pd. we have new details on how an influx of chp officers will be working in oakland amid an increase in crime and residents concerns for their safety. why? some say more law enforcement, though, is not the answer. then. while we've had a lot of rain recently, some of it is going to waste. we'll check the state's drought threat and whether water restrictions still loom on the horizon. >> this is kttv fox two news at noon. >> good afternoon. i'm gasia mikaelian lien. we'll begin in oakland. where fired police chief laurent armstrong has filed a wrongful termination lawsuit against the city. and mayor shengtao. ktvu crime reporter henry lee now live to bring us the latest henry gasia. >> this was all but a foregone conclusion that lauren armstrong would sue, the former police chief says the evidence is in

his favor, showing that he was fired by mayor tao without cause. now the former chief, lauren armstrong, is fighting his termination in the form of a lawsuit filed in alameda county superior court. the lawsuit accuses the city and oakland mayor xiang tao of wrongfully firing armstrong because he had the courage to speak out about alleged misconduct by the federal monitor, robert warshaw. warshaw has been overseeing ongoing reforms at the oakland police department as a result of the riders scandal. from the year 2000, the city has been under the supervision of a federal judge and the monitor for two decades. in his lawsuit, armstrong says he led opd to the closest it's ever been to ending federal oversight. armstrong accused warshaw of repeatedly finding problems with the department in order to benefit financially and stay in his role. now, the suit says, in part as long as warshaw opines that opd has leadership problems , warshaw can't argue his continued supervision at great expense to oakland and its taxpayers remain necessary. now,

this lawsuit also says tao was, quote, intimidated by warsaw and bowed to his pressure. instead of standing up for oakland, tao fired armstrong a year ago, and the city has been without a permanent chief since then. now, we caught up with the mayor this morning. she referred us to the city attorney's office, but i asked her about the search for the next chief. >> i believe that, you know, getting having a chief just be named chief is not good enough. we need a chief who understands the intricacies of being under the federal oversight. the intricacies of ensuring that, you know, the progress that we've made here in oakland, that it keeps pace. >> now, moments ago, the city attorney's office says it has not yet been served with this lawsuit. and so it cannot comment on this complaint. now, the oakland police commission has restarted its search for the next chief after the mayor rejected its shortlist. three candidates, which included armstrong, these new names are expected in march. gasia henry lee. >> thank you. let's swing back to the bay area weather here.

something we've been watching for days. it seems. mark tamayo i just heard from my husband. he says. it is pouring in the east bay. >> yeah, the system packing a bit of a punch. garcia this morning and to the earlier portion of the afternoon. yeah. so the rainfall rates picking up. you know, it's hard to kind of describe because this is not like the system that moved in a few days ago. not a major system, but still packing some downpours with it and even some thunderstorms. so rainfall totals while you take a look at these numbers, they'll come up in a second. these the rainfall definitely picking up mid-morning into the late morning and into basically this afternoon. take a look at some of the rainfall numbers. you can see these were numbers up until about 11:00 this morning. so they'll update these in the next. next few minutes. but you get the idea. they are growing right now because we have those rain showers coming on board. so here's the radar imagery. you can see that system moving in from the north earlier this morning. right now the main focus is kind of moving out of the north bay. we still have some scattered rain up there, but it's moving into portions of the central bay and the east bay. in fact, a hail report here

in parts of the east bay. i'll click on this to get some more information. in the piedmont area, hail size of 0.3in. so yeah, we had some thunderstorms out there and there's the coverage from san francisco to oakland, concord to antioch. these are pretty good downpours across the region. livermore out toward fremont as well, and then extending to the south bay. you see the coverage closer to san jose, out toward los gatos and also the santa cruz mountains. so still a lot of rain to track with today's system. now, rainfall expectations. we're not talking about 5 to 8in. most areas, about a quarter of an inch to an inch. winds will be picking up around 25 to 35 miles an hour. the sierra, they pick up a winter weather advisory. here is our live camera this afternoon. looking out toward the oakland estuary. some chop on the water here, indicating a bit of a breeze. and look at these dark clouds. and they have the potential to produce some pretty good downpours, at least in the short terme over the next 1 to 2 hours. current numbers in the upper 40s to right around 50 degrees. and that's kind of the theme. once this front moves on through, we are tracking a cooling trend. definitely

