campus will reopen in the morning and classes will resume as normally scheduled it. and the north bay tonight about 1000 homes are without water in vallejo because of a water main break. officials say residents being affected are in the glen cove area of >> they say crews are working to try to find the location of the break so that they can make repairs. >> oakland, small business owners are concerned about a road project that would remove dozens of parking spaces. oak dot is hoping to make grand avenue safer with the repaving project. but businesses along the corridor say more input is needed before they can move ahead. kron four's dan thorn reports. >> avenue in oakland is a busy corridor. cars parked in front of small businesses as cyclists make their way through the traffic oak done is proposing to improve safety along this road. but that includes getting rid of dozens of those parking spaces. our concern is that if they take away.

>> easy access to our businesses. it's going to be a lot harder our customers. able to get to veterinarian elizabeth mcdonald says the proposed removal of 30 to 40 parking spots would make life difficult for her clients, especially those who are elderly and with pets that need extra care. her business, the grand lake veterinary hospital and the grand avenue business association have been asking for input to share with oak dot. we unfortunately, really haven't been able to get very much input to them. >> they have not really come down and not talk to the merchants on the street. so we got permission if we collected input. >> that we could. it was presented to kdot says grand avenue from broadway to macarthur needs to be repaved to cut down on a high number of bicycle and pedestrian accidents. the proposed improvements include new crosswalks protected bike lanes and turning angled parking spaces into parallel parking mcdonald's says she and other business owners all for safety. >> but a more balanced

documentary together. the gabe family has been pushing hard for the documentary to be released, hoping that it changes public perception about the case and possibly leads to charges against the mother of alexis ex-boyfriend, marshall jones. jones was the primary suspect in the case he was killed in a police standoff after watching the documentary tonight, alexis parents say they were disappointed that the final product was missing. some key pieces including video of the suspects. mother. >> that video is really important expecting to everyone to see. sue the something like he said something like was cold but it's not. with h and especially the inside of the house speak. what they do to

increase fines for protesters -very time they're convicted of blocking traffic on highways. the hope is to deter them from doing it again. but civil rights advocates tell tougher penalties will not stop people from speaking out. amid a series of protests related to the israel-hamas war assemblywoman kate sanchez has introduced legislation that would crack down on any demonstrations blocking traffic on highways in california. so this is becomes public safety healthcare risk. and honestly. >> i would hate to get to the point where we're losing a lawsuit. one life sanchez says she became frustrated after 78 protesters arrested for blocking the bay bridge in november. >> we're only ordered to 5 hours of community service and $57 fines under current state law. protesters can be fined anywhere between 100 to $500. >> sanchez wants to double those fines up to $1000 depending on past convictions

because we see that these laws on the books are are not enough right there tie the chart. what's happening now? >> we believe in doubling that would give them the a's marked holes in their tool box to go those that are continually putting others lives at risk. this bill passed a transportation committee hearing by both democrats and republicans, the california highway patrol association also in favor saying these protests prevent first responders from doing their job. law enforcement is prevented from helping a victim. fire trucks are prevented are delayed from coming to a fire. >> and also ambulances are prevented from getting to a patient terrible. we need to make a change. the executive director of the council on american islamic relations is on robbie lou is speaking out against the bill. frankly, i'm appalled that our legislators are using the pretense of transportation and public safety. >> to quell. first amendment protected activity, the loose

tonight. some members of uc berkeley's jewish student union say they don't feel safe on campus. this comes after demonstrators calling for a ceasefire in gaza are growing on campus. they've created a tent city. >> in front of sproul hall with about 70 tents. protesters want university officials to call for a cease-fire in gaza in the end of financial support to israel. uc berkeley says the free palestine camp has yet to disrupt campus operations and that the safety of all students continues to be the top priority. these protests are happening all across the country. video from usc shows students and school security. >> going head to head over, setting up tent camps at the university of texas at austin.

protests in support of gaza led to several people being detained this afternoon and similar protests continuing at columbia university. there. they're now asking tense to be removed by the end of the week. >> sfo in the city of san francisco are facing a lawsuit by airline mechanic who says he lost his livelihood due to a faulty security turnstile. they say the turnstile failed just before the anniversary of 9.11. now he's suing the city to get his job back. >> put on the list with felons murder and it's the same list, ok for tsa culture. spurlock doesn't want to show his face on camera because he's concerned it could be blacklisted by airlines because his airport security badge has been revoked on september 9th 2021, just 2 days before the 20th anniversary of the 9.11 attacks, the alaska airlines aviation mechanic was stopped at the employees, security turnstile, one trying to go to work at sfo. >> he used his biometrics

