(male announcer) this is the bay area news station, kron 4 news starts now.right now on kron 4. broken bolts found on the new span of the bay bridge. tonight -- an upclose look at the just uncovered problem. and we get answers from the people in charge. is the bridge still safe? will it open as planned? i'm pam moore. now at five busted bolts on the bay bridge. kron four gives you a closeup view of the what could be a major problem with the new span. just months before its planned a big problem for the new eastern span of the bayseismic safety bolts already installed. have turned out to be faulty and some of the them cannott be replaced. kron 4's maureen kelly explains the problem. and how it is going to affect when the bridge will be completed. >> reporter: caltrans says they got a bad batch of bolts from one of their u-s manufactuers..you can see some of them sticking out of the concrete here in this video at the beginning of the month 96 threaded rods that

are intended to anchor this part of the span to it's support pillers were tightened .and when they were inspected a little over a week later.32 of them.nearly a third.were found to be broken. another 192 of the bolts installed have not been tightened.but will beand closely scruntinzed. caltrans says a sample of the bolts were tested before they were embedded in concretebut not every single one. a big part of the problem.some of the bolts can't be taken out because of where they are located. so they are currently trying to figure out a solutionsince the whole point of this multi billion dollar project it to make it safe during a seismic event. once they come up with a fix, it's believed it will take a month or two to finish that work,.but they plan on doing while also finishing up the rest of the bridgeworkat this time they still think the new span will be ready for traffic by labor day weekend.but say there is no absolute guarentee. maureen kelly kron4 news. >> continuing our coverage on this story. the broken

bolts were found in a support column, just east of the new suspension tower. kron 4's charles clifford has a closer look at the problem. >> reporter: this is an artist rendering of what the new eastern span of the bay bridge will look like when it's finished. the broken bolts or rods that we're talking about are located here... inside this foundation support which is also called pier e-2 between the top of this support and the deck of the bridge there are several bearings and what are called shear keys... these are pieces designed to stabilize the bridge in the event of an earthquake. here's a look at it from another angle... these are the bearings and shear keys.. up here is the deck of the bridge.. this is the support column and these yellow lines here are the bolts. each one is between 9 and 24 feet long and they run vertically inside the column. now, recently crews started tightening the nuts at the top of the bolts... here and what happened is that after they had added tension.. the bolts started

to break.. and they know they're broken because the bolt popped up.. leaving this gap.. it should look like these other bolts.. flush with the concrete. finally, the rods that have brokedn can not be replaced or removed.. they're buried within the structure...so caltrans will have to come up with another way to attach the shear keys to the support column. possibly by installing some sort of collar around the base of in the newsroom, charles clifford kron 4 news. >> pam: same sex marriage had its second day before the u.s. supreme court this morning. this time the issue - the federal defense of marriage act. which denies federal benefits to legally married same sex couples. both a federal district court, and a federal appellate court ruled the law. known as doma. was unconstitutional. and the obama administration has said the same thing.

but now the fate of doma is in the hands of the highest court in the land. kron 4's dan kerman is here to report on today's proceedings. >> reporter: the defense of marriage act defines marriage as a union between a man and a women and that's why more than 11 hundred federal laws tied to marital status do not apply to legally married same sex couples. the court released audio recording of this morning's oral arguments. defenders of doma said the federal government is within its power to use a uniform definition of marriage regardless the consequences. the liberal wing of the court along with justice anthony kennedy took issue with that because it's the state that's supposed to have the power to say who is married. not the federal government. >> when it has 1100 votes, and in our society it means that the federal government is intertwined with the citizens daily life you are

thanks jim -- you'll be back at 5-30, and we'll get more of your take on all this. right now -- catherine heenan is standing by with details on the scene today outside the court room. >> catherine: a lot of the drama of the day was again happening 'outside' the supreme court. that's where people who care deeply about the issue have been gathering to be seen and heard. the people who are for and against the defense of marriage act have been holding court - 'outside' court. people on both sides of the issue - holding signs. and grabbing microphones. including politicians who want everyone to know where they stand. >> "to overturn the defense of marriage act, which was unconstitutional in the first place." >> reporter: but the star attraction for many today -- this woman. an 83-year-old new yorker. edith windsor is a plaintiff in the case. >> "they were certainly direct. they asked all the right questions. but i felt, though, i didn't feel any hostility okay, or any sense of inferiority, you know - what do these people want? i felt, were were very respected and i think, i think it's gonna be good.'