temperatures cooling off over the next several days. so here's a front. it has been drifting in from the north over the past few hours and today periods of rain with the possibility of some thunderstorms. we could have some breaks in the action throughout the afternoon hours, but here is the current forecast model. and we're showing you this. and this is 3:00. notice the more breaks. but we still have some scattered rain showers to track and the possibility of a thunderstorm. as we take this into your thursday tomorrow morning should be fairly quiet, but then into the afternoon hours, a few showers could pop up across portions of the bay area. once that moves on out, it looks like we should have a quiet weather pattern as we head toward the weekend highs for today in the 50s, and getrillioneady for a cooldown that's going to head our way. here's your five day forecast. rain. the possibility of some showers for your thursday, especially for the afternoon hours. by friday, a sun cloud mix and we're looking okay into the weekend but still. grab the umbrella. be careful on the roadways because we have some pretty good downpours this afternoon. >> gasia good advice mark. thank you. with all the rain we've received already this year, water officials around the state

say they're confident there will not be a need for drought restrictions in 2024, according to the u.s. drought monitor, no part of the state has been under drought conditions since september, but there is concern that the rain has fallen so quickly that some water agencies are prioritizing flood management over water recovery and are releasing water from the reservoirs. multiple deaths have been reported in relation to the atmospheric rivers in our state, and residents are dealing with extensive damage. fox weather's max gordon has the latest on how people are recovering ahead of more wet weather. that's on the way. >> several people are dead in california, in the state is still in the grips of a dangerous atmosphere. river that started on sunday, the historic storm triggering nearly 500 mudslides across southern california. >> it came down in once and then, then, then another two, three times more mud came down until it just covered the whole entire backyard in santa barbara county, a cliffside collapse, erosion on a bluff caused an apartment building's deck to crack and fall. >> 45 people were displaced. meanwhile, downed trees and

utility lines knocked out electricity to hundreds of thousands of homes and businesses. >> it just sounded like a sizzle . about six in the morning, i saw the flashes from the electric pole and went outside to check, and the whole thing had fallen over into the middle of the street. we called 911. >> rescue crews have worked around the clock since the weekend, with dozens of people and even pets plucked from the water. another rescue, the corona fire department, saved three people from a car that drove through a flooded road last night and got stuck. luckily, it did have a safe ending. the historic atmospheric river eased just about over, but one more burst of rain today is complicating recovery efforts. it's not really right now that's so difficult, but, um, kind of how quickly it gets back in shape afterwards. the landslide that we're standing next to right now is one of 475 in los angeles alone, the muddy mess making it difficult for neighbors to get to their homes in los angeles, california. max gordon, ktvu, fox two news new numbers from pg and e show the number of homes, schools and

businesses without power is dropping, but still thousands are without electricity. >> pg and e outage map shows some widespread problem areas. right now. power is out for more than 27,000 pg, and customers here in the bay area, down from 29,000 yesterday, more than half of the outages are up in the north bay, where power is out to more than 15,000 customers. pg calls the outages the third biggest single day event in its company history. 401 power poles and 239 transformers were damaged. power went out in san jose's willow glen neighborhood sunday afternoon, and here we are wednesday at noon. and power is yet to be restored to all homes and businesses there. it's been a rather tedious when it comes to, uh, trying to manage heat, trying to manage hot water and things of that sorts pg and e's regional vice president is asking for patience, but says she understands that people are frustrated about how long it's taken for power to return. power is currently out to 6900 customers in the south bay alone. we're learning more now about governor gavin newsom's plan to send 120 highway patrol officers to oakland to help combat rising crime back in

august, the governor sent six chp officers and a sergeant to help with crime. now, 120 more officers are on their way. this comes after the oakland chapter of the naacp, the unity council and oakland chamber of commerce met with the governor last month asking for help. mayor shengtao told ktvu she's grateful for the extra police resources from the state. we also have new details from the chp on what the officers will be doing here. they're also coming from various specialty units. >> we have canine air operations rouz investigative services units and task forces. in fact, another big part of this, or a key component because there's an auto theft component involved, is the alameda county regional auto theft task force. they're going to play a big role. >> i feel it's really needed. and a lot of us are very nervous walking around and whereas before we weren't at and people are getting hit over and over again, while many community groups praised the move, some say a heavier law enforcement presence is not the answer and

say they want more crime prevention resources and jobs. >> chp couldn't tell us how long the officers would be here, but says the program has already hit the ground running. residents in the oakland hills are using a graffiti removal program to help keep their neighborhoods clean. community members are being asked to report tagging and illegal dumping on the program's website. officials in montclair park say the graffiti has a negative effect on the community's value and attractiveness. volunteers regularly pick up trash, help with landscape and beautification, and paint over graffiti. a new bill proposed by state lawmakers would crack down on homeless encampments in california. >> the i support this bill because, simply stated, we cannot continue to allow our public spaces to become living spaces. unfortunately every month in this state street, homelessness grows. >> the bill would prohibit people from sleeping on sidewalks if shelter space is available, but also ban encampments within 500ft of schools. transit stops and open spaces. advocates for people who are homeless are against the bill. >> this is really ill advised.

