what were the defense attorneys reasons for needing more time? yeah as you well know, from covering many trials in the past , the defense really has the right to a speedy trial. but if they choose to waive that, right , they can delay that trial as long as they feel they need to. in this case, the defense attorney says she's going to delay entering a plea right now to give her clients the best chance. she says she can't nemo . many walked boldly into court tuesday what was scheduled to be his arraignment instead, the entering of a formal plea of guilty or not guilty was delayed again. paula canny defense attorney says she is waiting to enter a plea to make sure her client can operate on his time frame. not the prosecutors. of course i'm pleading not guilty. he is not guilty, okay? i'm going to enter that plea. but what i can't decide about is whether or not to waive time or not waive time for the preliminary hearing, and that's what i need the two weeks for

district attorneye nkins says her team was ready to proceed tuesday, but that it's not unusual for defense teams to delay looking for an advantage. the defense has the ability to continue this arrangement as long as they wish. mr momeni is in custody, and the law views it as though it is his choice, whether or not to exercise his rights to a speedy hearing or any any other part of this criminal justice process. the autopsy report for bob lee has now been released and says lee died after being stabbed in the chest, which resulted in injuries to his heart. the final report also reveals that the tech execs had cocaine and other drugs in his system at the time he died, may have provided a clue as to how she will defend her client, saying people on drugs sometimes act erratically . there's a lot of drugs in bobbly system. i mean, bobbly system is like the walgreens of recreational drugs. prosecutors

first stabbing victim was found dead in a park on thursday, and the second victim, the uc davis student, was killed saturday night at another nearby park. and just an hour ago, the university announced its expanded its safe rides program for students who don't feel safe walking home alone or at a small group and all classes after six pm will be virtual for now. also the university has set up a memorial fund for the student killed on saturday night. ktvu brooks jarocz was in davis for that update this afternoon and spoke with students and residents there. he'll have that update coming up tonight on the news at five o'clock, announced that deadly shooting of a suspected shoplifter at a walgreens in san francisco, the district attorney today, going into more detail about the decision not to charge the store security guard who fired a single shot henry lee learned of these developments last night us now live, henry. what evidence say? let her to this conclusion. heather the d a. tells me based on statements by the garden witnesses as well as video

footage. she doesn't believe she can prove to a jury that the guard had committed a crime. instead, she says, the guard acted in self defense to protect himself from a robbery suspect. the private security guard who shot and killed 24 year old banco brown at a walgreens in downtown san francisco, freed from jail after prosecutors declined to file murder charges . ultimately the security guard , um fired his firearm in what he articulated was based on reasons of self defense. san francisco de a brook jenkins says brown's killing was a tragedy. but she said video evidence and witness statements indicate it was brown, who threatened the guard 33 year old michael earl wayne anthony physical violence that was used in order to proceed with taking the property as well as threats of extreme violence. pursuing murder charges against the guard would be unethical and create false hope for a successful prosecution. in this situation, we had a shoplifting incident

that really escalated into an altercation that under the law ah! qualifies as a robbery. so first of all, we want to see the tapes. we want to see the proof. julie el royo is with the young women's freedom center, where brown was a community organizer . even if somebody felt like their life was in danger. why in the chest? why why would it be in somewhere that it would be so lethal security guard in this case, thought his life was in danger, and he took what he thought was appropriate action, ktvu legal analyst michael cardoza said businesses like walgreen's hire guards because of rampant theft. it's a lot more than only a petty theft because that's one petty theft on top of another on top of another until the businesses leave the area. at least five walgreens stores in san francisco have clothes and part because of theft now reached out once again to the guards security company today but there's still declining to comment. live in the newsroom.

henry lee ktvu fox studios want to go back to that evidence for a moment are officials saying whether the video shows the young person who was killed whether or not that person was, in fact, armed investigators tell us that there was no weapon display, but that this 24 year old threatened to stab the guard. alright again, another piece of important information that led to brooke jenkins decision not to charge that security guard henry lee. thank you. police in anti hacker searching right they believe wee involved in a deadly shooting. it happened around 7 30 last night at a convenience store on hillcrest avenue. police say witnesses saw a car crash in the stores parking lot, and after that crash, two people ran away from the car. police found a man with a gunshot wound in the driver's seat, and he died at the scene. officers say evidence shows that this shooting happened inside of that car. alright shifting gears now to talk about our weather in the bay area today, and we had some

