about yesterday's deadly police shooting. >> a law suit between uber and wamo over self driving car technology ends in a settlement. >> san francisco 49ers new franchise quarterback is speaking out one day after signing the record breaking contract. good afternoon. >> about 20 minutes ago the san francisco 49ers introduced the newly signed quarterback. he psyched a new five year contract worth more than $137 million. 90 million of it is guaranteed money. >> this is where i want to be honestly. i wanted to get this deal done. it's only going to help our team going forward, into free agency. it's 75 degrees out here so it's not like chicago. we just came from that. i can speak on that. it's a lot better here. there are other factors that go into it, but that's a big part.

a superbowl. san francisco based uber agreed to settle a law suit that alleged the ride sharing company stole self driving car technology from a subsidiary of google. >> alex savage is live with more on what the settlement means. >> reporter: it really is a surprising settlement. good afternoon to you. google's autonomous vehicle subsidiary will be getting a big pay out here. the company took uber to court accusing the ride sharing company of stealing trade secrets related to self driving cars. four days into this trial at the federal court house in san francisco, the two sides agreed to a settlement which was announced in court. uber will pay waymo $245 million. in the lawsuit waymo claimed a former google employee teamed up with the former uber ceo to steal laser sensor technology

which helps guide self driving cars. i talked a short time ago with a reporter from c net who has been covering this case and i asked her whether either company was the the clear winner in the deal. >> i think both companies have a lot to gain from the settling. a lot of dirty laundry was being aired about uber, and it is really trying to clean up its act. for waymo they got what they say they've wanted, that their trade secrets not be used. >> the testimony was really interesting but there never was a smoking gun. we heard all about uber's, you know, corporate culture, misdeeds. but we didn't hear that they had actually gotten the files. >> reporter: uber's current ceo put out a statement today about this settlement acknowledging that mistakes were made in the past at the ride sharing company and promising that uber

will not use any of waymo's self driving technology moving forward. part of the statement put out reads this "while i cannot erase the past, i can commit on behalf of every uber employee that we will learn from it, and it will inform our actions going forward." we should point out that the former uber ceo who did testify during the four days this trial was going on at the federal court house had been pressured to step down as ceo of the ride sharing company in part because of the allegations brought forth in the waymo lawsuit. >> alex, thank you. oakland police say they've made an arrest in a deadly shooting. they posted the update to their twitter account. the shooting happened a little bit after 8:00 last night at 74 74th and international. police say the man was pronounced dead at the scene and no other details on the arrest or victim. to antioch, a deadly

officer involved shooting of a man who police refer to as a wanted fugitive. >> reporter: shortly after 5:00 p.m. antioch police fired on a man they say was a fugitive. sources confirm that the man shot was 40 year old lloyd harris. >> the subject was wanted in multiple jurisdictions for serious crimes. >> reporter: sources say harris was wanted on a federal warrant and police officers trailed him from a home to the was station, tried to useless lethal means but he managed to make it inside his vehicle. while inside the vehicle he made a threatening move, reaching for something. at that point at least one officer fired. >> during the attempted arrest, officers, at least one officer fired his hand gun and the subject was struck. he has since been taken to a local hospital, and we have

recovered a hand gun at the scene. >> reporter: sources tell ktvu that the gun was a replica, a realistic looking bb gun. ktvu has learned harris had multiple arrests and convictions. police and the district attorney's office are investigating the incident. an update on a story we brought you yesterday at noon. four people are in custody and one woman is on the loose after two home invasion robberies that claimed the life of one person. this photo was released, about 4:45 yesterday morning her and other suspects shot a man during a home invasion on fulton road near santa rosa. the man is expected to survive. later the suspects we are told broke into a second home where a marijuana grow operation was happening. people in the home were tied up and one person was shot and died at the scene. hours later police arrested

three of the suspects after a car chase and they found and arrested the 4th man later in the evening. as of now hembry is on the run wanted in connection to the homicide. she's considered armed and dangerous and they add if you see her call 911. police investigating a violent home invasion robbery 8:30 wednesday night on little foot place. four masked men armed with guns broke into a home where seven people were inside including two children. the suspects pistol whipped and dragged some of the family and stole $8000 in cash, jewelry, electronics. three victims were treated for minor injuries. if you have any information, you are asked to call police. a brief government shut down is over. president trump tweeted he had signed the $400 billion spending plan claiming our military will be stronger than ever before. we love and need our military and gave them everything and more. first time this happened in a

containing the north korean threat. the canadian prime minister wrapped up his visit to the bay area. he met with governor brown, lieutenant governor newsome. they talked about climate change, developing technology for zero emission cars and how to expand trade between california and canada. >> it's great to be here and great to be able to talk about the issues that bind together california, canada, and other great work that we used to do together. >> yesterday the prime minister met with executives in san francisco urging them to set up shop in canada. there were a few protesters that say they're upset about the participation in the kinder morgan pipeline project. we are in for another pleasant weekend but sunday will involve a change. >> spring fever continues for today but as we get into the weekend temperatures will begin to drop off.

