wednesday, july 21. i am dave clark. >> good morning. and i am pam cook. let's start with the weather. mark is in for steve. what is weather like? >> good morning to you. the weather has not changed too much. fog and drizzle this morning, temperatures head into the 50s. skies partly sunny, more sunshine inland and fog around the beaches. afternoon seabreezes kick in, 15 to 25 miles per hour. more in the forecast in a few minutes. sal now has an update on traffic. good morning, sal. good morning. looking at traffic on interstate 880. moving along pretty well. we will be following that as we monitor traffic in the area. if you look at the bay bridge, small delay in the cash lanes, but really nothing major heading into san francisco. back to dave and pam. late last night the oakland city council approved an ordinance that would make the city the first in the country to license marijuana

cultivation. claudine long joins us with more on the controversial vote. good morning. >> reporter: yes. certainly the city council chambers were packed. this was a pacific vote last night. city council members say they know other communities are watching and could be going down the very same path t. vote came last night. the road toward industrial pot growing operations is well on its way. they voted 5-2 in favor of the plan. there were patient arguments on both sides of the debate. it would license 4 industrial plants where marijuana would be grown, packed and process. we are talking about industrializing pot cultivation, in contrast to the mom and pop centers you see now. supporters say this will be an economic boom for the city. critics say you will destroy small growers. others say it is time to move

on it now. >> if oakland want to do it, you need to start. berkeley is starting. others have if i canned my brain saying how do you do this. i know, if you start this -- don't start this, other people will. >> these are small mom and pop operations. they can make a living with this business. they are not getting rich, but they are able to live a good, middle class living. >> this ordinance would allow for four permits. reportly almost 200 interested party haves said they would be interested in getting one of those four permits. the pharmacists would only be allowed to sell to medical cannabis dispensaries, but some argue that if it is legalized, oakland could be in a good position to lead the industry. as far as the small growing operations, that is where most of this concern is. there is no provision in this ordinance for those hundreds of growers that supply the four

dispensary in the oakland, but the city council did promise last night to form late some kind of plan that would deal with the small growing operations before the permits are issued in january. live in oakland, claudine long, ktvu fox 2 news. >> and they have filed a lawsuit seeking to shut down a medical dispensary operating there. they argue morin holistic solutions the housed in a building that is zoned for light industrial. according to the lawsuit, medical marijuana dispensaries are not considered light industrial. parent haves complained about the dispensaries location around redwood high school about half a mile away. 60:00 will. the man who ex-- 6:04. the man who exchanged gunfire on the 580 freeway is expected in court.

45-year-old byron christopher williams was planning to begin a revolution. he was on the 580 when he was pulled over by the chp on sunday. he was planning to kill people at the american civil liberties union and the tides foundation because he didn't like their little view. >> we heard adverse comments about our work and various comment in the past, but inner anything like this. no -- but never anything like this. nothing even close. >> the head of the tides organization said he never heard of williams until the police notified him. yesterday williams was charged with four counts of attempted murder in the third degree finished last week's freeway shoot out. well, ac transit is warning its riders, expect more delay this is morning and possibly for the next 10 days. hundreds of bus drivers failed to report to work monday and tuesday, stranding many riders and delaying others. all this after the transit

agency imposed a cost cutting labor impact on the driver. >> 20% of the drivers are staging a sickout, and we think it is a terrible thing to do, because it penalizes the riders of this district t working class, poor, young and elderly. >> ac transit did an entire restructuring of the service that is providing to the public. they isn't put the public on notice, so, therefore, they are making it look like we are not come to work. >> now, the bus drivers have gone to court. they are seeking a temporary restraining order. however t judges ruling won't be issued until july 30th at the earliest. we did check this morning and there were no new fire in the berkeley overnight, but police and firefighters continue to search for suspect in a recent rash of arsons. since friday there have been 13 suspicious fires south of the uc campus, mostly in trash cans. we told you the latest arson

was around 4:00 yesterday morning on telegraph morning just about a block from campus. look at these pictures. they show two men walking to a trash can in front of the store. you can't see exactly what happens next, but blames flair up the moment the two men leave. >> i hope the two in that video get caught, and something worse happens to them than like a night in jail and they actually go in for arson. that is arson. it is not a little pertaining. >> if you recognize the two men in the video, please contact berkeley police right away. authorities say they want to stop the arsons before someone gets hurt. san francisco billion are serving for a woman who -- police are searching for a woman who robbed two bank of america branches. this is taken at the bank of america branch on balboa street. she had a gun and demanded money. four days later police say the same woman held up a bank of

