pretty good fog surge has been made by a system moving into the south, so shades of cool today for everyone in. after a brief little warm up for a couple of days, but that's a big fog bank once it retreats back. sunny and breezy and cooler. 50s, 60s to a few mid 70s. all right. frank is here at 7:00 on a friday and it's not friday light or is it? >> you know, it's getting better. you could have gone with a touch of gray to just throwing that out there. you grateful dead fans? okay well, good morning everyone. the bay bridge should be friday light, but we do have an accident on the san francisco side. let's take a look at our maps here. heavy volume across the span, both on the oakland and the san francisco side. due to that accident. 101 southbound. just as you leave the bridge into the city. so a slow roll across the bridge and let's take a look at those highways that are feeding the bridge. there's the bay shore, e shore freeway and berkeley emeryville, and that traffic is pretty moderate. and once you get past that and you head to the toll plaza, that is

fabulous. but you will hit those metering lights. and as you saw earlier, it is a slow ride over that bay bridge on a friday time now. 701 let's get it back to day, okay? >> frank. thank you. well, the biden administration refusing to answer questions about reports that israel retaliated against iran. secretary of state antony blinken was in italy at the g7 summit when reporters asked him about a drone strike in iran. ktvu james torres in our newsroom now to tell us about how blinken responded. and just to break down this newest conflict in the middle east. good morning, james. >> dave, good morning to you. well international reports saying israel carried out drone attacks in an area and iran home to military bases and even some nuclear programs. in comments, some israeli leaders alluded to an attack but still have not directly taken responsibility for it. iranian state media reports its military defended itself against airstrikes. those strikes, according to officials,

didn't do much damage in fact, the head of the international atomic energy agency, which oversees nuclear activity all around the world, confirms there is no damage to any nuclear sites in iran. it's believed this is a result of an attack on israel last weekend, where iran carried out more than 300 drone strikes. israel's defense forces say they didn't do much damage either because it intercepted most of those missiles. the u.s. immediately condemned the attack on israel last weekend, but secretary of state antony blinken would not offer any comments on this latest reported attack on iran. >> i'm not going to speak to that except to say that the united states has not been involved in any offensive operations. what we're focused on, what the g7 is focused on. and again, it's reflected in our statement and in our conversation is our work to de-escalate tensions. >> blinken spoke from the g7 summit in italy. he says countries involved have been speaking about de-escalation for all conflicts, including in gaza

and the war in ukraine. blinken did also mention more sanctions were coming to iran, specifically to its uav programs, its steel industry, as well as its ministry of defense. president biden expected to speak from the white house later today on the topic of union workers. we'll have to wait and see if he'll have something to say on israel and iran. reporting live from the newsroom. i'm james torres, ktvu , fox two news. >> james, thank you. the fbi is on high alert for potential threats against the american jewish community just before the start of passover on monday, the fbi director, christopher wray, says the agency is concerned that lone actors could target large gatherings. high profile events or symbolic or religious locations raised, cautioning that the recent hostilities between israel and iran could spill outside the middle east with attacks from other countries or in the united states. the fbi reports three times more anti-jewish hate crime investigations since the start of the war between israel and hamas, the us vetoed a

united nations security council resolution to accept palestine as a full member of the un. us says the veto doesn't mean the us is against a palestinian state, but that it should be a result of direct negotiations between israel and the palestinians. palestinian leaders condemned the us veto, saying it will encourage israel to continue its war in gaza. >> now, for all the latest developments about the conflict in the middle east and the protests that have followed, you can always go to our website, ktvu dot com. time is 705. more details this morning from oakland about the incident on wednesday, where oakland police shot and killed a murder suspect from sacramento. ktvu now confirming he was 33 year old domonique broat. he was wanted for the shooting last month of his girlfriend as police were conducting a welfare check on her on wednesday, sacramento detectives tracked brought to west oakland, and they asked oakland police to help capture him. >> the door suddenly opened. he