security badge to pass through, but it didn't work on. his first attempt started through and then the turnstile froze up and locked up. >> so came back. i tried it again. i use my bad jen fingerprint like its foes do it gave me the green light now on through. and that was the violation. they said that we had spurlock says he was accused of trying to circumvent security by trying to go through again after the turnstile froze. so what they did is they pulled my badge, astounds me from working at basically every airport that you need. a side of stands for security identification display area. the san francisco city attorney's office responded by saying spurlock, quote. >> tampered with the secured access point which violated airport rules. the airport had previously warned employees that this type of conduct posed an unacceptable security threat, ensuring the safety and security of the airport is paramount. the decision to revoke their security badges is clearly warranted. and within the airports, discretion, the airport followed all necessary

procedures. we look forward to discussing this matter. further in court emotionally, it's just been a roller coasters. the coalition used overwhelming air power to defeat a brutal dictator. >> and free a nation spurlock has been an aviation mechanic ever since his service in the air force during the first gulf war working on military aircraft. >> and holding a top secret clearance. by all accounts, he has an unblemished record and 20 years of work with the airline. not at any point was security jeopardize into the end of the day. the entire incident was a function of the faulty turnstile, which is the responsibility the airport to maintain alaska airlines and the mechanics union have tried to resolve the situation to no avail. we had our attorneys write letters airport commission. it was just a complete storm. all the timing couldn't have been worse for spurlock. i just had a baby and i was going to start my baby bonding leave 2 weeks after this happened. the has since found aviation work. but

earning less than before. i was also eligible the right tire for alaska. 55, i just turned 55. so i wasn't able to retire. but i lost my health insurance. basically took everything spurlock and his union say they think sfo and the tsa overreacted. i don't understand why the authorities at sfo are taking such a hard line on this and basically ending an individual's it scenes spiteful, it seems emotional and it doesn't seem rational. and the only thing that we're guessing are trying to figure is that it was because it was close to 9.11. >> so they're trying to make a point. so again, lawsuit has been filed within the last couple of months or so. it has not actually had a court date with everybody to get involved talk about what's going to happen next. so we're going to >> continue to follow so why is it that he tried to go through twice in the first

place? >> he says in the union says, and even the airline says turnstiles were giving them problems, getting access to get in to go to work and they had their badges. they would try to use it to go through and from time to time those turnstiles lockup. so they would try do it over again. and the airport says that is the security breach. when you tried to repeat the process to go through. so there's a big, you know, difference of opinion whether or not that can is considered a security breach will be interesting to see the result of thanks, ken. >> president joe biden has signed a bill that could ban tiktok the bill bans the app unless its chinese parent company bytedance cells to a non chinese company. that means bay area companies like meta and google could soon own a u.s. version of tiktok. >> the culture of silicon valley is one these larger companies, by up all the competitions, only a handful of companies control the internet. so i would be

surprised some of the names you name there, step into try and take over this very popular product that roughly 170 million americans are using. >> as of now, there are not any talks of sales in place. let's get a check of your 4 zone forecast as we take a live look from our mount tam cam, i guess is that the moonlight? everything up tonight? it's the moon or some alien invasion. it's bright out there, laura. yeah, it is gorgeous out there. you see the clouds have parted just a little bit, too. so that's a good sign. >> as we head toward tomorrow, but see that feeling a little bit overnight tonight back to cloud deck. public a lower just a bit as high pressure begins to build in overhead. still, we're going to try and squeeze a little more sunshine, least in parts of the bay area tomorrow, i think especially inland. you may see an early or burn off of some of the clouds and that can lead to some more sunshine and well, some warmer temperatures go along with that to not going to be heatwave, but just a little bit warmer out there over san francisco. you've got some patchy fog floating on by more than on the way we had

really kind of a bottoming out today as we saw these temperatures and some places a little cooler than in other places, maybe just slightly warmer. so kind of bottoming out today. and i think by tomorrow we're going to see some warmer weather. but all these numbers still running below the average in most spots for this time of year. 65 in santa rosa. 66 in cocker. 65 in livermore. 69 in san jose. that was one of the warmer spots. 62 in san francisco and 64 degrees in oakland. overall, though, we have this area of low pressure. this little low spinning off the coastline. but boy, it really deep in the marine layer over the last couple of days. the point probably have some showers off the coastline here. and some drizzle, of course, along the coastline as well and deepen. all the clouds made a push all the way inland. tonight we're seeing a patchy fog out there right now, but it's broken just in spots. we're going to see some changes coming the next day or so. as we see high pressure sneak in for one day. but just to our north, we've got a cold front and that front is going to start to drop southward as we head into thursday night and friday. there's a slight chance we could be talking about some more rain. but more on that.

