[cheers and applause] ♪ ♪ ♪ ♪ >> from the bay area's local news station. you're watching kron. 4 news at >> tonight at 5, we're learning more about the kidnapping of 3 month-old baby brandon quay are as police identified the people they say were involved. thank you for joining us tonight on kron. 4 news at 5. everybody. i'm grant lotus and i'm vicki liviakis. the san jose police department says that they have. >> these 3 people in custody. that is a jose por use anya ramirez. there and a sandoval at the end. and they say ramirez was with brandon's grandmother earlier in the day and may have been communicating with por for to

you is who they believe is pictured here walking to the home where the baby was being cared for by his grandmother. >> the grandmother had just stepped out of the home at the time of the kidnapping, ok? so here's a timeline of the events leading up to baby brandon's rescue on monday. the 3 month-old was reported missing just after one in the afternoon shortly after 5 is when san jose police announced the kidnapping and released photos of the missing child and the suspect later that night, the fbi joined in the search for the infant. and on tuesday morning sen. police announced that the baby baby brandon have been located safely and unharmed and that one person was in custody a couple hours later, the announced 2 other people have been detained and shortly after that, police revealed baby brandon and his mother were reunited. there's still a lot of unanswered questions in that case. so we don't know

how sandoval is related to the case. >> and so far police are holding off on answering those questions. >> some parts of the investigation that cannot be revealed that we're not ready to share them with the public because we do not want to compromise investigation. very, very important to maintain the integrity of this investigation because we want these 3 people to be held fully accountable. >> so far, police have not released a motive in this case. and right now all 3 suspects face multiple charges, including kidnapping, child abduction and home invasion. now the baby brandon is back home with his family. some people are wondering why an amber alert was not issued. >> kron forcefully to call spoke with a victim's advocate who says law enforcement had the authority to do so. >> ultimately, child safety advocate marc klass as miscommunication between the san jose police department and california highway patrol is to blame for an amber alert not being issued after 3

month-old brandon quay are was abducted monday. instead, the chp issued an endangered missing advisory which does not have the same extensive reach as an amber alert high. we understand the reason there was not because they had no vehicle verification information and we're under the belief that i was component the criteria that one had to pass in order to issue an amber alert assistant san jose police chief paul joseph confirmed as much during a news conference tuesday. we did not have information for an amber alert. we didn't have initially a suspect vehicle. we didn't have a license plate. >> we released what we had as soon as we had in order for an amber alert to be activated. there must be confirmation that an abduction has occurred. >> or a child was taken by anyone. the victim is 17 years of age or younger or an individual with a proven mental or physical disability. >> the victim is in imminent danger of serious bodily injury or death. and there is

information available that if disseminated to the public could a system the safe recovery of the victim on monday night. the chp released a description of the vehicle possibly used by the kidnappers, but later retracted it shortly before san jose police said it would not make that information public and turn talking before. issue was to rowing who bring thing to a resolution. and i also think that agencies probably more education on what is necessary to issue an amber alert because it seems like there may have been some disconnect may have been some disconnect in this particular cas little baby and phillipe djegal all kron. 4 news. >> and now to a missing persons case in contra costa county. the oakley police department is expected to announce a reward for information on the disappearance of alexis gabe. the 24 year-old was last seen on january 26th in antioch.

more details on the reward will be announced at a news conference tomorrow. police will also be providing updates on their investigation. the news conference starter left to start at 11 o'clock in the morning and you can watch it live on our streaming app. kronon. >> there are new developments tonight in the death of mario gonzales. a second independent autopsy lists. his official cause of death as restraint is fixe ation. >> and not. >> drugs, 6, the 26 year-old gonzales died a year ago this month after 3 police officers. you see body camera footage here but their body weight on him for more than 5 minutes while trying to get him into custody. this second autopsy was ordered by the oakland law firm, dodd and sure when that firm is representing gonzales is son in a federal lawsuit against the city of alameda and against the officers involved in his death. the latest autopsy results contradict the autopsy from

the alameda county coroner's office which ruled gonzales died from methamphetamine in his system, combined with the stress of being restraint. district attorney nancy o'malley announced earlier this month that none of the officers involved will face criminal charges saying the use of force used on gonzales was, quote, objective lee, reasonable. >> strong winds are in the forecast for the bay area tonight tomorrow and several days this week, gusts of up to 30 miles per hour are always a big concern for firefighters working to put out wildfires all over the state efforts are being done to mitigate the risks of wildfires this year. kron four's rob nesbitt joins us now live on what cal fire and county officials are doing to keep us safe. rob, i see some of the leaves on the trees in the background welling there. kind of windy out there. that's right. vicki. kind of windy right now. the good news >> is that there's no major wildfires in california right

now. that being said, firefighters say now is a good time for you to lower the risk of having a wildfire at your home. >> a wildfire in fairfield created this plume of smoke wednesday afternoon. californians may call the warmer months of summer and fall fire but cal fire battalion chief john heggie says that needs to stop. we don't have fire seasons anywhere. we have a fire year. he says precautions should be taken year round. encouraging homeowners to make a defensible space around their property by removing flammable vegetation. while cal fire crews are hard at work in larger dry areas. we have multiple controlled burns going through up and down the state. so really we're trying to do our part to reduce the final vegetation. but, you know, it takes all it takes is a community-wide effort. that community includes local fire departments. steve hill with contra costa county fire says the fleet has been upgraded their with specialized equipment to help fight wildfires. wildfire control workers, campus contra costa

county to reduce risks by overgrown vegetation. >> fire lines working to clear evacuations, groups from manpower to go power. goats are eating through dry brush on grizzly peak as well as the terra linda preserve in marin county. >> superintendent, a marine county parks, jim jacobs says the more than 100 goats there can access the high terrain that others can't. what's lunch for them is fire prevention for us. >> some of these techniques like raising just help, you know, mimicking the benefits of a small fires that would occur regularly. >> battalion chief peggy says that cal fire has a pretty good success rate containing wildfires to 10 acres or less. 95% of the time reporting live. i'm rob nesbitt kron. 4 news. thank you, rob. the east bay transit riders union is trying to bring back the mask mandate on bay area. public transportation, the union,

which is a group made up of daily public transit riders wrote a letter to ac transit's board of directors saying to the people who ride these buses who are high-risk and vulnerable. they also argue that taking no action is likely to drive people away from taking public transit bart's board. president also wants masks were required to ride. bart's board of directors will consider this mask requirement at a meeting tomorrow. the ac transit board of directors will discuss whether masks should be required on public transit at their meeting tonight. >> meanwhile, the nation's top infectious disease specialist doctor anthony fauci is clarifying his remarks today about the covid-19 pandemic phase being over. our first and kerman spoke to bay area doctors about fauci is comments and what they see. i had. >> we are certainly right now in this country out of the pandemic phase after making those comments tuesday evening, president biden's chief medical advisor, doctor anthony fauci clarified his statement wednesday suggesting
