fox two. an emotional night in the east bay for the family of mario gonzalez. tonight, the community coming together for a vigil after three alameda officers were charged in his death. >> pain, pain. every single day. you know, missing my son. they're going to pay. i know that. >> mario gonzalez's family struggling to move forward. good evening. i'm cristina rendon, and i'm greg lee. >> gonzalez died in police custody exactly three years ago. tonight. we are hearing from his loved ones after the alameda county district attorney charged three police officers in his death. ktvu jana katsuyama attended tonight's vigil and spoke with mario's mother, gianna. >> well, his mother, edith, said

that she has been waiting for this day ever since her son died three years ago. and tonight they held their annual vigil in the park. she said that she had a message for the three men who are charged. >> the third year my son died right here in this park. >> edith arenales has been coming to this park in alameda since april 2021, marking the death of her son, 26 year old mario gonzalez. >> it's not easy to me to be holding the pain, but on friday, this year's vigil came with new hope for his mother and family. >> alameda county district attorney pamela price announced thursday that her office was charging three law enforcement officers with involuntary manslaughter in connection to gonzalez's death. a relief for his family. >> we always missing him in birthdays, you know, christmas and all the holidays. tomorrow is my birthday. but, this is my present today. >> body camera footage had shown gonzalez when the three police

officers, eric mckinley, cameron leahy and james fisher, detained him. he later died at the hospital. the previous day had declined to file charges, noting gonzalez had meth in his system. an autopsy commissioned by the family blamed restraint, asphyxiation. >> when i first heard the news just yesterday, i felt really i was actually in tears. i think it's important for all families, really to kind of stay united as a front because we're like the voiceless community. >> we really appreciate y'all spending your afternoon with us. >> dozens of people came to friday's vigil dancing, praying and giving support to the family. >> i was surprised, but but also relieved for edith and her family. >> we're a little disappointed that it's, you know, only involuntary manslaughter. and the maximum is four years. but like i said, it's just a little bit of justice for this family. >> i think it's a systemic issue that needs to be dealt with that way. and a few officers are unfortunately not going to solve that problem. >> gonzalez's mother had this message to the three law enforcement officers.

>> i'm not going to say nothing, but then i feel bad for them. i believe in god, and i know, you know, you kill somebody, you for sure, you're going to pay in different ways. so i want to say i forgive them for everything, but a mother, you understand? >> the family did reach a settlement with the city in a civil lawsuit. but they say that the criminal charges are important for their closure. and they say that they are hoping that this does go to trial. >> all right, jana katsuyama, thank you. >> well, ktvu legal analyst michael cardoza pointed out the da's accountability unit, which brought the charges, was formed specifically to reexamine cases of police use of force. >> this is a case that's going to have to be tried. i mean, to bring charges against these officers years later, and they've had all this time to invest gate. and the day before the statute of limitations is going to expire. they file

against these three police officers to have the officers have been placed on leave by alameda pd. >> the third is now a contra costa county sheriff's deputy. if convicted, the three officers could face up to four years in state prison. alameda county sheriff yesenia sanchez says she supports the findings by the department's independent investigation, released in 2022. it found no criminal wrongdoing by the officers, she said in a statement. mr. gonzalez's preexisting medical conditions and the level of toxicity of methamphetamine found in his system during the autopsy contributed to his death as apd officers tried to overcome his resistance. >> new at ten east palo alto police say a man is under arrest in a deadly stabbing. 19 year old ernesto samayoa was already in custody at the san mateo county jail for an unrelated crime. the deadly attack happened on february 8th near university avenue and bell street. two people were stabbed.

