time in office. plus, the big developments in his so-called hush-money trial. crackdowns on campus. as the pro-palestinian movement grows at colleges across the country, some schools are turning to police to quell the demonstrations before they take hold. and police custody death. body cam video shows officers leaving a handcuffed man lying facedown on a bar floor. before he died, his final words. good morning, and good to be with you. i'm anne-marie green. this morning president trump is due back in a manhattan courtroom for his so-called hush-money trial. it follows yesterday's historic supreme court arguments with nine justices poised to decide if trump has absolute immunity from criminal prosecution for official acts while in office. cbs' jarred hill is joining us here in new york with a wrap-up of i guess all things court side. good morning. >> reporter: good morning, anne-marie. this supreme court case is so much bigger than former president donald trump.

the justices repeatedly emphasized that whatever they decide on immunity for him will impact any other president from here on out. outside a manhattan courthouse, former president donald trump again repeated his claim that all presidents should be free from criminal prosecution for official acts taken while in office. >> a president has to have immunity or you don't have a president, or at most you can say it would be a ceremonial president. >> reporter: 200 miles away in d.c., justices on the u.s. supreme court seem poised to reject trump's claims of absolute immunity. >> if there's no threat of criminal prosecution, what prevents the president from just doing whatever he wants? >> reporter: trump is the first former u.s. president to face criminal charges. yesterday's historic high-court arguments stem from special counsel jack smith's case charging trump with plotting to overturn the results of the 2020 presidential election. >> whatever we decide is going to apply to all future presidents. >> reporter: the justices suggested that presidents should have some level of protection from criminal prosecution for

official acts, though with that came more questions. >> how exactly would we determine what the -- what an official act is? >> reporter: the supreme court is expected to issue its ruling by early summer. so depending on that ruling and whether the court says presidents have some immunity but not full immunity, this could end up getting sent back to a lower court which likely would delay the election interference trial until after this november's election. >> i suspect that's part of the plan. jarred hill in new york. thank you. >> reporter: thanks. onto the other criminal case, as we said. trump's criminal trial continues today in manhattan. the defense is expected to resume cross-examination of the lead prosecution witness, former national -- "national enquirer" publisher david pecker. he is accused of a catch-and-kill scheme. >> reporter: president trump weighed in on a key witness in

his trial. former "national enquirer" publisher david pecker. >> been very nice. he's been -- david's been very nice. nice guy. >> reporter: trump has known pecker for decades and it's alleged that they along with former trump lawyer michael cohen engaged in conspiracy to suppress negative stories about trump as he ran for president in 2016. picker told jurors after the "access hollywood" tape surfaced weeks before the election, discussions about what to do with stormy daniels heated up. the adult film star was, allegedly, shopping the story, and pecker testified he didn't have the $120,000 she wanted so he told cohen to buy and bury her story, saying if he didn't and the story gets out, the boss is going to be very angry with you. >> the da's case is really rises and falls with david pecker's testimony because he is the linchpin behind their theory of this sort of conspiratorial scheme to influence the election.

>> reporter: pecker also testified about an agreement with former "playboy" model karen mcdougal who says she had a ten-month affair with trump which he denies. pecker acknowledged ami that owned the "enquirer" paid $150,000 for her story weeks before the election and never published it. >> if donald trump hadn't been running president do you believe the deal would have been made with ami, knowin what you know now? >> probably not. no. >> reporter: in his testimony, pecker said the payment orchestrated was done because they didn't the story to embarrass mr. trump or hurt the campaign. pecker said he asked cohen who would foot the bill. he responded, the boss, meaning trump, will take care of it. and pecker also revealed in an alleged 2018 conversation with him, hope hicks, and sarah huckabee sanders, then white house staffers, about extending mcdougal's contract, raising new questions about whether the trump administration might be further implicated in this case. robert costa, cbs news, new york. turning to the severe

[ chants ] >> reporter: campus crackdown at atlanta's emory university. police tore down tents, and some appear to be tased by police. some students and faculty were led away in handcuffs. here at the university of texas austin dueling protests. pro-palestinian and pro-israeli protesters facing off on campus with security watching. >> it is my understanding that the university of texas at austin funds research that israel directly benefits from. >> reporter: on the campus of usc, the lapd used their batons to disperse a large crowd last night. the school canceling the main stage commencement ceremony. cbs' nancy chen is at columbia university. >> reporter: dozens of tents remain here at columbia university. right outside it, israeli flags. and some jewish students we spoke to say they feel scared to be on campus.

