from cbs news bay area, this is the afternoon edition. >> right now, the man accused of killing the cash app founder, bob lee pleading not guilty today in court, good afternoon, i'm elizabeth cook. these are the latest development, he appeared today for his arraignment, more than a month after allegedly stabbing bob lead to death, this is the third time his arraignment has been pushed back. his defense attorney asked for more time so the team can build the case. he is accused of stabbing and killing bob lee with a kitchen knife on april 4, he was arrested by police less than two weeks

later at his home in emeryville. prosecutors say he stabbed him to death after a dispute over his sister. court documents indicate he was concerned she was doing drugs with bob lee . earlier this month, a medical examiner report showed he had alcohol, cocaine and ketamine in his system. >> the police spoke to witnesses, they knew everything within like five hours of it. and i don't understand for the life of me, having done that as a da, i would have knocked on people's doors , and they did not do that. >> the judge ruled that he will remain in custody. our team will have a lot more later in the newscast, you can get the latest news streaming 24/7 on cbs news bay area . new video this afternoon of a brush fire along highway 4 in martinez, it broke out this morning on the westbound

mount diablo just over walnut creek. current temperatures near concord sitting at 72 degrees, it is going to be a warm one today, especially off into the east hills. the daytime highs today are going to warm up even more, right now it is 57 near san francisco, 72 in concord, and we will see that marine layer break apart and i will have more on that coming up in a bit. thank you. we are hearing exclusively from the father of banko brown as a fallout grows over brown's shooting death at a san francisco walgreens. the security guard , michael earl wayne anthony was shot down after a suspected shoplifting. brooke jenkins announced she will not file charges. now, there are new calls for the state attorney general and the department of justice to step in. brown's father sat down with reed cowan. >> reporter: his father said his last moments included his ability to get his dad the name and number to the police.

of the gender, they might have had an altercation before, we don't know. i wish i did know but i don't know. i can't answer that. >> the district attorney's own report reveals this directive from the security firm kgps. it said an abrupt policy change directing guards to engage in hands-on recovery of merchandise and actively work to retrieve or recover any stolen items once it was clear that the individual intended to leave the store without paying. we have reached out to the district attorney's office for her response but we have not heard back yet. police say bill scott also faced questions about the case during a police commission meeting yesterday, he said the report to the police was missing a recommendation about whether or not to charge the guard. >> to my knowledge, there was no recommendation charges, and does that ever happen?

victim stood up to her attacker with a cell phone and ended up putting a suspected serial offender behind bars. she shares her story with andrea. >> jeannie was fueled by anger after a man attacked her on the streets of berkeley, she was just walking to her friends house in broad daylight and after the assault, she personally made sure that her attacker would pay for his crime. >> when he grabbed me, i was furious. i wasn't going to take it. and i didn't want him to get away with it. >> the suspect made a huge mistake when he decided to make jeannie his next victim. >> i have a story to tell. name him, get him caught, don't protect him, don't feel ashamed. he should feel ashamed. actions have consequences. >> she fought back with a vengeance when she was attacked in may of last year. first she yelled at him, then kicked him in the shin. it's what she did next that eventually put him behind bars. >> so i knelt down and i

grabbed my phone out of my backpack and i chased him around the corner and i took his picture from the side, and then i was chasing him with my phone in my hand. >> she called 911, the suspect had already left the scene by the time the officers arrived. while berkeley police investigated the case, she took another step to find her attacker. >> i can post this picture online. i get to do that. this person has given up any rights to privacy , and there's no reason for me to feel bad and i'm going to put this out there because somebody knows who he is. >> and it was on next-door where the neighbor recognized the man, that led to the arrest of 45-year-old, tommy giles junior. he was connected to four other assaults, the victims ranging from 9 years old to 63 years old. >> i wanted to turn the tables, it shouldn't be on us, it should be on them. if that is a problem that men are

gusts up to 35 miles per hour into the afternoon. the marine layer has been stubborn, the marine layer is mostly a morning person, but even into the evening hours tonight, i extended this all the way through 7:00, we are still seeing it along the coastline, a very stereotypical system even into the evening hours for our friends that live closer to the pacifica, half moon bay, and even up to stinson beach. partly cloudy skies, it could cause some issues when it comes to visibility . so, daytime highs today, thanks to the marine layer, we are seeing below average, and i will talk about that more in a second. heading off to the inland east bay, quite the opposite, still sitting in the upper 80s this afternoon. all across the bay bridge and into san francisco, upper 50s and mid to low 60s this afternoon for the daytime high. so a little bit below average off on the coastline, a little bit above average inland
