cases in alameda county are now limbo because of potential misconduct. >> legal experts are now weighing in. and the alexis gabe documentary just hours away from airing what her family is hoping the public will learn. and the city of san francisco is celebrating the opening up san francisco's newly renovated 9-1-1, dispatch live with the details. station. >> he's calling for news 2. >> thanks for joining us here on kron. 4 news at 2. i'm justine waldman this afternoon. there are allegations of racism in the alameda county justice system. the alameda county district attorney has revealed that a federal judge has issued an exhaustive review of 35 death penalty cases that go back several decades. kron four's terisa stasio. joining us now live for news or with more on what's happening here and what they're hoping to fix really just in the review comes as the alameda county da says

that her office found the scribble notes which may show prosecutors strategize to block black and jewish chores. >> from serving on these death penalty cases. now, legal experts say that these are profound allegations was sweeping consequences. >> it's a very disturbing development. this is probably just the tip of the iceberg on wednesday. legal experts weighing in on the bombshell dropped by alameda county district attorney pamela price that a federal judge has ordered the review of 35 death penalty cases after these scribbled notes were discovered while examining and appeal for this man, earnest, a 51 year-old was convicted and put on death row for the 1995 killing of 9 year-old lance clark and attempted murder of his grandmother. price says that the notes suggest prosecutors may have blocked female black and jewish potential jurors from serving on trials. from is a criminal law professor at uc law. san francisco.

>> maybe what happened here is that these people were deemed to be opposed to the death penalty. and that's how they got away with removing people based on that the city because it just so happens. the people of certain demographics tend to be more opposed to the death penalty than others. so that was my other shot. and what could happen next is not only could these death verdicts be set aside. >> but the entire case could be set aside. and some of these individuals may be given a new trial in its entirety. >> stephen clark is a former santa clara prosecutor and now defense attorney and legal analyst. both legal experts say that the review of 35 current death penalty cases in alameda county will be very arduous. just have to look at transcripts. they're going to have to somehow look underneath the transcripts because what the script to the transcripts, mike show they usually. you know, sensible reasons. and what you're actually going to have to do is kind of like reconstruct everything that happened, kind of like what questions did you

ask? how did you craft been? now? it's been documented both by the legislature and the courts that anyone who dismisses jurors house to have a legitimate reason for doing so. >> there's a lot of lot of to give him the lawyers to dismiss church. but race and religious beliefs is not one of them. >> in fact, both point out that in the past couple of years, there has been several cases that have radically changed out. jurors can and cannot be eliminated. i'm going to take a closer look at that. coming up on kron, 4 news at 3 o'clock in the newsroom. back to just a theresa. we'll see you then. thank you so much. david pap the man convicted of attacking paul pelosi will have to wait another week to learn his fate. the paps original sentencing hearing was scheduled for this morning, but it has now been pushed back to monday. the 43 year-old faces a maximum of 50 years in prison for attacking nancy pelosi's husband in october of 2022. body camera video captured a pair of

hitting paul in the head with a hammer and he was convicted last november in federal court of assault and immediate family member of a federal official and attempted kidnapping. pap faces additional criminal charges in san francisco's county court. the san francisco sheriffs association says there is a deputy shortage and is now calling on the city for help. they sent a letter to city leaders and the sheriff's office asking for nearly 300 more deputies to be hired. the sheriffs association says deputies are being asked to work. 28 hours of overtime each week, which is 3 times past the set limit by osha due to the staffing shortage in a letter written to san francisco, mayor london breed. the association explained findings of their own study in which the union says with an average of only 5.2 5 hours of sleep per 24 hour period. deputies are facing serious health risks to their safety. the survey also found high rates of physical mental problems among deputies,

including high blood pressure, sleep apnea, depressive symptoms, and anxiety. we did reach out to the mayor's office for a response to the sheriffs association request. we are waiting to hear back when we do. we'll let you know. and san francisco's now celebrating the opening of a newly renovated 9-1-1 dispatch center kron 4 s charles clifford was there. he joins us now live with details and thanks for joining us. charles. >> well, good afternoon. you know, the city of san francisco has a goal of answering all 9-1-1. calls, actually 95% of 9-1-1. calls within 15 seconds. but the been falling short of that goal over the last year or so. today they unveiled major upgrades to their 9-1-1 center in a new effort to recruit dispatchers in an effort to get those numbers back where they want them to be. wednesday, san francisco unveiled its new 9-1-1. dispatch center. the new facility features 55 brand-new work stations and updated break from an elevated supervisor area and a new training room, new facilities