wet weather here to start off the month of may with some scattered showers. for many folks across the region a live look here as we look from our studios here at jack london square in oakland across the bay towards san francisco. great clouds off in the distance. ktvu meteorologists mark tamayo tracking this weather here and wet weather and very unsettled here as we as we move through the afternoon mark, that's the best way to describe it unsettled, alex, in fact, always changing with with qasem sunshine. some cloud cover some light rain, some downpours. and even some snow in the sierra. take a look at the rainfall totals so far for today, you can see napa approach and a half an inch of rain falls up pretty good downpour there. santa rosa 0.16, san francisco 0.14 and just about 1/10 of an san jose, but we still have some rainfall showing up here on the radar. you can see all those lightning strikes detected. it looks like we have a cluster. lightning strikes approaching sacramento moving in from the south, you can see some of that activity out to the east of the

death monday inside the home of a convicted rapist jesse mcspadden am just lost. i really lost for words right now, like i said, i right hand side kick. father says the girls were spending the nightfadden'se road, where he lived with a woman and her three kids. the girls were close friends with the children. webster however, says he had no idea mcfadden was on the state sex offender registry was locked up for the 28 years like he was supposed to i would never have done this. the people that released them need to be held accountable well . police haven't identified the victims. mcfadden is believed to be among the dead. we know they were shocked. we we don't yes, the mother of the woman living with mcfadden has also come forward on social media to say her daughter and grandchildren were among those killed. that woman also said she had no idea

mcfadden has spent nearly 16 years in prison. he was also set to appear in court for separate charges of soliciting sex from a minor and possession of child pornography on monday. police say they are no longer looking for any suspects. in this case in new york, c b cotton fox news attorney general rob bonta says california will continue to leave the nationwide defense of reproductive rights today marks one year since the u. s supreme court decided to overturn roe v . wade today. california ag bonta joined the southern california legal alliance for reproductive justice to boost its legal aid effort. the alliance is made up of law firms related to abortion. another reproductive important part in the defense against unprecedented attacks nationwide that he called on reproductive freedom. the legal landscape across the country. it can be confusing. and frankly, scary. leaving patients and

announced they will go on strike if no deal can be reached by this thursday. the district says its proposal includes a salary increase for every teacher, but his ktvu sally rasmus explains, the union is not satisfied and says teachers deserve more. the union representing oakland. teachers say they want a new contract that includes things like better support services for mental health, further students , smaller class sizes and higher pay. the union says, if they don't reach an agreement with the district to get those things there are members are prepared to go on strike this thursday at chabot elementary school this morning, we spoke to parents who say they're preparing for the possibility that they will end up keeping their kids home from school this thursday. if the strike does happen, i hope there's not i mean, i know the teachers work really hard, and i know everybody's trying to come to a resolution, but it'll be hard for everybody. we're hoping it doesn't have to happen. um but we're we're going to support the teachers with whatever they need to do. they deserve a lot more than what they have to contract and so we're behind

them 100% but we hope it doesn't have to get to that because i'm thursday, my sister's having a field trip education association , the union that represents about 3000 oakland teacher says the members contract expired in october. they accused the school district of stalling and delaying the negotiations since then, something the school district denies that union members and their supporters voiced some of that frustration at a news conference and rally in oakland yesterday. their supporters made signs in preparation for a possible strike this thursday, may 4th goal right now is to get our first in our new teachers up to $62,000 a year. because of the cost of living because of, um student loans are just so much that are on new teachers right now that we can't keep folks in education, not just here in oakland, but across the country. we haven't reached any agreements yet, so i want to be really clear. there's some ideas that are bringing us closer. but we're not quite there. the oakland unified school district sent this statement in response, saying quote our team has remained at the bargaining table

daily and is committed to continuing to work in good faith. toward a contract that works for both sides. we remain optimistic that we will collectively come to a resolution in time to prevent the teachers from hitting the picket lines. rasmus ktvu, fox two news according to the surgeon, general, loneliness and isolation or public health crisis in this country, dr vivek murthy says about half the adults here in the us have experienced loneliness and it poses a health risk, he said. loneliness poses health risks as deadly as smoking up to 15 cigarettes daily, costing the health industry billions of dollars annually. no surprise. the loneliness crisis worsened during the pandemic affecting young people between 15 and 20 for the hardest. dr murthy says he issued this advisory to pull back the curtain on the struggle that many people are facing loneliness and isolation can elevate a person's risk of experiencing depression, anxiety and dementia. are you? a senate

