and father of 2, is in the hospital this morning listed under critical condition with bob's donuts. his employer telling me he hasn't been responsive since the accident. san francisco police say early sunday morning around 03:00am near to pass avenue in guerrero street. they found a man that was unconscious and lying on the ground with no identification. he would soon be identified as his sous mizzou deo. he had been hit by a vehicle while riding an electric scooter with the driver and vehicle fleeing the scene. he was rushed to a nearby hospital and has been listed under critical condition ever since. where is he headed? well into his 3 m shifted bob's donuts and he was wearing his uniform when he was police you know, and that's >> the stories since created a gofundme account and has the flyers posted all throughout its windows where worked? they

because of the staffing shortage. >> will tran actually standing by the city with more on what they're talking about, will. >> the deputy sheriffs, they are basically calling 9-1-1 to mayor london breed as well as the city of san francisco saying they desperately need help not down the road, but immediately because they are overworked and their health and safety at risk. not only at work but also at home. so they wrote a letter to mayor breed saying we need approximately 300 more deputy sheriffs. i just got off the phone with the association and he tells me they need 300 more because right now without the extra manpower, they are asked to work overtime to dangerous levels. approximately 28 hours of overtime every week. and that is 3 times past the set limit by osha. so take a look at your screen. this is what they found out in there. commission report their study and this is what they sent to

mayor breed. they say with an average of only 5.2 5 hours sleep per 24 hour period. deputies are facing serious risks to their health and safety survey also found rates of physical and mental health problems among deputies, including high blood pressure, sleep apnea, depressive symptoms and anxiety. they say right now because they are so overworked that they're in danger, possibly when they're on the job because there's so many things that they have to handle, especially the inmates in san francisco, not to mention when they leave work. all of those problems follow them as well, the health problems. and that is why they're hoping the mayor response sooner. then later, back to you. all right. thanks a lot for the update to know is that i'm in a memorial service for fallen oakland police officer jordan wingate is set for this friday. >> officer wingate died saturday from injuries that he actually suffered back in a

didn't hear you say we could still do that story if you come back to rain. okay. when we come back you minutes. okay. well, a juvenile has been arrested for attempting to carjack a woman in san bruno. this >> happened monday in the 700 block of san felipe avenue. police say the driver was in her parked car when this would be thief opened her door and demanded her keys. now that juvenile was unable to take anything and ended up running away. a short time later, police spotted the suspect and that person has been arrested. >> take a look at this. fight is a story you'll see only on kron. 4 tense moments in san jose downtown when we were interviewing mayor matt mahan he was standing there off to the side looking just moved out of the frame and that's his security guard who's handling this man who walked up and was acting erratic. the security guard tried to kind of diffuse the situation and

kept standing back. but then the man you can see, i'm jumping around, ended up actually taking swings at the security officer. passers-by helped him to detain the man until the police got there and actually arrested him and this is all something that happened right there in the middle of the street, as you can see, the mayor is okay. and as far as the officer who was involved, he was treated and the hospital for minor injuries. and now that man is facing several charges, including felony battery on a police officer. >> 10, 0, 8, is the time. we're going to take a break. but still ahead on the kron, 4 morning news and east bay restaurant has been broken into so many times that the owner now doesn't even call the police anymore. but he says he does have a suggestion for them. we'll have that story. and a new initiative in san francisco targets overnight corner stores in the tenderloin. it's an attempt to crackdown on the drug market will explain and your days scrolling on tiktok could soon be coming to an end. how long it might take. we're a to take effect.

valley. some thunderstorms popping up all day long to our east. the interior, the state was really active on the bay area. kind of set it out. low pressure moves past us in the days to come. this will result in active weather for southern california as well as the sierra bay area, comparatively quiet. we will get a couple of sprinkles possible thursday night into friday. high pressure builds back in after this. and that's going to make a business as usual kind of forecast starting this weekend into next week. for now, though, a lot of cloud cover kind of a humid feel to it today tomorrow. also partly cloudy, but dry during the day tomorrow night, a chance of sprinkles for the bay into friday. a chance of them as well. take a look at the valley, though, as we move into friday, as well as the sierra thunderstorm activity popping about that direction. not so much for those of us here locally. that means our rainfall totals really just going to be a sprinkle or 2 at most, the sierra and got another chance of some snow. this is very high up in elevation, though. likely something you won't encounter if you are heading up there.