it will turn breezy especially in our hills. there is a look at san francisco. isn't that beautiful? as we look to the east bay we have a lot of sunshine for today. temperatures will be in the upper 60s to upper 70s and we are already seeing some of that at this hour. half moon bay is 75 degrees. 67 in san francisco, low 70s in berkley, 74 concord, 74 in the north day. temperatures are up by a few degrees in most areas, up by 3 in oakland, 3 in santa rosa. that will be the warmest day. things start to change as we get into your weekend. here is a look at the high pressure still in the pacific controlling our weather pattern. there will be a system that drops on the back side of california and that will help turn conditions cooler and eventually breezy. today sunny for all, nice to warm.

if you will be out and about, it's gorgeous. don't forget your sun block. into sunday, there is a change coming our way. that transition is happening between saturday and sunday. temperatures expected for the afternoon today are 76 santa rosa, inner east bay mid 70s in concord, east bay shore, low 70s in oakland with 72 for san francisco. south bay locations will range from upper 60s to upper 70s. 80 today for gilroy. as we get into your extended forecast temperatures are dropping off on saturday, not quite as warm as today. it's still very nice, very well above seasonal average. sunday evening is a little bit cooler. that's when we expect the wind to turn up because we haven't had any rain. we are talking about wind, and now we are talking about february weather. no advisories are issued yet

with you there is definitely heightened alert. >> a possibility. >> temperatures are looking too to trend downward monday into tuesday but still no rain is in sight. >> thanks. people living along california coast were treated to a light show in the water earlier this week. tiny glowing phytoplankton lit up the waves. tiny single cell organisms that form near the surface. apparently they're always there but you can't see them unless conditions are right. in the photos, they are. >> we know the weather here is beautiful. it's a different story across the the rest of the country. millions are in the path of a massive winter storm bringing heavy snow and frigid temperatures to several midwest states. >> already some major air lines are canceling hundreds of flights. in chicago the bulk of snow is winding down.

here comes the messy part as the city works around the clock to clean up anywhere from 8 to 12 inches of snow. the city has over 300 plows and salt trucks going around the clock hitting major arteries and then hitting side and residential streets. many have been largely untouched and probably will be for the rest of the day considering how sprawling the city of chicago is. right now the city is warning anyone who is parking where they shouldn't be will be fined and at the o'hare and mid way airports nearly 1000 flights have been canceled. you can imagine the domino effect that will have on airlines and flights around the country. city transit authority is heating the tracks to keep trains moving. the storm is far reaching from minnesota to ohio, chicago expecting a 1-2 punch with more snow on the way sunday. this is one of the classic winter headache storms for just about everyone except for

a new report shows more people are leaving san

francisco than moving in. according to a website for the real estate industry, in the 4 4th quarter last year, san francisco saw the major exit for a city. top destinations for people moving out of the area are sacramento, los angeles, seattle, portland, san diego. we'll take another look at stocks. dow jones is up by 100 after some major swings earlier in the session. one week ago today, last friday, is when the dow closed down 660 and kicked off a tumultuous week. pg & e reporting profits took a financial hit in the 4 4th quarter last year that includes the three month period when devastating wildfires struck the north bay. pg & e has incurred costs of $82 million in connection with the fires. the wine business institute at

sonoma state says 99.8% of vineyards went unscathed. researchers surveyed and there was a 70% drop in the number of tourists visiting tasting rooms. people affected by north bay wildfires who haven't yet applied for help from fema are facing a deadly of this sunday to do so. attorneys say some people especially the homeless or those who don't speak english have been left out of the process. attorneys have been visiting homeless incampments to share information on how to apply for help. the the story of the cardinal newman high school football team will receive nationwide attention. espn is handling segments on the show sports center. it will focus on the star quarterback and wide receiver who both lost their homes in the fire. it also destroyed much of the campus. yet the team persevered and went all the way to the north coast section division iii

championship game. teachers and counselors facing layoffs in one school district. what officials are attributing to the pink slips. >> new flu numbers out. some warn even if you have already had the flu shot this season, you should still go out there and get it.

