lawmakers want to increase the fines for protesters who choose to block highways like we've seen here recently. and new federal rules crackdown on hidden fees and makes it easier for you to get a refund. >> from the local news station, you're watching you on morning team. >> good morning and thanks for waking up with us. i'm daria and i'm james john and rain here as well as we're looking at whether and news this hour. working on the animal. you got some breaking news this morning. army wants go into getting a new trial and that landmark me too movement we'll break that down and talk about life. okay. and we're also looking at the weather day or a couple days from the thank you for and super close. but are we going to keep the clouds around? and that's the airport. oh, yeah. this weekend saturday, we get that sunshine back. and this is kind of a little bit of a preview of what that looks

like. again, because the past couple of days, you didn't see too much of it. quite our looks great. you can see that. we do have the wind pushing through today. we're getting rid of that muggy feel. but what we're adding in is a northwesterly breeze that is going to get blustery at the coast and a little brisk feeling as you're getting out there. so just make sure that you get the jackets ready to go. we're still hanging out in the 50's at this 10 o'clock hour. and temperatures barely in the 60's for concord, pittsburgh, in brentwood, but definitely still cool enough for the jacket, especially once you factor in the winds later on today. daytime highs back in the 60 similar to yesterday. another cool one tomorrow remains fairly cool, too. the weekend, though, it does look really nice and i'll get to that. still to come back to you. thanks a lot. and at 10 o'clock, our top story is a man who is in jail. >> after fighting with a police officer who was protecting the mayor of san jose. how this all happened in the middle of a kron, 4 interview with the mayor and we've got dan kerman now. >> telling a little bit more about the man who was arrested. it's this attack

that's led to the arrest of 35 year-old leslie pollard, san jose. police say pollard has been booked for battering a police officer and resisting arrest with violence. the incident was caught by kron 4 cameras during a tuesday evening interview with san jose mayor matt mahan at first in san fernando as steps right next to the mayor. both he and the plainclothes san jose police officer providing security for the mayor in-form pollard. but an interview is under way do it. >> we're moving talking for mark. >> pollard uses profanity and tells the officer to mind his own business. what happens next is off camera. it's unclear who touches to first. but pollard is heard saying all smack you right right now 9 seconds later, he does just

that hitting the officer in the face and head at least twice at that point. a scuffle in season. police are called witnesses say at some point pollard begins yanking on the officer's tie after 2 more minutes and police nowhere in sight. a customer from a nearby business comes to the offices. rescue removing pollard's hands from the officers tie and allowing the officer to handcuff him. police eventually arrived and took pollard into custody. one person who witnessed the confrontation but didn't want to go on camera says he's not even sure that the suspect knew the mayor was even -% involved in all of this and was definitely clear that the person did not know that the security person protecting the mayor was actually a san jose police officer. while kron 4 has posted edited version of the video online sent as a police point out in a statement, the video does not contain the entire incident in particular. it does not include the officer identifying himself, nor does it include the many attempts

teammate to de-escalate the situation and avoid using force or taking any enforcement action. police confirm pollard has an outstanding arrest warrant out of georgia for resisting arrest with violence. the officer hospitalized overnight with head and neck pain. but it's now been released. the case is now under review by the santa clara county district attorney's office. dan kerman kron. 4 news. >> happening today, classes will resume at san jose city college after police canceled them yesterday to investigate a bomb threat. the threat came in shortly after 5 o'clock last night. this is video showing police blocking moore park avenue at bascom. they did that while they searched the campus, took about 3 hours to do that work. and in the end, investigators say they found nothing suspicious. >> the sonoma county sheriff's office is asking the public to share any information that you might have about the victim of a cold case dating back to the 80's is a picture of jeffrey thomas group and his skull was

found in 2001 and turned into the sheriff's office in santa rosa 2001, it was categories categorized as a homicide as they had this call that it took investigators more than 20 years to identify whose skull it was and they figured out it was reopened. rubin came from the east coast and he was rumored to have worked as a house painter in california. so they're investigating that cold case. it's 10, 0, 4. and there's a bill making its way through the state legislature that would double the fines for protesters who block our bridges and freeways. certainly there's bipartisan support for it at the state capitol. >> but maybe not so much across the rest of the state with kron four's sara stinson with a look. >> this bill is proposing to increase fines for protesters every time they're convicted of blocking traffic on highways. the hope is to deter them from doing it again. but civil rights advocates tell tougher penalties will not stop people from speaking amid

