governor pat mccory is in a press conference, no mention of the video of the incident in charlotte, it was given to us by scott's wife who made the recording. you hear her voice on this tape and our understanding is that mr. scott was in a vehicle parked in a visitor's spot and the police were at that complex to serve a warrant on someone's else. keith scott's wife went inside to get a charger and when she came back out, that's where this tape starts. we'll play the full video in its entirety in case you are just joining us now. all two-minutes and 12 seconds of the video. it is disturbing to watch, while you will hear the gunshots and not see anyone shot. >> don't shoot him, he has no weapon. he has no weapon. don't shoot him.

y'all call the police, the ambulance? >> it does not get any easier to look at that video. we are analyzing the video. >> hillary clinton just tweeted that charlotte police should release the video. i want to get right out to nbc's gabe gutierrez, he's the one that obtains the video. he's joining us. where did we get the video and why did he give it to you? >> reporter: hi there, kate, this video was released to us by the scott's family. by the attorney of scott's family.

they wanted the public to get a clearer picture of what happened in the moments leading up to keith scott's death. we have not seen any images of the video. kate, we have seen repeatedly of facebook stream and live stream that went viral on social media of the night of the shooting that got national attention and that was shot by a woman who said she was scott's daughter. this womvideo was shot by scott wife. they have been together for 25 years and they have been married for 20 years. they have seven children together ranging from 9 years to 20 years old. they were both in a pickup truck at the apartment complex and she says, she went inside the apartment tcomplex to get her

cell phone charger according to her attorneys. she returns in about three minutes according to her attorney. as we mention, right there is where the cell phone video picks up. we have seen two-minutes or 20 seconds where shots rang out. several things here, we heard or say "don't do it, don't do it," that raised questions of why she's saying that to her question. again, police have said that a gun was recovered at the scene. her attorney is now saying that this cell phone video did not prove there is a weapon on the scene. when i asked her attorney about the phrase, don't do it. they first refused to speculate, it is possible that she's telling her husband not to get out of the car or engage with the police. it does not prove he had any type of weapon on them. we do hear the officers yelled

"drop the gun." >> a bigger picture, today, the state bureau investigation took over this case. however, it was not a question of if it should be released but when. the police chief also said that you know pending the investigation that he has said that it should not be released and he said that it was apart of the process and he suggested that at some point he would be released but to give the investigation time. it was not up to him. with that broader context and with that understanding, now the community here for the past three nights, they have taken to the streets and they have demanded the release of the video that might show what

exactly happened here. again, the cell phone video completely separate from that. the scott's family have not released this video to anyone. before we aired it this afternoon, right here on msnbc, they say they gave it to the police department. now, we reached out to the city of charlotte. so far, no response from what we can understand. again, since the family have not given this to detectives. this is the first time they are seeing this video. as we just heard in the governor's news conference, he did not address this video. there is outrage from this community. they say their officers felt an

eminent threat in this case. the question right now is whether the city or the state, where the state investigators will release the cam footage. and as we go through the cell phone video, how it plays into a larger narrative. rememb narrative. earli the family members, they have said that he was reading a book that he was not -- police disputed that and no books was found. conflicting narrative at this point. this cell phone video provides us a first glimpse of what happened before the shooting and the immediate after math. >> gabe, let me update your viewers.

we are talking about mostly flooding in other parts of the state. as far as this case goes, they'll respect the process and the governor is saying we still won't release the video tape. that video -- we are talking about the body cam video in possession of the police. gabe, let me ask you. the governor is talking about the state of the community and the protest, last night it was peaceful and the two nights before that, we saw the kind of damage that was right behind you to property and one person being killed in the process. where is the governor coming from when he says, he talks about calm? >> reporter: well, yes, you mention that right behind me, this is the streets that was two nights ago that the windows here were shattered and boarded up and major clean up effort that happened here. last night, it was a positive

development, many in the community felt that there was no major violence to speak of. we saw protesters out on the streets making their voices heard. no major clashes with police say for a few instances when they're trying to go at 277 and shutting down the interstate. they were quickly dispersed and no major injuries. last night, around 9:00 p.m. the mayor had impose a curfew and we learned today that the reason it was done at 9:00 and some said at the time it was rather late at midnight. the police chief had said that the reason they did that was they thought of a security threat by outside group the chief said it was from south carolina that was coming potentially to stir up violence in the community and that was the curfew was imposed. the chief and the mayor both side that curfew was a tool and what ended up happening was mid