came out with a gun, raised it and pointed it, and the shooting occurred. i think in this case, there is no question that this suspect posed an imminent threat of death or serious injury. when the officers fired. >> this was the first deadly shooting by oakland police since november, according to authorities. that's when a police internal affairs sergeant shot and killed a man who pointed a gun at him near oakland city hall. >> safety improvements could be coming to one san francisco neighborhood following the deaths of a couple and their two young children at a bus stop last month. ktvu andre senior here in studio with the changes, the city is now considering. andre. >> well, garcia, we can tell you this morning that that deadly crash in san francisco's west portal neighborhood that took place on march 16th, just more than a month ago, was prompting changes here. now, police say a 78 year-old woman crashed her suv into a bus stop right near the west portal muni station, killing a couple and their two kids. we told you about that

when it happened, investigators have not identified yet what caused the deadly crash, and prosecutors are still debating whether to file criminal charges against the driver. but city leaders are telling san francisco's transit agency that there needs to be major safety improvements in the west portal neighborhood. >> mayor london breed and to district seven supervisor mariano melgar, who have asked the sfmta to work immediately to improve traffic safety near west portal station. >> the plans call for banning all left turns on busy west portal avenue and there would be several other new traffic restrictions on the streets surrounding the bus stop where the family was killed. but some people who live and work in the neighborhood have some concerns about the safety plan. they question whether these changes will prevent a similar tragedy in the future. >> i was shocked because it i don't think it solves the problem of what happened to that poor family. it's just going to increase traffic all up and down west portal.

>> one incident should not be a one that makes so many changes at the same time, so the department will be considering the changes that will be coming up soon. >> we'll keep you posted on what will happen next in this neighborhood after that very tragic accident. garcia will send it back over to you, senior. >> thank you. as expected, san francisco is suing oakland airport for its plan to change its airport name to san francisco bay international airport. the lawsuit seeks an injunction against oakland and travel related services, such as airlines and rental car companies, from using the proposed new name in marketing or advertising. one trademark law attorney says this case is about protecting consumers from confusion. >> our time is all we really have to compare are the names, and they tend to give the first two words a lot of weight because that's the first thing that the person hears, that a consumer sees on their screen when they're ordering their lyft or when they're booking the flight. and so the fact that the two first two words are really

similar, it's going to really lend itself to a finding of confusion. >> the lawsuit accuses oakland of trying to capitalize on sfo's reputation and pull in travelers who weren't intending to fly to the east bay. oakland mayor shengtao did not respond directly to the lawsuit, but the discussed and the discussed but discussed the proposed name change. sorry, she explained the rebrand could offer a number of benefits, saying notably, it could support the airport's efforts to secure more direct flights to additional destinations, enhancing convenience for travelers and potentially boosting tourism in oakland. >> okay, gasia time is 708. there will be a huge traffic disruption in the north bay starting tonight. part of highway 37 between vallejo and sears point will be closed for repaving work. that will send a lot of traffic to the richmond-san rafael bridge. it all starts at 9 p.m. tonight and westbound highway 37 will close between vallejo and sears point. it's scheduled to stay closed until 4 a.m. monday morning. now, to get around that road closure, many drivers will

probably head over to the richmond-san rafael bridge. however, caltrans also recommends going north on highway 29 and west on highway 12, and then south on highway 121. >> all righty, dave, so if you are going wine tasting this weekend, do take note because that could get clogged up pretty quickly. we're going to take a look at south bay on your morning commute. it has just been fabulous down there. a lot of green on the screen. they get a friday light, a plus one little accident there. that's highway 87 in san jose, but pretty much incident free and traffic flowing pretty well except for one on one. you got one little slow spot there. let's head north, take you up to the san mateo bridge. people getting out of the east bay, heading over to the peninsula. and that is pretty heavy volume at 710 on a friday. but it is moving along. and if you head a little further north from there, highway 880 in oakland, traffic moving into oakland at a pretty

is will soon be welcomed back to the san francisco zoo. mayor london breed announced it during her trip to china. ktvu bailey o'carroll's in san francisco. now you have more details. good morning bailey. >> dave, the pandas are getting set to make their return. very exciting news. one quick look at social media this morning and you will see just how excited san franciscans are that the giant pandas are returning the last time they were in the city was back in 1985. they called the san francisco zoo home for just about three months. while those pandas were on a bit of a world tour, making stops at zoos all across the country. and they drew more than 260,000 viewers to the san francisco zoo. of course, zoo officials, hoping that that number only goes up when they're here. this time around, san francisco mayor