>> many of us knew people at the music festival or that live nearby -- i'm sorry, i'm getting emotional about that. the situation where people scream hateful speech, who have harassed and attacked us verbally and physically people is just making it impossible to be here. >> reporter: back in austin, student demonstrators are still to campus. police have stayed close by, but they have not made any moves to clear out this space the way they did before. in austin, jason allen, cbs news. president biden joins 17 other world leaders demanding hamas release the hostages still being held in gaza. it is the latest attempt to ratchet up the pressure on the militant group which the white house blaes for blocking a diesel with israel. a delegation will arrive in israel to jump-start the talks. meanwhile, the u.s. began constructing a temporary pier off gaza to help deliver humanitarian aid, but there are big concerns about security.

the israeli-built port has already been attacked by mortar fire this week. hamas has not claimed responsibility, but the group has said it rejects the presence of any non-palestinians in gaza. and a court overturned harvey weinstein's conviction in the state. the disgraced movie mogul is serving a 23-year sentence for sexually assaulting two women. the court ruled weinstein did not receive a fair trial because the judge allowed women who were not part of the case to testify that weinstein assaulted them. the case against weinstein sparked the me too movement. >> i'm disappointed. i'm angry. i'm sad because no matter what work we do they still keep getting it wrong. >> weinstein will remain in prison because he was convicted in 2022 of raping women in los angeles and sentenced to 16 years in prison. the manhattan district attorney says he plans to retry weinstein. coming up, police custody death.

firefighters battled a fire on a southern california pier using boats and helicopters. a vacant restaurant at the end of the pier in oceanside about 40 miles north of san diego caught fire yesterday. it sent smoke billowing into the sky and onto the nearby beach. no one was hurt, and there's no word on what caused the fire. a high school athletic director accused of framing the principal with ai, and an investigation into a police custody death. those are some of the headlines on the "morning newsstand." "the columbus dispatch" reports canton, ohio, police released body cam video of a man who died while in custody.

police responded to a report of a car accident last week where they found the driver, frank tyson, inside a bar. the video shows officers forcing tson to the floor as they handcuffed him. at one point, an officer had a knee on tyson's back as he spoke his final words. tyson was left facedown on the floor for nearly eight minutes before officers discovered he did not have a pulse and began cpr. two officers have been placed on paid leave. "the baltimore sun" says a maryland high school athletic director is accused of using artificial intelligence to create a fake racist audio recording of the school's principal. the pikesville high school principal was temporarily removed from his job back in january. police say they traced the recording back to the athletic director, dazhon darien, through an email. he was arrested yesterday trying to board a flight. investigators say the principal

was investigating darien for misappropriating school funds. and "usa today" says 17 states sued the equal employment opportunity commission over a federal rule giving workers time off and other accommodations for abortions. republican attorneys general filed the lawsuit claiming the eeoc is illegally applying the 2022 pregnant workers fairness act. it comes after the agency approved its regulations on how to implement the law last week. the rules are set to go into effect in june. still to come, a cat's wild tale. how the feline ended up 650 miles from home. well a cat used at least one of its nine lives when it survived a harrowing 650-mile journey. a utah woman says her cat galena vanished this month and was nowhere to be found. turns out galena snuck into an amazon package being returned. she was discovered trapped in a taped box in a trailer in california six days later thanks to a microchip. galena was dehydrated, lost some weight, but otherwise was okay. halloween comes early for one big retailer, and a bumpy ride ahead for southwest airlines. here's shanelle kaul with today's cbs "moneywatch." >> reporter: u.s. stocks plunged thursday after newly released data showed the weakest economic reading for the first three months of 2024 in almost two years. the dow lost 375 points. the nasdaq was down 100, and the s&p 500 lost 23 points. southwest airlines is cutting back.
