tough one. lots more coming up on sports. sportswrap 1130. >> all right we'll see you then jason. thank you. next at 11. >> the potential implications here are really, really huge tomorrow. >> the us supreme court will hear a landmark case on homelessness at issue, in part whether people can be cited for sleeping on the streets. the implications the case could have right here in the bay area. >> the 11:00 news on ktvu fox two starts now. >> advocates call it the most important supreme court case addressing the homeless issue in 20 years. good evening everyone. >> i'm mike mibach and i'm julie julie haener. the case boils down to whether people can be cited for sleeping or camping on sidewalks or public property. opponents argue it would be a violation of people's constitutional rights. reporter michelle bandur takes a look now at how the ruling could impact the rest of the country. reporter a cup of coffee on a sunday morning. >> it's very hot, guys. >> no, i really appreciate you guys. >> goes a long way when you don't have much. and they're

hopeful. >> they actually have hope when you when you see them. >> margaret carruthers is a volunteer with mercy peddlers and sees the homeless crisis up close. >> it's actually they need a place to sleep and they need a place to camp. and if they're not blocking the sidewalk or the street, you know, i don't see where the harm is. let them have someplace to sleep. >> that's one of the arguments the nation's highest court will hear monday in a case stemming from grants pass, oregon, making it a crime to sleep outside. >> we have the right to do that. we don't have the right to do it on private property. we don't have the right to do it in the middle of city streets. >> reporter 67 year old joseph gibson blackstock says with his health problems, he just had heart surgery. he's found a bed in a shelter, but he says there's just not enough room for everyone. >> if they can live in tents and stay out of the way and not be criminals and try to get by and with a little help, get out of this situation. >> there are no shelters, whether it's in jail or

otherwise, to accommodate the in our case, 9000 people who are on the streets in the city, attorney for the homeless union, marc maron says the justices will also hear arguments on a ruling from the ninth circuit court of appeals that says the grants pass law violates the eighth amendment, making it cruel and unusual punishment. it's cruel and unusual to tell a person who's homeless, who's sleeping outdoors that he has to move. he can't sleep there or he's going to be arrested. it's a it's a it it's an abuse of the constitution which prohibits cruel and unusual punishment. >> whatever the supreme court decides, the mercy peddlers won't put the brakes on helping the homeless. >> just out here doing the best we can to, you know, at least brighten their day. >> and again, that was michelle bandur reporting tonight. we spoke with law professor david levine of uc college of the law about the case's potential implications if this is somehow decided very narrowly, according to the facts that apply to

little grants pass, oregon, it may not have such wide applicability. >> but if the supreme court writes a pretty broad standard, it really will dramatically change the potentials that are dramatically change. what's going to happen in the san francisco case, as well as in places, really across the country. >> a lawsuit over homeless sweeps in san francisco is currently on hold pending a decision in this case. now, tomorrow, a demonstration is being planned in san francisco in support of the unhoused population. protesters plan to start at the federal building and end up at city hall. organizers say overturning grants pass will create a devastating ripple effect for homeless people across the country. new at 11, the city of cupertino is about to make some budget cuts in an attempt to balance its $15 million deficit. >> the city council approved the $9 million reduction on tuesday. it applies to this fiscal year and is 1.5 million less than originally planned. the council voted to keep tree and sidewalk maintenance services, but will

be cutting the 4th of july fireworks show and the free shakespeare in the park festival. >> a new housing unit will be unveiled in san jose tomorrow. solitaire apartments was developed by eden housing and consists of 130 units. the building is located on azorius avenue, and half of the apartment units have been designated as permanent supportive housing. the development was funded by housing trust silicon valley, with the mission to address the homelessness crisis in santa clara county. the building has convenient access to transit options nearby, and it also has multiple amenities like a community room, fitness studio, ev charging stations, and more. san pablo residents will submit more than 1500 gathered signatures to the city tomorrow to launch a renter protections legislation package on the november ballot. the renter protections package would include rent stabilization, tenant anti-harassment and a just cause eviction ordinance. the mission of the ordinance is to prevent people from being