london breed made the announcement on social media last night, when she was on a week long trip to china. this that in an effort to bring more business and tourism to the city , mayor breed called the process of getting the pandas to san francisco a collaborative one that required months of advocacy and coordination. the idea was actually originally floated at the apec apex apec excuse me summit back in november, which did take place in san francisco. >> we have some cute cuddle, early black and white beauties coming to our city. ladies and gentlemen, welcome pandas to san francisco. >> for engineers from the beijing zoo were at the san francisco zoo meeting with officials there to look at potential enclosures and discuss where the bears will exactly call home within the zoo. it's likely that their new home will not be ready until 2025, after san francisco could renovate

their existing facility. abc news reporting that it will cost about $25 million for those renovations now typically, pandas are on lease for about $1 million annually for two bears. that money does go towards conservation efforts. also, abc news reporting that the zoo will start major fundraising efforts to help pay for that new enclosure. updated enclosure now, the only pandas in the u.s. right now are actually at the atlanta zoo. no word yet on when exactly the pandas will arrive, or just how many of them will make the trek from china here to san francisco. reporting live. i'm bailey o'carroll, ktvu, fox two news. >> thank you. bailey. state lawmakers could soon make it easier for renters to find an apartment that will accept pets. assembly bill 2216 would prevent property owners from imposing a blanket no pet policy. landlords also could not charge extra fees for pets. the director of oakland's animal services says the number of people giving up

their pets soared ever since the city lifted its covid eviction moratorium last summer. the shelter now averages about $350 a month, more than 100 over its 2022 numbers. >> we've seen a doubling of the number of people that are surrendering their pets, and that's largely due to the housing crisis. >> i allow pets, because a single family, right? you got the backyard, etc. but i will tell you, the dogs have destroyed the place, they've chewed up holes in the side of the wall. they've chewed up all of the drip system. so it's going to be pretty expensive to return that unit back. >> another bill would mean that landlords can only ban pets for public health or animal control concerns, among other justifications. >> all right. our time is 717 city leaders in redwood city are thinking about permanently closing off parts of broadway to cars during the pandemic. the city closed part of the road to cars, an idea that became pretty popular. but a vote to make that stretch of broadway a permanent pedestrian mall has been pushed

back to may. the city council decided to delay it to hear more questions and get comments from the public. now, that change turned out to be an economic boom for downtown businesses. if the permanent change is approved, the city will present a new design for that area this coming summer. fans of taylor swift got a huge surprise overnight. >> the pop singer dropped two new albums, all my morning on monday, starting on and swift's new album the tortured poet's department, came out at midnight eastern, as expected. then two hours later, the singer announced she is releasing a full second album with 15 more songs. at the same time, there's potential for this to be my favorite album ever because we've just seen this growth in her. >> after her six year relationship, and i'm so excited for her and her scorn is our magic. >> this is swift's 11th studio album, features special guest appearances from post malone, florence and the machine. it also comes in the wake of her

there are 11 confirmed cases of the virus. it was found between march 31st and april 1st in people who ate the oysters. the county officials are still trying to learn more about these imports and frozen oysters. >> we don't know the extent to which these oysters have been distributed. we're still working with the california department of public health and the fda to understand the where. this has all been distributed. >> now, this outbreak comes just four months after raw oysters imported from outside the country were linked to 41 confirmed norovirus cases in san diego county. >> prince harry, the son of king charles the third, is formally confirmed. he is now a us resident. it's been four years since harry and his wife, meghan, walked away from the royal duties and moved to a villa in southern california. since moving, harry criticized the royal family in his autobiography and netflix series . the formal acknowledgment further separates harry from his royal duties, as an oakland volunteer based group is taking

you might want to kick, sir. all right steve happy friday everybody. apparently the bay bridge did not get the friday light memo because it's a bit of a mess right now. one accident is the culprit. as we take a look that southbound 101, it was just cleared as soon as you get off the bridge. and of course, that's pushing back traffic all the way across the span. all the way onto the oakland side. but the toll plaza actually looks fabulous. if these people only knew once they get past the metering lights, it will be a bumper to bumper drive to get into the city. but now that that is clear, hopefully the bridge will clear up here on this friday. that's traffic 730 your time. let's get it back to garcia. >> thank you frank. bart's now required to do a better job of keeping its station elevators from breaking down. this comes after the transit agency agreed to settle a class action lawsuit from riders with disabilities. katie rasmus is live at the walnut creek bart station to explain for us the changes bart is going to have to make here. ali >> well, garcia, some of those changes include repairing

