misconduct and allegations of racism. the alameda county district attorney has revealed a federal judge has issued an exhaustive review of 35 death penalty cases that date back several decades. kron four's terisa stasko joins us with the latest on this developing story. thanks for joining us. high just saying that review comes as the alameda da says that her office found these handwritten notes that may show prosecutors strategize to block black and jewish jurors from serving on death penalty cases. legal experts are now telling us that these are profound allegations was sweeping consequences. >> maybe what happened here is that these people were deemed to be opposed to the death penalty. and that's how they got away with removing people based on that city on wednesday, legal experts weighing in on the bombshell dropped by alameda county district attorney pamela price. >> that a federal judge has ordered the review of 35 death penalty cases after these scribbled notes were discovered while examining and appeal for this man, earnest,

a 51 year-old was convicted and put on death row for the 1995 killing of 9 year-old lance clark and attempted murder of his grandmother. price says that the notes suggest prosecutors may have blocked female black and jewish potential jurors from serving on trials. brown is a criminal law professor at uc law. san francisco. >> this is probably just the tip of the iceberg. because there were a lot of bats and shenanigans going on until california tightened its laws and what could happen next is not only could these death verdicts be set aside, but the entire case could be set aside. and some of these individuals may be given a new trial in its entirety. >> stephen clark is a former santa clara prosecutor and now defense attorney and legal analyst. while the death penalty cases are under the microscope, both legal analysts say that there has been sweeping changes in the past couple of decades, making

jury selection more transparent. there's been a tremendous evolution and how jury selection is you have to have a legitimate reason for removing a juror. >> and you have to articulate that reason to the court. if asked. >> so we are no suspicious of removals of people on the basis not just of race or gender, but a bunch of other categories like religion, nationality. you know, a lot of other things. and moreover, when the prosecution has to provide a reason, it can't be a silly reason. it has to be a reason that stands lake that. that makes some common sense. >> both legal experts say could take years before the truth is revealed on whether or not there was misconduct in these cases. now being examined in the newsroom, theresa stasi, back to just a he theresa, thank you. the san francisco sheriffs association says there is a deputy shortage and is now calling on the city for help. they sent a letter to city leaders. >> and the sheriff's office asking for nearly 300 deputy sheriffs to be hired. the

association says deputies are being asked to work. 28 hours of overtime each week, which is 3 times past the set limit by osha due to the staffing shortage in a letter written to san francisco, mayor london breed, the association explained findings of its own study saying that the union has this. issue here because there's an average of about only 5 hours of sleep per 24 hour period that deputies are getting, which means they're facing serious risks to their health and safety. the survey also found high rates of physical and mental problems among deputies, including high blood pressure, sleep apnea, also depression and anxiety. we did reach out to the mayor's office for a response to the association's request. we're waiting to hear back when we do. we'll let you know. also san francisco is celebrating the opening of a newly renovated 9-1-1. dispatch center concourse. charles clifford was there. he joins us now live with details on what the center's going to do. thanks for joining us.

>> good afternoon. you know, the city of san francisco has a goal of answering 95% of 9-1-1. calls within 15 seconds. but for the last year, so they've fallen short of that goal. today they unveiled a new modern 9-1-1, call center and an effort to recruit new dispatchers to hopefully get those response times back where they should be. wednesday. san francisco unveiled its new 9-1-1. dispatch center. the new facility features 55 brand-new work stations and updated break from an elevated supervisor area and a new training room, new facilities on the second floor of the old 9-1-1, center along turk street. the city says that the center includes extra space to offer growth and upgrades to equipment in the years to come. and it prepares us for the future by increasing our capacity and our ability to >> add more dispatchers and create the kind of environment that's going to be a better environment for the people who are answering the most challenging calls. and san francisco. the city is also ramping up efforts to recruit

new 9-1-1, dispatchers. and they're hoping that the new facility with its improved employee amenities will attract applicants. in addition, we've taken a lot of measures this year to make the process to become a dispatcher and the process of going through the hiring a lot easier and shorter. >> and so we are hopeful that people will look at the job considered this public service job that you can really build a life and and be a part of this beautiful community of san francisco based pay for a new dispatcher is $106,000 per year. and it takes about 2 years to fully complete the training. >> all right, back live. now the city is hoping to hire 30 new dispatchers and san francisco charles clifford kron. 4 news. charles, thank you. >> but now new details on a story you'll only see here on kron 4 as an officer who is providing security for san jose's mayor matt mahan has now been released from the hospital after spending the night recovering from head and neck pain. the injuries came

