the bay area still cannot turn on the lights after powerful storms. a look at how long those communities may be in the dark. an appeals court unanimously says donald trump is not immune from federal criminal prosecution. skyler henry is in washington as a former president has indicated he wants the u.s. supreme court to review that ruling. >> reporter: the d.c. court of appeals rejected former president trump's claims he is immune from prosecution. for his actions while in the white house and leading up to the capitol riots on january 6th, 2021. the three-judge panel noted the unusual nature of trump's assertion in court last month. >> i think it is paradoxical to say that his constitutional duty to take care that the law be faithfully executed , allows him to violate criminal laws.

paneput that on paper and a 57 page willing. >> what they are saying is that criminal cases are different. yes, we have concluded that when it comes to civil cases, and official acts, presidents do enjoy absolute immunity. criminal cases are different. criminal investigations are different. we have to be allowed to let those proceed. >> reporter: trump's campaign responded saying, president trump respectfully disagrees with the d.c. circuit's decision and will appeal it in order to safeguard the presidency and the constitution. the way for the ruling pushed back the federal election interference trial against the former president. had been scheduled to get underway in less than a month. the appeals court has given trump's a few weeks to go to the full d.c. circuit court for review. and he could take his case to the supreme court . >> i see no way that the supreme court does anything other than what this three-judge panel did here, if they decide to take up the case. >> reporter: all of this is making it harder and harder for the current gop presidential

front-runner to avoid going to trial as voters waiter option for the november ballot. time for look at this morning's top stories. governor gavin newsom will send 120 highway patrol officers to help fight crime in oakland. the additional officers will help tackle the rising in carjackings, retail craft and other crimes in the area. newsom's office said the new officers represent a ninefold increase in the number of state police patrolling that region. street vendors in san francisco's mission district will remain banned from the more than six months. the ban went into effect late october and was supposed to last 90 days. the city said the area is cleaner and safer and more accessible. after fighting cancer since 2021, country music star toby keith has died. those closest to him say he was surrounded by family . he continued to

perform including las vegas last december. he was 62 years old. king charles has been diagnosed with cancer. buckingham palace did not specify the type of cancer but it was discovered by doctors who were treating the monarch for an enlarged prostate, which the palace says was not cancerous . for now, the kings appearances have all been canceled. this morning more than 85,000 pg&e customers across the bay area are still without power and in many cases wind is to blame after the powerful storms hit the area this past weekend with gusts reaching 90 miles per hour. here is a look at the pg&e outage map. the north bay has 36,000 homes and businesses in the dark. the south bay has more than 28,000. the climate prediction center showing wetter than normal conditions in the next eight to 14 days in the bay area and widespread throughout the state of california. after two back-to-back atmospheric river events we just experienced. heading into tomorrow, we get our first taste of showers and more rain rolls in tomorrow in the early morning hours lasting into the afternoon. today we can see a little drizzle hit or miss throughout the bay but the

rain starts to ramp up more tomorrow. we will see a quarter of an inch of rainfall throughout the bay area as we head into the afternoon hours around lunchtime and then it is game on with scattered showers throughout the evening hours tomorrow night. then it clears up into the weekend and we have more on that, coming up. new this morning, video out of southern california after the area was hit by an historic and deadly atmospheric river, some places have record rainfall and more than seven inches fell over the past 48 hours. the highest today rain total in los angeles since 1877. landslides are also a major issue down south. this was left behind in one beverly hills neighborhood. the mud so thick it looks like the suv was swallowed up in the quicksand. >> public works has been hard at work. they have reported over 120 mudslides and debris flows throughout the city. as the mayor stated, we have just surveyed firsthand several and witnessed their damage across

the city. and this is an incredible, incredible thing to see and it is a very powerful thing to see when the earth moves like that. >> the fire chief said officials are investigating the structural safety of about 25 buildings in the county. president biden said fema stands ready to help state and emergency responders in any way that is needed. more job cuts are coming to the bay area's tech sector. the positions impacted. the super bowl sunday could get expensive.