committee is looking at whether congress should implement a code of ethics for supreme court justices. the hearing follows reports that justice clarence thomas participated in luxury vacations and a real estate deal with the top gop donor. democrats say that lacks ethical standards have weakened public confidence in the supreme court. members of congress have introduced legislation requiring the justices to adopt a code of conduct to impose on current and future justices. it is critical to our democracy that the american people have confidence. the judges cannot be bought or influenced. this is a political attack directed at a justice they hate. the hearing comes one year to the day after the leak of a draft of the dobbs opinion , ultimately overturning roe v. wade chairman #### durbin invited chief justice john roberts or justice of his choice to testify, but he declined the request. steps are being taken in washington, d c to try to reach a deal as the deadline

approaches for the united states to default on its debt. treasury secretary janet yellen says the government could run out of cash to pay its bills by june 1st unless congress extends the credit line president biden, senate majority leader chuck schumer and house democratic leader hakeem jeffries have been meeting behind the scenes. the white house says it's trying to pave the way for an 11th hour deal with a small group of republicans to try to avert default it would raise or suspend the nation's debt limit . the white house insists it's congress's constitutional duty to act. in his calls, he was clear. it is congress's constitutional duty to prevent default. this is not an issue that we will no guilt negotiate on the debt limit was increased three times under president trump. it should be no different this time. president biden is set to meet with house speaker kevin mccarthy and other leaders next week to talk about the debt

publishing a shared love of food , asian american pacific islander month here at ktvu. we want to highlight the grassroots nonprofit called cut fruit collective are andre senior, spoke to one of the founders this morning about their mission of empowering people through art. we actually originally started off back in march of 2020. our name was saver chinatowns. we were relief fundraiser dedicated to saving or uplifting chinatowns during the pandemic and so hard by the way during the hit very hard, and so, um, and then as, uh, as we moved into 2021, we wanted to extend that form of community

care through art to other neighborhoods, other asian american pacific island neighborhoods. and so we found this name cut fruit, which is a very common practice across asian and pacific islander household. and you'll see that across the world where people prepare fresh cut fruit, further loved ones and to us that really evoked a sense of community care that we wanted to. um, we wanted to show through our organization . so you you do you still help with the communities, the businesses that are in chinatown that were hurt as well. and how are you doing that? and how is your organization evolved since then. so some of our programs, one of them, which is the community prosperity program. we are code designing merchandise with small businesses in chinatowns and little side icons across the bay area, and i'm actually representing one of them is, um, this is green fish seafood in oakland, chinatown. and so we code create merch, and we also help to market and sell

. and then we provide all the profits to the small businesses as another form of revenue for that's interesting that you have now is that part of the marketing that yes, you've done for this company. so this is you can buy this on our website cut fruit collective dot org. and so all of the profits go towards these small businesses. what prompted you just to get involved in this way? because it sounds, you know, very detailed, kind of partnering with these businesses to help them in any way you can just donating time. what prompted you to do to seek heliport or to help these companies in this way. so our founder jocelyn's high, she's an artist. she actually wanted to rally the creative community and the best way she knew how which is through art. and similarly that that you know that was really resonated with me as a creative and i wanted to find an outlet to be able to support the community. and so for us, it's all about building coalitions, bringing in people from different backgrounds together to help create more resilient neighborhoods and communities.

tip off and chase center with the warriors hosting the lakers and jason a lot of people going to be watching two players in particular, of course, i'm talking about steph curry and lebron james. that's where the that's all the hype right and it should be. but listen, the warriors in the lakers, this is not a rivalry because the lakers just dominated during during the eighties, early nineties, they haven't met in so long in the playoffs. gonna be fun, but hard to believe that you know, this is the first playoff series between the warriors and the lakers since 1991 and i think we all just need to take a step back for a moment and just appreciate that we are getting the steph versus lebron match up yet again, two of the greatest ever to play the game without a doubt. this may not be the last time the two meet in the playoffs. but steph is now 35 lebron is 38. the definitely coming at some point

know. you know, steph played a lot of that game. we know how much effort he took his career high and shots. so that's the only thing i would look for. the lakers have had two extra days of rest there well rested and they're solid team. i mean, we make a lot of the stephan curry lebron james matchup here, but you know, the odds are that the two of them are not really going to be facing offother in troubl. and likewthe warriors going to o slow down lebron james. and how are the lakers going to try to slow down steps? i mean, that's a great question that the main thing with the lakers this year is they made a big trade. they got rid of russell westbrook, who actually, you know, turned out to be have a pretty good season with his new team, but when they traded him, they got three guys, right? and since they got those three guys, the d'angelo russell being the headliner there and two role players the warriors played him three times down the stretch. february and march. the warriors lost all three of those games against the new look. lakers now keep in mind. lebron didn't plan two of those three games didn't