fairfield are investigating after a woman was hit and killed by a semi truck early this morning happened near i-80 in a parking lot on canton. also drive investigators say the semi truck was pulling away when it hit the victim. >> this is the second deadly pedestrian crash in fairfield in the last 2 days. meantime, a bay area man was found dead after falling while on a hike in oregon happened on sunday near the coast. less than 20 miles from the california border. another hiker reported seeing the body and the rocks down below that rail. the victim has been identified as richard ehrhart of san jose. >> recently released data shows more marine mammals such as the sea lions pier. 39 are

having more negative interactions with humans. according to the report from the marine mammal center over the last 2 years, the most common type of disturbance reported was people crowding around an animal and not giving it appropriate space. researchers say this can lead to increased stress levels and separate moms from their pups and disrupt rescue operations. but specifically talking about the bay area. >> remember, disturbance is a year-round problem. we had 30% of our marine mammals last year experience some form a disturbance before these rescues for seeing the disturbances are just as high in the summer and fall months is they are during our busy season on site here in sausalito that's tied with pupping season. >> researchers want to remind people not to touch the animals, even if you think you're protecting wildlife. some actions actually cause more harm than good. missus, really sick. what's happening in this country right now. >> coming up next, governor

( ♪♪ ) mugs. ♪ bmo ♪ >> now at 10, 30, a man is in jail tonight after fighting with the police officer who was protecting the san jose mayor kron four's. dan kerman reports on what the man's arrest uncovered. it's this attack that's led to the arrest of 35 year-old leslie pollard, san jose. police say pollard has been booked for

battering a police officer and resisting arrest with violence. the incident was caught by kron 4 cameras during a tuesday evening interview with san jose mayor matt mahan at first in san fernando as steps right next to the mayor. both he and the plainclothes san jose police officer providing security for the mayor in-form pollard. that interview is under way do it. >> we're moving talking for reduced. mark. >> pollard uses profanity and tells the officer to mind his own business. what happens next is off camera. it's unclear who touches who first. but pollard is heard saying how smack you right right now 9 seconds later, he does just that hitting the officer in the face and head at least twice at that point. a scuffle in season. police are called witnesses say at some point

pollard begins yanking on the officer's tie after 2 more minutes. and police nowhere in sight. a customer from a nearby business comes to the offices. rescue removing pollard's hands from the officers tie and allowing the officer to handcuff him. police eventually arrived and took pollard into custody. one person who witnessed the confrontation but didn't want to go on camera says he's not even sure that the suspect knew the mayor was even involved in all of this and was definitely clear that the person did not know that the security person protecting the mayor was actually a san jose police officer. well, kron 4 has posted edited version of the video online sent as a police point out. in a statement, the video does not contain the entire incident in particular. it does not include the officer identifying himself, nor does it include the many attempts teammate to de-escalate the situation and avoid using force or taking any enforcement action. police confirm pollard has an outstanding arrest warrant out

of georgia for resisting arrest with violence. the officer hospitalized overnight with head and neck pain. but it's now been released. the case is now under review by the santa clara county district attorney's office. dan kerman kron. 4 news. david de pap the man convicted of attacking paul pelosi will have to wait another month to learn his fate. >> the original sentencing hearing was set for this morning. but it's been pushed back to mid-may. he faces a maximum of 50 years in prison, attacking nancy pelosi's husband in october 2022. >> 35 death penalty cases in the in alameda county are now being reviewed following allegations of racism and the justice system. kron four's terisa stasio spoke with legal experts who say the allegations could havp sweeping consequences >> maybe what happened here is that these people were deemed to be opposed to the death penalty. and that's how they got away with removing people based on that city on

wednesday, legal experts weighing in on the bombshell dropped by alameda county district attorney pamela price. >> that a federal judge has ordered the review of 35 death penalty cases after these scribbled notes were discovered while examining and appeal for this man, earnest, a 51 year-old was convicted and put on death row for the 1995 killing of 9 year-old lance clark and attempted murder of his grandmother. price says that the notes suggest prosecutors may have blocked female black and jewish potential jurors from serving on trials. brown is a criminal law professor at uc law. san francisco. >> this is probably just the tip of the iceberg. because there were a lot of bats and shenanigans going until california tightened its laws and what could happen next is not only could these death verdicts be set aside, but the entire case could be set aside. and some of these individuals may be given a new trial in its entirety.