a series of protests related to the israel-hamas war assemblywoman kate sanchez has introduced legislation that would crack down on any demonstrations blocking traffic on highways in california. so this is because public safety, healthcare risk and honestly. >> i would hate to get to the point where we're losing a lawsuit. one life sanchez says she became frustrated after 78 protesters arrested for blocking the bay bridge in november. >> we're only ordered to 5 hours of community service and $57 fines under current state law. protesters can be fined anywhere between 100 to $500. >> sanchez wants to double those fines up to $1000 depending on past convictions because we see that these laws on the books are are not enough right there tie the chart. what's happening now? we believe in doubling that would give them. >> yes, mark tolls in their tool box. this bill passed transportation committee hearing by both democrats and republicans, the california

highway patrol association also in favor saying these protests prevent first responders from doing their job. this is dangerous. something needs to change. >> the executive director of the council on american islamic relations is on robbie lou is speaking out against the bill. frankly, i'm appalled that our legislators are using the pretense of transportation and public safety. >> to quell. first amendment protected activity, the loose as if this bill gets passed into law. it won't stop protesters. the only way to deter protesters. urgent implement a permanent cease-fire. now. >> assemblywoman sanchez says she's hopeful her bill makes its way to the governor's desk. it next goes to an appropriations committee. i'm sara stinson reporting the studio. back to you. >> it's 10, 0, 6. and we have breaking news this morning. the new york appeals court has overturned. harvey weinstein is 2020 rape conviction and

they've ordered a new trial in this landmark. me too case. rick conference radar here in the studio to take a closer look at what exactly happened. dari and james, the new york's highest court ruling that the former hollywood mogul. >> wasn't given a fair trial. the new york court of appeals decided the judge in the case was prejudice against weinstein allowing testimony from 3 women whose allegations weren't connected to the case. however, prosecutors say weinstein abuse his power take advantage of aspiring female actresses and the flood of assault allegations against back in 2017 spark the me too movement. now weinstein has maintained his innocence say that any activity was all consensual. it's been serving a 23 year sentence in prison following that twenty-twenty conviction and he will stay behind bars because he was also convicted in los angeles 2 years ago of another rape and sentenced to 16 years. as for the new york case, the manhattan district attorney's office could decide to retry

to the government that it is so difficult to get a refund. you have to be delayed 3 hours or more domestically for an international flight 6 hours or more, but it doesn't stop there. if your bags are delayed after you land more than 12 hours, no questions asked you to. we'll get a refund for that. and that includes taxes. got a chance to talk to travelers this morning. they, of course, are on board with it. scramble to find other airlines flights to get on and then have to pay for that and not get refunded because you chose not to take that flight. so, yeah, it's been frustrating. >> airlines, they're saying that they're not crazy about this, but they were always offering refunds big. did you know about that? no, i didn't know that they're offering refunds. i just got a free credit on a flight that was delayed to our east recently. but i didn't know i can get a refund for the ticket. now there are hard guidelines, 3,

6 hours and you will get your money back. you don't have to wait on line for ever. >> talking to somebody hoping to talk to somebody for a refund. it should come back within a week or so to your credit card and no junk fees, whatever they average ties is exact price, no more lower price. and then you go book your flight, all kinds of fees. come forward and all of a sudden that deal doesn't seem like a deal anymore. they have to be up front with the prices. back to you. >> 10 10 is the time. and still ahead on the kron 4 morning news. nearly 3 dozen death penalty cases in alameda county are in limbo. now because of potential misconduct. we're going to talk to some legal experts about that. and college students across the nation are protesting the war in gaza, including here in the bay area. we'll see how uc berkeley is responding to this camp in on campus. and big changes being proposed at san francisco stonestown mall. we'll take a look at what the