one victim survived, the other victim, identified as frank finney, died from his injuries. the suspected motive for the attack was not released. two people have been arrested for the shootout that killed a delivery driver in pleasant hill. 18 year-old joe washington junior and 20 year old money green were arrested in sacramento yesterday. investigators say they shot and killed 63 year-old peter popovich on march 19th during a robbery attempt. they're also charged with the death of trayvon davis, an alleged accomplice, police say, as the suspects tried to rob popovich. the confrontation led to an exchange of gunfire. both davis and popovich were killed. >> a san jose fire captain is no longer employed with the department after federal authorities arrested him in a child sex abuse sting operation. the former fire captain faces three felony charges of trying to arrange sex with a 13 year old girl. >> ktvu south bay reporter mark sayer spoke to the city's mayor about the allegations. >> when you need help in an emergency, every second counts. firefighters are some of the

people you trust the most to help, and they often have access to your home and to your family. so in the city was notified that one of its own had been arrested on charges of soliciting sex from a minor. san jose mayor matt mehan says he was gravely concerned. >> i'm disgusted by the allegations. this individual no longer works for our department. we're working closely with law enforcement agencies to make sure a thorough investigation is done and justice is served, according to a felony criminal complaint filed by the sacramento county district attorney. >> former fire captain spencer parker is facing three felony charges. all involve a 13 year old only identified as jane doe. they include communicating with a minor and sending or soliciting explicit pictures, all with the intent of engaging in sexual acts. in a statement, city manager jennifer maguire said on monday, april 1st, 2024, the san jose fire department was notified of the arrest of an employee, a fire captain, who was charged on april 3rd with

serious crimes. this individual is no longer employed by the city. the arrest occurred in sacramento county. i'm just completely disgusted by these allegations and it's really important to me that that we get the truth and that justice is served. and this is only the most recent incident involving san jose fire in october of 2022, a video posted on social media showed a bikini clad woman exiting a san jose fire truck, which was parked in front of an adult entertainment business at the time. a nearby business owner told us he simply could not believe it and she had no clothes on. >> i mean, what she did, i mean, and what she doing inside the fire truck? >> in june of last year, the city council received the results of that investigation, which said only that numerous city and fire department policies were violated and that a fire captain was demoted as a result. >> these kinds of incidents are, unfair. frankly to the rest of the public servants at city hall within our fire service and

other departments who wake up every day and want to serve our community and work hard to do so . >> we did reach spencer parker's sacramento based attorney on the phone. he said neither he nor his client would have any comment on this case. reporting in san jose. i'm mark sayer, ktvu, fox two news happening now in the north bay, all westbound lanes of highway 37 between vallejo and sears point are closed again. >> here's a live look. you can see the crews have already moved into place to begin that work. crews shut down this stretch of the highway a little over an hour ago. ago. crews are getting to work on a major repaving project. this portion of westbound highway 37 is scheduled to remain closed until 4:00 monday morning. the same stretch will close again next weekend. the eastbound direction will be closed. the first and second weekends of may. >> new at ten students from two high schools invited well-known bay area political activist angela davis to speak about her decades of experience fighting

against racism and other causes. the students say they wanted to hear directly from her. ktvu amberleigh joining us live in alameda tonight after attending that event and speaking with davis and the students, amber. >> christina. the event was held here at alameda high school. the students tell me they learned about angela davis during their study of african american history. davis says the challenges she faced shaped her life's work as an activist and educator. >> i'm so happy to be here at alameda high school. >> angela davis, a longtime political activist and professor, took the stage at alameda high school to speak with a panel of high school students. she drew an audience of 1800. i spoke with her just before the event started. >> as a long time oaklander, it's really important for me to do work in the community, and that work includes engaging with members of the black student unions of alameda high and castro valley high, who

organized this event. >> you inspire us to, like, become our own person, davis says the work that she's been doing for the last 50 years was sparked by her time in jail. >> in 1970. guns belonging to davis were used in an armed takeover of a courtroom in marin county in which four people were killed. she was prosecuted for three felonies, including conspiracy to murder. she faced the possibility of the death penalty three times. she was held in jail for over a year before being acquitted of all charges. i don't think i would be who i am today had i not spent that time with other people in prison. students say they admire her strength and resiliency in the face of adversity, especially when she was going to prison. >> when she was facing the whole legal system. she stood up. she stood on what she believed in the specific experience of the black woman. >> i think that's, a perspective that the light isn't really shined on all the time. you know, we talk about women's