night, there were some fear that the community thinking there will be people refused to get out of the streets and raise tensions again. thankfully, the people that were out there were very calm and deliberate protests and they got their voices heard. around 1:45, they started to disperse. the curfew was in effect from midnight to 6:00 a.m. it is indefinite right now. over the weekend there were demonstrations planned and there is a concern to sunday as well of a major football game here with the carolina panthers. later in the week, the nfl came out and said that the game will go on. this is a broader context. there is been tensions here since the shootings. two of those nights, the first two, chaos erupted and things got much better last night and

the chief attributed to good police work in the community. now we are seeing this cell phone video for the first time, the community demanded of the release of other videos. back to you, kate. >> right, of course, the key difference, we got this video out there right now that everyone is seeing, gabe gutierrez, thank you very much, we'll continue to follow your reporting as you learn more, please call in or come back to us. i should note that the governor of north carolina was speaking. the governor says we have to respect the process locally in charlotte and that we still won't release the video tape that some are demanding to see release, the governor wrapped up that press conference, it is now over. we want to walk you through of the footage that we have. there are so much to digest. joining me now is our senior

editor, cal perry, take us to the key moments of the video. >> definitely, we have vdivided into this video. we are going to show it transparently so you as we went through this ourselves. the first thing is a 26-second clip. you are going to hear mr. scott's wife talking directly to the police officers. take a look. >> don't shoot him. he has no weapon. he has no weapon. don't shoot him. [ bleep ] don't shoot him. he didn't do anything. >> drop the gun! >> he does not have a gun. he has a tbi. he's not going to do anything to you guys. he just took his medicine. >> a couple of things there is important. one, you hear the police say

drop the gun and ythe other thig is tbi, she's saying traumatic brain injury there. i am going to quote, the family's lawyer who says mr. scott had a bad accident a year ago and he suffered severe body injury as well as severe head trauma. tbi, she means traumatic brain injury. this next section is 20 seconds where she starts talking to her husband. take a look. [ bleep ] keith, don't let him break the windows. come out the car. keith, keith, don't do it. >> you see there, we frozen that video on a police officer who's up nens against that pickup truck. we'll talk more about this

police officer. you heard there she says again, "don't do it." we don't know if she's still talking to her husband or the police. this next section is the dramatic moment where he's shot by the police. you will not see the shooting but you will hear it. some of our viewers may find it disturbing. >> keith, keith, get out the car. don't you do it. keith, keith! don't you do it! [ gunshots ] >> did you shoot him? did you shoot him? did you shoot him? he better not be dead! >> there you have it. the moment that fatal moment where mr. scott is shot by police of four separate gunshots that we can hear in that video. we have reviewed it a great number of time. this is the point now and we start to get to items on the ground. this is very, very important in this investigation. we'll start a spotlight for you here.

some of these items as they are introduced in the scene. there is the first one right there. again, the video is two-minutes and 12 seconds long. the first item that we see, you will see a police officer and again, i want you to focus on the police officer with that red t-shirt bending over and he's picking something up. we can zoom in closer as we have more time going through this video. you can see in his hands of a pair of glooves. this officer with his red shirt and this is going to be important for our time line. at this point, he's picking up that glove. now, the other thing we'll show you here is that in slow motion, this is the gloves that's being tossed. the reason why i am highlighting this officer, we'll go now with

wcnc, our affiliate in charlotte, this is of stilled photo of what is proported there at the bottom of the screen to be a weapon of some kind. you see the officer with a black jacket. these are the stills of our ifi affiliate. this shot is taken after the video that we have obtained today. we have missing time that needs to be accounted for. this is why so many people are calling for police to release the dashcam footage. when did the weapon get introduced in the crime scene? was it between the time that this video starts or the time we have those stills from your affiliate in charlotte. it seems likely and obvious. until we see a proof of it, people are going to have questions >> cal perry is breaking down

the video. ari melbourne, you have been watching this with us. the first time i am watching it i was in tears as i am thinking most of our audience about it. to get analytical about it. we hear the shots but we don't see the critical moment. >> that's right, what this video shed lights on was what was happening in the 50 seconds leading up to the shot and the sho shots transpired relatively. what scott has given to nbc news is -- multiple dashcam videos would be helpful.