missing. it's not clear why that wasn't caught in the manufacturing and inspection process. >> plus, the fact that they have these different reporting structures and sign off requirements, etc. and that they just weren't done it, you know, is doubly shocking. it's not that they didn't know what they should do. they knew exactly what they should do. and they just didn't do it. >> nearly all max nine jets operated by united and alaska airlines have been inspected and returned to the flight lines. the investigation continues. at this point, we don't know if the subcontractor who built the door plug or boeing, which installed it, is to blame. boeing says it continues to cooperate with investigators. space is now under investigation over allegations of discrimination and sexual harassment. the california civil rights department is looking into claims filed by a group of engineers accusing spacex of routinely passing over women for promotions, paying women less than men for the same work, and tolerating sexual comments. the group says the company and the ceo, elon musk, failed to address the claims. spacex has denied any wrongdoing. new at noon, the port of oakland is holding its first ever zero

emissions symposium. port officials have brought together some of the world's top experts on climate change to talk about reducing emissions. mayor shengtao also taking part, along with the ports, vendors and leaders in the maritime and aviation industries. their focus is on reducing greenhouse gas emissions and attracting more green businesses to oakland. >> we're excited to be a green port. we're hopeful that we could be the nation's first and greenest port in the nation. and so this is just the beginning of that work. that means that we're going to have healthier air if we work together. >> oakland is one of the cities the white house has chosen to be part of california's hydrogen hub, which is set to receive $7 billion in infrastructure funding. it will be used to accelerate the domestic market for low cost, clean hydrogen. the american lung association says california's clean air programs could save 20,000 lives if they're all put into place and continue through at least 2050. the lung association says california has the worst air pollution challenges in the united states, but says 11 new laws related to cars and trucks,

as well as leaf blowers, cargo ships and trains, have the ability to make major changes in air pollution levels. a association leaders say it's only possible if state officials invest in zero emission transportation and strong enforcement of the new laws. well, millions of people are expected to watch the super bowl, but some may be watching another big game right before it. the puppy bowl also airs sunday. it's a chance to raise awareness about pet adoption. ktvu ali rasmus reports from the humane society. silicon valley, the home turf of two of this year's puppy bowl competitors. >> these puppies from the humane society, silicon valley, are four legged 49ers fans and friends of two of this year's puppy bowl competitors, frankie and. niner, were chosen from the humane society silicon valley shelter to compete in this year's puppy bowl. >> frankie was the smallest of the group and the only girl, and she was a spitfire niner was just the chunkiest biggest boy, and i just knew together they would be so cute together on screen, frankie and niner had a

chance to train with some of their own 49ers coaches ahead of the big game. >> each puppy had a coach a lot of smack talking between the two coaches about who's puppy was going to get chosen, and then ultimately both got chosen to go to the big game. >> we don't know which team won the puppy bowl. >> it airs on sunday. we know that frankie and niner have found forever homes, but there's still many puppies still looking for a family, including puppies like tom. he was part of a group of puppies from the humane society silicon valley that helped with this puppy therapy session for the 49ers before their nfc championship game. several of the dogs were adopted after video of the cuddling session went viral, but tom and others still need a home. we have more than 60 animals available for adoption right now. their biggest challenge fostering and adopting out large dogs that weigh more than 50 pounds. >> i think it's the lack of housing, um, pet friendly housing is really a problem. >> as puppy bowl competitors frankie and niner are now ambassadors, the humane society silicon valley is running a $49

in a waymo self-driving vehicle in the potrero hill neighborhood . the cyclist escaped with minor injuries, but one expert tells ktvu baillio carroll that the crash will be it not serious could point to a larger issue. >> even humans, he people you know, even in cars, break down with humans inside and that there is nothing they can do. so same thing. you know, they have

glitches. they break down. >> jesus, the owner of an auto body shop near a bustling waymo car park, said like normal drivers and cars, autonomous vehicles have problems occasionally. on tuesday, a waymo self-driving car and cyclist crashed into each other on 17th street and mississippi in san francisco, according to waymo, a large truck passed through the intersection at the same time as a cyclist, but the truck hid that cyclist. the cyclist crossed into the path of a waymo car, and at that point, the car couldn't break fast enough. they crashed into each other. waymo said the cyclist reported only minor scratches and walked away. but missy cummings, a professor of engineering and computing at george mason university, said the waymo computers should have been able to stop it before it reached the point of a crash. >> their sensors are typically faster than the human, your average human, she said. >> it appears the waymo car made its maneuver too aggressively, so no u turn before you look, and most people would let a