. direct and indirect. every single one of us will be impacted by this, and we're very concerned about what's going on because uh, both sides are dug in and the stakes are high talks between the guild and a trade association representing hollywood's marquee studios have failed so far to reach a deal of the alliance of motion picture and television producers says that it offered a generous offer that had increases in compensation as well. joining us now for more on the writer's strike is brant. pin vidic, film director and television producer . thank you so much brandt for being here. why are the riders taking this action wh well it'sl comin the center on both sides of the line, you have the producers that writers like they're a gig economy, hire you for one specific project and then not hire you until i need you again, and the writers want to preserve sort of the employment status

and the job security and so as this has been progressing over the years there are a little bit out ahead where it's like, hey, you know, we got to make some changes now or we're not going to be able to get ahead of this. it's going to continue this way. yeah, so do you see the riders being successful and kind of changing this business model? uh no, i don't. i don't think that the changing the business model is going to work. the business model has changed. there's not a lot you can do. except delay it the you know the real power that the writers have is that there is no replacement for them. you cannot train people. you cannot teach people how i level hollywood level producing and writing level is incredibly hard to do. so that's the leverage they have is that you can't write massive hit series and giant movies without top notch writers, and there's no there's no replacement for that, so they'll leverage that the best they possibly can for everything they can squeeze out at this point, and brent writers particularly frustrated with streaming shows, explain what the issues are there. well traditionally, you've been, um

as a writer, subject to great royalty structures where, you know, we make a show today and that that show will air for years and years and decades to come and you get paid every time it airs with the streamers have changed is they're saying hey, listen, we're just going to have it on our platform. it's not like we run it in different places were just going to buy you out now of your royalties, so they'll pay more money up front and everybody was happy with that, and the rush to produce content for netflix, etcetera, but now looking at it, they're like, wait. long term. this doesn't have the upside that we used to have. and so it's really easy to be, um, you know, in favor of the upside when it works when the show is a hit, it's harder to do that. when shows don't work, and writers don't traditionally take on any risk, right? they want to get paid. regardless so it's the streamers have really made that difficult from a long term viability of getting royalties and getting paid for stuff. okay now let's talk about the future impact of artificial intelligence there on riding explain the concerns there.

there's obviously a lot of them. well, the concern is that an ai engine will be able to learn the style of a writer enough to make. i mean the only real concern is that it can make some sort of revisions or make adjustments right. there is no real concern that ai is ever gonna replace an aaron sorkin or anybody who can write at a level um, in the hollywood sphere. that's just not a reality that the writing process and the skill required to do that is astronomical. so but from a you know, take a few jobs here and there and replace people and make things more difficult. it's certainly can. my instinct is that this is more of a bargain chip to try to like, you know, wedging the stuff that really matters, which is we want to get paid more. okay so we we've talked about the sticking points here and the guild's demands. what about for folks like me who like to enjoy shows what happens to our favorite programs? uh for now, you won't really see any difference the you know the programs that are really going to take a hit of the late night shows that are in that live mode. you know they'll be off

the air, and that's going to be very painful for them because, as you know, there is a lot of entertainment out there outside of the tv box, basically and in the film seat, so i think what the last thing both sides of this debate want to do is drive people to another form of entertainment. and that is what happened. the last writersstrike, it created. the reality tv boom was born from the reality from that. writersstrike. i was there. i was part of it. and so the lucky part of that for guys like me and other producers that is that it spurred more in the tv industry. now, with so many other forms of entertainment you take scripted and off tv and movies, and you make that scarcer. i think there's a good chance that another form of entertainment booms and it doesn't have to do with t v or film, and i think both sides know that i don't expect this to go along. okay so how likely do you think that this will go on? i mean, my instinct is very like maybe. the did that, but i'm

now it turns out sea lions are getting larger study by uc santa cruz scientists found the male california sea lion has increased its researchers call these findings very unexpected, joining us now at u. thank you so much for coming on today. we appreciate the time you're the lead author on this study. so help everyone understand why sea lions are getting bigger and why you were so surprised by these findings. maybe so, yeah, we discovered that california's lion in particular mels are becoming bigger and we think that it has something to do with sexual selection. so it turns out that california sea lions are very unique in the reproduction and one because one male found rub