>> stephen clark is a former santa clara prosecutor and now defense attorney and legal analyst. while the death penalty cases are under the microscope, both a legal analysts say that there has been sweeping changes in the past couple of decades, making jury selection more transparent. there's been a tremendous evolution and how jury selection is you have to have a legitimate reason for removing a juror. >> and you have to articulate that reason to the court. if asked. >> so we are no suspicious of removals of people on the basis not just of race or gender, but a bunch of other categories like religion, nationality. you know, a lot of other things. and moreover, when the prosecution has to provide a reason, it can't be a silly reason. it has to be a reason that stands like that. that makes some common sense. >> but legal experts say that it could take years before the truth is revealed on whether or not there was misconduct conducted in these death penalty cases in alameda

county in the newsroom to recess stasio kron. 4 news. >> governor gavin newsom is asking lawmakers in sacramento to pass a bill that would allow arizona doctors to perform abortions here in california. kron 4 grant lodes joins us in the studio with more grant. that's right. ken newsom is calling the arizona abortion law extreme currently. >> arizona has a law on the books allowing abortions in the first 15 weeks of pregnancy. but the state's supreme court ruled earlier this month that the state should follow a law from 18, 64 banning nearly all abortions except when the pregnant person's life is in danger. doctors who are found to hav violated the law could face a penalty of 2 to 5 years in state prison. now governor newsom says california now as a role to play. he joined lawmakers today to announce an urgency bill allowing arizona doctors to come to california to provide abortion care for their patients who have traveled here.

>> well, and our hand, not just our hearts and we want to we want to create framework of real support. >> we have the opportunity to help women who woke up last week with fewer rights than their mothers have had for their lifetime. we proudly take on this fight. we will not abandon our sisters or their health care professionals in arizona or in any other state. just hours after this announcement, the gop controlled arizona lower state house. >> but it to repeal the near abortion ban. but it still needs approval from the arizona state senate before it can make it to democratic governor katie hobbs desk for now. newsom says he is working with the nonprofit to help crowdfund abortion care for arizona and sue cross into our state. as for this urgency bill, it needs a two-thirds vote in the house and senate before the governor can sign it will keep you posted there.

can noel, back to you. all right, grant, thank you. want to give you a live picture of a developing news that has been taking place all day and into the night in los angeles. you're looking at. >> the get the 77th a for the los angeles. >> a police that is where protesters have gathered outside actually told this is downtown l a and there were protests all day and night at usc. there were clashes between the protesters were demanding a cease-fire in gaza with los angeles. police officers or physical confrontations. police were in riot gear on the campus of usc and a number have been arrested. we don't have an idea of exactly how many people were arrested or whether or not there are any injuries. but of course, as follows and these kinds of w% protests have been taking place across the country, including at columbia university, which had to basically suspend on campus class activity in turn it into virtual classes. there is an encampment that has been set up at berkeley on sproul plaza

where some tents are in place. also calling for a cease-fire in gaza. in that case, count, officials are saying as long as is no blockage is taking place that prevent students from getting to class. and as long as there's no violence on the campus, they'll be allowed to remain. but this has been a hot topic on college campuses across the country. and today in los angeles at usc. it did turn violent. we'll keep an eye on things. >> the u.s. department of transportation has issued new airline rules to prohibit surprise fees and require passengers be refunded automatically. right now, refunds are typically made at a passenger's request. if there's a cancellation or delay. but now the refunds will be made automatically when flights are canceled or significantly changed when baggage return is greatly delayed or when customers don't receive amenities, they paid for the other rule requires airlines to explain

of you see the areas in blue that some models starting to pick up on some of the temperatures dropping off of the 40's over some of the mountain tops there. so some cooler weather on the way tonight. that area of low pressure kind of scum southward. now that's been bringing all the clouds across the bay area, but out a little bit civic. we have some storm clouds out there. they're likely to make a return. in fact, a chance of rain on the way. not tomorrow. i think i'm mostly just part passing clouds throughout the day and then a slight chance of showers as we get to friday. not going to be a big weather maker, but a chance of a couple raindrops clear out for the weekend. but then next week again, looks like get a little busy again. the chance more raindrops coming our way late in the week. all right. all that being said tomorrow, going to be another cool day in the san francisco 50's and some 60's out there as you head down the coastline, not much clearing in keeping on the cool side. only in the 50's inside the bay will try to warming up just a little bit specially the south some mid 60's by tomorrow afternoon, maybe getting close to 70 degrees. morgan hill. it will stay mild to warm if you head to the interior valleys, 70 degrees in discovery bay about 17 up about 70. also in