temperatures today are going to be in the low 60's at the coastline where as the rest of the bay area see some mid to upper 60's today. very pleasant. feeling day. just a little muggy, which is the downside to it. a lot of upper 60's in the south bay, san jose. as i mentioned, one of our warmer spots just shy of 70. all of us today with the year along shoreline or inland, going to be in the 60's this afternoon. as for our next several days, we are looking at temperatures that are going to be pretty level even with a little bit of a warm-up next week at the very warm us. we only get to the mid 70's by next monday, 60's through the rest of the week with a lot of cloud cover hanging out through friday. back to you. thank you. it's 10, 30 right now. we want to cover the big story that we've been talking about this morning. the san jose city council approved a plan to build. >> 150 new affordable housing units. and the catch is that if a person who is homeless currently in an rv or so by says no, they want to live there than they would have to leave. yeah, that's what the mayor's office says is going

to be the requirement. anybody living in an rv encampment in that area where this. >> facility is going to be built has to either accept that offer or find some place else to go and complex. jack moment takes a closer look. well, it was here at san jose city council last week were councilors approved the contract to get the ball rolling on this housing project in south san jose, a neighborhood where mayor matt mahan tells me there is a significant number >> of unhoused people there. and he says once this facility is constructed, they will offer shelter numerous times to the unhoused people there. and if you do not accept it, they will be swept. >> right now, it's an empty lot. but soon a housing complex will stand with 150. a small step to help bring the thousands of currently unhoused people in san jose get off the street. yes, it is very difficult. sharon lee has been at this encampment between and monterey road for a year. kate. he's speaking outside. scary. she says volunteers used to take trash

out of their encampment. that stopped 3 months ago. she also says there are rumors that this camp will be swept. i was on the late in this 2018, that's 6 years. she's waited for housing. she hopes that wait will be over with this new facility gets built in her backyard. one is that the neighborhoods to take on solutions homelessness should see the immediate benefits. mayor matt mahan says the beds will first be offered to those unsheltered in the immediate area. >> those who have refused and remain will be abated. the city would that make it so camping near the facility is illegal. they had says it's a good step. >> but it's still not enough. we know there's more need than that. we're going keep building shelter, housing, safe, within safe, sleeping sites. but igwould be great. got at lee says she's looking forward to the day where she and the thousands of other and house in san jose to get offered housing. >> we can do better than that of the taxes. the bag money that cycle money. haha, the

pot money. they got it. >> now i spoke with an house advocates who tell me that they are supportive of low income housing project. they say it's much better than homeless shelters that they've seen or it could be quite crowded inside. they tell me that they want to make sure, though, that everybody who is living on the streets nearby gets offered every type of help they could possibly get. we're in downtown san jose jacmel kron. 4 news. >> in the south santa clara man is charged with stealing more than $10,000 from an elderly couple that he was hired to take care of. and the santa clara county sheriff's office believes there could be more victims. investigators say that gerald com no, sir rio was working as a temporary caregiver for a couple in the los altos hills. and during that time, he used their credit card 15 times over 2 weeks. and it was their daughter who was preparing their tax documents who spotted these transactions.