america branch on diamond heights boulevard. she is 5'3", 130-pounds, and brown hair tinted red. san francisco police also want your help this morning trying to find a missing elderly man who suffer from dementia. anthony gardona was last seen in the elderly care district saturday. he is hispanic. 6'2", brown eyes and grey hair. he walk we had a limp and because of the dementia, probably can't find his way home. contact san francisco police if you have any information. 6:08. we want to go over to sal who has an update on the fatal accident in sacramento. >> yes n roseville, south of sacramento, near douglas and i- 80. after douglas. major injuries, a confirmed fatality blocking the two right

lanes. the coroner has arrived on the scene. a big rig hit a pedestrians. this was reported first as a pedestrians on the road. that is why it is so dangerous to be out on the freeway. i am not exactly sure why the person was on the freeway, but he was hit by a big rig. the freeway is going to be closed for quite some time. if you are leaving the bay area, heading up east sacramento to rowsville, this will affect you. -- roseville, this will affect you. and look at i-80 westbound to mcarthur mays, no problems in the toll plaza there. the weather is a different matter. hello, mark. that was a nice observation about the cloud deck. a deeper marine layer with the dense fog has kind of elevated a couple hundred feet. we don't have the complete overcast right in the surface. upbound a can positive of clouds and drizzle up there.

welcome back to the morning news. 30 people were injured last night, one critically when a united airlines jet hit severe turbulence over kansas. it had taken off from washington, d.c. and with no warning, the plane simply droppe20 to 30 feet, sending drinks and people flying. >> i saw drinked hit the ceiling in front of me. i saw someone hit the feeing and come back down. luckily i had my seatbelt on. >> more than 20 people were taken to the hospital as a precaution t. plane landed in denver. the injuries include bruises,

whiplash and sprains. time now, 6:14. early this morning, agriculture secretary, tom vilsack issued a statement, saying he will now reconsider the statement for the resignation of an official on the grounds of making racial comments. now the employee says she is not sure she even wants her job back. >> reporter: good morning. shirley sherrod said she wastered so by her -- said she was treated so cold by by her bosses as usda, she is not sure she would go back to the job. agriculture secretary, tom vilsack is criticized for acting too quickly in the case and not getting all the facts. this video of sherrod shows her intentionally dismissing white farmers for help, but the

family comes out today saying sherrod did help them. it is said usda officials over reacted. >> if they had taken the time, even without looking at the tape, to look at me, to look at what i have stood for and done since i was actually been at a the department, i don't think they would have been so quick to do what they did. >> reporter: and, in that 2:00 a.m. statement, vilsack says he is now launching a thorough review, something sherrod says should have happened before she was let go. ktvu fox 2 news. secretary of state hillary clinton is in south korea, killing solidarity with the government there. secretary clinton and robert gage held high level secretary talks with high level officials and they announced noisings against north korea, as the united states will freeze

assets and prevent some businesses and individuals from traveling abroad. secretary clinton says the sanctions are signed to limit north korea's nuclear activities. the oil spill president is down playing worries that the cap on the well is causing problems. thad allen says at least 5 leeks have been discovered around the well, but dismissed them as very small drips, like an oil leek around a car. a relief tunnel should reach the broken well by the weekend, meaning the well should be shut down for good within two weeks. and a bill to extend unemployment benefits should be extended. the democrats over came a republican filibuster yesterday with the help of maine' two republican senators and the new senator from west virginia. after a full senate vote t bill goes back to the house, which is expect today approve it. and the nomination of kagan

behind bars, and after that she will go directly to an inpatient rehab facility to complete her 90 days. well, people who carry weapons say legally they are vindicated. an palo alto police officer is criticized for a comment on his facebook page where he joked gun right supporters should be shot. a group of supporters showed up at palo alto city hall last night to protest the fewer of the department to quick -- failure to quickly discipline the police officer. there is an internal investigation which found detective, rod tuason's conduct unbecoming of a police officer. >> being a police officer, irresponsible for things you do on and off -- you are responsible for things you do on and off duty. and his conduct did violate department policy. >> he could be suspend, but

now with the details on the controversial late night vote. we have claudine. what happened? >> reporter: the votes came in 5-2 in favor of the ordinance. what that means you could be looking at the brand new world when you are talking about marijuana growing operations. this is a history-making vote at city council chambers. it is certainly getting both sides passionate on the debate. there are moneys of small growers currently that support ply marijuana dispensary. this is a big industry. last year they sold $28 million in marijuana. oakland has a pot tax already that city council members wants to raise. what does this new ordinance mean. it take it is business of growing pot up a bunch of notches. we are talking about four permits, going to industrial- sized operations, each with $211,000 in permit fees, 8% in sales tax and $2 million in