issues and we talk about black issues, but we don't really talk about how those align. >> among the many topics davis addressed was her passion for the abolition of prisons, a cause she hopes future generations will continue the work repressive and racist structures of jails, prisons and police. >> and so i certainly hope that we are able to engage those issues. how do we create hope? >> davis tells me young people are always at the forefront for a better future. she says she loves their enthusiasm and sense of urgency. her message to them it's okay to make mistakes. christina. >> amber, did you talk with the students and ask them why they decided to pick angela davis out of all of the candidates they could have chosen for them to hear from? speak tonight i did. >> a student organizer tells me she saw a documentary about davis, and she was impressed by davis's unapologetic stance in

>> it's a bummer. >> i'm sad that they're closing down the library that is temporarily panama, one of the younger patrons of the main branch of the oakland public library. i hope that they make it better. >> that's the plan. at least starting may 27th, the downtown library shutting its doors until at least november for a, quote, critical repairs. >> it's great that they're doing renovations, but six months doordash edmond, who regularly uses the library with her son, not alone in wondering why so long staff say that's the time needed to complete all the work, including a new roof, boiler system and upgrades to the building's electrical heating and cooling systems. >> my thought is necessary. i think that this is an older and authentic library. i've been coming here since i'm 60. i've been coming here since i was like four, and it's about time we did some renovations. >> brian compton also looking forward to some more obvious esthetic improvements in store for the library. new lighting, flooring and ceilings. he just

like to see one more area get a little tlc. >> the restrooms aren't horrible conditions. >> well, the work is underway. patrons will have to head to other branches. >> it's going to be hard. >> my son likes to come here all the time. it's peaceful, relaxing, you know? it's a very good resource for those who are doing studies and doing work projects. >> the library is fun to look at, new books and things that i haven't seen before. >> among the many reasons this library will be sorely missed over the next few months, but perhaps we all just need to look at the project the way panama is . >> sometimes it helps just to close things out for a little bit, just to like help it grow and make it better than it was before. >> yeah, a wise young girl there, the library planning to fund the project through a variety of sources, including a $4.2 million grant from the state. if all goes well again, the library should be back open by sometime in november. in the meantime, staff say other branch libraries will be operational,

including the asian library. that's around a half mile away. greg. >> yeah, looking forward to the final product there once it's finished. zac sos live in our newsroom. zach. thank you. the red cross is partnering with the oakland fire department to install free smoke alarms as part of the annual sound the alarm event. the program started ten years ago and is now held in cities across the country. the oakland neighborhood around partridge avenue, which was the site of a deadly house fire last december, was chosen for the giveaway this year. that fire killed local artist and activist hilda robinson. the free alarm program is funded through donations from partners such as state farm, fema, and pg and e. >> the california service corps is looking for new bay area recruits. state chief service officer josh friday was in san jose today with mayor matt mehan to announce the recruitment drive. they say there are nearly 2000 paid service corps positions available right here in the bay area, including tutors and mentors for school students helping support communities affected by disasters, working with programs

be the warmest of the weekend days. some patchy morning fog, but mostly sunny skies into the afternoon. satellite tonight is picking up with that low cloud deck near the coast and already pushing back into the bay this evening. the wider view out here in the pacific you can see a storm system, but no rainfall for us just yet. this will keep our temperatures somewhat to down in the forecast for tomorrow, but then a little bit of a rebound as we talked about in your weekend outlook and your sunday outlook, i should say here is our live camera looking out toward the golden gate bridge. some cloud cover out there. current numbers have cooled off into the 50s, except san jose right now checking in 60 degrees. the clouds tomorrow morning. maybe some drizzle, especially right near the immediate shoreline. and here's your forecast models picking up on the clouds tomorrow morning, and then skies becoming partly sunny into the afternoon. hours temperatures the range from around 60 to 77 degrees for your saturday afternoon. there will be a bit of a breeze out there as well. winds will be around 20 to 25 miles an hour. we'll talk more about that warmer sunday forecast coming up in just a