>> well, nasa's juno spacecraft is capturing some new images of that torture moons around jupiter. look at this. these images reveal 127 mile long. lava lake active volcanic plumes. and so there are the most detailed look so far at all the mountain peaks. look at that. that's pretty incredible. juno's camera captured these views while sweeping past it back in december. other than earth,

you know, this moon around jupiter is the only other place in our solar system. at this point where we've seen active magma volcanoes. so a lot of activity there. could that mean like >> who knows? and is that fresh powder excuse, lowest and all right, dan, 14 right where they still skiing. i think they are in tahoe with >> as we're getting our nice weather got some snow up there, john. yeah, and we're going to get a bit more this weekend. not a time, but a couple more inches on the way for tahoe. this is your view at san jose, which has some cloud cover overhead. but peeks of sunshine and has generally been on the cooler side after a tease to start the week. we've been back down in the 60's, partly cloudy for the bay to our north. right before the break, i showed you that advancing cold front and along it some rainfall stretching across the north coast of the state. the low pressure that's anchoring this cold front is going to pass just to the north and east of us. and as it does so is going to result in that mountain snow in the sierra as well as north coast showers. bay area,

though, were not sitting in its direct path. so just a couple of sprinkles overnight for us into tomorrow. maybe just a drop of water to chance of thunderstorms out towards the central valley. as for rainfall totals, not a lot of it may be a drop of water. as i mentioned, as you can see in future cast, the sierra gets a little bit of snowfall. 3 to 6 inches at the highest of elevations. donner summit echo past could be seeing around inch of snow. that's not going to shut anything down but could make things a little bit slick. if you're heading up there tonight into tomorrow. today's daytime highs are generally on the cooler side of things with those 50's at the coast and then 60's for most of the rest of us. it's a cooler day and less humid than yesterday. does make a nicer one to get outside. if you didn't enjoy that muggy, feel. but the catch 2 today is the wind. it's going to make for a brisk feeling day, especially with winds picking up to 30, 40 miles per hour. gusts later on today. we'll keep the jackets close at hand. tomorrow is also going to be breezy little cloudier. the

chance of sprinkles saturday. we clear things back out with cool sunshine that will stay put through next week. >> thank you, john. 10 16 is the time and in the east bay protesters calling for a cease-fire in gaza have been growing in numbers on the uc berkeley campus, demonstrators. in fact, created a tent city in front of sproul hall. all in solidarity with other universities across the country. we have video of what it looks like here on the uc berkeley campus about 70 tents or so there participants say they're going to continue protesting until their demands are met and they include that the university call for a ceasefire in gaza and stop any and all financial support being sent to israel. the uc berkeley spokesperson says school officials are monitoring the situation. he says as of now, this protest is not disrupting operations on campus. >> it comes to nonviolent political protest. the campuses are not to use law enforcement unless it is absolutely necessary. to

prevent bodily damage or threat to anyone's life. we're not at that point. >> well, uc berkeley officials say the safety of all students continues to be their top priority. it's 10, 17 and a former president of a san jose elementary school enrichment program is arrested and accused of embezzling more than $400,000 from the organization. police say between 2019 2023 tell us tonight road herself, fraudulent checks, claiming to get reimbursed for services that were not rendered. a warrant was served tuesday and she was arrested on suspicion of grand theft and forgery. in the north dave aleo police have arrested a man for stealing a car and having a loaded gun and trying to ram a police vehicle. take a look at the vehicle. he was driving monday when police saw a shattered sunroof on that car in a parking lot near tennessee street. and so they

did a check and found out it was stolen out of richmond when they tried to pull the driver over. he tried to take off by ramming a patrol vehicle 6 times. and then when after he crashed into a wall, they apprehended him and look what they found in the back seat loaded firearm with no serial number on it. police arrested him for suspicion of multiple felonies. >> finally getting a look at the future of san francisco stonestown shopping center kron four's gayle ong reports on what it may look like. >> the stones town revitalization project has been 4 years in the making with the community and the city of san francisco. that's according to brookfield properties. the company behind the proposal, the company declined an interview with kron 4 but shared these renderings of the project that include plans for a civic town center, affordable housing neighborhood, open spaces and retail. it would be good for the businesses and for the

