>> tonight at 5.30, allegations of racism and the alameda county justice system. and now the search for the truth and what it will take to uncover it. on monday, the alameda county district attorney revealed a federal judge has issued an exhaustive review. >> 35 death penalty cases dating back several decades. legal experts say the allegations could have sweeping consequences. kron four's terisa stasio has more. >> maybe what happened here is that these people were deemed to be opposed to the death penalty. and that's how they got away with removing people based on that city on wednesday, legal experts weighing in on the bombshell dropped by alameda county district attorney pamela price. >> that a federal judge has

ordered the review of 35 death penalty cases after these scribbled notes were discovered while examining and appeal for this man, ernest, a 51 year-old was convicted and put on death row for the 1995 killing of 9 year-old lance clark and attempted murder of his grandmother. price says that the notes suggest prosecutors may have blocked female black and jewish potential jurors from serving on trials. from is a criminal law professor at uc law. san francisco. >> this is probably just the tip of the iceberg. because there were a lot of bats and shenanigans going until california tightened its laws and what could happen next is not only could these death verdicts be set aside, but the entire case could be set aside. and some of these individuals may be given a new trial in its entirety. >> stephen clark is a former santa clara prosecutor and now defense attorney and legal analyst. while the death penalty cases are under the

microscope, both a legal analysts say that there has been sweeping changes in the past couple of decades, making jury selection more transparent. there's been a tremendous evolution and how jury selection is you have to have a legitimate reason for removing a juror. >> and you have to articulate that reason to the court. if asked. >> so we are no suspicious of removals of people on the basis not just of race or gender, but a bunch of other categories like religion, nationality. you know, a lot of other things. and moreover, when the prosecution has to provide a reason, it can't be a silly reason. it has to be a reason that stands like that. that makes some common sense. >> but legal experts say that it could take years before the truth is revealed on whether or not there was misconduct conducted in these death penalty cases in alameda county in the newsroom to recess stasio kron. 4 news. >> a rideshare driver escaping

a carjacking in palo alto. the victim telling police he was driving the pickup. a writer monday around midnight when a car pulled ahead of him. he says 3 men got out of that car and began to hit his car with a metal rod. police say the victim was able to drive off, but the suspects chased him until they eventually gave up. the man stopped near the palo alto to train station to call police on familiar with the area. he was unable to tell police where the incident happened. police believe it began in the crescent park neighborhood and may have made its way into downtown palo alto. they believe the victim was targeted for robbery carjacking. he's ok, but his car does have some moderate damage. is. a memorial service for fallen oakland police officer jordan wingate is set for this friday. officer wingate died saturday from injuries he suffered in a 2018 car crash while on duty. the service will be held at 3 crosses church in castro valley at 11:00am. it is open to the public.

>> the san francisco sheriffs association says there is a deputy shortage and they're calling on the city for help. they sent a letter to city leaders and the sheriff's office asking for nearly 300 more deputy sheriffs to be hired. the sheriffs association says deputies are being asked to work. 28 hours of overtime every week, which is 3 times beyond the limit set by cal osha, the union, own study in a letter written to san francisco mayor london breed, the union explained its findings saying, quote, with an average of just over 5 hours of sleep per 24 hours. deputies are facing serious risks to their health safety and beyond. the survey also found high rates of physical and mental problems among deputies, including high blood pressure, sleep apnea, depression symptoms and anxiety. we've reached out to the mayor's office for its response to the sheriffs association request. and we are waiting to hear back. keep

you posted there. meanwhile, the city of san francisco is hoping to improve 9-1-1, response times by opening a new emergency dispatch center. the new facility was unveiled this morning on the second floor of the old 9-1-1, center along turk street. it features 55 brand-new workstations sent updated breakroom, an elevated supervisor area and a new training room. and it prepares us for the future by increasing our capacity and our ability to >> add more dispatchers and create the kind of environment that's going to be a better environment for the people who are answering the most challenging calls in san francisco. >> city says it's also ramping up efforts to recruit up to 30 new dispatchers as they are hoping this new facility will help attract applicants. >> a network documentary detailing the murder of east bay woman. alexis gabe is slated to air tonight. gabe's

