related prior to a trial. oh you know, i think the video of certain is damaging for the defendant. you know, this is the type of horrific attack that anyone who's home alone and you know intruder breaks into the home. this is what you have nightmares about, so i don't see this being considerably helpful for the defendant here relates to the prosecution. you know, it shows why they're prosecuting sex. serious charges. you know, you can see when he wields the weapon and takes down. this is general blow he is trying to do harm. this is a sorry i didn't mean to interrupt you there, dante, but was also so interesting is that we really get a good look at the timeline here from from when he arrived at the home to what he allegedly broke into the hall and the interactions with paul pelosi. and what do you make of this extensive amount of evidence? you know, it's a mountain of

think the officer there should have been on high alert and instantly. this is a situation where you interest home and separate the two. so you know this was a case just on its face. you can see that this is a very scary situation once again, mr lucky to be alive because when that weapon came down upon his head, he went to the ground. that's not where the assault ended. it continues. and so you know, we're just very lucky that he's here to be alive today. and just do they have any case at all? i mean it. it's all they're on video in the video doesn't lie. we're leave. well, i think you know there's a lot of options available for the defendant here. you know you could this some type of out of insanity was this situation where mental health is that issue and so there should be some consideration given to them by the prosecution. you know, i think, and i think that's something that can be developed. especially when you start

the accused gunman had been upset for a while, but that this demand to pay $100 apparently sent him over the edge, triggering this tragedy that's covered family who lost everyone's it wasn't anything other than through work and what was going on at work, and he felt picked on san mateo county d a steve, says trinley jiao 66 year old farm worker accused of fatally shooting seven people at two mushroom farms in half moon bay bullied and had a long time this people with cope. but he may have triggered by a bill over a crash involving farm equipment. he dispute with the first victim regarding $100 bill , the $100 repair bill had to do with a collision at california terror garden off highway 92, where authorities say joe killed his first four victims and supervisor to co workers and the wife of one of the victims. allegedly drove to a second farm where he previously worked and killed two more farm workers and the wife of one of the victims.

direction, but the train was just stopping it in the car there. problem was fixed and most translate. bart service was restored by seven o'clock this morning. okay we are following some breaking news is coming to us from tracy, where there's been an officer involved shooting a live look now from the air over this neighborhood where this incident happened, tracy police saying it happened a little before to this afternoon. so just about two hours ago, officers were called out to fox tail way if you happen to be familiar with the tracy area for reports of a man who was chasing another man with a knife. one officer arrived and the man made contact with the people involved. police say one point the man with the knife, then charged the officer and that officer fired his or her weapon and shot the person. that man was taken to the hospital with unknown injuries again. an officer involved shooting has obviously affected this neighborhood in tracy. we will continue to follow developments here. as soon as we learn any

least try to take him into custody. his christian captain has been looking now over that video and joins us now live from the newsroom. christian we know that this video is graphic. in fact, officials who had previously seen the footage called it appalling. tell us more about what it shows certainly appalling, shocking. there are lots of words that you can use to describe this. that is exactly what we heard from tyree nichols family and from the tennessee bureau of investigation in anticipation of this video being released, and as expected, the video shows the brutal encounter as five memphis police officers were trying to take karen into custody, and we want to warn you that the video is great. that we are showing you first at the second scene

after a nichols was initially pulled over. and that video you can see he was already on the ground after he was pulled over at that other location. the officers in the video repeatedly punched and kicked nichols over and over again. you know, at one point you can see they stand him up. they hold his hands behind his back and begin punching and wrestle him down to the ground again. at various points in time in the video. they also kick him now body worn camera of the same incident were able to actually hear what the officers are saying in that very scene that you're watching right there. those offers repeatedly ordered nickels to quote give them their hands. they pepper spray him, punch him and kick him over and over again, wrestling his hands behind his back. now in an earlier video we saw police initially pull over nickels you can see in body cam video on that we're reviewing that video right now where they pull nichols over and within seconds