whole community. something joseph mccain has lived near stonestown galleria for decades after hearing about new plans to transform part of the area into new homes. pretty surprised that they're they're going to do because it's been like that for, you know, as long as i can remember since the 70's, it's a good area and it's it's a great place to be. you know, they got libraries here and, >> you know, schools and things will get educated it's a great place. >> know that a good idea. i i object that but this woman who worked at the shopping center says the neighborhood has enough already. >> we need we need them all. you know, mean. >> builders are just building building and building. houses. what we don't need the san francisco planning commission has been gathering public input since last year. >> in a series of social media post, mayor london breed wrote the project will create a vibrant town center saying in part, quote, 3500 new homes, including housing for seniors, students and families, 6 acres

of publicly accessible parks. plazas new jobs in both construction and permanently on site onsite childcare to support families, funding for park improvements, transit funding to make muni more efficient. >> that was gayle ong reporting for us. the project still requires approval by the planning commission of the board of supervisors. kron 4 reached out to city officials for comment and we're waiting to hear back. >> it's 10, 20 right now and more than 100,000 rain camera customers are going to get a refund. money back because the company has reached a settlement with the federal trade commission over this case where rain is accused of allowing contractors and employees to access customers, private videos and also accused of failing to stop hackers who took control of customers accounts and cameras and videos more than 100,000 customers who have certain types of cameras are eligible to get in on this 6.5 million dollars settlement. the money

will be sent you through paypal and you'll have 30 days to redeem it. if you are part of that affected group. more than 100,000 california college students could be in stuff for some financial aid and relief by the fall. lawmakers want to expand the free tuition in cash program so that students who are not eligible for the cal grant can still get money for community college. this expansion would cost about 200 million dollars. and it depends on the state budget which has to be finalized by june. and as you know, probably know, california faces a multi-billion dollar deficit that could delay this program expansion. if it does pass low-income students and those who do not meet the 2 point, oh, gpa requirement will be able to apply. >> going to take a break here 10. 22 just about and coming up on the kron 4 morning news teams won a vote in san francisco and we'll talk about a new push to lower the voting age. and the alexis gabe

back at 10. 24 and teens in san francisco. >> want to vote and they want lower the voting age to 16 to make that happen. youth activist you and barker plumber. is gaining support among community leaders backing another attempt now to pass a measure that would grant 16 year-olds the right to vote in san francisco for local elections. not the national elections, but barker plummer says this would help increase engagement overall in local elections. among

teenagers. this is actually the 3rd attempt to lower the voting age in san francisco. the first one failed in 2016 and then again in 2020, it failed, although by a small margin. so we'll see if it fares any better this let's take a look at how bart is fairing as they go to expand the south market. you can see here crews in santa clara yesterday. >> getting the site ready for a new maintenance yard. it is going to be built behind the santa clara transit center and across the border with san jose in they're going to have 3 other bart stations that they're building there. transit officials say that this expansion will serve about 55,000 people every weekday by the year 2040. why be them? the port of oakland is busy getting busier all the time. record volume of containers coming through the port last month. nearly 203,020 foot containers. pastor the oakland port facilities. that's a 19.0. one percent increase compared to march of last year. full imports and the oakland

seaport continue to rise for the 5th month in a row. 38% increase on those and full exports. also grew. so for the 4th month in a row by nearly 15%, that marks the highest monthly total for full outbound cargo in oakland since april of 2021. well, health care cost increases will be capped at 3% under a new california rule that health care affordability board, which is a new state agency approved. >> that limit yesterday, health care costs went up nearly 5 and a half percent every year for the past 2 decades. however, people's incomes increased only about 3% a year over that same period. so health care costs of in faraway outstripping anybody's cost of living increases. so this is going to be phased in over 5 years, starting next will be following that. all right. it's 10. 26. we've got to take a break. but up next on the kron, 4 morning news, a proposed city project in oakland now has businesses a little nervous. >> about losing customers will tell you why they're worried.