with many females for do or die doing that. uh males need to secure their territory and secure the females and, um, doing that they had to fight with other males. and if you are beer, you're going to have an advantage against other males. so you're gonna be more successful, and that is what we think that they are becoming bigger over time, and it sounds like the lions overall off the california coast are becoming less particular about what they eat their really sort of branching out in terms. of their diet. what? what? what have you seen in your research? and how far off the california coast? are they now going to find food? yeah, there is a great point. so in our study, we discovered that males millennials are diversify , have diversified their diet over time over the last 50 years and apparently what they're also doing and they are going further

north to feed their written areas near alaska, where they were never seen before, and apparently that is the consequence of their population increase. yeah so you know it. when you look back at the history here, it became illegal to hunt sea lions back in the early 19 seventies, and then you've seen the numbers since that time explode the population of sea lions as tripled, essentially, so that's explain why that's not what you would normally expect to happen with a species we usually when you get , um, animals when they increased their numbers, usually their size tends to shrink. why is that? exactly so what happens ? i asked him population numbers increase competition for food will increase, too. and we know because other studies if you have less of a level of food to eat your body size, and your growth will decrease. so that is why we expected when where we started this study to see that

california's alliance have increasing numbers over the last decades. um so probably their size will decrease along with that increase, so, but we found completely the opposite, at least for males. and finally, let me just sort of key in on one point here is that your your study found that it was only male california sea lions who are getting bigger, so and you didn't observe any significant size increase for the female sea lions. why do you believe that was well, i think there are two major reasons. one is that we couldn't include many females, female schools and our study. but i think the second reason the most important is that probably females are exposed. i have been exposed to different ecological. uh forces. uh so probably they are facing different population dynamics over time. alright really appreciate your time and letting us know. hear about this study

the city of sonoma, and then still some action and closer to the peninsula and parts of the east bay as well. in fact, you can see these two cells were watching out towards a pleasant in and also right around the hayward area. this rainfall intensity this is one you know one self producing a intense rainfall radars. higher rainfall rate 10.65 inches an hour with that rainfall intensity. and there are some of the coverage right now stretching down the peninsula from san francisco to south san francisco. approaching san mateo. here's a live camera looking out towards mount diablo , some clouds and also some breaks in the clouds. we had a few raindrops on this camera lens about a half hour ago and current numbers most neighborhoods right now in the fifties and the sixties, some neighborhoods reporting mostly sunny skies. other neighborhoods reporting mostly cloudy conditions and other neighborhoods, reporting some showers. overnight temperatures will be in the forties and the fifties and tomorrow morning the possibility of some scattered showers, in fact, will jump right into the forecast model. as you can see 10 o'clock it's going to hold on to that motion.

and the state board of education over gender identity privacy policy. according to state and district guidelines, transgender students identity must be kept private even from parents unless the students has otherwise forces them to lie to parents and to deceive parents and to participate in a student social transition. paul jonah is representing the teachers who have taught at the school for more than 20 years. according to the lawsuit. policy requires teachers to refer to students by preferred names and pronouns at school while reverting to biological pronouns in legal names. when speaking with the students, parents, experts on both sides of the spectrum agree that when you're dealing with the child that has gender dysphoria, the solution is not to leave the parents out of the picture, and the solution is not to leave the parents in the dark. these children need love karen attention in the school and the state have no business, presuming that parents will be unsupportive or their parents will be harmful or abusive.

flock reports from philadelphia international airport now the house transportation committee as the general accounting office to determine the cause of airline cancelations. is it whether it's the airlines often suggest or problems that the airlines themselves with the staffing or maintenance? the

answer is in and, to paraphrase taylor swift, it's them. they're the problem. it's them. the airlines take a look at the numbers from the g a o. they can computer the amount of cancelations the percentage attributable to causes at the airlines themselves and not whether hawaiian air topping the list 96% of their cancelation spirit. allegiant alaska are also high on the list. it's a list that you want to be at the bottom of, and that was the big carriers, delta, american and united fewer of their flights canceled because of maintenance or staffing issues. of course, these were numbers from 2021. the cancelations have continued well into 2022. you may remember the southwest debacle in december of 2022 between the 21st and 31st 16,000 flights canceled over christmas cost the airline $825 million. the problem largely was not a problem prior to the pandemic. take a look at spirit. for