the deputies say they also have video of surreal at atm's and surrey was arrested last week. >> well, new this morning, as we mentioned, palo alto police now investigating an attempted carjacking of a rideshare driver and crawford's reyna. harvey has the details. rana. >> so darren james on monday around midnight, police say a victim, a man in his 20's. he was on his way to pick up a passenger when a car with multiple suspects pulled right up in front of him, surrounded the car and chased him down. victim tells police 3 men yelled at him, told him to get out of his car. they tried to open the door. one of the suspects started striking it from the outside with a metal rod. the victim was able to drive off, then suspects chased him down all the way to university avenue. he wasn't hurt, but investigators believe the chase started in the crescent park neighborhoods on your screen. mind continue all the way to downtown. i think the suspects targeted the car maybe robbed the victim or even still the car. he was driving. the

victim says the suspects were in an older model. white minivan, possibly a toyota sienna or kia sedona. a lot of police are asking if you have any information to get back to them, send it back to both of the desk. thank you very much. rain. >> in the east bay restaurant owner in downtown oakland now cleaning up after yet another break the most recent happened on monday morning. the owner of the roasted and raw shared video of the restaurant's glassdoor being shattered with the owner saying the break-in cost him around. 35 $100. and here's the video. the owner says this is the 4th time now that he's been burglarized in the last 3 years since he opened his restaurant. he says he doesn't call police anymore, but he is asking police to patrol more. >> a huge police presence. a lot of be cops. a lot of cars driving around during the day. but for some reason that night. oakland police just turned into responding to gunshots and violence. and to me, that's not. that's not a feeling, you know, the entire

city. >> well, the local police department says their staff tracks crime trends and they are deploying officers to areas where they see crime is spiking. we've also expanded their foot patrol. they say to 14 officers. >> 19 and the clock is ticking on tiktok. the app will be banned in this less. it is sold off by its chinese washington correspondent trevor shirley in dc with more. >> that law goes into effect today with the president's signature the u.s. says it's time for tiktok's chinese owner bytedance to sell the app to a non chinese company or say goodbye to the u.s. market. congress is not acting to punish bytedance tiktok or any other individual company. congress is acting to prevent foreign adversaries from conducting espionage. some lawmakers say tiktok is like a giant intelligence vacuum up american users. private data for the chinese government.

bytedance denies this saying it shares nothing with the chinese communist party. chinese companies at the end of the day, they don't do their obligation to their customers. shareholders. what they owe it to the prc government bytedance will have 9 months to divest from tiktok. if a ban goes into effect tiktok wouldn't disappear from users. phones but updates. a new downloads wouldn't be available from u.s. app stores. this legislation may address or at least mitigate a national security rest, but it could and likely will result in widespread censorship. but critics say the u.s. government is chilling. free speech. this censorship with predominantly impact young people in our country. others say the amount of support in congress speaks for itself. certainly enjoys a whole lot of support i think there are only 48 vote against it. now it will be at least 9 months

before any ban would take effect. it's expected to face legal challenges reporting in washington. i'm trevor shirley. >> well, the california state university system is announcing more than 4 and a half million dollars to advance black student success across their system all part of a 10 million dollar allocation over the next 3 years. it's aimed at helping fund programs and projects that each university is identified. they need to do in order to meet the reccomendations that were outlined in the black student success report issued last year. that report hopes to address persistent trends. enloe black student enrollment retention and graduation rates the csu system also announced it's going to be holding its second biennial juneteenth symposium. that's goi g to be virtually on june 13th and 14th to celebrate african-american history and achievement. >> it's 10 21. and coming up on the kron 4 morning news and people in the south bay jammed a burger joint because the burger pit is now closed after being open since th

>> we're back at 10. 24 in the east bay. police now investigating an assault that took place at u c berkeley last night. police responded to the report of this assault on university drive right near the crescent lawn on campus. the report says that a woman sprayed the victim with a liquid and hit her over the head with a hard object. the attackers then fled the scene in a dark colored older european style sedan. no word on the condition of the victim this morning. it's 10 24 your local election headquarters. san pablo rent control activists submitted more than 1000 signatures. >> to the city clerk to get a

renter protection package on the november ballot. this proposal would would have some rules for rent stabilization 10, an anti-harassment and just cause evictions renters. it would also allow them to file petitions with the city manager. if your landlord failed to make repairs and landlords could file a petition to if they feel they're not getting a reasonable return on their investment. the contra costa county board of registrars a registrar of voters has now 30 days to verify and approve those signatures and then this would go on the ballot. the federal trade commission has voted to ban nearly all noncompete agreements across all industries. the agreements have in the past prevented millions of employees from working for competitors are from starting their own business after they leave a company. noncompete agreements are not legal in california. the rule also calls for companies to get rid of existing noncompete contracts.

