>> good morning. and thanks for waking up with us on the right and i'm james. we want to start this hour with a check of the weather. it's going to be a nice day. today will be the windy one. yeah. those breezes are picking up morning, john. this sure our picking up. temperatures cooling down a little cloud cover this morning. seems like yesterday's low 80's in some spots are along distant memory. now, but it is just going to be a comfortable forecast for may be changing up the wardrobe and still getting out there. looking at san jose skies, a little cloudier up above big change from yesterday. that's for sure. we are seeing even some showers out towards the central valley in the sierra. won't see those in the bay area today. we do have a chance later this week, though, as for winds 2030, miles per hour, gusts at the coast and up into the delta. temperatures are mostly in the mid to upper 50's with dublin at 58 degrees conquerrd and pittsburgh just shy of 60. that cloud cover this morning is kept temps down a little bit, but we will see increased sunshine later today. and with that sunshine, we get to some 60's to low 70's noticeably

>> within the first hours of reverend cecil williams, passing people filed into glide memorial church in san francisco monday night to honor him. this man of peace. >> this man of justice passed away peacefully. i'm hearing about i really can't believe it's record. williams was the co-founder of glide. he was also a civil rights and lgbtq activist. >> was a larger than life figure. minister marvin white intern for williams when he was 18 years old and has become his protege. he says he'll never forget with the reverend told him he said. >> i need for you to be you. >> glide put up photos of williams over the years with people of all walks of life from political activists like bobby seale and angela davps to politicians like nelson mandela and celebrities like marvin gaye in sammy davis, junior williams was also close friends with former san francisco mayor willie brown. more than 50 years. yeah. my friendship with cecil williams.

michael. hey, good morning, everyone. the sacramento county sheriff's office says the san jose fire captain was just one of many in a position of public trust that were arrested for trying to meet up with young girls. >> adding that they were caught because undercover detectives were posing as 13 year-old girls on social media. and these men caught the bait. take a look. this is video from the sheriff's office says they arrested 24 suspects at the end of march during a three-day child predator sting. now, during this operation grown adults ranging from age 22 men in their 70's. we're trying to meet up with young girls for 43 year-old spencer parker, a san jose fire captain was part of those arrested and now faces charges from the sacramento county district attorney's office. those were filed on april 3rd, the san jose fire department tells me his last day of work was march 31st. he was then placed on administrative leave on april 11th and resigned that following day. he had been with the department since july of 2008. no details have been given on parker specific case. but investigators say during this time some predators

persuaded detectives to send pornographic photos and even made plans to meet up in a hotel room with kids just 13 and even younger. 10 years old, but a knock at the door and they were greeted by deputies. take a listen to what officials had to say regarding this entire operation. it's like having your and a. >> trying to hold that. is that prolific? i don't care how smart or how sophisticate you think your son or daughter is an adult coming up with a child battle lines period. >> now, take a look. this is a statement from the san jose fire department. they tell us, quote, no criminal activity is tolerable in our service and the type of crimes described by the charges are beyond the trail of public trust and are particularly reprehensible when committed by someone swarm to public service. spencer parker is no longer with the department, according to them. and he was arrested and is set to appear in court tomorrow morning. that's the very latest in the newsroom. i'm michael thomas story. james, we'll send it back to you. michael, thank you very

much. >> time now is 908, in the east bay. the group is behind the effort to recall alameda county da pamela price is calling on the county supervisors to set a date for the recall election. the organizers with the group safe sent this letter to the board of supervisors saying that according to the state election law, the board must set an election date during its meeting on april 30th. and if they don't, then the group says the responsibility goes to he county elections. official safe plans to hold a news conference and a protest this morning at 10, 30 at the alameda county administration building the registrar of voters announced last week that they had certified enough signatures for a recall election to take place. for your money this morning. gas is really high around the bay area is continuing to soar, especially as we get into the summer driving season. >> we've got kron four's will tran standing by with a look at where prices stand at the moment morning. well.

