>> from the bay area's local news station. you're watching kron. 4 news at all. >> the big story tonight. yet another fire at the tesla factory in fremont. what authorities are saying about the severity of this most recent fire. good evening, everybody. thanks for being with us tonight on kron, 4 news at 5 o'clock. i'm grant lotus, not vicki liviakis. firefighters were called to the tesla factory in fremont this afternoon. officials say that the fire was actually outside the building and comprised mainly packing materials. kron four's rob nesbitt has been on the scene all afternoon long joins us now live with the latest. rob. >> 5 of the key the fire was put out quickly in crews have

since cleared the scene here at tesla. according to the fremont fire department was a large pile of packing materials that did catch on fire. here are some pictures that i want to show you right after the fire was put out packing material such as pallets in cardboard boxes. you can see them went up into flames. the fremont fire department says crews are working for hours after separating the smoldering materials. they say that no one was injured during the fire and operations continued as normal inside the tesla factory. no evacuations were required. this is not the first fire at this location. 2 people were sent to the hospital for smoke inhalation back in december after a fire broke out in a boiler room on the 3rd floor of the electric carmaker's administrative building. officials reported that filters for the heating ventilation and air-conditioning system caught on fire. then the cause of today's fire is still under investigation. i reached out to tesla for comment but have not heard back live in fremont. i'm rob nesbitt kron. 4 news >> thank you, rob. now to another big story tonight. the latest on that forty-niners fan who owns a popular

restaurant in oakland and who is now in a coma after he was reportedly punched in the face at the niners game sunday outside sofi stadium. tonight. an arrest has been made and we have team coverage for the latest details. we're now hearing from family and friends of both the victim and the man who is allegedly responsible. the first questions still remain as to what exactly led up to it and who may have started it. our country's dan kerman live for us tonight with more. dan. all right. we don't have dan right now, that fight will get back to him momentarily. the fight outside. so fi stadium that has shaken a lot of people, including one of the daniel lunas longtime friend said daniel luna is the man who owns a restaurant in oakland and who is now in that medically induced coma after police say he got into an altercation with someone they

say he pushed that person who was wearing a rams jersey luna had a forty-niners jersey on these a forty-niners fan. police say that that other person then push luna and then pushed him in the face which caused him to fall down his head and he didn't move after that. according to the inglewood mayor who has been updating us yesterday and today, vicki mention daniel luna, the victim, one of his longtime friends, is shaken up but also shaken tonight. one of the suspects kuz. it's kron four's. catherine heenan has their reaction tonight. catherine, this is just a horrible situation all the way around. it really is. and both men seem stunned by what happened even though they have. >> different opinions on what happened. they are trying to process the fact a brief but angry confrontation and did so terribly putting luma and coma, a man who says that he is a cousin of the suspect that this man that you're looking at insists that

bryant's appointees must have acted in self-defense. that cousin was at the game, but he did not see what happened. he wasn't in the parking lot of that time. but he argues supplant ease did what he had to do. >> and do you believe that it was self-defense? the page? my kitchen was station opposite way with stripping of that. and just like just like anybody, you get a text from did and yourself, especially when you're with your life. you have to. they can drag. you will and team. might mr. newman and i hope that he's ok and team and you as well. >> again, he is a cousin of the suspect. but on the other hand, people who know daniel luna say that the good-natured chef just is not the type to cause trouble or pick a fight. one longtime friend says he cannot believe that luna got involved in a fight without

really being provoked. >> annual >> everybody does agree that that fight, which apparently lasted about 5 seconds, has had devastating results. grant and vicki. >> indeed. thank you, catherine. by the way, we'll get back to dan kerman here momentarily. in the meantime, though, we're going to switch gears and get a quick check on the 4 zone forecast as we are eyeing the weekend's here on a friday night. a hazy friday evening overlooking san francisco kron four's rebecca strong here to tell us what the weekend's going to look like. >> yeah, guys, you might have seen that that afternoon. hayes begin develop around the bay area. maybe side at home as well. and we do have an offshore flow. it's a weakening offshore flow. so it's me the air quality, not the greatest around the bay

area, but this is our live camera right now overlooking our east bay's own. normally on a clear day, you can make out downtown san francisco in the buildings there. can't, though, because the haze is a bit thick in the air quality right now we're seeing it mainly around the central bay. that's a moderate once we get past that, then it gets better air quality. so we're going to see that over the next couple of hours until breezy conditions start to mix some of that out. temperatures right now 50's and 60's. it was another mild day on tap. so a way to wrap up the workweek. if you like those mild temperatures, we're looking at 62 in fremont right now. 59 in oakland, 58 in concord. 58 napper right now. 59 currently in nevado petaluma currently at 59 degrees as well. we're getting into the weekend and it's going to be pretty much very similar tomorrow. the what we saw today, we're really dealing with this stubborn upper ridge of high pressure that is just can't go away any time soon. that's keeping all the storm systems away from the bay area. keeping us mild