this is how the process has been played out. it does suggest that they were under the belief that he had a gun and they felt that he was not complying with commands. we are hearing for the first time that his wife now, a widow, attempted to inform officers that he had a traumatic brain injury. we have reported previously that up to a third or half of police shootings involved people with mental problem disabilities or some sort of brain trauma which mean in the situation of the communication device went viral. she tried to issue the warning. then you have everything after the shooting. again, we have a brief amount of time but what you see is scott on the ground and police surround him and the area appears to be fairly clear

especially down around that key area and around his feet on the c concrete. that did not tell us what came next. cal was zooming in on the glove that there may be an object that came from mr. scott's body or his clothes. >> remind us of this photo that we are looking at now came from our affiliate as cal said, police corroborated. did they say if that's a weapon? >> they have done select relief of information which was not under stated as possible and not ideal. >> could that be a glove? >> we at nbc news have not confirmed what that object is. what we mean is we are under the

impression that it could be any number of things. there are times when we zoom in and we use our video software and we talk to policing experts and we do say with some confirmation certainty of what we believe it to be. the police did not say that. what they said was that witness photograph appeared, they confirmed on the scene. >> it was a real photo. >> we don't know how that may also overtime see an image on the internet and maybe distorted. we did confirm with gabe good news -- i will say this, it is a tort and a civil in fraction to force someone to watch a grievance injury or a death of a

family member. the law recognizes that as so dramatic. we don't know the answer to. we play it because it is part of the news and it is an important fact. it is a deep trauma. she's literally watching and bearing witnesses. >> she cannot get close. she cannot move any closer because she's afraid she will be in trouble. >> because she just watched her husband not shot and the people conducting that shooting telling her to stay back. >> there are not great words for that. it is difficult, i think the way forward here is will this police department and now the state police investigation, will the state, the governor is saying one thing, no video and the mayor is saying to release it. it does not mean by the way under state law that you can. with at the kwquestion is wheth the authorities of north carolina will try to find a way to -- regardless of the video

lets get right back to charlotte, lets bring in our tremaine lee, you have been down there and talking to folks as we are seeing this video. what are you hearing? >> reporter: i will tell you kate, after viewing this video

and mrs. scott narrates the last moments of his life. it is hard to imagine that this will not be playing in the background of the streets of charlotte. we are seeing it time and again across the country. as mrs. scott says "don't shoot him, don't shoot him" and he's pleading, he better not be dead. that pain that i have talked to many in the community fighting for justice in this shooting. they are saying that pain is translated to them and it is not just the family of scott's but it is a collective pain. i want to bring in a woman nawhs a friend of the family. i want to ask you after watching that video, how do you think the change and the dynamic of the fight out here in the streets for justice of mr. scott. >> we as citizens see a lack of

integrity on the part of the city of charlotte and on the part of cmpd. we have to ask ourselves when we saw the stilled footage earlier of the photos. where is the gun? there was a gun that was planted apparently, possibly. >> reporter: you believe the gun may or may not be planted. >> when we saw the footage of the wife filming and viewing, we did not see the gun there. where did it come from? >> reporter: is there anything that the police can do? is there anything that could be done to bridge the gap in terms of the trust and let the people know? >> no, the trust is shattered. we cannot trust chief putney. two hours after the unfortunate tragedy unfolded, he was not we need to collect or gather our information, we need to complete an exhaust investigation.

he was definitive. that mr. scott had a gun and he pointed out to officers and obviously, we are all seeing now that was simply not true and from monday morning and him and mayor jennifer roberts and other council members to stand at that podium and looking in the camera and with our african-american sons and children and daughters, you lied to us. who knew what and when, that's what we need to know. they do need to release the video. although the trust factor have been damaged, it may not be unreparable. we need to see that video. we feel they were lying to us and being dishonest, now, we feel that we have been vitam vindicated -- now, putney has a lot of work to do.