while he was protecting the mayor and this altercation was caught on camera. so these tense moments going down in downtown san jose yesterday with mayor mahan was talking with the kron. 4 reporter. >> our crews then captured this physical altercation between the mayor's security detail on a person who's just walking by. police say the situation began when that man who hostile towards the mayor and staff the mayor there standing aside finally inside a nearby building. but the punches, though, still look like they're about to be thrown. they say that this plainclothes officer who is assigned to the mayor's security detail, tried to de-escalate the situation several times, but that that man grew more agitated and eventually then hits the officer. we capture that they're on camera. look at them going at it. police say several people who are walking by help to detain the man and he was eventually taken into custody. police are saying the man is now facing several

charges, including felony battery on a police officer. and we're told that san jose police plans to hand this case over to the district attorney's office. paul joseph, who is the acting chief for the san jose police department released a statement that included some information about the suspect. it says in part the person involved in this incident had a warrant for his arrest from georgia for resisting arrest with violence. adding here, this will be reviewed thoroughly by the police department to ensure the officer complied with the law and policy. and the mayor's office. a spokesperson did issue a statement about what happened here as well saying the actions of that officer were heroic in a testament to the de-escalation training that makes our officers affective, compassionate and stewards of community trust. and his thoughts are with the officer and he's hoping for a speedy recovery. the sonoma county sheriff's office has identified the victim of a cold case that dates all the way back to 1980, something in 2001, a human skull that was

turned into the sheriff's department. the officer in santa rosa's. what started this? because investigators determined that that school was likely the victim of a homicide. 2022. they submitted this call to the dna doe project which confirmed the identity is being bad of jeffrey thomas. ruben ruben's family had not heard from him since 1980. police say at some point he visited california and was rumored to have become a house painter. the sheriff's office is asking anyone with information on his life or death to contact them. david de pap the man convicted of attacking paul pelosi will now have to wait another week to learn his fate. pats original sentencing hearing was scheduled for this morning. but was pushed back to monday. the 43 year-old faces a maximum of 50 years in prison for attacking nancy pelosi's husband in october of 2022, there is body camera video that captured impact hitting paul pelosi on the head with a hammer and he was convicted last november in federal court of assault of an immediate

family member of a federal official and attempted kidnapping to pat faces additional criminal charges in san francisco county court. we'll go to the east bay now as a young boy who was killed after his family says a drunk driver hit their car and then drove office asking for help. this alleged hit and run happened on wednesday at cutting and carlson boulevards. the 6 year-old he's here. he's alvarez junior. he was a passenger in that car during that richmond crash. his family says that he died after the crash. his family saying he likes playing sports and was a member of the richmond little league. and now they're asking for community support as they're coping with unexpected funeral and medical expenses. there's a memorial service for a fallen oakland police officer jordan wingate. it's set for this friday. officer wingate died saturday from injuries that he suffered from a 2018 car crash while on duty. that service will be held at 3 church in castro valley. it starts at 11 the morning. it is open to the public. new at

3 in the port of oakland is busy and receiving record volume of containers. this is according to officials in march, nearly 203,000, 20 foot containers pass through the ports facilities. officials say that marks a basically 19% increase from the march 2023. volume full imports at the oakland seaport also continued to rise for the 5th month in a row registering about a 40% increase compared to march 2023. full exports also grew 4 the 4th month in a row by nearly 15%, which marks the highest monthly total for full outbound cargo in oakland since april of 2021. here's what it looks like outside right now. gray looking out towards the golden gate bridge there goes a cargo ship right now seeing where it's headed under the bridge colleague over here now with and we just have not been able to break through those clouds today. well know, and we weren't really expected to today or tomorrow, frankly, really

won't be until we get towards the weekend. but we start to see a break from this. but what we are getting a break from his the wind. as you can see, it's not too bad this afternoon. we've got about 60 miles per hour there in fairfield that everyone else. >> 10 miles or less. for the most part, we do have a little bit of drizzle that's coming in over the peninsula. and it had a little bit in the north bay today, too. but mostly it's been all about the cloud cover and the cool temperatures as we remain under the influence of some low pressure. you can see that jet stream is taking that will dive to the south that allows that cooler air to come in and some of that moisture as well. but waiting on the pacific is some high pressure that ultimately will make its way towards us as we get to the weekend. but we're not there though. temperatures today certainly reflecting how cloudy we are out there. san francisco still in the 50's 60's in oakland but just low 60's. you can see san jose's up to about 67. it's about as warm as we've gotten today, just 57 degrees or they've been socked in with the clouds. i mention that the wind is going to an issue not today, but tomorrow and friday into saturday morning. that's when we're really going to get