station elevators that are down more quickly as well as upgrading all 87 station elevators in the bart system throughout the region. this is one of them. here behind us. we're at the walnut creek bart station now imagine if a station elevator is broken. there is no way for someone in a wheelchair to get up to the platform and take bart. and that was the basis of a class action lawsuit brought by several bay area groups representing people with disabilities and mobility challenges. that lawsuit was filed back in 2017. it claimed that bart was violating the americans with disabilities act by failing to properly maintain its elevators and escalators. now, under the settlement agreement reached and announced in federal court yesterday after seven years, bart is now required to dispatch a repair person within an hour. if an elevator or escalator at one of its stations breaks down and it has to come up with a strategic plan to renovate and update all of its escalators and elevators in the next decade. now we rode the station elevator here at

walnut creek with one bart rider who reminded us that you don't have to be in a wheelchair to benefit from this agreement. she gave us her thoughts as she was taking the elevator with us up to the platform. >> it is very dirty and it needs to be sanitized. it's small. this is what the smell is not good at all. i do think it's very important. there is a lot of elevators that are out of use sometimes. usually in the morning when i'm going to bart, i can hear it say, oh, this elevator is out of use. and it's like, even sometimes for me, i'm like, great. so, you know, i think this is amazing. and i think they need to do it quicker and faster. >> bart spokesperson this morning sent us a statement in response to the settlement. it says, quote, that bart is working with advocates to advance a series of improvements to elevators, escalators, training and other things like accessible path signage. we will continue to work to make bart as accessible as possible for all

our riders. end quote. now, as part of the settlement, bart did not accept any wrongdoing, but it does have to pay the $825,000 in attorneys fees to the groups that brought this lawsuit. but according to the settlement, in the terms of this agreement that was unveiled yesterday, bart does have a little bit of time to make that system wide upgrade to all of its elevators. the lawsuit says that they have about 15 years to make some of those improvements live in walnut creek. ali rasmus ktvu, fox two news. >> okay, ali thank you. time now. 733. well, tonight, the family of mario gonzales will hold a vigil marking exactly three years since he died. >> this follows last night's announcement by the alameda county district attorney's office that it will file involuntary manslaughter charges against the three alameda police officers involved in his in-custody death. now, the coroner's office had ruled gonzales death in 2021 was the result of a combination of methamphetamine and the stress of being restrained by police, former da nancy o'malley cleared

the officers of any wrongdoing last night. the current district attorney, pamela price, reversed the decision following a new investigation. >> if people don't believe that police officers or law enforcement can be held accountable, then witnesses won't cooperate. we can't do our job without witnesses. we won't be able to administer justice if the community doesn't trust that the system is going to work for everyone. >> the attorney representing gonzales mother tells ktvu the family is grateful the da's office decided to revisit the case. >> the family is elated to know that mario's death was not in vain, and that the people who needlessly caused him to die, to not be able to hug his child, to never to be able to say hello to his mother. those three officers are being held accountable, and it's long overdue. >> the three officers are james fisher, eric mckinley and cameron leahy. they could face up to four years in state prison

if convicted. the attorney for officer leahy has released a statement saying, quote, there is no new evidence. this is a blatantly political prosecution. the officer's actions while taking mr. gonzales into custody were reasonable and necessary and lawful, and his tragic death was the result of drug toxicity, not criminal misconduct. >> our time is 735 the woman driver who hit and killed a four year-old girl near oracle park last summer will not be going to jail now. the crash happened back in august at fourth and king street. police say a little girl was in a stroller when she and her father were hit in the middle of the crosswalk. the 71 year-old driver was charged with vehicular manslaughter, but after officials met with the victim's family, that driver will serve two years of probation and 400 hours of community service. she also cannot drive again until she completes a driver safety class. >> some female inmates are being released early as part of a plan to close the women's prison in

dublin. the federal bureau of prisons announced the closure of fci dublin on monday, where eight officers have been charged with sex crimes. attorneys tell ktvu some of their clients who had a short time left on their sentences, are either being released early for good behavior or put on house arrest, sources tell ktvu. all women there will be relocated by this weekend. >> time now. 736 in november, californians may have a chance to vote on a measure mandating more jail time for crimes like smash-and-grab, robberies and drug offenses. a group called californians for safer communities announced it submitted 900,000 signatures to get the measure, called homeless drug addiction and theft reduction act, on the ballot. it would essentially roll back parts of prop 47, which was approved in 2014, and reduced punishments for some property and drug crimes. >> our businesses are being attacked every single day, and many of them are being forced to be closed. our employees are