jennifer doing the same thing, he needs to apologize. >> miss forrest, let me ask you this, when you watch that video and you hear scott's wife pleading for his life. how does it touch you? >> i can hear charleston in her voice, we are as charleston, very strong and proud, african-american people very proud, we don't back down. i can hear her strength and anguish. keith went to school with my family and his twin sisters are the sweetest and beautiful people in the world and for them to be feeling this anguish, it is unacceptable. >> is there any way for the city to put the peace back together

to say that word even though he will support the nominee but he did not say he will vote for donald trump. the election is like none other in our nation's history and he struggled to determine the right course of actions. he has come to a conclusion that he will vote donald trump. secondly, he said even though i had areas of significant disagreements with our nominee, hillary clinton is wholly unacceptable and that's why i have been #neverhillary. ted cruz is giving his support to donald trump. lets go to kasie hunt who's out covering for politics for us. you think back all the time these two men went at each other and all the nasty things they said to each other and some deeply personal to donald trump

and here he is putting that aside and endorsing and saying he will vote for donald trump. >> reporter: he did indeed going after ted cruz's wife. that was felt very personally by the cruz' family and people surrounded ted cruz. he, of course, also insinuated that cruz's father was involved with harvey oswald of the kenne kennedy's assassination. trump also stood on that debate stage and repeatedly calling him lying ted which was something that stuck in republicans' primary voter minds. there is no shortage of animosity here. cruz ended up being that last man standing against donald trump. of course, cruz also -- cruz has

not made the fact that he has additional ambition to potentially run for president in the future years. the delicate dance for all of these republicans who are negotiating over how or whether public to be in their support for donald trump is the fact that there is this is, the primary electorate and it is their base. they're the ones who picked trump as their nominee. and ocourse, you have seen others like -- the republican president nominee, you see mitch mcconnell doing that as well and many republican poll tipiticiane

different comfort levels with donald trump. john mccain, another politician up for election contending of the same pressure of having this base electorate supporting donald trump. kelly o'donell, i am just reading the facebook post which lists out six things why he gave his support to donald trump. number one, the supreme court, the court hangs in the ballot, he writes and number two, obamacare, it is hurting millions of americans and third is energy and the fourth is immigration and national security and the sixth is internet freedom and free speech online. the supreme court, today donald trump released a list of

possible contenders for the supreme court. people he would think about in filling any vacancy on the court. ted cruz seems to be using that moment or the fact that list came out to say why this is the moment for me to stir my support behind donald trump. >> i don't think that's the moment. although important because his best friend of the senate is bi mike lee and they have often been alone on an island when they're taking on the rest of washington. i don't think that was the only moment. it was something donald trump did as another gesture towards ted cruz but i think in watching crui cruz, he has fought vigorously on the issue of -- that's been something that cruz has been really working on. mike lee, the senator from utah

has said that he does not want to be a trump's appointee. things could change down the line, of course. it is sort of an aggregate of these things where trump moves toward to things that's according to cruz and cruz embracing the nominee and not the endorsement that typically one would want. we were there at cleveland, when he talked about vote your conscious and at that point, it was clearly that not a conscious that would leave one to donald trump's and in ted cruz's mind at that time. it was clear he was not going to endorse him at the convention. it was always clear that he was not going vote for hillary clinton. he kind of left it hanging for a time. you may have already made the reference to the fact that there

were two big hurdles for ted cruz, criticism of his wife heidi and criticism of his father rafael. both were considered far out of bound by many republican party and about mrs. cruz's appearance and the sort of conspiracy theory that his father had some kind of ties to lee harvey oswa oswald. you heard about that out of donald trump's mouth. those are two things of his father and his wife being attacked by donald trump. looking towar a future in the party and embracing the nominee is in fact important. even if donald trump were to lose and if ted cruz had not embrace the nominee, that's a real problem if he want to run in 2020 and in his own of the election campaign not in his cycle or '18, he's already

announcing he's embracing that. >> kate, just reading a little bit more, we are processing this kelly, as it came through, reading more from his facebook post that he tweeted out. he says that the supreme court obviously was an important issue to him. the first thing he said that sometimes i have been seeking greater specification on this issue and today the donald trump provided that and including senator mike lee who would make an extraordinary justice. that's the sorts of reasons that he's given for putting this out on a friday afternoon at 3:00 p.m. eastern time. >> i think that ted cruz supporters, many of them have

moved to make shetheir own decin supporting donald trump because of a contrast between trump/clinton binary choice. many of cruz supporters were ahead of him getting to not all but many. he needed to provide reasons and he did it when you print out of two full pages. i think he can also rely heavily as a fact as a candidate himself to promise to support the nominee. when you are ted cruz and sort of being a fire brand about standing by your word, that was a problem as well. to do it on the eve of the debate is also significant. this is something that is helpful to donald trump and it shows a further bringing up the party together which is something that they had struggled with and each time there is a former foe that gets on board that's helpful. you have to look at this in a sort of holistic way for ted

cruz. regardless if mike lee is picked, that's a good reason for ted cruz to give. h an important sort of get for donald trump, it may help to bring along some of the christian conservatives and also a hidden footprint him with mike pence, he meat privately with cruz and they had a lot more in common. not much of ted cruz's traditional in the sense where he really has a lot of struggle with establishment figures. they can continue on the issue of having many voters in common. perhaps, some of this is due to the partnership of trump and pence. kate. >> kelly o'donell for your quick perspective from this breaking news. appreciate it.