priced out of their rentals, and to curb growing homelessness and housing costs. residents attending plan on sharing their struggles of renting in san pablo because of a lack of protections. >> new tonight a group of government attorneys in santa clara county have filed a complaint with the federal election commission against district 16 congressional frontrunner sam liccardo and his campaign. now, this complaint accuses liccardo of forming a super pac to pay for the recount . ktvu lamonica peters reports. >> on friday, the santa clara government attorneys association filed a complaint with the federal election commission accusing district 16 candidate sam liccardo and his associates of trying to avoid a three person race in the november election. >> when we're talking about third party money, when we're talking about super pac money, a federal campaign laws require that there not be coordination in between those super pacs and a candidate. >> qajar released a statement saying in part, no reasonable

person would believe that sam's close personal friend and former staffer, jonathan padilla, went to all of this trouble because he loves democracy. he who is paying for this recount and what's in it for them, the complaint says. liccardo used a poll from april 8th that showed his campaign would be vulnerable in a three way race, and the next day, padilla requested a recount. it also says the recount was paid for by the ctv pac, which the association says was formed by people close to liccardo, an unknown number of ballots are also now being challenged in the recount. >> even one vote, if it's for simitian or low, then yeah, that changes what the count will be, and that'll move us from three candidates to two. >> liccardo's campaign released a statement in response to the complaint, saying in part, this complaint filed by a supporter of one of sam liccardo's political opponents, lacks any evidence and cites a poll in

which sam liccardo wins a general election by over 5. >> regardless of why there's a recount or who's paying, these are people's votes, and i think we all want everyone's votes to be counted. >> michaelson says that it could take the fec months to investigate these claims, and that any conclusion to this filing will most likely happen after the november election. lamonica peters ktvu, fox two news san francisco mayor london breed arrived back in the bay area today and shared some details about her trip to china. >> the mayor clarified an earlier announcement about giant pandas coming to the san francisco zoo today. she said china plans to send two pandas to the city. the mayor's trip could also net millions of dollars in airline travel. she hopes to rejuvenate tourism from southern china by working with airlines to get more flights in and out of sfo. >> it's so powerful what it represents, not only for our airport but for local economies. we look at a single flight and

i'm talking a daily flight between a foreign destination like china and the us to sfo, it can be upwards of $175 million in annual revenue, 1200 jobs to the bay area total. >> so and that's just one flight. >> currently sfo is seeing flights to china at 50% of pre-pandemic levels. >> new at 11 two santa clara county sheriff deputies disrupted a theft in progress at a walgreens in cupertino. here's a look at the $2,000 in merchandise nearly taken from the store. officials say the suspects were caught due to the quick response from those deputies. oakland police are investigating a shooting just off hegenberger road this afternoon. officers say when they arrived, they found evidence of a shooting, but no victims. well, shortly after, officers say one person self transported to a hospital with gunshot wounds. police say the victim's injuries are considered non-life threatening. no arrests have been made. >> a whale was found dead near a beach in alameda. what wildlife experts say may have happened to

casino. >> this story begins tonight's west coast rap. auburn detectives say the attack was unprovoked and completely random. it happened right before last call, around 1:30 a.m. at the muckleshoot casino. investigators say the victim was a 29 year old man. first responders tried to save his life, but it was too late. no one else was injured in the stabbing. that incident still under investigation. >> and in arizona, hikers helped a man who passed out on a trail on a day when the temperature actually hit 100 degrees. in phoenix, a group of hikers saw a man struggling and asked if he was okay. they tried to give the man as much shade as they could, but he eventually passed out and the other hikers did call 911. the 60 year old man was then taken by helicopter to a hospital. the phoenix fire department says some inexperienced hikers often underestimate hot temperatures that can hit even in the month of april. >> and in southern california, at least 15 people were injured when a tram crashed at universal studios hollywood. it happened last night. l.a. county