getting hurt and some are being killed. and guess what? when all these businesses are being closed, many of our employees are losing their jobs and it's actually hurting every one of us . >> the measure needs 550,000 verified voter signatures in order to get on the november ballot. >> happening today new protections for renters go into effect in concord. the new laws were approved by the concord city council back in february. the just cause for eviction has several new rules for landlords, including one that requires them to pay thousands of dollars in relocation assistance for no fault evictions. a group of community members had tried to get the issue on the ballot, but didn't gather enough signatures in the north bay. san rafael is working to stop a surge of evictions in one part of that city. >> we've seen many buildings being sold to, you know, other investors that are just looking for an investment opportunity that will become, you know, an opportunity for displacement for our community. >> the city council this week heard from those supporting a

in use in new york city in donald trump's criminal trial. 12 jurors have now been seated, seven men, five women. today's jury selection continues to pick alternates. now, one excuse juror in the case says she was shocked to find out which case they were being considered for. >> everybody was shocked when we saw him on tuesday for the first time. you know, we couldn't believe that that was the case. so we were shocked and frozen. >> prosecutors could start presenting their case early next week. time at 755. three suspects now behind bars, accused of kidnaping and torturing a man in san jose earlier this year. investigators say the victim was kidnaped back on february 13th, then was held against his will inside a house in the foothills of east san jose. police say the three suspects tortured and assaulted the victim several times before finally letting him go.

you'll go all the way to the metering lights and then crawl across that bridge. good. 2020 five minutes to get across. let's zoom in because we have an issue. northbound 101 at debow's chevy into ford collided, blocking at least one lane there. so the northbound commute beginning to stack up as well into the city toll plaza. as i mentioned, it's a bit of an illusion you're going to go through there, but once you get past the metering lights, you're going to bump into some traffic and then kind of crawl into san francisco for a good 15 or 20 minutes. let's look at traffic time now. 801 let's get it back to andre heartbreak. >> thank you. the biden administration is refusing to answer questions today on reports that israel retaliated against iran. secretary of state antony blinken was asked about a drone strike while attending the g7 summit in italy. ktvu james torres is in studio with blinken's response and a breakdown of the newest conflict in the middle east. james. >> andre. the international reports are saying israel carried out drone attacks in an

area and iran home to military bases and even nuclear programs. but in some comments, some israeli leaders alluded to an attack but never really directly said if that's something that's happened. iranian state media reporting its military defended itself against airstrikes. those strikes, according to those officials, didn't really do much damage. in fact, the head of the international atomic energy agency, which oversees nuclear activity around the world, they confirm there was no damage to any nuclear sites in iran. it's believed this is the result of an attack on israel last weekend, where iran carried out more than 300 drone strikes. israel's defense forces say that didn't do much damage either, because it intercepted most of those missiles. the u.s. immediately condemned the attack on israel from last weekend, but secretary of state antony blinken would not offer any comments on this latest reported attack on iran. one political expert we spoke to this morning suggests these so-called strikes are just a show teeth, rather than actually cause any damage.

>> good morning. yeah, it's been quite a while since the last time giant pandas called san francisco home. that was actually back in 1985. they were here briefly, just for about three months, but it did draw a heck of a lot of people to the san francisco zoo here about more than 260,000 visitors came out to see those pandas decades ago. of course, the zoo and san francisco officials hoping that the draw even more people this time around. now, san francisco mayor london breed made the announcement just last night on her social media accounts while she is on a week long trip to china in an effort to bring more business and tourism to the city, mayor breed called the process of getting the pandas here a collaborative one that required months of advocacy and coordination. the idea was actually originally floated around during the apec summit, which took place here in san francisco in november. >> we have some cute, cuddly black and white beauties coming to our city. ladies and gentlemen, welcome pandas to san

francisco. >> so the prep for housing those pandas has already started. engineers with the beijing zoo were here at the san francisco zoo, meeting with officials to look at potential enclosures, discuss where exactly the bears will call home inside the zoo. and it's likely, though, that their new home here won't be ready until 2025, after san francisco can renovate its existing facility. now, typically, pandas are on lease for about $1 million annually for two bears. right now, though, the only zoo in the u.s. that has giant pandas is all the way in atlanta. so this will be a kind of a new thing for the west coast here in san francisco. again, the last time this happened was back in the 80s, but we do not know exactly when the pandas will get here or how many will be sent from china here to san francisco. reporting live. i'm bailey o'carroll, ktvu, fox two news.