little bit. >> all right mark thank you tesla is recalling nearly 4000 of its cyber trucks to fix a potentially dangerous issue with the accelerator pedals. federal safety regulators announced the recall is for cyber trucks with manufacture dates back to november. the defect can result in the pedal pad dislodging and getting stuck when high force is applied to the pedal. tesla says the brakes will still function if this happens. when driver shared how the issue affected him on social media, the cybertruck owners post went viral after illustrating how his pedal gets stuck in the vehicle starts to accelerate on its own. >> the oakland a's have reportedly asked a nevada court to allow them to intervene in a lawsuit filed over public funding of a new ballpark last year, the state approved funding of up to $380 million for construction of a ballpark on the las vegas strip, a political action group formed by nevada school teachers then filed suit saying the bill is unconstitutional. while the la times reports the a's told the court without intervention, their ability to protect their

interests could be impaired under the bill, the funding authorization could expire just over a year from now. if the team is not executed, a development and a lease agreement coming up. >> several bay area cities are being recognized by governor newsom for their housing efforts , plus controversy surrounding a senior living facility in the east bay. >> the potentially dangerous living conditions we're learning about from residents. >> plus, the u.s. supreme court will soon hear arguments on a case that could impact cities across the bay area. the homelessness issue at the center of the debate.

funding, incentives and more resources to help speed up housing production. >> a senior living facility in east oakland is under fire as residents complain of bad living conditions. >> in one case this week, firefighters had to carry a patient down six flights of stairs because the elevators were shut down for safety issues. ktvu crystal bailey digs into the concerns and has more. >> 1428 105th avenue in east oakland is a six floor apartment building housing elderly folks with mobility issues who use walkers and wheelchairs. residents complaining about multiple issues after elevators were out all week. >> i had to ask my son to go pick up my medicine because the elevators were out. >> the oakland fire department put the building on fire. watch on wednesday, citing fire hazards and noncompliance, requiring 24 over seven monitoring. the leasing office door tagged with notices. afd says a small fire on april 4th caused the sprinklers to go off, flooding the building. two weeks later, the water damage left the

ceilings exposed. >> the damage was so bad it went to the fourth floor and to the third floor. >> earlier this week, state inspectors shut down the elevators due to safety concerns after residents say a woman got stuck inside. >> she was stuck in there over an hour. >> they did not notify any of the residents. >> cal osha tells us all three elevators were overdue for required safety testing, even after cal osha had granted a two week extension. >> this fire drill the alarm, it goes off constantly. >> we get a lot of that during the middle of the night, and people come out of their buildings, out of their apartments, stand on the streets until the fire department comes. and then there's a it's a false alarm. >> early wednesday morning, oakland firefighters responded to a medical emergency at the building, and when they got there, the elevators were not working. crews were forced to carry the disabled patient down six flights of stairs. a spokesperson with offd told us in a statement our concern is

wide ranging. these fire code violations are extremely serious, and we hope that the building managers understand the urgency of correcting the deficiencies as soon as possible. residents saying they just want management to do the right thing. >> that's all we wanted somebody to hear us. >> now, i went into the leasing office and tried to speak with someone in person. i had to leave my card and i also reached out to the property management company con am for comment, and i have not heard back yet. crystal bailey ktvu, fox two news. >> on monday, the us supreme court will hear arguments in a case on homelessness that has implications in the bay area and across the country. the town of grants pass, oregon, is asking the court to overturn a ruling that found issuing citations to homeless people for sleeping outdoors. if there are not enough shelter beds available, violates the constitution's ban on cruel and unusual punishment. a lawsuit over homeless sweeps in san francisco is now on hold pending the decision in the

the natanz nuclear facility. a plant used to enrich uranium, according to fox news sources. the apparent retaliation to an iranian attack against israel over the weekend was meant to send a message to iran that israel can reach out and touch close to nuclear facilities. reports indicate an airbase was hit with israeli missiles. iranian military leadership claimed, without evidence, that explosions heard in the area were caused by successful air defense interceptions, as american and israeli officials had very limited reaction to the strikes overnight. but secretary of state antony blinken reiterated that the united states stands behind its key middle east partner. >> we're also committed to de-escalating, to trying to bring, this tension to a to a close. >> the united nations nuclear watchdog says there was no damage to iran's nuclear sites. late tonight, the senate voted to reauthorize a key surveillance authority, saying