>> and network documentary detailing the murder of an east bay woman is slated to air tonight's crowd for super reports. alexis capes. family is hoping a change is public perception about her killing and possibly leads to charges against the suspect's mother. >> the long anticipated documentary on the alexis gabe murder case will soon air to the public. and though some of the facts presented in where is alexis on investigation? discovery is on the case with paula zahn will be new to people who follow the investigation run for legal analyst. paula canny does not believe it will unearth anything previously unknown to police or prosecutors. certainly the family is absolutely heartbroken that their daughter was killed by

the sky. that dinner, all war thing to kidnap and kill somebody. >> but to try to blame the killer's mother. >> is. >> a stretch to my way. earlier this month. alexis's father gwyn gabe telling kron 4 he believes the suspect who was killed during a shoot out with police months after the killing tried to cover up the crime with help from his mother. i just don't know why. >> they're saying it's they're not. that's not enough. and that's what my attorney is going >> try and prove in january 2022. alexis, gabe was reported missing out of oakley months later, investigators found her partial remains near sacramento. the game's suspect, the man's mother was involved in the aftermath. but to this day, she has not been charged in response to a kron for news inquiry. the contra costa county district attorney's office says, quote, based on the evidence that we have been provided by the investigating agencies. there

is no indication that anyone other than marshall jones was directly involved in the murder of alexis gabe, either as a direct perpetrator or an aider and abettor under the law. >> when somebody aids and abets in a killing. >> they are prosecuted for murder as if they are the killer. so if online, all here is that i want you to shoot that person. that's >> aiding and abetting in in the crime. >> in this instance, the family is upset >> because that killer allegedly brought the victim's body parts to the mother's home obviously after the victim was dead. that's not aiding and abetting. the game's intend to have their attorney present their case to prosecutors to have charges filed against the mother after the documentary airs.

>> philippe djegal all kron. 4 news. a sit-in organized by pro-palestinian protesters now entering a 3rd day at the uc berkeley campus. >> here's video from sprawl hall from yesterday. protesters have dozens of tents along with banners and signs in support of the people of gaza and palestine. they're demanding the school call for a cease-fire. but so far. no police have been seen clearing the area. no arrests have been made at the university at the university of texas at austin. protesters in support of gaza led to several people being detained. this happened today. organizers are encouraging students to walk out of class. and occupies a lawn throughout the rest of the day after about an hour. that after it started, police started to detain some demonstrators. officers did tell the protesters that their presence on campus is considered criminal trespassing. and anyone who does not be able be detained. the school did issue

a statement saying in part here, ut austin does not tolerate disruptions of campus activities or operations like we have seen at other campuses. and more protests going on at columbia university where a tent encampment is still in place after the university gave a deadline for its removal today. so that deadline has now been pushed back to the end of the week. students reacting to the protests. >> i'm really inspired by how many students have organized around such a meaningful cause. it is something to behold and historic moment and we go on the lawns for the protest leaders. >> they say we have zion this on our encampment. everyone form a human chain so we can push designed this out. we were just astounded at that. well, speaker mike johnson today says he intends to call president biden and demanded he take action to stop the protests at columbia. >> california lawmakers

rejected a bill aimed at cracking down on how utility companies spend customers money per state rules. california investor owned utilities are not allowed to use money from customers to pay for things like advertising or lobbying. they're supposed to be using that money from private investors to pay for those things. but some groups are accusing these companies have going around the rules. for example, they have been accused of using customers money to pay for tv ads disguised as public service announcements. the bill would have expanded the definitions of the standards while also allowing regulators to find utilities that break the rules and monday marked the second time this proposal failed to pass a legislative committee. switching gears to talk about the weather with this. look here at san francisco and the clouds are winning again cuyler. i know they really are. and i'm about to show you a picture of a cruise ship that's here in town. >> you know, i came here at a cruise ship years and years and years ago. and i remember going to north beach and walking around and thinking

this place is really cool. and i had a really good coffee and a pastry. >> and now i live there. so how you never know folks of i was visiting my sister that i was living here today. we're going to stay cool and cloudy tomorrow. more of the same. but we're going to get breezy tomorrow. now that will stick with us through friday and even into saturday morning. but then saturday, we're really going to start to move into a different weather pattern and it should look quite let's put it in future mode and see how this plays out. so notes tonight. just want to show you. we're going look couple little breaks in the clouds as we get into the evening, but they'll be back with the fog as we get into tomorrow morning and a little bit of that drizzle as well throughout the day as we get into friday. now we're starting to see that jurors will pick up a little bit more. this is what we're going to have. the biggest chance of having a light shower or 2. and you can see in the afternoon much of it will stay to the east of us. but a little bit could come through here, too. but by friday night, we should be wrapping it up, at least with the rain chances. and when i say rain, really, the coast might get a 10th of an inch. but the rest of us are really just goina to get a few sprinkles out of this. it shouldn't be that big