on the second floor of the old 9-1-1, center along turk street. the city says that the center includes extra space to offer growth and upgrades to equipment in the years to come. and it prepares us for the future by increasing our capacity and our ability to >> add more dispatchers and create the kind of environment that's going to be a better environment for the people who are answering the most challenging calls in san francisco. the city is also ramping up efforts to recruit new 9-1-1, dispatchers. and they're hoping that the new facility with its improved employee amenities will attract applicants. in addition, we've taken a lot of measures this year to make the process to become a dispatcher and the process of going through the hiring a lot easier and shorter. >> and so we are hopeful that people will look at the job. consider this public service job that you can really build a life and and be a part of this beautiful community of san francisco based pay for a new dispatcher is $106,000 per year. and it takes about 2

years to fully complete the training. >> all right, back live. now the city is looking to hire 30 new dispatchers. but for now in san francisco, charles clifford kron, 4 news. well, short of the 300 they're asking for, but it's a start. thank you, charles. new now at 2, 3, construction workers have been taken to the hospital. one of them is in critical condition. >> after a fire started at an apartment building in oakland, oakland, fire racing to 60th street and martin luther king junior way when those flames erupted on the first floor of a four-unit apartment building. the battalion chief james brown says crews were able to put out the flames before that fire spread. 2 other apartments. >> big quake first energy out. lots of smoke, small amount of fire went rather quickly. extension any of the other apartments. >> people living in the other 3 units will be temporarily displaced until power is restored. the cause of this fire under investigation. a

network documentary detailing the eurder of an east bay woman is slated to air tonight's crowd for super reports. alexis, gabe's family is hoping it changes the public perception about her killing and possibly leads to ect's mother. >> the trailer for where is alexis provides a snapshot of the episode of on the case with paula zahn set to air on investigation. discovery. alexis, gabe's family pushed hard for it to run with hopes to convince his prosecutors to pursue charges against the murder suspect's mother. the kron, 4 legal analyst paula canny says that is unlikely. while it's true that journalists, you know, are really good at getting information as well. i'd like to think that the police did a thorough investigation. >> so, no, i don't anticipate any big surprises. earlier this month, alexis's father gwyn gabe telling kron 4 he believes the suspect who was

killed during a shoot-out with police months after the killing. >> tried to cover up the crime with help from his mother. based on what we saw. >> there was definitely evidence showing. aiding and abetting in january 2022. alexis, gabe was reported missing out of oakley. >> months later, investigators found her partial remains near sacramento. the game's suspect, the man's mother was involved in the aftermath. but to this day, she has not been charged in response to a kron for news inquiry. the contra costa county district attorney's office says, quote, based on the evidence that we have been provided by the investigating agencies. there is no indication that anyone other than marshall jones was directly involved in the murder of alexis gabe, either as a direct perpetrator or an 8 or and a better phrase aiding and abetting. >> is a special term of art. >> but in the law, aiding and

abetting means you are helping thetperson pommit the crime. >> so to have the mother be charged alien. >> aiding and person. the prosecution would have to have back showing that the mother help the >> kill. the victim. and there are no facts like that. there's no evidence to show that the mother knew in advance what he had done. >> that is not aiding and abetting. it's going to be difficult to watch. >> but we need everyone to witness what we witness. we need everyone to implore if we're wrong about what we saw either way, the game's intend to have their attorney present their case to prosecutors to have charges filed against the mother after the documentary airs. the da's office says it was never contacted by the production company for comment. concerned were shown

a preview copy of the episode. philippe djegal all kron. 4 news. >> the marine mammal center in sausalito releasing some new data showing how human wildlife interaction has severely impacted marine mammals along 600 miles of california coast. according to the report over the last 2 years, the most common type of disturbance reported was people crowding around an animal and not giving it enough space. researchers say that this could lead to increased stress levels separating moms from their pops and disrupting rescue operations. >> but specifically talking about the bay area. remember, disturbance is a year-round problem. we had 30% of our marine mammals last year experience some form a disturbance before these rescues for seeing the disturbances are just as high in the summer and fall months is they are during our busy season on site here in sausalito that's tied with pupping season. >> the marine mammal center says monterey and santa cruz