an east bay school district facing budget cuts. that could mean pink slips for as many as 20 teachers and counselors. >> some say the cuts reflected changing demographics. >> the end of the school day is a happy time for many students. things may not be as nice next year. if the district eliminates 20 full time positions, half of which are teachers. >> we will plan for the worst and hope for the best and we'll see where things land by march 15. >> also, three science, two physical education teachers and three counselors which one student says adds up to unneeded stress. >> we have to wait longer to get classes changed. they help a lot with careers. they can help with college credits and stuff. >> cuts are necessary but over the last seven years the district has lost roughly 100 students a year.

instead of a population of 7000, the number is decreased to just under 6000. >> cost of living and cost of benefits for us is increasing by 12% a year. what we are getting in revenue and students is actually decreasing and not making up the difference. >> reporter: school officials have made drastic cuts but there is still more needed to be done. 85% of the budget is made of personnel and that's why the jobs are at risk. losing teachers may mean an increase in your child's class size next year. >> it's bad because it will be harder for the kids to learn. you know, getting one on one with the teachers. >> typically we end up bringing most of the positions back. that's been the historical way to do it. it takes time to work through it with the union. >> leaders say there is a bright side. they say over the next six years enrollment is expected to increase by 250 students. until that happens, they're doing all they can to protect class sizes and experienced

teachers. >> looking at tenure, at who started late as a temporary teacher verses a teacher that started at the beginning of the year. >> the numbers are not etched in stone and the district has until march 15 to notify anybody they're not planning to bring back. san mateo police department says its officers all have body cameras after a year of research and training. this is insteaded to help improve transparency, credibility, evidence collection. >> it is the mission of the police department to remain transparent with those we have sworn to protect with honor and serve with pride. this will capture professional conduct our officers have with the public. >> the department says the public can make requests for footage captured by the cameras but the requests will be reviewed on a case by case basis. >> a report finds number of african-american pedestrians and motorists being stopped by oakland police is down.

according to a study, traffic stops involving african americans dropped 18% last year in oakland. in 2016 the study found almost 2/3 of drivers stopped were african-american. the racial disparity has been an ongoing issue. today the police chief said in the year since she has been hired the department reduced racial profiling by officers and shifted to a precision based policing model. >> it is very important that our focus not be on a person's gender, their race, but behavior. it is behavior that we are focused on. based on history, we know who is engaging in criminal behavior. so we are trying to intervene verses just arrest as well. >> chief kirkpatrick says the emphasis on precision based

policing is helping repair the relationship between police adam frazier the african- american community. the city of oakland is facing a law suit after a deadly fire. surviving tenants and families of victims who live at a halfway house originally filed suit last april after four people were killed in the march fire. last month oakland was added to the defendants. in 2015, a firefighter checked a referral box to alert an inspector to visit but the referral alert didn't work and the building was not inspected for another 15 months. safety problems were found and three days before the deadly fire the inspector wrote in an e-mail "this building is dangerous" but no precautions were taken. about 9:40 last night a fire was reported at a transformer near oakland colosseum bart station. an hour later smoke and flames

were reported along the tracks. one station was closed while the situation was checked. no damage was found on the tracks and service resumed but there were delays after midnight. police asking for help identify suspects they say they believe robbed the same convenience store twice. the first robbery happened on december 22. police say two men went into the store wearing black hoodies, face masks, held the cashier up at gun point. police released this short surveillance yesterday after a second robbery a man wearing similar clothing, blue gloves, and a black hand gun went back on january 26 and again stole cash from the register. police believe the two robberies are related. if you have any information you are asked to call the police. according to a report from cdc, there have been 63 pediatric flu deaths this season nationwide. according to the last report in california, at least 127 people

died from the flu since october. that includes 30 deaths reported in just one week. when it comes to the flu, it is not a one and done kind of virus. since there are several strains, you can be hit twice in one season. >> our reporter spoke to a doctor to see why you should still get the flu shot even if you have already had the flu. >> the flu can knock you out. >> predator i believe, especially this year. >> reporter: laura just got over the flu. >> i got the chills and i went to the doctor the next day and got the medication. >> reporter: even if you have had the flu this season, you can still get it again. >> yes, you can get the flu more than once. >> reporter: a professor of medicine and a fox news medical contributor. >> there are four prevailing strains this year like there is every year. you can't really get the strain you just had but you can get one of the other three. >> it is strongly recommended you get a flu shot if you