of a deal. the wind is going to be a bigger deal. so not too bad this afternoon. but as we get into tomorrow, expect those gusts to go upwards of 2025 miles per hour. even higher in some spots. and as i mentioned, that won't just be thursday will be into friday. and in fact, friday, that onshore push gets even stronger. you see these numbers getting higher and it's very pervasive across the entire bay area. so batten down the hatches, make sure the trash cans are in a position where they can't go flying because this is going to be a bit of an issue for us over the next few days as we see kind of this toggling between low and high pressure, that's going to start happening. we get a little bit of a wind gradient and then behind that comes the drier kind of nice or air mass for us. and you can see that as we get into saturday and then temperatures start to pick up a little bit sunday into monday, tuesday, beginning of next week. i mean, really from the weekend through the beginning of next week, looking really nice. all right. still ahead, a big development project is moving forward in san francisco. why officials say will help the city's economy economy. >> bounce back. and as gas prices are on the rise, car

the site does not include the existing stonestown galleria. more than 100,000 california college students could receive some financial relief by the fall of 2024. lawmakers are hoping to expand the free tuition and cash aid program. so students were not eligible for the cal grant. can still get money for community college. the expansion would cost more than 200 million dollars and depends on the state budget that still needs to be finalized by late june. currently, california is facing a multi-billion dollar deficit. and experts say that the projections are showing california will battle 30 billion dollars deficit through 2028. so this could delay the program's expansion if it were to pass low-income students and those who do not meet that 2.0 gpa requirement will be able to apply. the department of transportation has issued new airline rules that prohibit surprise fees

>> the victim of a hit and run from over the weekend is still in critical condition this afternoon after that collision in san francisco and the work to the popular donut shop in the city as kron four's michael thomas reports the community is coming together to help him and his family. >> the driver and the situation is still on the tun. and when it comes to that man who was hit a husband and father of 2 still in the hospital listed under critical condition. his employer, bob's donuts tells me he hasn't been conscious since sunday. san francisco police say early sunday morning around 03:00am

they found a man that was unconscious and lying on the ground with no identification. he would soon be identified as his sous mizzou deo. he had been hit by a vehicle while riding an electric scooter with the driver and vehicle fleeing the scene. he was rushed to a nearby hospital and has been listed under critical condition ever since. where is he headed? well to us, 3 m shifted bob's donuts and he was wearing his uniform when he was say, you know, and that's >> the stories since created a gofundme account and has the flyers posted all throughout its windows where worked? they say he was the sole provider for both his wife and 2 young kids, ages 3, 5 that live in mexico. and his family still hasn't been able to see him in the hospital because of visa paperwork. so social workers

where the clouds been hanging around. keeping us cool today. but kyla standing in front of a pile of snow. so what's going on with i'll that white stuff. so this is yosemite. and remember, we looked at halftime. you guys, we have the snow kind of piled all the way up. we have the last big storm that was here. so we've got some melting going on. >> also, they have just a little cloud hanging out in europe. this high elevation. you're kind of eye level with some of the clouds. we do have a shot, believe it or not at a little bit of snow as we head through this next system. obviously a little bit of rain possible for us as well. it can be very light, but notice just a little bit of snow in the sierra. and that's going to be thursday night into friday. then we clear out we head towards the weekend we dry out and it's going to be quite nice. this could be low impact. both for us here in the bay area's far as any showers are concerned and certainly for the sierra. but this late in the season, right? it is kind interesting to 3 to 6 inches expected up at the peaks. now, what does this mean for you if you're traveling in that direction? we're taking a live look here at diamond peak. pretty quiet up there at the moment. but if you are headed that way, just know that by the time we get to thursday night, you're

going to on the slick roads likely into friday and then things will clear out for you when you get into saturday. so just a heads up about that. also, this kind of shows us where our temperatures are going. so you can see over the next couple of days, we're still staying below average here taking san francisco's example and then we get into the weekend. you see things start to change. that's going to that newer weather pattern. that's going to be the warming that's going to start happening in some parts of the state as we roll our way into monday. and we'll probably be saying about average, though, just to kind of wider view of the temperatures. if you're ready to warm up a little bit, we should get a bit better as we head into the weekend all right. thank you. >> the san francisco board of supervisors approved an ordinance that will help extend methadone treatment in the city. this ordinance would allow clinics to dispense 72 hours worth of methadone when it's requested, which removes significant barriers to treatments. methadone is used to ease symptoms of opioid withdrawal and has been shown to improve people's chances as they begin the journey to recovery. today, president joe