. the majority of positions of the company's sales and marketing organizations. docusign said it is all part of a restructuring plan. snapchat is the latest company to announce mass layoffs and it will cut more than 500 jobs about 10% of its global workforce. the california-based company previously cut about 20% of its staff in 2022. the cost of owning a car is getting more expensive. a new report from bank rate shows the price of car insurance jumped 26% from last year with the average driver now paying around $212 a month. the report found in addition to inflation , weather and population density play a role in the rising cost. this just in. meta said it will add a.i. generated labels to images made by third-party tools in the coming months. the tech company already applies a similar label to images created with his own a.i. generated tool. there are concerns about people using a.i. to produce realistic images, especially ahead of the 2024 presidential election. ♪ that is what you will

be seeing sunshine in the bay area, just in time for the 49ers to win the super bowl. in las vegas, they will see sunshine. from vegas back to california and back over into nevada, we will be seeing wetter than normal conditions, especially in southern california and stretching into the bay area heading into the the next eight to 14 days. we are not done with the rain. enjoy the day we had today and help out your neighbor if possible, and we are dealing with the recovery from this week's atmospheric river and last week's. we had two back-to-back systems give us major impacts in the bay area. today is a great day to reassess your local area and help out how you can. here is what were looking at into the next seven days. sunshine in the forecast as we head into this weekend. saturday and sunday we expect 60s. a little warmer and sunnier. tomorrow we have an area of low pressure dipping the temperatures down and we expect low 50s in the forecast and the rainy skies widespread throughout the bay.

super bowl lviii is less than five days away. both teams will battle on a neutral site. it is supposed to be an even playing field except when it comes to practice. niners are practicing at the university of las vegas all week. unlv. the team reportedly unhappy with the field. here is commissioner roger goodell's response to the niners. >> we have had 23 experts out there and we have had the union out there , all of them think it is a very playable surface and it is softer than what they practiced on. but that happens. it is well within all of our testing standards. it is something we think all of our experts, as well as neutral field inspectors have all said , unanimously, it's a playable field. >> despite the complaints , last night kyle shanahan said the team will practice is scheduled. a live look at allegiant stadium where the faithful showed up for opening night of super bowl week . this is the

where do you find joy? in oakland the city is constantly in a fight for positive change against negative stereotypes . one woman who loves her city and community has made it her goal to shine a light on what is good by holding a parade. ♪ >> i think it is the best day of the year in oakland. it is a fun. >> reporter: inside alicia greenwell's home -- >> it makes me emotional. >> reporter: there is a wall that defined the past six years of her life. each poster -- >> all the memory and footage and video were beautiful. >> reporter: highlighting a moment in time each year. >> 2022 was our fifth year as an organization. >> reporter: is the founder of the black joy parade. >> it is 100% my baby. >> reporter: it is a parade

born from the marches and protests of black lives matter and occupy, to a community fighting for social justice. >> that is the only time you saw a lot of us together was these fights and against the system and having to be on the frontlines of the things like we always are. i just wanted to have a moment where it was not bad we were gathered in a group for celebration. >> reporter: it was during that first celebration in 2018 when 14,000 people showed up. when alicia knew she had given birth to something unique , and special. >> i remember the very first one , we could see other people and we started crying. who are all these people? how did they find out? that is when i realized we hit a nerve and it was not just something we wanted and needed but so many other people were craving. >> reporter: the dance line team , has performed in the

parade since day one. >> it is hands down my favorite event in oakland. >> reporter: her group celebrating and teaching the dance lines of the historically black colleges and universities, attracting a number of young black teen girls. >> it is like the style. it is the pizzazz and part of our culture, right. >> reporter: the black joy parade giving them a perfect platform. >> it really inspired me and allowed me to say, we can dream bigger. for oakland and we are the aunties and uncles who are now bringing this new wave of kids up and what do we want to show them? it has grown like a baby and i nurture it like a baby and i get emotional and defensive about it like a baby. >> reporter: a parade she gave birth to. >> i keep telling her, you are coming the day after. >> reporter: and now a world she imagines for her own daughter. >> i am do the week before black joy parade this year. i