>> the victim of a hit and run in san francisco remains in critical condition after a collision this weekend. and he worked at a popular donut shop in the city. kron four's michael thomas reports the community is now coming together to try to help him and his family. >> the driver and the situation is still on the run. and when it comes to that man who was hit a husband and father of 2 still in the hospital listed under critical condition. his employer, bob's donuts tells me he hasn't been conscious since sunday. san francisco police say early sunday morning around 03:00am they found a man that was unconscious and lying on the ground with no identification. he would soon be identified as his sous mizzou deo. he had been hit by a vehicle while

riding an electric scooter with the driver and vehicle fleeing the scene. he was rushed to a nearby hospital and has been listed under critical condition ever since. where is he headed? well to us, 3 m shifted bob's donuts and he was wearing his uniform when he was say, >> the t-shirts. >> you know, and that's how >> the stories since created a gofundme account and has the flyers posted all throughout its windows where worked? they say he was the sole provider for both his wife and 2 young kids, ages 3, 5 that live in mexico. and his family still hasn't been able to see him in the hospital because of visa paperwork. so help >> san francisco police say they're still investigating and trying to find that driver now turning to the public for any information. it may have.

>> well, as family in mexico and that bob's donuts try to figure out what's next as we get more information on both his condition. and if that driver is caught, we'll keep you updated. that's a very latest here in the newsroom. i'm michael thomas will send it back to you live in the studio. >> the sonoma county sheriff's office has now identified the victim of a cold case that dates back to the 1980's in 22,001, a human skull was turned into the sheriff's department office in santa rosa. and investigators determined the skull was likely the victim of a homicide in 2022. police then submitted the skull too. the dna doe project which confirmed the identity jeffrey thomas ruben's family had not heard from him since 1980, police say at some point he visited california and was rumored to have become a house painter. the sheriff's office is asking anyone with information about his life or death to contact them. more than 100,000 california college students could receive

some financial relief by the fall of 2024. lawmakers are hoping to expand the free tuition and cash a program. so students are not eligible for the cal grant can still get money for community college. the exp nsion would cost more than 200 million dollars and depends on the state budget that has to be finalized by late june. currently. governor newsom is facing a multibillion dollar deficit and financial experts say projection show california will battle 30 billion dollar deficits through 2028. so this could delay the program's expansion if that were to pass law income students and those who do not meet the 2.0 gpa requirements will be able to apply. a proposed repeal of arizona's near total ban abortion has now won approval from the state house there. but in the meantime, governor newsom, the california women's caucus and abortion rights activists are announcing a bill that would allow arizona doctors to come to california and perform abortions. this is

that's been the story. and that's certainly the story today and a little bit of drizzle out there, too, depending on where you are >> but, you know, it's relatively quiet, wind wise today. and yesterday we're getting breezy tomorrow friday, even into saturday morning. we're going to see the winds start to pick up and get very gusty. we could see gusts upwards of 30 miles per hour or so. you know, now's the time to kind of prepare for that as we have a little weather coming our way over the next couple of days. right now, you can see just a little bit of drizzle that is out there in and around the peninsula, some up in the north bay as well today. and as we zoom out, you can see our low pressure system is now it's a little bit further to the south of us, but still sitting right offshore and kind of funneling in some of that moisture. and some of that cloud cover and the jet streams just dipped a little bit to south. so that allows that cooler air to roll into that. we've been feeling now there is a ridgway off in the pacific meeting, some high pressure that's going to be building in and that will help to bring us back to normal temperatures. once we hit the weekend. but until we get there, we're going to get a whole bunch of this, which is we've got some 50's and 60's

out there right now. my warmest spot is san jose about 66 degrees. but the cloud cover is pretty pervasive today. so tonight, looking out for those clouds to be a part of the forecast. certainly we are going to have some of that drizzle out there. some of that fog as well. we're turning in the overnight hours because we all the cloud cover temperatures, not bad. 44 to 51 degrees. so if there's, you a bonus on this is that we're not getting terribly cold as we get into the overnight. having said that, the clouds are winning the day. i don't think we're going to be whole lot of breaks. we got like 5 minutes of a one streak of sun coming down. high street about 5 o'clock yesterday. that was about it. we're going to be breezy tomorrow. they're going to pick that up to wait windy on friday and have a slight chance. just a very slight chance of a passing brief showers. so we'll talk about that when it come back in a bit. but you can see saturday, we're starting at sunshine back and warming up as well. back to you. all right. still ahead. >> exceptional 2 or week. that's the only 2 options. the san jose mayor is giving some people who live in encampments