we are three days out. the first one i want to bring in jennifer graham, she's with us to talk about the debate -- let me ask you about this news on ted cruz. in his statement, he says hillary clinton is "wholly unceptable and he unacceptable" and he's talking about positions making him to support donald trump. he said "obamacare is a failed." >> this is much more about ted cruz than donald trump's. this was about his future. he was looking for a reason to get back in line with his party since he see himself as the future of the republican party and the fact that he put mike lee on the supreme court's watch list is the reason to allow him to tip off. ted cruz does not bring a whole

voters and folks that donald trump have lost or people in the business republicans or the security republicans who have felt that donald trump is too crazy. it is just too much of a risk and too much of a threat. ted cruz does not bring any of those back. >> our country is in crisis and hillary clinton is manifestly unfit to be president and her policies would harm millions of americans and donald trump says ted cruz is the only thing that's standing in her way. >> donald trump says ted cruz is the only standing in her way >> sorry, that was from ted cruz's facebook. ted cruz is saying hillary clinton is unfit and donald trump is the only thing in her way. >> honestly, he's going to say that. that's the same old,rhetoric. we'll give people on a real chance to compare apples to apples on monday. i hope msnbc and others maintain

a level plainfield and do not grade donald trump on a curve. this is the moment of people deciding who should be the president of the united states. there was a poll today that more than half are afraid of donald trump being president because he's so unstable, because he has in the past an acted, acted in a way that threaten individual citizens with his own actions and their economies going after them and his deception and dangerousness and vdecisiveness all are things that people have to remember. if donald trump comes to the debate on the debate and is looking presidential which i fully expected that he will try to do then people have to be reminded, not just how he is in a 90-minute debate but how he has been throughout the course

of the campaign because one debate does not change of what he has said in the past. >> you have experience in this back in 2008 of joe biden and you claimed sarah palin. we know that's happening with hillary clinton right now. we don't know who -- do you know who is playing donald trump? somebody is. >> i don't know. >> she's working on it. what is your advice to hillary clinton on monday night? >> she's going to be totally prepared and anybody, it would be malpractice not to practice so practicing is a really important thing. but, and i am not at all worried about her knowing the feedbacks and all of that. this is an an opportunity for her to speak to the people who are in the echo chamber of the right who believe, you know, all of these stories about her and who may not have seen her one on one against donald trump and for her to be able to show her heart

and show her gut and be light hearted and she has a great sense of humor and she can show that and she could have fun with it and be the happy warrior on behalf of the people. they need to know why she's going to fight for them and for her to hold that out ther there -- she's going to fight for them to bring people together, that's what she had an opportunity to do to show the real hillary clinton on monday night. >> donald trump has said repeatedly that she's not repairing for doing any test runs. could you argue though -- >> hey, i don't know if it is true. he maybe practicing -- >> but their point is, his strength is impromptu and his strength is able to go off the script, is that the hardest part for hillary clinton that he will come off in so many directions.

carolina. what did they do? can they mend the relationship between the police force and the community? >> i am never in a hurry to talk about menting relationships. we have to have a level of transparency and if they have a narrative to what we just witnessed, it would behoove them to release the tapes. many in north carolina and around the country were insulted and disgusted by the governor. to talk about the fatigue of the police officers and think about the fatigue of the cav machi african-americans. there is a hierarchy of value when it comes to human lives. based on what we have seen and the history, it is a low value placed on african-americans.

how do you read that? >> i want the citizens. they are taking it to the streets and peaceful protest. nobody should attack law enforcement and i want to take it to the streets and i am not talking about this year. whatever we want in this country, a lot can be solved about the types of people. we should not elect people who don't believe in the value and the work of all people, but especially african-americans at this point in time. we see how the country feels about us. this is a generational struggle. there are constitutions that we can have. i don't believe we have to fate for folks to be elected to the presidency. the mayors and governors and state legislators have it within their power to do something about this so we don't have any