us. make for that brisk wind and even result in some showers across parts of the region, including a few north bay. sprinkles tonight. as for current temperatures, we're finally seeing some more low 60's on the map that sunshine is helping out a little bit. today is going to be less muggy than yesterday, but a little bit breezier. so there's a plus and a minus for about the changes from yesterday's forecast. back to you. thanks. a lot of 10, 30 in the big story this morning in east bay. 35 death penalty cases in alameda county are being reviewed. >> because of allegations of racism in the justice system. we have kron four's terisa stasio talking with legal experts who say the ramifications could be far and wide. >> maybe what happened here is that these people were deemed to be opposed to the death penalty. and that's how they got away with removing people based on that city on wednesday, legal experts weighing in on the bombshell dropped by alameda county district attorney pamela price. >> that a federal judge has ordered the review of 35 death penalty cases after these

scribbled notes were discovered while examining an appeal for this man, ernest, a 51 year-old was convicted and put on death row for the 1995 killing of 9 year-old lance clark and attempted murder of his grandmother. price says that the notes suggest prosecutors may have blocked female black and jewish potential jurors from serving on trials. brown is a criminal law professor at uc law. san francisco. >> this is probably just the tip of the iceberg. because there were a lot of bats and shenanigans going on until california tightened its laws and what could happen next is not only could these death verdicts be set aside, but the entire case could be set aside. and some of these individuals may be given a new trial in its entirety. >> stephen clark is a former santa clara prosecutor and now defense attorney and legal analyst. while the death penalty cases are under the microscope, both a legal analysts say that there has been sweeping changes in the

past couple of decades, making jury selection more transparent. there's been a tremendous evolution and how jury selection is you have to have a legitimate reason for removing a juror. >> and you have to articulate that reason to the court. if asked. >> so we are no suspicious of removals of people on the basis not just of race or gender, but a bunch of other categories like religion, nationality. you know, a lot of other things. and moreover, when the prosecution has to provide a reason, it can't be a silly reason. it has to be a reason that stands like that. that makes some common sense. >> but legal experts say that it could take years before the truth is revealed on whether or not there was misconduct conducted in these death penalty cases in alameda county in the newsroom to recess stasio kron. 4 news. >> well, 10 33 is the time in a long anticipated documentary on the alexis gabe murder case has finally aired. gabe, who

was 23 years old at the time from berkeley, went missing back in january of 2022, her partial remains were later discovered months later near sacramento. now, gabe's family and friends and members of the community came together. it's a brand is pizzeria in oakley to watch the documentary together for the first time last night. and the family has been pushing hard as we know for this documentary to be released, hoping that will change public perception about the case and possibly lead to charges against the mother of alexis's ex-boyfriend, marshall jones. he was the primary suspect in this case. but unfortunately died while in a standoff with police. after watching the documentary, alexis, his parents say they were actually a little disappointed in the final product and the fact that it was missing what they think are key pieces, including a video of the suspects. mother. >> that video. so were expecting that to everyone to see. to the police report said something like go. he said something like it was cold but

quote. now family says they still intend to file a lawsuit against jones as mother. >> it's 35 and tomorrow in the east bay, there will be a memorial service for fallen oakland police officer jordan wingate. he died on saturday from injuries that he suffered in a 2018 car crash while he was on duty. the service is going to be at the 3 crosses church in castro valley at 11:00am. and it is open to the public. >> some oakland small business owners are concerned about a road project that they think would remove dozens of parking spaces and remove a lot of customers. their businesses are on grand avenue and kron four's. dan thorn takes a look. >> grand avenue in oakland is a busy corridor. cars parked in front of small businesses as cyclists make their way through the traffic ok'd on is proposing to improve safety along this road. but that includes getting rid of dozens of those parking spaces. our concern is that if they take

away. >> easy access to our businesses. it's going to be a lot harder our customers. able to get to veterinarian elizabeth mcdonald says the proposed removal of 30 to 40 parking spots would make life difficult for her clients, especially those who are elderly and with pets that need extra care. her business, the grand lake veterinary hospital and the grand avenue business association have been asking for input to share with oak dot. we unfortunately really haven't been able to get very much input to them. >> they have not really come down and not talk to the merchants on the street. so we got permission if we collected input. >> that we could at least presented to kdot says grand avenue from broadway to macarthur needs to be repaved to cut down on a high number of bicycle and pedestrian accidents. the proposed improvements include new crosswalks protected bike lanes and turning angled parking spaces into parallel parking mcdonald's says she and other business owners all