and keeping us dry with a whole lot of sunshine. so we're going to see mild conditions, a little bit of breeze as well during the rest of the evening into the overnight hours around the bay area. and we're going to see get into the weekend. but a warmup is on the way, especially on sunday. have all those details coming up in just a bit. back to the news. thank you, rebecca. and back to our top story tonight. that forty-niners fan. >> who is now in a coma after he was punched in the face, according to inglewood authorities outside the rams game at sofi stadium sunday. as we mentioned earlier, an arrest has been made but big question remains what started it and who actually was involved to dan kerman has that part of the story. inglewood police have arrested this man, brian in connection with sunday's assault on oakland chef daniel luna outside the nfc championship game at sofi stadium. >> inglewood mayor says surveillance video helped police track down the suspect

who voluntarily accompanied officers to police headquarters thursday and was interviewed. >> after the interview, he was placed under arrest for 2.45. a subsection 4? assault by means to produce great bodily injury. a felony. it was booked at jail. he bonded out at 01:00am this morning on $30,000 bail. >> luna is the chef and owner of mist or a peruvian rotisserie in oakland. the forty-niners fan had traveled alone to los angeles to see the game and was discovered bloodied and beaten in a stadium parking lot about a half hour into the game. after reviewing 90 seconds of surveillance video, the mayor says the incident looks to have begun during a tailgate party when luhnow wearing a white jersey pushed stuff went ace who was wearing a yellow jersey. >> the individual, white jersey. pushes the individual yellow jersey and he falls over backward, didn't fall to the ground. the individual,

>> democratic infighting is not limited to the national level. just how progressive argue. that's what this is all about. youth members of the california democratic party who are moving ahead with an effort to block support for some democratic lawmakers who are seeking reelection. this is in response to the universal health care bill. the died in the legislature earlier this week. kron four's capitol bureau reporter ashley zavala explains. >> state lawmakers in the assembly monday are set to vote on that health care proposal. also known as cal care or ab 1400. this comes just days before the

california democratic party is set to begin the pre endorsement process ab 1400 would eliminate private health insurance and create a state-run health care system in california. ahead of the vote for that, the leader of the progressive caucus of the california democratic party tells us the group is taking steps to make sure any democratic assembly member who either rejects the proposal or doesn't vote will have their party endorsement taking away before the upcoming election. this vote comes as the party's pre endorsement process begins february 5th, not having the democratic party's endorsement could mean a significant lack of support activism in funding for the assembly members seeking reelection in order to be endorsed by the democratic party delegates in each district have to be in strong agreement about a candidate. the progressive caucus chair and democratic party board executive tells us the caucus has many districts in the state where they have more than 40% of delegates willing to not endorse over the rejection of cal care and then the assembly member of the things they ignore the party,

more labor, more people vote against us and then still get the endorsement, might find that they have a tough reelection battle ahead of them >> we reached out to democrats who either suggested they will not vote for this bill on the assembly floor or who did not vote for the bill in the earlier committee process. that includes assembly members burke, celia curry and akila weber. none of them have responded to our request for comment. party officials say if an assembly member loses their endorsement because of this vote, they could try to say that at the democratic convention later this year at the state capitol. ashley zavala >> and despite omicron surge, leaving millions of workers, second businesses short-staffed u.s. employers added 6 up 467,000 jobs in january, beating expectations. economists say it shows many employers were willing to hire even during this. the surgeon paying more people more money to draw them back into the workforce. the labor department also says the unemployment rate went from 3.9% to 4%. lift every voice.

the twilight hour on this friday night, san francisco's embarcadero. >> pretty peaceful. pretty nice. it's been warm, vicki, but a bit hazy. and we do like to call this a finally a friday ready for prime for is for becca strong. yeah, that's right. happy friday, everyone. we have him. it was a little bit hazy around the bay area, specially visibility. >> we started to see the haze creep through this afternoon. a lot of it having to do with a week, an offshore flow that we are going to be seeing over the next couple of hours. so outside right now. that's some of our live camera shot showing us a little bit of that haze, san francisco international airport. but it was sunny. it was beautiful around the bay area. tonight. lows are going to drop into 30's and 40's a little bit of a light breeze around the bay area tomorrow, a pretty much a very much of the same as what we saw today. that's how your saturday should shape up some dry and mild afternoon low to mid 60's tomorrow. and then sunday, though, there is so little bit of a change. we're going to see a little bit of a bump up in temperatures. much