plea deal was reached in the

murder of a home depot worker. the worker was shot and killed while confronting a shoplifting suspect in pleasanton. >> kron four's dan kerman talked with the victim's mother and she help to set up that plea deal. 26 year-old blake most was shot and killed a little over a year ago. >> while working as a loss prevention officer at this home depot in pleasanton. police say he was shot after confronting a woman for shoplifting. that woman was later identified as benicia naps. she was eventually charged with murder and her accomplice. david guillory was charged with child endangerment and accessory to robbery. now is the 2 are set to go to trial. a plea agreement has been reached with naps, pleading guilty with the sentence of 19 years to life and guillory pleading guilty with a sentence of 7 years and 4 months that the deal is actually a plea deal that i. >> arrange for. >> lori moses, the mother of blake moe's. she says it was the family's decision to offer this deal instead of going

through a protracted trial with grisly details and potential appeals. >> it gives us our life back. we now get to pursue other things and honor our son instead of. the people that killer side continuing to hold ransom our lives and our families. it's big, big deal to us. 2 to have freedom and to be able to grieve properly and to most never thought. da pamela price made the proper charging decisions in her son's murder. >> and says if she had a plea deal may have been reached earlier. now with the deal done, the family can grieve properly. and remember, blake moe's for who he was. blake was all about the love people, the one that is bullied or b not or forgotten about. he was the person that we go, find them and bring them into the fold. >> he lived with his heart on his sleeve and with massive compassion for people and his family. any touch so many

people in 26 years. >> that was dan kerman reporting a sentencing hearing to finalize this deal is set for june 6th. also in the east bay, a 6 year-old boy was killed in a car crash in richmond. middle alvarez junior was a passenger in a car that his family says a drunk driver crashed into this accident. happened at cutting and carlson boulevards family says that he loved practicing sports with his dad and he loved being with his teammates he played. but the richmond little league, his family is now asking for community support as they cope with the unexpected funeral and medical expenses. now we have new details on a story that you'll only see here on kron 4, an officer who was providing security for san jose mayor matt mahan is recovering now from head and neck pain after this altercation that was caught on camera. ok? so

here's what happened during these tense moments downtown san jose yesterday when mayor matt mahan was speaking with the kron, 4 reporter doing an interview there on the street. >> our crews captured this physical altercation between the mayor's security detail at a person who was walking by police say that the situation began when the mayor the man grew hostile towards the mayor and the staff, they say the plainclothes officer assigned to the mayor's security detail tried to de-escalate the situation several times. but the man there grew more and more agitated and eventually hits the officer. police say several other people we're able to help detain the man who was eventually taken into custody. the mayor there doesn't even go inside there for a little while. they finally kind of get him to go inside the building. and police are saying the man there holding the fists up there, grabbing the back there, say he is now facing several charges, including felony battery on a police officer. we're told that san jose police plans to hand over

this case for the county district attorney's office. and officer is expected to be released from the hospital sometime this afternoon. a spokesperson for the mayor issuing a statement that reads in part here, the actions of the officer were heroic and a testament to the de-escalation training that makes our officers affective compassionate and stewards of community trust. his thoughts are with the officer and hopes for a speedy recovery. so that kron 4 interview that was interrupted was for the approval of a proposal to build 150 new affordable housing units in the southern part of san jose. right off of great oaks. the exit off of highway. 85 mayor mahan says the beds will first be offered to those unsheltered in the immediate area. and once the new housing is built homeless people who live in rv's and encampments around it will be asked to accept shelter or be told to leave. the city has plans to make camping near the shelter illegal in order to clear out that area.

>> one is that the neighborhoods to take on solutions to homelessness should see the immediate benefits. we know there's more need than that. we're going keep building shelter, housing, safe within a safe sleeping sites. >> and we spoke to some unhoused residents who say they've been on the housing waiting list for years and they're hoping that this process will speed up once that facility is built. now to the north bay, where former benicia teacher has been charged with sexually abusing a student at an elementary school. prosecutors have charged matthew shelton with 7 counts of child molestation for allegedly touching and abusing a 5th grade girl. this happened during an after-school program at robert simple elementary school and 2022, that's the allegation he worked at that school since 2015, a benicia school district officials said that is part of the 2023 24 school year shall no longer worked during that district at that district. the lawsuit also claims shelton committed smell a similar acts against a minor