>> catherine: what's good for edith is not good for others. one clergyman says if the defense of marriage act is shot down -- he's worried about colleagues bring forced to perform same sex ceremonies. >> "military chaplains, civilian chaplains who are under orders by federal authorities as well as other clergy required by law to uphold the constitution and in this case may have their authority to solemnize marriages held in doubt." >> catherine: long after court wrapped up today. people stayed outside the supreme court building.saying they wanted to be a part of legal history >> pam: the defense of marriage act marked the beginning of a decades=long debate over same sex unions. many of its original supporters now say it was a bad idea.

the year was 1994. same sex marriages were not legal anywhere in the country. but in hawaii, the state supreme court hinted it might allow them. congress took action. the defense of marriage act defined marriage as being between one man and one woman. the federal government was barred from recognizing any other kind of union, even if legalized by an individual state or another country. that means same sex partners could not share insurance benefits for government employees or collect social security survivors' payments. same sex couples are not considered married by immigration officials. they cannot file joint tax returns. in 2009, elizabeth windsor was forced to pay 360=thousand dollars in estate taxes after her wife died. windsor and thea spyer were legally married in canada after living as a couple for 40 years. the i=r=s said under doma, she did not qualify as a

>> catherine: lawyers for the suspect in the colorado theater shooting have offered to enter a guilty plea. it's a move to avoid the death penalty. james holmes faces murder and attempted murder charges and would serve the rest of his life in prison if the deal is accepted. it's not clear yet whether along with the offer. they're expected to talk to victims and their families before making a decision. holmes is accused of killing 12 people -- and injuring dozens more. thousands of documents have been released today in arizona. giving us new details about jared loughner - the man accused of killing 6 people -- an injuring 12 others -- including former congresswoman gabrielle giffords. an example.loughner had been stopped by police that same day for a traffic violation. he cried -- which the officer said seemed odd. some say it's evidence that he was on the verge of a break-down.

the documents reveal that loughner had grown increasingly erratic and delusional in the mohs before thshooting. his parents had him tested for drugs - but didn't follow up on a mental evaluation. loughner's father told police - "i tried to talk to him. but you can't. he wouldn't let you." the lawmakers who want to toughen gun laws may have waited too long. it's been three months since 26 people were shot and killed at a connecticut grade school. new polls show that public support for new gun laws has fallen ten points since then. the biggest drop was among people who live in rural areas and older americans. some of those surveyed say congress has simply taken too long to act.

supreme court debate over same-sex marriage and the rights of same-sex couples. today, the high court heard arguments on the legality of the defense of marriage act. doma, as it's known - is the federal law defining marriage as a union between a man and a woman that means same sex partners could not share insurance benefits for government employees or collect social security survivors' payments. kron4's dan kerman has more from today's supreme court doma hearing. dan?

the defense of marriage act defines marriage as a union between a man and a women and that's why more than 11 hundred federal laws tied to marital status do not apply to legally married same sex couples. the court released audio recording of this morning's oral arguments. defenders of doma said the federal government is within its power to use a uniform definition of marriage regardless the consequences. >> we want to treat the same sex couples a statewide. >> we are saying that new york's state same-sex couples are different than a different state. >> the only with the return is because the with the state law treats them. >> the liberal wing of the court along with justice anthony kennedy took issue with that because it's the state that's supposed to have the power to say who is married. not the federal government. lawyers opposing doma also argued that claims the law was enacted for the purpose of uniformity or caution are simply not true justice antonin scalia and chief justice john roberts questioned whether the issue

this is an artist rendering of what the new eastern span of the bay bridge will look like when it's finished. the broken bolts or rods that we're talking about are located here... inside this foundation support which is also called pier e-2 between the top of this support and the deck of the bridge there are several bearings and what are called shear keys... these are pieces designed to stabilize the bridge in the event of an earthquake. here's a look at it from another angle... these are the bearings and shear keys.. up here is the deck of the bridge.. this is the support column and these yellow lines here are the bolts. each one is between 9 and 24 feet long and they run vertically inside the column. now, recently crews started tightening the nuts at the top of the bolts... here and what happened is that after they had added tension.. the bolts started to break.. and they know they're broken because the bolt popped up.. leaving this gap.. it should look like these other bolts.. flush with the concrete. finally, the rods that have brokedn can not be replaced or removed.. they're buried within the structure...so caltrans will have to come up with another way to attach the shear keys to the support column. possibly by installing some sort of collar around the base of

this driver is also stopped at the toll booth and if look right here he has cash in hand but he also leaves the car looking for a place to pay. he even tells the drivers behind him that there is no one there to take the his cash. a bridge worker finally convinces he to return to his car a contuine on which is what you should do. now that the bridge is all electronic, you don't need traditional money you fastrak transponder or you license plate will do. even if you drive a rental car, there are ways to pay in advance or opt in for the rental company to bill you. stopping in a toll booth is dangerours and could get you seriously injured this driver stopped between the toll booths. the one benefit i see from using a fastrack is it's a dollar cheaper they just using your plate. one other thing, stopping on the shoulder could get you a ticket so i would avoid that like the plague.