warmer afternoon expected on sunday with a whole lot of sunshine to enjoy futurecast for showing not any rain in the forecast. unfortunately, we've got a really stubborn a ridge of high pressure. that's just not going to go anywhere for the next week or so. it's keeping all the storm systems away from the bay area, keeping them to the far north of us. so folks oregon and washington, they will be getting some of that wet weather. we're going to remain dry here for the next a week or so around the bay area. soa lots of sunshine to enjoy and warmer temperatures. we're actually going to get into the 70's. can you believe it as we get next week. so we'll try to enjoy it. well, we can temperatures tomorrow. the a lot of 60's on the board. 63 in downtown oakland tomorrow, high of 62 in san francisco. and 66 in san jose. now, how about next week in those 70's? i'll have more details on that just ahead. back to the news. all right. thanks for back. at today, marks the birthday of civil rights activist rosa parks. >> she would have been 109 years old today. parks is probably best remembered for her role in the bus boycott

for civil rights and montgomery, alabama parks refused to give up her seat on a public bus to a white man on december. first, 1955. that action started the bus boycott targeting legally sanctioned racial discrimination in public transit. u.s. has called rosa parks the first lady of civil rights and the mother of the freedom movement. still ahead, why a grieving mother is taking on alameda county to him taking him to court. >> and new details from a spot shooting in oakland that we've been reporting about. but police say they are now learning as they investigate.

>> in the east bay, oakland, police say a shooting at a spa near oakland's lake merritt is being investigated as an attempted murder and suicide. it happened tuesday morning at the a spa. police say the woman who was a spa employee shot in oakland man and then shot herself. she later died at the hospital. police say that there are no other suspects. the oakland man who was shot, he remains in critical condition tonight. police in san francisco are looking for the people responsible for a fatal shooting that left. >> one man injured. it happened just after 9 o'clock last night near 9th and howard, the victim was reportedly trying to stop the suspects us. they were breaking into his vehicle when he was shot. well, sfpd has not released a description of

the suspects. they do say they're looking for 2 people. anybody with information is asked to call the sfpd. >> a second federal civil rights lawsuit has been filed against the city of alameda and the officers involved in the death of 26 year-old mario gonzalez. this time on behalf of can solace. his mother gonzales was killed during a struggle with police last year, which the alameda county coroner's office ruled a homicide crowd forcefullh to got spoke with the attorney whose firm filed a lawsuit. >> the purpose is off lawsuit is to hold the police officers as well as the city responsible for young man whose life was taken from him far too soon on thursday, even our knowledge, the mother of 26 year-old gonzalez filed a federal civil rights lawsuit against former interim alameda police chief randy fenn. >> the 3 officers involved in her son's death in the city of alameda. she claims the officers illegally and

unjustifiably restraint, a confused and disoriented gonzalez at a park in alameda last april, adding that the officers failed to de escalate a situation during which gonzalez was not a threat. the lawsuit is seeking money to cover financial and emotional damage caused by mario's death. civil rights attorney adante pointer places representing our goal. it's apparent under federal law is entitled to bring a lawsuit for the loss of their in december. the alameda county coroner's office ruled mario's death a homicide stating that drugs and the officer's restraint contributed to his passing shortly after through a different law firm, the gonzalez family filed the first federal civil rights lawsuit against the same defendants listed in this latest lawsuit on behalf of mario's 5 year-old son mario junior. the family, unfortunately is united in grief in outrage that their loved one has been taken from them. >> this is just purely a legal

vehicle. >> to present the claims of the mother in a statement, the city of alameda confirms it received the federal complaint, adding, quote, the loss of mario gonzalez is life was indeed tragic and the city will vigorously defend itself. its former police chief and the named officers against all allegations will be more lawsuits. >> we don't anticipate any more losses for the death of it was all as the city of alameda confirms the officers involved remain on paid administrative leave. >> the alameda county district attorney's office says it is still investigating the matter and has not made a decision on whether or not to file criminal charges against the officers kron. 4 news. still to come, a south bay food pantry in danger of closing could actually stay open. how the city of san jose is stepping up to help. thanks to a new proposal. >> and gas prices, they're on

tonight, health in contra costa say that this move is all about the public doing its part. >> we we were really grateful to our community doctor, or is it valley acting contra costa county health officer sharing the news with kron 4 about how you no longer need to show proof of vaccine status or recent negative test to go into bars. gyms or entertainment venues. >> over 87% have gotten at least one dose many people have gotten the natural infections so between all of that put together, we estimate that over 95% of members of our community have at least some measure of protection. this is happening as the county continues to see covid-19 cases rise >> and the doctor explains why they think easing the restrictions is okay but made sense back during the delta variant when the virus are