in alameda county in 2018, according to the napa valley register, he was acquitted of 6 counts of child molestation in 2008. there is a memorial service for the fallen oakland police officer jordan wingate that is now set for this friday. the officer died saturday from injuries he suffered during a 2018 car crash while on duty. the service will be held to 3 crosses church in castro valley. it starts at 11 in the morning and is open to the public. the california department of water resources has announced a 10% increase in state water project, water supply allocations for that forecast for this year. the dwr says that increase from 30 to 40% would provide an additional 420,000 acre feet of water, which is enough to serve an estimated 1.5 million households for a year. this forecast is based on the latest snow survey that was done in april. 1st, the department is also working with the u.s. army corps of engineers to manage flood

releases and store as much water from the winter storms and spring runoff in its reza farce. so we'll talk about our forecast now with a look at what's going on here at the embarcadero. welcoming a cruise ship to the city. we have a lot of clouds there and kyle us here and we're just talking about the reservoir levels and you have some details on yeah, i just wanted take a look at this because we look at the historical averages and these are where a lot that are in the northern california region in central called for a region are. and you can see. >> you know, with the exception of one, there were all above 100%. obviously, we've done really well for our season this year and we didn't have a lot of problems either, which is kind of nice. we've got enough rain but not too much rain enough snow but not too much snow. we have a chance to add just the tiniest bit to that, both for a little bit of a shower in northern california. you can see it there as we get into friday and then even a little sierra snow as well. so it is going to be low impact, both for showers and for any of the snow that's available. and as we get to the weekend and into next week, we're going to dry out again and the looking

grab mic. so talking to some friends and they're why tiktok what's the what's the big deal? why we're trying to get rid of tiktok and i'm hoping you might feel to give me a simple answer here that i could share with them because people are thinking aren't there like bigger problems than tiktok right now? >> yeah, i don't blame your this quite out of character for the federal government. they they've largely avoided regulating big tech for the last 30 years. but there's been a consensus developing amongst federal lawmakers. that tiktok is a unique threat to amirican national security interests. and so this ban was put passed by both parties and signed by president biden and now looks like it will be up to the courts to decide whether or not it's unconstitutional. act. >> so should be worried about using a now more of an instagram gal. but like i know, people use tiktok a lot of and people like that's their jobs. they're like professional tiktok cursed. should they be worried about what they're posting right now?

>> you know, i at the very i would estimate that we have about a year here before with actually get under the the company has, depending on the scenario 6 to 9 months, but they're going to the courts the courts will probably extend how long that that timetable is. and let's not forget, tiktok has been very successful in in court in the past. they defeated an effort by then president trump to ban them. they defeated a bill in montana just as previous november. so tiktok has had success in the courts before. and i imagine that they will be successful in at least extending this deadline through the courts. >> so if you have it on your phone, should you delete it? >> from what some of observers have said thus far. you all need to delete it. but ultimately, if it does get banned, the app itself will either be removed from your phone or or go nowhere. so as far as i can tell this point, they're not trying to put any

responsibility and users to get rid of the app. >> so who do you think might want to buy it? it has to be according to the u.s. government and non chinese company to think elon musk might be mark zuckerberg like who might want to purchase is and how much do think it's worth? >> i couldn't even begin to tell its its i'm sure it's devalued by the fact that it's forced to sell right. the culture of of silicon valley is one these larger companies, by up all the competitions, only a handful of companies control the internet. so i would be surprised some of the names you name there step into trying take over this very popular product that roughly 170 million americans are using. >> it gets banned in you do continue to use it despite the updates. are you figure out some sort of like tech savvy work around? we would you get in trouble for it? >> the best i can tell and from from others, there's nothing in the legislation that will punish users. i i

roll into the weekend, right? but on the way there, we're going to see a few things. first of all, stay cool right through friday. and then we're going to see a little bit of a wind gradient set up. >> when this high pressure does kind of start to move in a little bit. so what that means? well, my data just dropped out here, folks. sorry about that. what that means is that we're going to be windy. there it is. as we get into tomorrow afternoon and you can see it here with these gusts, the very onshore flow that are between about 25 30 miles per hour. and then as we work our way towards friday, more of the same only a little bit stronger. so you can see now are up to 30 35 miles per hour in some spots, particularly along the coast here. but it also can translate right on across the bay. so this is going to be very widespread wind event and will probably last about saturday morning. so just get ready for that right now. if you have anything on the patio, the can fly around. make sure you batten down the hatches. we will start to warm up once we get into saturday, we do have a slight chance of a little shower coming through on friday in the afternoon. i don't think it will be much will be measuring rain and hundreds of an inch if any at