>> bailey, thank you. there's a new development involving a teacher accused of sexually assaulting a student in san jose. more than 20 years ago. the woman, whose allegations led to the arrest of lee high school teacher shawn thomas, has now filed a lawsuit, and it claims thomas forced her to terminate a pregnancy that resulted from their relationship when she was still a teenager. so far, thomas's attorney has not commented on this lawsuit. >> the popular activity of line dancing is causing a rift in san francisco's chinatown. a local troupe founded more than a decade ago, performs throughout the year throughout the city. every year since the pandemic, the group has been closing off a section of grand avenue for rehearsals and a free performance on weekends. the chronicle reports that four chinatown merchants, though, have complained to the city that the noise from those pop up shows is driving away customers. the city says it will allow the dancers to perform on grand avenue every weekend through next march. state lawmakers could soon make it easier for renters to find an apartment that accepts pets. assembly bill 2216 would prevent property owners from imposing a blanket no pets policy. landlords could

also not charge extra fees for pets. the director of animal services in oakland says the number of people giving up their pets soared ever since the city lifted its covid eviction moratorium last summer. the shelter now averages about 350 dogs a month, 100 or so more than in 2022. we've seen a doubling of the number of people that are surrendering their pets, and that's largely due to the housing crisis. >> i allow pets, because a single family, right? you got the backyard, etc. but i will tell you, the dogs have destroyed the place, they've chewed up holes in the side of the wall. they've chewed up all of the drip system. so it's going to be pretty expensive to return that unit back. >> another bill would mean that landlords can only ban pets for public health or animal control. concerns among other justifications. >> 817 redwood city leaders are considering closing parts of broadway to cars permanently during the pandemic. the city closed a section of the road to cars, which ended up being popular, but a vote to make the stretch of broadway a permanent pedestrian mall has been pushed

back to may. city council decided to push it back to hear more questions and comments from the public. the change is said to have proved to be a boon for downtown businesses. if the permanent change is approved, the city will present a new design for the area this summer, happening today in the north bay, part of highway 37 between vallejo and sears point will be closed starting tonight for a repaving project, one that will send more traffic to the richmond-san rafael bridge starting at 9:00 tonight. >> westbound 37 will close between vallejo and sears point. it is set to stay closed until 4:00 monday morning. many people will likely head over to the richmond-san rafael bridge to get around the road closure. caltrans is also recommending going north on highway 29, west on highway 12, then south on 121. >> all right. the researchers are testing an electric device that could make detecting spoiled wine easier. recent tests show the device can identify signs of microbes organisms in white wine within a week of initial contamination. that's four weeks earlier than the average person, and previous tests showed similar results with red wine to the creators of

in oakland. highway 980 eastbound, which, if you know, 980, it's a very short highway. according to chp, a motorist passed out in their car. chp is on hand. it does require a tow truck car, by the way, blocking two lanes. no word on the driver's condition, but they do have a tow truck there to try to take care of that. let's widen out where we've had some issues and earlier incident on treasure island that's since cleared up, but an atypical friday slow ride into the city over the bay bridge because of an accident right after the bridge. southbound 101 that got cleared up about a half an hour ago. but we're still working that two car collision northbound 101 at dubose, which has traffic gummed up all the way down to 280. so if you're trying to get into the city from the peninsula, 280 would be your road of choice. that is traffic. 831 your time. let's get it back to the desk. >> all right, frank, thank you.

