department of justice. in addition to his time as an assistant u.s. attorney, and later u.s. attorney. i will tell you from spending 20 years in the u.s. attorney's office. it is very rarely discussed the political party of any of the career prosecutors. i don't know the party of most of my former career prosecutors. i never told anyone whether i was a democrat or republican. and it just went away career federal prosecutors operate. they follow the facts, and the evidence were athletes. we applied law dispassionately. they -- both towards prosecution or against prosecution. and i think that mr. her will approach this investigation same way brush every missed getting a bit of alton's career. >> vista her was apparently a deputy to rod rosenstein. when rod rosenstein was

overseeing the mueller investigation that you participated in. what was your experience with him? >> there's a limited amount that can say. because that is an area where would have to do something called, prepublication review to speak about private matters. but i do share the assessments with career prosecutors. >> the one thing that i do think is worth noting is something that i think will make a very hard for republicans to attack him. which is, he did make one misstep. which was he announced the prosecution of various drug gang leaders. from the white house and that. it is a line that is really not crossed when you are in the department of justice.

because of the independents of the department. it is something i know marion i would never think of doing. it is something that if you keep politics out of it. i think that probably was a misstep on this parts. i think he may regret it. because, bylaw counts, he otherwise, has really been a career prosecutor. as i said had never going to make it extremely hard for republicans to attack him as being some kind of, you know, lapdog to the current administration. >> donald trump is already saying he's not good enough to do this job. and andrew, donald trump was attacking you, again tonight. on right-wing radio show. we are going to squeeze in a break here that you hear with donald trump had to say about you, when you come back after this break with andrew weissmann and mary mccord. we'll be right back. were not secure. and hit the regulations for transporting classified documents. said nothing about the months, and months, and months, of defiance and request to return classified documents. the need for the government to seek a subpoena where that is it enough. the need to seek a search warrant. so donald trump says lots of things. most them are not believable at all. in fact, the horrible horrible things that he said today, about jack smith and his wife. i actually am kind of glad those are not being elevated by the press. because it might be a double standard. but it is lies and the kind of lies that actually really works up the extremists in this country. the hyper partisan, and sometimes violent extremist. who then take those words and then elevate their extremism. the elevate the violence associated with them. and sometimes back on those things.

lashing out if we think that the past is any sign hit is going to get worse. as the georgia case is proceeding down the tracks. as the federal investigation of mar-a-lago, and january 6th. so we are going to see mary admission which is right, to be very careful that we cover these things. because it really is a huge problem of domestic extremism in this country. and donald trump is quite aware that. as we saw on january 6th, he's also ready to activate that kind of force and he will do that. they seize at the end is nearing for them. >> there is a report of many documents being filed among the biden documents to be -- by our count, 60.

60 of the documents found and seized from donald trump are top secret, one from joe biden. so that was the perspective of the top secret document. then we take you back to the congressional part when he said that i'm allowed to have them. that is a document. says that i am allowed to have them. 60 classified documents. he's allowed to have those a year and a half after pregnancy. >> he's about to have classified or frankly, on classified documents. these are government property. and their criminal laws with respect all of that. so what he could do as president, as what was said, is very different from what he could do not as president. so his admitting he was authorized to take them. really, his confession is what

happened next day. which he, no longer as the ex president is allowed to have them across whether they're classified or not. her place -- which is the key issue in the case. and again, i think it is a thing that will differentiate the conclusions reached by jack smith. and the conclusions reached by mr. her. what is one document, there's still a national security concern, potentially, depending on what is in those documents. and that is a serious and real issue. but in terms of criminal liability. having one straight document doesn't suggest, in any way, the kind of facts that we are seeing with respect to the former presidents. >> mayor mccord, when donald trump says i am allowed to have them? to what extent can hayes miss understanding, or misunderstanding of the law,

can that work as a criminal defense? it depends when there's a very limited defense based on misunderstanding. here, was going to be key is not what they were taken -- in particular after they were asked by officials when their two points in time where we can compare the biden administration to the trump administration. we don't yet know, in either case, who originally remove these documents from the white house. and took them to a place where they're not authorized to be. we don't know for trump itself, or one of his aides. we don't know what those biden himself, or one of his aides. we don't know whether it was inadvertent, and by accident, or whether it was purposeful. so, even donald trump sang was authorized to have them doesn't

answer the question about whether he knew if they were part of what was being transferred to mar-a-lago. for that question about how they got to where they were found. i don't think we have answers. and that will be critical there. there is no tends to take them. that least for that piece, there's no criminal activity. then this would happen after. stage two. that's where the cases are entirely dissimilar. that is where, president biden 's lawyers immediately notified the national archivist. who notified the department justice. and has been cooperating. expect the trump, many many months of requesting. finally the first set of boxes. classified information. a subpoena, that give over a few more documents. but it's not everything. and the government was forced to give a search warrant, and even actor executed a search warrant, they still found

additional document since then. so now we're talking about an intent to retain what is known possession of classified material. that's where these two investigations don't dramatically part ways. at least based on what we know publicly. so, back to andrew's point of how this might end up. you don't know the beginning stage. for the second stage. which is all very very relevant to any type of criminal charges, it's very different. and any case, it is not good. i don't want to belittled the fact that it is significant but there were top secret documents found in biden's presidents who are in this locked storage area and -- it is a mishandling, it is wrong. here's something people need to be far more careful out. >> -- thank you for both for joining us. thank you. coming, up more republican --