there. this morning we watched a steady stream of them head out and hit the streets. this morning, just about the time that rush hour was happening. in a statement, waymo did tell us that they are cooperating with the proper agencies as it pertains to the investigation of this crash in san francisco. i'm bailey o'carroll, ktvu, fox two news. >> self-driving car company cruise is working to find a way to finish in investigation into a crash where one of its cars hit a pedestrian. company offered to pay a larger fine to the california public utilities commission during the hearing yesterday. executives for the company also said they regret the effort to cover up the crash in october to regulators and the public. general motors, which owns cruise, has replaced many of the company's leaders and has paused autonomous car testing indefinitely. apple is, for the most part, staying under the public radar as it increases the number of miles it's putting on its self-driving car program. the washington post reports. apple has 67 autonomous vehicles, and they've driven more than 450,000 miles since december of 2022. apple doing all its testing on public roads and all the cars have a human

behind the wheel in case there are any problems. so far, no problems have been reported. and today's the second day of a two day strike by optometrists at ucsf. they're joining their colleagues across the uc system. the striking optometrists say the university of california has failed for more than a year now to agree to the terms of employment for 80 optometry artists who joined the union in 2022. they're demanding an agreement that will invest in more staffing and better pay. >> we've been in negotiations with uc for over a year, trying to come up with a fair contract that is going to retain and attract quality optometrists who are going to stay here and unfortunately, uc has been negotiating in bad faith and thus we have no option but to go on this ulp strike. today. >> both the union and uc have recently filed unfair labor practice charges against each other, with state regulators. the office of the uc president issued a statement to ktvu saying in part, the university believes the planned upda action related to this limited group of employees is an unlawful exercise by the union since their contract contains a no strike clause that prevents work stoppages and requires the union

>> the 20 acre costco project will be located near prospect high school and save west valley also says heavy traffic, months of construction and access to nearby stores are also concerns. they've gathered over 3300 signatures of support on change.org to halt construction. >> there's a lot of concern about things like noise, uh, for pollution. there used to be an auto shop there was like a muffler shop, an auto repair, and there was concern that there was toxic chemicals that had gotten into the ground. and they're going to be digging it up and throwing it up into the air, holliger says there are already two costco stores within six miles of the proposed new location. >> he says they understand the city's position to do business, but he hopes their voices can still be heard. >> maybe the city will actually engage and, you know, look at is this an appropriate project for the site? and you know, if they decide to go ahead with it anyway, what can they do to make it safe? >> san jose residents have until february 20th at 5 p.m. to give

but chain restrictions are in effect. resort officials say the snow will help make an excellent rest of the winter season. a lot of bay area families mark tamayo making plans for the president's day weekend. it can be a busy one at resorts for sure. >> yeah that's right. and as we know, not the greatest start right. but yeah, playing catch up right now. and that's a great change in the sierra. in fact for the 12:00 12:00 observation blue canyon reporting some heavy snow right now. so yeah, some snow in the sierra. and of course here in the bay area, some pretty good downpours out there. here's the radar. you can see just over the past four hours some development up in the north bay earlier this morning, then kind of moving across the heart of the region. those yellows and reds indicating some heavy downpours kind of cruising across portions of the region. so take a look at the rainfall totals so far. belmont 0.40 san francisco almost at that point. concord, napa, san rafael, oakland all 0.32 and san jose up to a quarter of an inch, almost a quarter of an inch. and they are reporting some heavy rain at the airport in san jose right now, showing you this, the radar coverage. and here you can see

some rain showers kind of clearing out of the north bay, but still some lingering activity. we're not completely dry, still some action moving into portions of sonoma county right around healdsburg and santa rosa. one storm report to show you this was linked up with a thunderstorm that produced some hail this morning during the 11:00 hour, so that was out toward the piedmont area earlier today. here is the radar coverage. a pretty good downpours out there, especially from hayward to san ramon to dublin, out toward livermore and fremont. as we move the maps closer to the south bay. as i mentioned, the south bay is reporting some heavy rain right now as we coming closer to san jose and right around morgan hill, especially with those yellows and reds indicating in fact, we'll click on this one cell here showing you rainfall rate right now. currently 1.66in an hour. so that's a lot of rain coming down at this one particular moment. so we still have some heavy downpours out there. winds gusting around 25 to 35 miles an hour in the sierra. they have the winter weather advisory in place. here's a live camera looking out toward the golden gate bridge in the north bay. and those clouds,