, they draw firearms and began shouting at him to get out of his car and lie on the ground. at that initial seen numerous officers wrestle him to the ground. at one point, nichols says to the officers, i am on the ground and man, you guys are doing a lot. the officers then threatened to tase him and at some point nichols breaks free and runs away from those five officers, one of the officers at that initial seen fires his taser at him. it's unclear if he strikes nichols, who has broken away, the officers demeanor change as they radio for backup and then discuss amongst themselves how nichols got away. all of that again, happening on the first two minutes of that body cam video we did hear from nichols mother earlier, who had asked for peace. as people see this video, she says that she knows it's going to be difficult to watch and that she did not watch it herself. but she is asking for justice for her son as people review this video for

the first time. and i want to say to the five police officers that murdered my son. you also disgraced your own families. when you did this but you know what? i'm going to pray. for you and your families. to give you a little context here again that this all started january 7th when police pulled nichols over on suspicion of reckless driving at around 8 30 in the evening. the police initially said that nichols ran from that scene and he was injured as officers arrested him. he was taken to a memphis area hospital after he complained about quote, shortness of breath. three days later, the tennessee bureau of investigation said that nichols had died. by last sunday, memphis police said an internal investigation was underway. and then last friday, memphis pd said its officers violated policy and fired all five officers involved was five officers were arrested yesterday

and charged with second degree murder. cities here in the area are already preparing for the possibility of protests. in the last two days. i've had discussions with francisco police officers and with sheriff's deputies who all say they are on alert in san francisco, you can see them their barricades around san francisco's hall of justice with a narrow gap to limit how many people can approach the building at one time now. we also heard that there is a solidarity rally planned for sunday in oakland, and we are already here. planned protests in chicago and washington, d c. and we will, of course, continue to monitor local developments here again. all i can tell you from having seen that video for myself. it lives up to all of the descriptions that we've heard of it so far, heather holmes you've heard so far about appalling video shocking. it is that and so much more. i guess so. after after watching what you just saw as well, christian captain live in our newsroom. thank you. okay

we want to continue to follow this breaking news and bring back with us. oakland civil rights attorney a dante pointer . i know that this video was just released, and perhaps you haven't had a chance to watch it in its entirety. but your first reaction to what we've seen so far and that includes tyree nichols being punched repeatedly while he's on the ground. apparently we're having some some audio issues. hopefully we can we can address that and bring a dante back to get some of that reaction right now, though, we want to bring you to memphis. and these are live pictures of a small group of protesters that have gathered just minutes after this camera. this police footage has been released. um now i believe that we have our connection with the dante restored. again your initial reaction to what is seen on this body camera footage. i am just sick to my stomach. you

know, you don't want to see anyone treated in that type of manner. like a punching bag. yeah. you know, you see him go limp and they stand them up, and they continue to beat him up and torture him is what you're saying. and that's the type of behavior that you just should never see anyone do to another human being, much less someone that has taken an oath and a duty to serve and protect when instead they set upon him like a wild pack of animals. and what do you make of the fact that there are a number of officers in involved here? and that no one has the presence of mind to say. okay, let's stop. what i make of that is what i make in many of these viral videos where you see officers engaged in all kinds of misconduct and abuse in the other officers turned the other way, or they join in, or they stay silent and write false

police reports. unfortunately this is not an isolated incident . i'm here to tell ladies and gentlemen and the viewers this type of stuff goes down more frequently than any of us would like to believe why? because we trust these people to protect us and to do the right thing, but absolute power corrupts. absolutely and this is just the latest incident in a dark, dark book in the darkest chapter. what do you think should be the takeaway? what when people are watching this footage and from the death of tyree nichols what will it take for us to have the courage to push the people who are responsible for regulating police officers? those who are responsible for the training those are responsible for disciplining police officers to do the right thing. this only continues because for right now our society is unwilling to pass the bills unwilling to support

criminal prosecutions and unwilling to convict officers who offend the public's trust. until we put our foot collective foot down. we'll continue to see this. it is just disgusting, and it's disheartening because as much litigation as many court cases as many rallies as many speeches as many apologies, this continues, and yet we're unwilling to cut the cancer out of our society. some people have pointed out that here you have tyree nichols, a black man and that all of the officers involved were also black and say that this points to the fact that this isn't an issue about race, but more about the police culture. absolutely absolutely. i think they're spot on. you know, you can be a perpetrator of abuse of power, no matter your race, ethnicity or creed or gender. i've seen it in any matter, a number of cases. so you know the fact that they're

black men beating and brutalizing another black man. it's even that's much more disheartening. but you know what? what they see themselves, as is a part of the thin blue line. and so the idea that it can't happen. it's for a black officer. to do it to a black person is absurd. the point is, is that they're on they have unchecked and unmitigated power , and they believe that they can do these things. and oftentimes they do, and there's no consequence. dante, though emotions obviously really raw anytime there was a death like this, and especially when there is video like this, your message to people, though, who might be responding to this and have certain feelings and emotions after watching it. i can understand. i have my own emotions. it's hard for me to see something like that and not be emotional. we're human. how can you see something like that and not have a reaction? all i can say is that you know, i'm glad that justice at this point