that lawmakers voted 60 to 34 to reauthorize section 702 of the foreign intelligence surveillance act. this is. congress is gearing up for a very busy weekend. yeah. >> lawmakers trying to pass several important bills. one fund to allies overseas, including israel and ukraine. the other is intended to protect the us from foreign threats. fox's connor hansen has the details. >> an extension to the foreign intelligence surveillance act was put in the hands of the us senate before an end of the week deadline. lawmakers debated potential changes to the law. >> we're still trying to see if there's a path to getting this bill done quickly, but disagreements remain on how to proceed. >> minority leader mitch mcconnell, giving a grim warning about letting the law lapse. >> we could pass the house's reform bill, or, given the late hour and political reality, we can essentially doom the program to go dark, pass the house reform bill, or give free reign

>> the house is set to vote on a new border security bill tomorrow, but democrats say it will never pass the bill, calling for border wall construction to resume is nearly identical to a bill republicans tried to pass last year. >> i rise today in opposition to this foolhardy attempt to pass for a second time, one of the most draconian immigration bills this congress has ever seen. this rehashing of h.r. two is a joke. >> some republicans in the house are venting frustration with house speaker mike johnson for pushing a border security bill on its own. they wanted border security addressed in another bill providing wartime aid to israel and ukraine at least three republicans, including arizona congressman paul gosar, think handling border security legislation this way is reason enough to oust speaker johnson from his leadership role. >> i'm concerned that the speaker's cut a deal with the democrats to fund foreign wars, rather than to secure our border. >> i'm going to do my job. i'm

not deterred by threats and we're going to do the right thing and let the chips fall where they may. so far, no formal action has been taken to remove speaker johnson from leadership. >> votes on the wartime aid bill and border security bill are set for tomorrow. >> former president donald trump is expected to hit the campaign trail this weekend, but will have to be back in new york monday for opening arguments in the first ever criminal trial of a former president. today, jury selection wrapped up in his hush money trial. 12 jurors and six alternates have been chosen to decide whether or not former president trump broke the law and falsified business records. trump spoke to reporters outside the courtroom today and complained about his gag order preventing him from speaking about certain people involved in the case. >> gag order has to come off. i should be allowed to speak every time i come out to speak to you. i want to be open because we did absolutely nothing wrong. >> mr. trump has pleaded not guilty to 34 felony counts of falsifying business records. opening arguments again expected to begin on monday. authorities

say a man deliberately set himself on fire outside the manhattan criminal court, not far from where former president trump's trial is taking place. the man is identified as 37 year old max azarello of florida. officials say he is in critical condition in a burn center. police say he tossed out a number of pamphlets, which reportedly contain anti-government conspiracy theories, before pouring a fluid over his head and igniting it. >> he's on fire. another area in the park where some of the accelerants spilled is also on fire. civilians caught officers. members of the police department . they run into the park. they make efforts to put him out. they use their coats. they use fire extinguishers. >> police say the man did not breach any checkpoints, but they will review their security protocols in light of this incident. >> coming up at 11, san francisco mayor london breed pushing for more flights between the city and china. but there is

group, the service employees international union, required members of the fast food industry to sign ndas in the final negotiations of the state's fast food labor law. we need to eliminate the use of ndas when it comes to the legislative process. >> the public deserves transparency when bills are being drafted, you know, legislators and the public need to know how those provisions were drafted, what was behind it , who's asking for it? >> the california chamber of commerce immediately voiced its opposition to the bill in a statement, saying in part, quote , oftentimes the negotiation process involves disclosure of confidential financial information or company trade secrets in order to develop sound public policy. ndas are necessary to ensure companies can remain at the table without fear that their financial position, intellectual capital, or other proprietary information will become public. >> a sacramento superior court, weighing in today on a dispute over a ballot measure that notifies parents if their child asks to change their gender