family is hoping it changes public perception about her killing and possibly lead to charges against the suspects. mother in january 2022. alexis, gabe was reported missing out of oakley months later, investigators found her partial remains near sacramento. before that discovery, her ex-boyfriend and suspected murder was shot and killed by police. the gabe family says justice has not been fully served because no charges have been filed against his mother. they believe she helped her son cover up the crime. but legal analysts disagree. >> just don't know why. >> they're saying it's they're not. that's not enough. and that's what my attorney is going >> trying prove by the sky, the dinner, all war will thing to kidnap and kill somebody. but to try to blame the killer's mother. >> is. >> a stretch to my way. >> in a statement to kron 4, the contra costa county district attorney's office says, quote, based on the evidence we've been provided

by the investigating agencies. there is no indication anyone other than marshall jones was directly involved in the murder of alexis, gabe, either as a direct perpetrator or an aider and abettor end quote, the gabe family still intends to have their attorney file charges against the mother after the documentary airs tonight. it will air on the investigation. discovery channel at 07:00pm. well, calling it a big day for america's flying public. transportation secretary pete buttigieg is expanding and toughening up the laws protecting passengers. for starters, it will be a lot easier for. >> passengers to get refunds after canceled flights in kron four's. catherine heenan is live in the newsroom. >> with more on this, catherine, it a lot of people i think feel like it's such a racket these days with all the fees and rules with flying this at least feels like it's for the people. yeah. and we all know somebody or few some buddies have had really, you know, frustrating stories when

need to refund or there's been a cancellation. >> and if this works the way the transportation secretary says it well, flight cancellations will soon result in you're getting automatic cash refund. this is part of what pete buttigieg calls the biggest expansion of passenger rights in the history of the department. >> in theory, passengers are already supposed to be refunded for a cancellation or a major delay in practice. it often doesn't work that pete buttigieg says he and his staff have heard it all. >> including people coming up to him and airports to share travel horror stories. many involving the struggle to get refunds. it will now be harder. he says for airlines to ignore you. but harris administration is now requiring. >> that if an airline cancels or significantly delayed your flight. within 7 days, they will required to provide automatic refund to the credit card. be used to book it

these changes to take effect. grant. >> lot of people being we'll be looking forward to that. all right. thanks, captain. well, speaking of flying, squirrels are said to be causing safety issues that at least 2 bay area airports, the faa. >> sent a notice to santa clara county saying the agency is investigating the conditions. it reid-hillview and san martine airports. officials say the ground squirrels are potentially affecting the airfield, pavement, signage and lighting the squirrels apparently also cause a chain reaction of aviation disturbances by attracting birds of prey into the airspace. county officials say they are addressing maintenance concerns and do not believe the faa investigation is necessary. >> taking a live look outside, of course, at sfo. now probably a little bumpy. get mountain getting in. >> squirrel delays. can tell you guys, but they are having

some delays. but that's to some construction going on. the ongoing construction on some of the airport. so some of the departures are delayed there. but in the meantime, yeah, that wind has been blowing around a bit. we've seen those gusty winds causing some delays yesterday. not augusta causing delays today. just from construction is still 47 minutes on some of those flights that are departing. so watch out for that. no delays being reported or san jose. right now we're looking good out on the road. you go so far. so good on the san mateo bridge. lot of cars out there right now. but mostly dry. a lot of clouds out there right now. they're quality. looking good, though. how about that? you get that nice. fresh ocean, aaron. that really brought some fantastic your quality last couple of days all across the board. not only just along the coastline, it inside the bay in the valleys. fresh. they're going to be that way again. i think as we look for tomorrow, too. so that's the big benefit of get that nice seabreeze go on. that definitely clear things out there with your quality and brings a nice fresh air. but of course, it also brings down the temperature quite a bit, too. so another low pressure

>> a san jose sharks have fired head coach dave quinn in just 2 seasons in the south bay. the sharks at the worst record in the nhl. so not really a surprising decision. the sharks set a franchise record for fewest goals scored per game this year and miss the playoffs for a franchise record. 5th straight season. in a statement, the general manager mike greer said quinn and his staff did an admirable job. anderson, difficult circumstances. and the gm says he sincerely appreciates how they handled the situation. nonetheless, the sharks are starting over. as for the giants, their prized free agent signing pitcher blake snell. well, this area hasn't gotten off to a great start. so far the left-hander posted