crown beach. i feel like bad for the whale because it is dead and its life is over. >> the female gray whale first spotted saturday evening, possibly stuck on a sandbar. it stinks and it looks weird. >> according to the marine mammal center, it marks the first reported whale death in the bay area this year. now the question on everyone's mind how did it die? theories, speculation already swirling. >> i heard that it got tired because it came in and it's too shallow, and it couldn't get back out too early to tell. >> according to whale expert bo flannery from the california academy of sciences, we couldn't really determine anything today. >> there were no obvious signs of death, flannery says. >> the most common causes of death for gray whales include poor nutrition, boat strikes and entanglements with netting. as for whether the whale might be connected to one spotted several weeks ago and tangled in fishing gear and making its way up the southern california coast, this is not the entangled whale. a

few heading out for a closer look, but i wouldn't do that if you know, because apparently the oils from the whale will stick to their skin. the idea of that it's just like gross. and more importantly, it's really not safe to be around a large animal that big in the water. >> they move around. that's why we don't do more with it when it's floating in the water. >> the plan now to tow the 40 foot whale away for testing in hopes of learning its cause of death, and it's always an opportunity for us to learn more about the species. reporter back at the beach. sue's only wish. >> hopefully they'll get dignity soon. >> and as for the process of removing that whale from the water, the us army corps of engineers and the us coast guard are expected to help out with that process of towing it away. that process could begin on monday, and afterwards they'll be able to start figuring out how that whale died in alameda, zac sos ktvu fox two news. >> new at 11, the state

department of fish and wildlife released 500,000 juvenile salmon into the klamath river, just below the iron gate dam. governor newsom tweeted this video showing the release, saying it is part of the state's salmon strategy to restore the salmon population. it was the first major release of coho and chinook salmon since the dam removal began late last year. officials say river conditions were ideal for the salmon releases. this past week. another release is planned for later this spring. >> all right, let's give you a look at the moon tonight. not quite a full moon yet, but you can see it is getting very, very close. just a few weeks after the total solar eclipse earlier this month, the moon is set to make another notable appearance. it's known as the pink moon, the full moon full moon in april usually gets its name from one of the earliest widespread flowers of spring. >> it's a very cool picture there, almost. >> it's almost. it looks like it is like a full moon right there. all right, let's go over to our meteorologist, mark tamayo, for

a full look. now at the forecast. so will we be able to see that pink moon? >> well, for tonight we'll have a clear skies. but over the next, over the coming days, we'll be talking about some more clouds and cooling conditions. but yeah, by the way, that moon is 94% full. it was a nice sight in the sky for tonight with with the clear conditions as far as the highs from this afternoon. it was warm in a few spots. lots of 80s for concord, fairfield and antioch. san jose 81 oakland mid 70s and some 80 up in portions of the north bay. so for earth day for your monday, we are expecting some patchy coastal fog. it will be cooler last warm day will be inland for tomorrow and that means temperatures still in the low 80s for the warmest locations for your monday afternoon. right now though, as you can see, we have some fog down to our south. we'll be watching out for this because it's going to be moving up the coast over the next 12 to 18 hours that we call that the southerly surge that will ultimately begin to cool off portions of the bay area, especially coast side and right around parts of the bay as well. this activity in the pacific, this is the cooler pattern that wants to set up camp over the next several days, especially

for wednesday, thursday, and into friday. here is our live camera tonight. looking out toward the bay bridge, out toward san francisco, and current numbers have cooled off into the upper 50s for santa rosa. concord is still 65, oakland, 58, in san jose and in the mid 60s. weather headlines tonight, fair skies tomorrow. cooler coast, some warm temperatures inland. and then everybody cools off. in the extended forecast. we'll bring in more clouds and maybe a shower chance as we head toward thursday night and into friday. as far as overnight temperatures, we're going to start out your monday in the 50s. partly cloudy skies, some patchy fog, and then into the afternoon hours. we begin to cool things off in your monday forecast. so the cooling trend begins. but the warmest locations still close to 80 degrees. we'll have a few visiting clouds and still some patchy fog hanging out near portions of the coastline. so here's the plan for tomorrow. cooler for the beaches. still warm away from the shoreline. and then we'll be watching out for this system later in the week. more clouds, cooling conditions, and maybe that shower chances. we've been kind of tracking over the next several days. by thursday night