liability insurance. estimates say the city could get at least $1.5 million in new revenue every year. that is a lot of money for this cash-strapped city. oakland may be the first to walk down the path, but sit likely not to be the last. >> as the industry continue to emerge and grow, we know that other cities are looking at this and trying to figure out where these types of facilities can be located. >> reporter: almost 200 people have expressed interest in the four permits. a few of those people already have plans they are talking about of the one operation boasting they would be the world's largest. so, what does that mean for the little growers. remember, there are hundreds of them right now. that is unclear t. ordinance doesn't say anything about them. but last night, because it was such a huge concern among people critical of the ordinance, they promise today work on a plan that would

address the small grandmothers before the permits are issued in january. whether he have more on that, claudine long, ktvu fox 2 news. >> well, an internal investigation is being launch because of a video tape arrest on you tube. we have more on a look at what it reveals. good morning, craig. >> reporter: good morning, pam. this is the second controversial amateur video tape involving san francisco police officers in about a month. the first one involved officers following a pride parade celebration. there appear to be differences between that video and this one shot on sunday. police are conducting an investigation into the officer's action. police say they stopped the woman walking down the street because she was a suspect in an assault they were responding to. the identified woman who was pushing a baby in a stroller was drunk and resisted attempts

to get into the police officer's unit. they then force her to the ground and she appears to fall down face first. she bit one of the e in, t's along the way. the officer involved in the video has been put on nonbeat duty. a form vietnamese fighter pilot accused of attacking a musician on stage is speaking out ahead of his court appearance. 61-year-old lee congress calls himself a freedom fighter. he is describing his bizarre attack during a concert. he offered the entertainer flowers bioplasted him, instead, with pepper spray. he disguised himself as a female fan to get close to the stage. >> i am not a celebrity. the organizers know who i am so

the $480 million project. now the bart board is looking at the new funding plan which relies on money from a mix of state and federal sources. opponents say the project is financially risky and maintain that the buses, now used to link bart with the airport work just fine. bart is also expected to vote on temporary fare roll backs at tomorrow's meeting. because of an unexpected budget surplus, bart officials are considering reducing fare business 3% for about four months. according to a bart survey, four out of five passengers oppose the idea, saying the extra money should be used to extend service hours and clean the cars. late last night after long, intense negotiations, san francisco's mayor and supervisors agreed to a 6.5 billion budget. the spending plan restores funding for many health and human services programs. it does not include two controversial proposals from the mayor to increase the number of condo conversions and

it could affect a lot of people. we have jay hernandez in alameda. >> reporter: good morning. it could be another 10 days until a judge steps in. we spoke with a at transit spokesman. they expect anywhere from 200 to 250 union operators to equal in sick today. rider here in alameda say the delays hurt them. >> the only way i can get around is car or bus. that is the only way or you are walking. it is important to get to the bus. >> reporter: ac transit this morning can't tell me where the longest delays are or how many drivers have called in sick this morning, but ac transit is calling this a sick-out. on sunday a new work schedule was put out changing the shifts and schedules of more than 1000ac transit drivers. 200 called in sick this morning, and yesterday 250

drivers were out. a superior court judge is now weighing whether to lift an injunction to lift the new schedule, but a decision won't be reached for at least 10 days, which means riders will not see an end to their delays. they issued an apology on the website. >> we have try today make concessions. i will not negotiate in the public. we try today make concessions. ac transit want as strike, which is why they are doing everything within their power to disrupt the lives of the people who do their work. we are at work. we are. we are at work. >> it is reckless for the a/c u leadership to try to overturn the district's decision of the contract. they have cut everything in the district. management. riders have paid their fair share. it is time for the union to step up to the plate and take cuts themselves. >> reporter: about 236,000 riders use the east bay bus

system. the biggest delays, we were told yesterday, were right from alameda to berkeley. the riders on the dunbar don bridge line also experienced delays monday and tuesday. time now 6:46. a little baby in los angeles county has just become the 6th death this year in california's whooping cough epidemic. the i want incidents around the case are five times higher this year than last. the cases are expected to spike between now and september. doctors are advicing parents and child care workers to get booster shots against the disease. well, time now for an update from sal on the traffic. do you have an update? >> yes, i endorsement the problem at 580 and livermore at airway boulevard, with a motorcycle down, blocking all