june if it were to pass low-income students and those who do not meet the 2.0 gpa requirements will be able to apply. the california department of water resources has announced a 10% increase in the state water project waterson projected water supply for this year. dwr says that increase from 30 to 40% would provide an additional 420,000 acre feet of water, which is enough to serve an estimated 1.5 million households for a year. the forecast is based off of the latest snow survey conducted on april. 1st, the department also working with the u.s. army corps of engineers to manage flood releases and store as much water from the winter storms and spring runoff and its reservoirs. >> well, the port of oakland, it's busy port, according to officials there receiving record volume in container, send march more than 200,020 foot containers pass through

along the coastline and that sea breeze. you get that moisture in the atmosphere that wind blowing outside. definitely feels cool out there out toward the golden gate bridge. cool, brisk, walk across the bridge today. clouds continue to stream up above the temperatures. just about bottoming out today. see some places actually warmed up just slightly. you get to places like hayward, your degree warmer than a degree cooler oakland. so right, just about the bottom there. but boy, these temperatures down across the board around the bay area over the last few days, low clouds and fog again tonight. i think that marine layer is actually going to lower somewhat overnight tonight. probably not going to be quite as extensive as it's been over the past couple of nights. some patchy drizzle still a possibility out there tomorrow morning clouds giving way to some clearing into the afternoon and then a slight chance of showers on friday. but a warmer weekend ahead out the door now to 65 degrees with some partly cloudy skies in san jose. 62 partly cloudy, dublin. 61 degrees in napa right now. 58 cloudy and san francisco and a cool 56. it civica to low pressure. just

kind of spinning around along the coastline. there it is helping to deepen that marine air. looking very grey off the coastline. probably some scattered showers just off the coast. but overall fairly dry. but here we go getting into the next couple of days, we've weak system passing to our north on thursday, going to bring a few more clouds, high pressure. just going to sneaking in here. just strong enough. but then we get friday, slight chance of a few showers. some snow showers over the high country and then we get the weekend. i think the weekend looks pretty good. high pressure going trying to sneak in here. not going to be a real hot weekend, but lisa will be mild around the bay area. but then guess what? next week again, here we go. look at this. the model starting a bullish, bring some more rain late next week and possibly into the following weekend. temperatures around the bay area for tomorrow. 50's and 60's in the san francisco cool along the coastline. not much clearing again there. i think if i'm a little more clearing inside the bay, temperatures warming up just a tad. 64 degrees in woodside. the south bay enjoying temperatures up in the 60's in a place like san jose. 69 warmer in morgan little warmer. i think in the interior valleys tomorrow, some places getting closer to 7 degrees. all these numbers

still running below the average for this time of year about 63 in san leandro. 65 become sunny in orinda by the afternoon about 6, 7 degrees and low 70 degrees in fairfield travel back to the coastlines could stay fairly cool. a little breezy to back those winds likely to kick up front. that's coming through on friday. not going to bring much in the way of rain if it does, but it will kick up. the ranges can feel cooler around the bay area. those winds calm down for the weekend. we bring back some sunshine by sunday. we break out a couple of 70's. okay. that's great. yeah. next weekend, i can't promise that. so let's enjoy. this was we just work so much. whether 7? there we go. things ok. >> the marine mammal center in sausalito releasing new data showing how human wildlife interaction has severely impacted marine mammals along 600 miles of california coast. according to the report over the last 2 years, the most common type of disturbance reported was people crowding around an animal and not giving it appropriate space.

researchers say this can lead to increased stress levels separating moms from their pups and disrupting rescue operations. >> but specifically talking about the bay area. remember, disturbance is a year-round problem. we had 30% of our marine mammals last year experience some form a disturbance before these rescues occurred. we're seeing the disturbances are just as high in the summer and fall months is they are during our busy season on site here in sausalito that's tied with pupping season. >> researchers want to remind residents to not touch animals, even if you think you're protecting wildlife. some actions add more harm. that good right now is popping season. so definitely keep your distance. >> ace are running rampant across san francisco. just

>> speaking of new movies, it is officially opening night of the san francisco international film festival. this is the 67th year of the festival. more than 80 films featured in between tonight and sunday show that movie theaters across san francisco and the east bay, 7 of the films are from bay area filmmakers from documentaries to feature films. there are 40 different countries represented this week. the director of programming says this year's selections feature many filmmakers who pulled stories from their own lives and their real experiences. there's also several filmmakers featured who have been part of sf film since early in their careers. >> and one of the filmmakers this year doesn't renee jones was a part of our use competitions several years ago. her producer went through our development program and then now they are screening their phone seeking mavis beacon at the festival, which was largely on the east bay.