>> they stand at painful and it's going to get worse jays before it gets better because they expected to continue climbing in till july. look at the gas prices at this san francisco station, $5 and $0.69. that's $0.24 more than the average in california. so the reason why we're paying more well in weather is getting warmer. a lot of people are driving more on that dips into supply and demand. not to mention that they have maintenance issues at the refineries. so they say as well as the summer blend and all of those things add up. that's why we're paying the highest gas prices in california. take a look at your screen. we want to show you some of the gas prices in the bay area waking up this morning. well, if you're in napa county, it's 5.72, san mateo county, 5.65. alameda county, 5.60, contra costa county, $5 and $0.53. and in santa clara county, $5. and

>> 9.13, right now and we're looking at another windy day. it's going to feel a little cooler even than it did yesterday. yeah, we've got john tracking that forecast for us today and beyond. john goodman, things a little different out there as we make our way through the rest of this forecast for the month. you can see outside how much cloudy we are already across the golden gate bridge, not foggy, but some low gray hanging out. >> all above the bay area. definitely sunnier inland. that's where we're seeing some of those low 60's and a solano county as well as the inland east bay. and we are actually seeing some thunderstorm activity up around red bluff

in reading as well as on towards lake tahoe, seeing some light showers up there very much feels like springtime in these areas now for the bay, we see a lighter chance of showers later on this week. more so towards thursday night into friday morning. the low pressure that's really stirring things up is going traverse to our south. so southern california has an even better opportunity for showers later on this week. notice how much red you're seeing across the rest of the country. you're april outlook for the rest of the month into the start of may is going to be warmer than average for most of the u.s. but for the bay area in northern california, just the opposite. we're in a cooler trend of weather with generally slightly below average temperatures for the remainder of the month and the start of next month. so get used to whether that's kind of looking more like what we have today than what we saw yesterday, 60's to low 70's for today's daytime highs. and this is actually not even the coolest that we're going to be seeing at this forecast. san jose down from the 80's to just the 60's today. hey,

we're at 68 degrees. oakland, 66, our biggest drop in temperatures in vacaville for 86 degrees to just 68 degrees today. a huge drop from that warmth yesterday tomorrow, thursday and friday. some of our cooler days of the forecast with friday morning bringing our slight chance of showers the weekend ahead doesn't look bad. it's just cooler with upper 60's to low 70's for your highs, right? all right, john, thank you for that. see some improvement on our bridges, highways over the east bay. >> still seeing a little red traveling along 80 or 8.80. they bridge right now about 16 minutes heading into the city right now. san mateo bridge from 30 down to 20 minutes. so certainly seeing traffic start to go down our bridges. highways still covered in a little red. 40 minutes along 80 crockett out towards the maze. you start to build soon as impossible all the way into oakland checking on things along selling to 37 about 45 minutes 8. 85 80 through oakland. if you had to choose, i would just 5.80. does not is backed up as 8.80. right now. and let's check on 24 walnut

back 9.24. is the time. and the supreme court is hearing arguments right now in a case that could shake up how cities across the country deal with homelessness. so demonstrators gathered, as you can see here outside the court as the justices inside heard arguments about laws that ban homeless people from camping in public spaces and whether that could be enforced. the case specifically relates to a law that was passed in grants. pass oregon. demonstrators say that fining or jailing homeless people makes it harder for them to find housing. instead, the court

areas should stay inside the courtroom. justice elena kagan suggested that the law there in grants pass goes too far. chief justice john roberts asked of homelessness should be a constitutionally protected status. >> it seems like you're criminalizing the status. if someone is homeless for the week. and finds available is that person homeless when he's in the shelter? >> this case comes after a lower court ruled in favor of homeless advocates in oregon that called the law. they're cruel and unusual punishment to fine and jail. someone who doesn't have anywhere else to go here in the bay area. san francisco officials, as we know, have been blocked from enforcing. camping regulations because the city doesn't have enough shelter beds for its full homeless population. the decision on this case is expected this summer. we'll keep you updated. >> new this morning if you have used or expired medications that you need to get rid of saturday. this

morning. san mateo bridge somewhere around 18 minutes were up to 30 at the peak of the morning. there started to slowly go down 8 minutes long. the richmond center fell bridge the golden gate bridge at about 24 minutes. look at those highways. the east bay still seems a little congestion along 88 85 80, the south bay. if you are going to be taking that to 80's looking much better than 101, at this time there james, back to you. thanks. a lot let's get to the big story, which is 35 death penalty cases are now under review in alameda county because of possible. >> misconduct by prosecutors. yeah. the alameda county says her office uncovered what may have been a pattern of misconduct going back. more than 30 years where prosecutors >> were purposefully excluding black and jewish people from serving on juries. 4 dan kerman takes a closer look. >> we recognize how terrible this and it is something that we have to make right at a news conference monday. alameda county district attorney pamela price said a