shortly after the vote, the u.s. chamber of commerce said that it would su the ftc to try to block this from taking effect. the commerce department says the noncompete agreements are vital to companies to safeguard their trade secrets and better invest in employees. so we'll see what happens nationwide. we know it's illegal california here's another rule. you need to aware of millions of workers who are salaried at their jobs will soon qualify for overtime pay under a rule. >> released by the u.s. department of labor. so the new rule raises the current threshold under which salaried employees are eligible for overtime pay from the current $35,568 a year to now $43,8e8 a year that goes into effect july first and then it will raise even further to $58,656 a year starting on january, first of next year. the change is expected to get pushback from business groups. trade association say this will just

outside of the golden gate bridge, very overcast. and that's what we're seeing all across the bay area. and yes, that muggy feel pretty evident. a pretty subtle southerly wind into the bay area ahead of a low pressure area is dragging up some moist air into the region. temperatures are been hanging out in the 50's to low 60's for a long time now and we're going to see very minimal temperature change today at the warmest some of us only getting to the low to mid 60's for your daytime highs. so not all that warm of one and just a data get outside not worry so much about how hot it is going to get were staying cool. in fact, the rest of the week, i'll break down the rest of your forecast. still to come. >> back thank you, john. 10, 30 right now in the east bay. a plea deal has been ration the murder of a home depot worker who was shot and killed while confronting a shoplifter in pleasanton. you know, we have kron four's dan kerman. he actually had a chance to speak with the victim's mother who says she is on board with the idea. >> 26 year-old blake most was shot and killed a little over a year ago while working as a

loss prevention officer at this home depot in pleasanton. police say he was shot after confronting a woman for shoplifting. that woman was later identified as benicia naps. she was eventually charged with murder and her accomplice. david guillory was charged with child endangerment and accessory to robbery. now is the 2 are set to go to trial. a plea agreement has been reached with naps, pleading guilty with the sentence of 19 years to life and guillory pleading guilty with a sentence of 7 years and 4 months. if the deal is actually a plea deal that i. >> arrange for. >> lori moses, the mother of blake moe's. she says it was the family's decision to offer this deal instead of going through a protracted trial with grisly details and potential appeals. >> it gives us our life back. we now get to pursue other things and honor our son instead of. the people that killer side continuing to hold ransom our lives and our

boy who sadly died in a car crash in richmond. emma dale alvarez junior was a passenger in a car. this family says a drunk driver crashed into the accident. happened at cutting and carlson boulevards. his family says that on the day like practicing sports with his dad and hanging out with his teammates, see played with the richmond little league. his family is now asking for community support as they cope with unexpected funeral and medical expenses. >> 10 33 and police in fairfield are looking for the person responsible for a hit and run a pedestrian was killed early yesterday morning. they were found on air base parkway around one in the morning. and now police are looking for the driver. a former benicia. a school teacher is charged with sexually abusing a student at an elementary school where he worked. prosecutors have charged matthew shelton with 7 counts of child molestation. he's accused of touching and

37. we've got more news from tesla now. turns out the company is laying off more people after earnings report showed a steep decline in sales. so tesla executives announced more than 2700 people are going to lose their jobs. and is the fremont and the palo alto facilities that we're talking about. executives reveal their net income dropped more than 50% in the first part of the year. a transportation analyst says these cuts will likely save the couple of billion dollars. but this does come after google to is firing people after they protested the israel-hamas war. last week we reported that about 20 pro-palestinian demonstrators and workers or google were fired after holding sit-in protests at google offices, both in sunnyvale in new york. well, now the company says that additional employees were fired as well. they had an investigation that revealed the identities of the people who were masks that they didn't initially know at the time were part of it. but the group represents the workers say about 50 employees in all have been fired. they say they