and into friday, highs for tomorrow will be in the still in the lower 80s out toward concord and antioch. san jose 79, san francisco 66 degrees. and here is your five day forecast. we're definitely cooling things off by tuesday. we're going to bring in more clouds for wednesday, thursday and by friday, there's that chance of a few scattered light showers. and then into the weekend looks like a sun cloud mix. the upcoming weekend. not like this past weekend, definitely. it's not going to be as warm. so definitely temperatures trending down over the next several days. >> all right mark thank you. marin county officials are wrestling with the high tech problem e-bikes in the hands of young teens. ktvu tom vacar reports on the increasing concern as some schools now try to protect their students. >> the tamalpais union high school district is considering requiring students who ride their bikes to school to register their bikes with the schools, and those bikes must be of a speed class, legal for their age. also under consideration, banning modified

e-bikes that would allow them to exceed the maximum legal speed of 20 miles an hour. >> we'll be working not only with our law enforcement partners, but i said across the county, this is something that a lot of districts are looking at doing in concert, so we can be uniform in how we're addressing these concerns. >> we're not just working with tim high union district on this. we're working with our middle schools and our elementary schools to push out this messaging, because we don't want them being purchased in fifth grade or eighth grade and then ending up at your campus. >> the marin county health department says the accident rate for children on e-bikes is nearly ten times the rate for older age groups. the u.s. national electronic injury surveillance system data shows that e-bikes are more than three times more likely to be involved in a collision with a pedestrian than powered scooters or regular pedal bikes. >> i live in a community of 55 and older, and we have a lot of issues with that. i've seen them

go right down dougherty drive like they are a car without helmets. >> add to that often going the wrong way on a one way street using their phones, ignoring stop signs and traffic lights, driving in the dark with no lights, making illegal turns and jumping in front of traffic when i drive, and there's an e-bike nearby, i always wonder if they know what they're doing. that would be one thing if these e-bikes stuck to the rules, stuck to their lanes, and stuck to the speed limit. unfortunate there have been enough shenanigans and enough places that finally, it's getting to the level of considering restrictions or even outright bans. >> i do see that they do dangerous things sometimes, but i think that comes from the speed. mostly. i think if they just were able to get it to slow down a little bit, it would be better. >> and though this is a case of a few causing problems for safety, bikers prepare for more rules and restrictions. tom vacar ktvu, fox two news.

lion in el dorado county. hundreds of people showed up at a brewery in camino to support the family. the brothers were antler shed hunting last month in a remote wooded area when the mountain lion attacked them. 21 year old talon brooks was killed. his brother wyatt brooks, survived but was seriously hurt. >> the horrible thing that happened, and it's a way that people can do something to help, and they really come out and come together for friends and strangers. >> paid $15 for an afternoon of music, food and drinks. another fundraiser will be held on saturday. >> happy hollow park and zoo in san jose hosted a party for the planet today. children were able

to play lawn games and engage in eco friendly crafts. there were also earth themed face paint designs. this celebration hosted a variety of educational booths to teach children about animals native to california. the park staff say today's event was part of the largest combined earth day celebration in north america. party for the planet is an event through the association of zoos and aquariums, which is the accrediting body for zoos and aquariums in the united states and worldwide. >> so party for the planet runs from earth day through world oceans day, and it's just an opportunity to celebrate our amazing planet and learn about some ways that we can take care of it and some of these green ideas shared with guests today included ways to host your own sustainable party, like swapping out confetti with bubbles, which will simply pop instead of creating litter. >> well, thousands of people flocked to san jose's historic japantown today for the annual nikkei matsuri festival. this festival celebrates japanese american culture through dance, music, art and food. this year,