federal judge has ordered her office to review 35 active death penalty cases going back nearly 50 years for prosecutorial misconduct. certain prosecutors and the alameda county district attorneys office may have intentionally appeared to have intentionally excluded jewish and black jurors from death penalty cases prices. these prosecutorial notes suggesting the exclusion of blacks and jews from juries was discovered when her office was reviewing the appeal of ernest. a 51 year-old man convicted in 1993 and sentenced to death in 1995. for the murder of a 9 year-old and the attempted murder of his grandmother during an attempted robbery discovered notes were shared with the federal judge in the dikes case who ordered a more thorough review. the evidence that we have uncovered suggest plainly that many people did not receive a fair trial in alameda county. and as a result, we have to review all of the files. >> to determine. what happened

and what the appropriate remedy price says that review is now underway and loved ones of those harmed by those on death row. >> are now being informed of what's going on. she says the alleged misconduct is not limited to just one or 2 prosecutors and doug's case is not the only one that suggests similar misconduct. dan kerman kron, 4 news. >> you see here in this video what oakland police had to respond to over the weekend sideshows sort of dirt bikers took over several city streets, one right direction to go to the hospital sunday afternoon after getting into an accident. but police say roughly 50 of these dirt bikers, racine popping wheelies, weaving through traffic sunday afternoon, even taken to local parks with their atv's to do doughnuts in the grass. kron 4 asked police what their protocol is for sideshows like this involving dirt bikes and atv's and they

got back to us with the following. quote, they say officers do not immediately surround or block off the sideshow. participants but rather assessed the number of sideshow. participants and spectators, whatever threats. there are public safety safety concerns for the officers and the resources available to address the sideshow. once this information is obtained, the incident commander will devise a plan to address the sideshow appropriately and quote, opd says that sideshows in the city have a fall from late night street race is too large weekend gatherings like you just saw the video drive participants from all over the bay area. so we'll see if they have to reassess their protocols. it's 9. 35 and in the north say a man seen slumped over the wheel of a car in fairfield is arrested. >> for drugs, a look at what the police found. more than 1000 ecstasy pills and a bunch of other baggies with what appeared to be cocaine, meth and fentanyl and the man's car he was booked into jail.

>> police in healdsburg are looking for the person who stabbed a 16 year-old over the weekend. they say it happened about 10, 30 on fox creek pathway which is right near carson. warner skate park. police say the victim in some some sort of an argument with a different group of people when the victim was stabbed in discovered a 17 year-old was stabbed as well. both had serious injuries and our recovery right now at a local hospital. anyone with information about what happened is asked to call healdsburg police. also happening today, we have nurses in san francisco they plan to rally for more safety in the workplace. the san francisco department of public health nurses union recently surveyed members about their experiences of assault and abuse on the job more than 94% reported being verbally abused on the job. 70% reported being physically assaulted and 10% said that they had been sexually assaulted or harassed in the workplace at 03:00pm. today nurses will deliver 2000 page through 1000 page

gray whale. we told you about offshore found just off of alameda. now those remains are on angel island. they were towed across the bay so that the whale can be exam and it's a 40 foot whale first spotted saturday evening. an adult female great whale and now biologist from the marine mammal center and the california academy of sciences will perform exams to see exactly how it died. we'll lovers in the bay area are also concerned. >> very beautiful creatures. and it's very sad, i want to know what happened. i'd like to know what happened to whale. >> we don't know when the next cops he is going to actually be performed, that we will get the results as soon as we can pass along that to you 9.38. is the time right now. other news that we're following out of the south bay where there are some apartments in san jose and they're meant for people to come out of homelessness. but the people who live there have a bunch of complaint. they do. yeah.

reports of break-ins and drug use tenants say at this point little is being done in their mind to fix this problem. moment explains. >> its been held since i've been there. >> genome monarch has been at the renaissance apartments for 4 years. she talks to us with 3 other tenants. all of these people say they don't feel safe living. there is tremendous amount >> and a lot of the andes i have been broken into my apartment exactly 10 times due to says when she reports these issues to property management. >> they're either met with silence or retaliation. i have many people that has just wanted to packet grab a kid least in there because got making better and that claim to gina and others hits close to home. >> the apartments are run by charities, housing and are meant to be the first housing for people who haven't had a place to call home. they stay here for 2 years and then go on to a more permanent apartment. many of the people who stay here are recovering from years of living on the street. levi send witness.