for safety but a more balanced approach needs to be taken. >> she thinks losing the parking spaces might be a death blow to already struggling merchants. we'd rather they slow down traffic. >> maybe have their be less lanes. but a company for both parking and safe biking, not have solution. 30 to 40 parking spots taking away affecting businesses ability to have customers come. >> mcdonald's is hoping to present ths findings of the parking survey to oak dot next month. then it's a waiting game to see if transportation officials revised their plans in oakland. dan thorn kron. 4 news. >> 10, 37 and for your money. well know insurance home insurance is expensive in california and hard to find too. yeah. last year, all state basically pulled policies for new new clients because of all the wildfires and earthquakes have had over the years of just too costly for state farm. was and how force reyna harvey is in the studio with more. so darren

james last june, all state, like you mentioned, stop writing new homeowners are sure it's in california altogether. >> because of the increased risk for natural disasters like wildfires and the recent storms that we had. meantime, over the last year and a half, you got 7 of the 12 major home insurance companies here in california, including allstate. limiting or stopping selling new policies for most fire prone areas that resilted in lot of californians struggling trying to find any insurance coverage at all. so kron 4 reached out to all state when they would start selling policies again here in california. they said in part, quote, working with the california department of insurance to improve insurance availability in the state. once home insurance rates fully reflect the cost of providing protection to consumers. we'll be able to offer hold insurance policies to more californians. so with timely rate approvals, the use of our advance wildfire, modeling and reassurance costs. so all state told us

they still sell auto insurance in california. however, they did raise car insurance rates by 30% in the state. that was back in february. send it back. you know that a desk. all right. thanks. a lot rain attend. 39 and and recently released data shows that we're marine mammals like these sea lions. you see a pier. 39, they are having negative effects because of human interactions. according to a report from the marine mammal center, the most common type of disturbance over the last 2 years. this people crowding around the animals and not giving them space. >> researchers say this could lead to increased stress levels, as you can imagine, pops sometimes being separated from their mothers and getting too close can also disrupt rescue operations to so researchers just want to put out a reminder again, don't get too close it and don't touch the animals either. even if you think you're protecting them, sometimes what you're doing can do more harm than good.

be playing particular really close attention to the draft tonight because one of the storylines it's fun to follow is the fact that >> 49 are legends, jerry rice and frank gore both have sons that are going to be waiting to hear their names called tonight. so we'll see if that happens. but this draft has a lot of college players with nfl bloodlines. let's start with jerry rice's son brenden. he's a wide receiver. had a great season with usc. he'll probably be a mid-round choice. and then here you see this is frank gore junior. he played at southern miss. he's a running back like this dad, and he's projected to be a later round pick as well. they're our is a litany of other names to ed mccaffrey's son. luke is coming off a great season at rice. of course we know looks brother. well, christian, he's become a powerhouse with the forty-niners right. and perhaps the biggest legacy name in the draft is marvin harrison junior. he's a receiver just like his dad, famous father and he's likely to go in the top 5. that's the thinking right now. forty-niners general manager john lynch says he's pretty excited to see what happens.

>> some inherent pressure on who their dad it is. but there's also some good genes. and and, you know, and i think that was out here at the local pro day and his son to rika, you know, performed really well. and that was that was pretty cool. and you could i saw him running at me and i played against, you know, a lot. and there were some in that stride that was very familiar, that it was it was something about the gate and it's crazy how those things translate. you know, it's just shameful. is that modeling that they watch their dad? you know, it's just it's interesting to me. and but it's a fun. element to this year's draft that and i think is it's going to be interesting to watch to see how it unfolds. >> well, the forty-niners have 10 picks in this year's draft. and for the first time since 2021, actually have a first-round pick there in spot number. 31, most people think they're probably gonna drafting offensive lineman because they do need a little help on that side of the ball. we'll see what happens. all right. let's change gears now and talk hockey.