bart. now required to do a better job of keeping its station elevators from breaking down. >> as ktvu allie rasmus reports, this comes after the transit agency agreed to settle a class action lawsuit from riders with disabilities. >> well, some of those changes include getting out of service elevators fixed more quickly, as well as upgrading and renovating some of the 87 elevators in the bart system. this is one of them here behind me. this is at the walnut creek bart station. if a station elevator is broken, there is no way for someone in a wheelchair or other mobility issues to get up to the platform and take bart, and that was the basis of a class action lawsuit brought by several bay area groups representing people with disabilities and mobility challenges. that lawsuit was filed initially back in 2017. it claimed that bart was violating the americans with disabilities act by failing to properly maintain its elevators and escalators. now under the settlement agreement reached in federal court, bart is now required to dispatch a repair person within an hour. if an elevator or escalator at its stations breaks down and it is

required to come up with a plan to renovate and update escalators and elevators across the system. we rode the station elevator here in walnut creek with one bart rider who reminded us, you don't have to be in a wheelchair to benefit from this agreement. she gave us her thoughts as we rode the elevator up to the platform with her. it is very dirty and something needs to be sanitized. >> it's small. this is what the smell is not good at all. i do think it's very important. there is a lot of elevators that are out of use sometimes. usually in the morning when i'm going to the bart, i can hear it say, oh, this elevator is out of use. and it's like, even sometimes for me, i'm like, great. so, you know, i think this is amazing. and i think they need to do it quicker and faster. >> bart spokespersons this morning sent us a statement in response to the settlement. it says, quote, bart is working with advocates to advance a series of improvements to elevators, escalators, training and other things like accessible

path signage. we will continue to work to make bart as accessible as possible for all our riders. end quote. as part of the settlement, bart did not accept any wrongdoing. it also has to pay the $825,000 in attorneys fees to the groups that brought the lawsuit, and according to the terms of this settlement, bart does have some time to make all those upgrades to its elevators in the system, wording says they have about 15 years to get that work done in walnut creek. ali rasmus, ktvu, fox two news. >> it is 834 now. tonight, the family of mario gonzalez will hold a vigil to mark exactly three years since his death. this follows last night's announcement by the alameda county da's office to file involuntary manslaughter charges against three alameda police officers involved in his in-custody death. >> the coroner's office had ruled gonzalez's death in 2021 had resulted from a combination of methamphetamine and the stress of being restrained by police, former da nancy o'malley had cleared the officers of any wrongdoing last night. the

current district attorney, pamela price, reversed the decision following a new investigation. >> if people don't believe that police officers or law enforcement can be held accountable, then witnesses won't cooperate. we can't do our job without witnesses. we won't be able to administer justice. if the community doesn't trust that the system is going to work for everyone, the attorney representing gonzalez's mother tells ktvu. >> the family is grateful the da's office decided to revisit the case. >> the family is elated to know that mario's death was not in vain, and that the people who needlessly caused him to die, to not be able to hug his child, to never to be able to say hello to his mother. those three officers are being held accountable, and it's long overdue. >> the three officers are james fisher, eric mckinley and cameron lahey. they could face up to four years in state prison if convicted. the attorney for officer lahey has released a

statement saying, quote, there is no new evidence this is a blatantly political prosecution. the officer's actions while taking mr. gonzalez into custody were reasonable, necessary and lawful, and his tragic death was the result of drug toxicity, not criminal misconduct. time is 835. californians may have a chance in november to vote on a measure that would mandate more jail time for certain crimes, such as smash and grab, robberies and drug offenses. a group called californians for safer communities announced it's submitted 900,000 signatures to get the measure. homelessness drug addiction and theft reduction act on the ballot. it would essentially roll back portions of proposition 47, which was approved in 2014, and reduced punishments for some property and drug crimes. >> this is about protecting our communities. we know oftentimes that we don't believe in massive incarceration, but at the end of the day, something has got to be done because as community residents living in our cities, the chamber protecting our businesses, we need this level of support.

>> the measure needs 550,000 verified voter signatures to qualify for the november ballot. >> the woman who hit and killed a four year old girl in near oracle park will not spend time in jail. the crash happened in august at the intersection of fourth and king street. police say the girl was in a stroller when she and her father were hit in the middle of the crosswalk. the 71 year old driver was charged with vehicular homicide, but after word officials consulted with the victim's family, the driver will serve two years of probation and 400 hours of community service. she's also unable to drive again until she completes a driver safety class. san francisco's west portal neighborhood will soon see major changes near the muni metro station. >> city leaders have decided the area is in need of safety improvements after a car crashed into a bus stop last month, killing a family of four that was waiting there. ktvu amber lee spoke with people who live and work in west portal.