biden signing a bill that could ban the wildly popular social media app. tiktok in the u.s. this bill bans the app unless the chinese parent company bytedance sells it to a non chinese company. some lawmakers say the tiktok is a security risk collecting users. private information for the chinese government during kron. 4 news at who i spoke with nolan higdon, a professor of communication with cal state east bay on what it might make for tiktok to stay. >> the culture of silicon valley is one these larger companies, by up all the competitions, only a handful of companies control the internet. so i would be surprised some of the names you name there step into trying take over this very popular product that roughly 170 million americans are using. >> the names and i mentioned we're elon musk and mark zuckerberg. but as of now, there are not any talks of sales in place. if the band does go into effect, tiktok would not just disappear from

users, phones but updates. a new downloads would not be available from u.s. app stores and he thinks it's still going take a long time for that to happen. new at 3 contra costa county animal services is welcoming some new leadership to the team supervisors are welcoming ben winkle black as the new director. in a statement he says he is honored to serve the community and to lead such an experienced team at animal services. county officials say that the department plays a crucial role and working to prevent animal cruelty abuse and neglect. that marine mammal center in sausalito is releasing some new data showing how human wildlife interaction has severely impacted marine mammals along 600 miles of california coast. according to this report over the last 2 years, the most common type of disturbance was reported when people started to crowd around an animal and did not give appropriate space. researchers say that this can lead to increased stress levels, separating moms from their pups and also

disrupting rescue operations. >> but specifically talking about the bay area. gary neville disturbance is a year-round problem. we had 30% of our marine mammals last year experience some form a disturbance before these rescues for seeing that the disturbances are just as high in the summer and fall months is they are during our busy season on site here in sausalito that's tied with pupping season. >> the marine mammal center says monterey and santa cruz counties have the most cases of animal disturbances. report it. researchers want to remind people not to touch the animals, even if you think you're protecting the wildlife, some actions do more harm than good. and if you haven't heard san francisco is getting a panda, a giant panda from china, but the city first needs to raise money to maintain them at the zoo. mayor london breed asking the board of supervisors to pass a resolution that would allow various city departments to begin raising money from

>> 2 weeks after the arizona supreme court ruled in favor of a 160 year-old near total abortion ban today, governor gavin newsom announced new legislation allowing arizona doctors to perform abortions here in california. our capitol correspondent eytan wallace was with the governor as he made this announcement and he has his message. >> well, newsome calls the arizona abortion law extreme, but he says he's turning anger into action. he believes will make an impact for women in the grand canyon state today. seek an abortion in the golden state. this is really sick. what's happening in this country right now. governor gavin newsom responding with frustration as he spoke about near total abortion bans in effect across more than a dozen u.s. states. and now arizona could be next. while

could playing food over there. just a squeaky fix. >> a little bit about the weather. all right. let's do this. you we're talking about the weather here because we do have the clouds that are out there. it is pervasive. i'm waiting for a break or their human far between today, everyone. >> we are going to see these temperatures pull up, but not until the weekends you can see we're not that bad. san jose were 67 degrees. 67 in dublin, % but just 60 in berkeley, 59 in downtown san francisco head up to the north bay and worry about 62 in sonoma. and at a point, raise 60 degrees there. so the cool temperatures, the wind is picking up a little bit, but it's not bad tomorrow. this time tomorrow. in fact, we're going to start to see a pretty pervasive onshore flow. and that's going to stick with us. not just tomorrow, but into friday. and even saturday morning as this low pressure continues to be the driving force of our forecast, though, as it kind of tracks across, we will get that chance of a shower that comes in a little drizzle to a shower thursday into friday.

but then you see what happens here is we're going to get this little when gray and that will set up now behind. this is going to be some nice, drier air that's going allow us to get back normal temperatures. but the wind between that low and high pressure will still be happening as we get into the next couple of days. so here you can see on thursday afternoon we're getting, you know, gusts upwards of 25 even 30 miles per hour. and then it gets even higher as we roll into friday. sorry, my date has been dropping out a little bit today here, but we're getting it fixed of. but you can see where some of these numbers get upwards, even 35 miles per hour. so what that means is that you've got to get ready for that could go to a wind advisory even as we get into friday. i think so. we'll keep an eye on that. but it's going make sure you're ready for it. the weekend, though, once we kick that wind saturday morning is actually looking really nice. saturday afternoon. we start gets nice sunshine in there. and then by sunday we're going to pull it back up into those nice, normal seasonal temperatures. and that is how we will begin next week. so our pattern changes once we hit the weekend. all right. perfect timing.