haven't already, even if you have had the flu this season. >> if you have had the flu and you haven't had the shot, i would still get the shot because you can still get one of the other strains out there. the shot is actually better at protecting against the strains that are just coming into play now. >> reporter: the flu shot will not prevent the flu, but it can decrease the severity of your symptoms. flu season is far from over. doctors say it will last through the end of march. >> go and get it. i am expecting several more weeks of peak flu activity. it takes about two weeks for the flu shot to work. >> reporter: classic symptoms are extreme fatigue that comes on rapidly, muscle aches, a high fever. doctors say in most cases you will feel like you got hit by a ton of bricks. police in san francisco state university investigating the death of a student on campus. officers were called to the dorms tuesday.

golden gate express reports officers found a man's body. he was declared dead shortly there after. police have not confirmed the cause of death. new sexual harassment prevention plans. the program will be taught to sophomores, juniors, seniors and will be different for each grade level. they'll teach children about sexual harassment, healthy relationships, consent, online harassment. students have complained how the school district has handled title 9. facing allegations of sexual harassment. cristina garcia inappropriately touched a male staff member following an assembly softball game. it is said she had been drinking and her actions made him feel uncomfortable. she said she did attend the

49ers on the new $137 million contract. >> our anchor is doing a little one on one with jimmy. >> you can't talk about your situation without talking about your contract since it is the richest in nfl history. did that surprise you based on seven starts, that you got that much? >> i think it was a mutual understanding between the two sides. we had a common goal. i wanted to be here. they wanted me here. i think we worked it out very well for me and the team. it will help with free agency and all that and have a great off season. >> you have been with championship teams with new england. how close are the 49ers in your opinion to being a really good football team? >> i think we are a good football team. it's the little things that separate the great from the good. we are working our way up there. this off season will be very important, putting the right pieces in place and getting on the same page with your teammates and coaches. it's going to be a whirlwind but we are looking forward to

service is still looking and observing some of that information coming in. here is a look at the temperatures. another unseasonably warm day. today is even warmer than yesterday. today will be the warmest day with 75 in half moon bay, low 70s in berkeley. i am not sure if this is correct in oakland. to the north bay, 71 in santa rosa. it's a few degrees warmer in oak land now. the high pressure is in control. we have seen this day after day now for a couple weeks at least. we have a system that's going to drop in. it doesn't come via the pacific. it's moisture starved. it will not have rain involved. it will drop down the back side of california. that's going to bring a slight chance of snow showers to the sierra monday. it's also going to bring a slight chance of scattered showers to southern california

as we get into the work week. it's not really anything that's going to be beneficial because we are looking at dry weather for now since january. for today, 70s are expected. then we will be cooling it down as we get into your weekend and the winds will be kicking up as well. it has to do with that system that will be dropping on the back side of california. last time we received rain on the 25th of january and we are looking at at least mid february or even farther out now before we see decent rainfall. as far as rainfall totals since october, the percentage is continuing to drop of course. we are now 58% of average in san francisco, 64% in oakland, 53 san jose. in the north bay, 58% of average. afternoon highs today are under mostly sunny skies, gorgeous weather. it feels like spring. the trees and flowers are blooming. you may be experiencing

allergies. low to mid 70s for the east bay. san francisco is looking good in the low 70s, 76 santa cruz, 80 in gilroy. your temperatures are continuing to cool for the back end of the weekend especially along the hills, coast, inside the bay. temperatures are continuing to fall but i would love to see some rain come back and snow for the sierra. >> thanks. a few hours from now an asteroid will pass close to the earth. astronomers say don't worry. the size is between 50 to 100 feet. asteroids this size only come this close once or twice a year. it is expected to pass by earth at 2:30 this afternoon. santa barbara county sheriffs department will not longer use the word voluntary when there is an evacuation. this was made after the mud slide that killed 21 people.

some california lawmakers are proposing legislation that

the number of saving accounts with a balance of $1 million or more grew in the 4th quarter. fidelity says there were 150,000 401(k) accounts with $1 million or higher compared to 93,000 this time last year. apple launching its home pod smart speaker today. the home pod costs $349, about 250 more than the basic amazon echo. apple defends the price tag because of the premium sound system. the sound is great but siri doesn't offer as much as amazon speakers. the down vote button lets users flag and hide comments they think are inappropriate. right now it will appear on public posts, not individual accounts. this feature comes after the ceo's vow to create a platform
