harm. she went to an area that is breath taking to look at, very precarious. >> reporter: kpix 5. developing story, san francisco police are stepping up patrols at a popular tourist spot after a 71-year-old man was fatally shot. kpix 5's susie stemiel is live at twin peaks with the crime and added security there. >> reporter: since we got here this afternoon, we saw three separate san francisco police vehicles patrolling the area as well as a couple of park rangers. if you are familiar with twin peaks, you know that is not normal patrolling activity. when ed french was here sunday morning he was doing what most people come to twin peaks to do, enjoy the view and take some pictures. the concern is that his camera may have made him a target. >> when it is someone that you know, it is really-- hits home.

>> reporter: susanna robins describes 71-year-old ed french as witty artistic sole she will miss, a commercial location scout with close ties to the xhilm community, lost his life-- film community, lost his life sunday morning, alone when two people robbed him of his camera and shot him to death. >> the view is amazing, the morning would have been a beautiful time. >> reporter: signs around the location indicate theft here is common, police have added 24/7 security as they investigate french's death. >> there is an uptick in crime up there, there is about 254 incidents that we have to this date, for 2017. >> reporter: 97% of those crimes are car break in's, but two tourists were murdered here on valentine's day of last year, multiple others reported being robbed at gunpoint. >> this level of violence is rare for that area, and the car break in's that we have been primarily focused on, but

obviously an incident like this takes our attention. >> reporter: susana says the story has shaken her sense of security, she and her co-workers are often alone on shoots at dawn and dusk around the bay area, now thinking twice about where she will feel safe. >> i think now i would be much more careful. >> reporter: police tell us they will keep those 24/7 patrols in place for the foreseeable future and taking a look at some surveillance video collected near by, hoping that leads to more information on those two suspects. live at twin peaks, susie stemiel, kpix 5. richmond police say a teenager shot and killed a woman two months ago at a bay area park, they arrested a 15-year-old in connection with the death of this young woman. 20-year-old alley swietser, police say it began in may when swietser and the teen were at a park, they started fighting and that is when swietser was shot and killed. the teen faces a murder charge. big story in washington

tonight, the gop plan to repeal and replace obamacare now a total failure, cbs reporter, seth lemon, tells us senate republicans can't even get enough votes to simply repeal the law. >> reporter: president donald trump is expressing his appointment with republicans on the latest plan to repeal and replace obamacare. >> for 7 years i have heard repeal and replace from congress, hearing it loud and strong, when we get a chance to repeal and replace, they don't take advantage of it. >> reporter: opposition from moderate and conservative republicans the most recent version of gop health care over haul, now senate majority leader, mitch mcconnell, plans to call a vote on clean repeal but doesn't seem to have enough support for that either. >> i think it would create great anxiety for vejs who rely on-- individual whose rely on the aca, i believe it would cause insurance markets to go into term oil. >> reporter: at least three gop senators said they would vote no

on repeal only, others argue it would push them to get something done. >> we have to put pressure on this to fix the mess. >> reporter: senate democrats are united in their opposition to the now failed gop plan and to any repeal only legislation. >> there has to be good faith efforts to build on the affordable care act, not repeal. >> reporter: house republicans, who passed their ownbill are hopeful the senate will get something done. >> we have a promise to keep and we need to step ahead of the problem that this law is collapsing. >> we are not going to own it. >> reporter: tuesday breads donald trump said let obamacare fail and then democrats would work with republicans on what happens next. senate majority leader, mitch mcconnell, says at the president and vice president's request, a vote on clean repeal will happen early next week. >> seth, if there is not enough support to repeal obamacare, then why would senator mcconnell force a vote next week?

>> reporter: well they are voting on the motion to proceed, they want this clean repeal bill to go to the floor for a discussion, but there is not the votes to support it. mcconnell wants to get people on the record, gop leadership looking to get them to put their firm vote on the record, that could prove to be politically significant for them in the future. >> seth lemon at the capitol building, thank you. coming up at 6:00, we hear from a berkeley woman whose medication costs $90,000 per dose. what she fears most about repealing obamacare. a scare for riders at the embarcadero bart station this morning after an insulator blew on the bart tracks, there was a loud bang and smoke filled the air just before 11:00 this morning. witnesses say it sounded like an explosion, no one was hurt and service was impacted for just about 10 minutes. bart continues to deal with a growing concern over rider's safety. now one of the victims of a mob attack on a train is suing, kpix

5's milind tambe with what he says bart should do right away. >> riding the train from the city, 10:30 at night, was rnt late. sudden-- wasn't late. suddenly 30 individuals rush on to the train, there is no where to go. >> reporter: april 22, rusty and his wife and daughter were on bart, coming home from celebrating his daughter's 19th birthday. >> myself and my family were a victim of the april 22 mob attack, when 47 individuals inundated the station, boarded the train beat and robbed a number of the individuals. >> reporter: he is suing bart for $3 million for failing to prevent the attack, he says the thieves were at a party and when the oakland police broke it up, the crowd headed for bart. >> 47 of them jumped and enterd the station and then boarded our train and before they boarded our train they had been beating on the side of the train. yet the operator still let them on the train. >> reporter: staff was kicked in

the ribs while his wife lay on his daughter. 7 people were robbed and thieves made up with cell phones, a duffal bag and purse. he told the bart safety committee to release the video of the incident. >> i think making the videos public of the incident helps inform the passengers of what is going on, how to recognize these things and to work with the agency on how to prevent the things from happening in the future. >> reporter: bart has given multiple reasons for why the video hasn't been released. one reason is because they believe the attackers are juvenile, but staff says these were repeat offenders. >> the police knew who these individuals were, in protecting them at that point, don't know what you are quite protecting, sounds like you are protecting yourself rather than the individuals or the public. >> reporter: melissa caen. >> we speak with a board member and why she think tlz is a

shortage of officers. in saratoga, the wildfire in the foothills is about 50% contained. good news is that the flames have spread up the hill and away from the homes. we learned today that a drone operator interfered with firefighting efforts yesterday, that meant that a helicopter had to be grounded, investigators say the pilot of that drone could be charged with a misdemeanor. governor jerry brown has delaired a state of emergency in mare posea county. >> reporter: fire crewerize trying to get a hand-- crews are trying to get a handle on the flames. the fire continuing to grow, lets get a look where the fire is spreading. it sparked sunday near lake mcclure, you can see the scope of the blaze as the smoke billows into the sky covering most of the area. air tankers dropping retardant trying to get a handle on the

flames. more than 19,000 acres have been scorched and it is only 5% contained. one structure has been destroyed and another damaged, 300 more are in danger of burning. the flameerize also threatening power-- flames are also threatening power lines that provide electricity to yosemite national park, officials ordered some evacuations and closed some roads including highway 49 at culterville road and highway 140 in aqua frea, evacuations centers have been set up by the red cross, the cause still under investigation. thank you, we are getting information in the death of a yoga instructor who was killed by minneapolis police, investigators say she was shot right after officers were startled by a loud sound near their squad car. justine damond called 911 to report a noise she thought could be a sexual assault. her family and the australian

prime minister are demanding answers. cbs recorder, aidreanna diaz has more. >> the death of justine is a loss to everyone who knew her, she touched so many people. >> reporter: justine damond's fiancee said piecing together the 40-year-old's final minutes will help bring comfort to those who loved here. >> we lost the dearest of people and we are desperate for information. >> reporter: back home in australia, her father said this is a nightmare for their family. >> justine was a beacon to all of us. we only ask that the light of justice shine down on the circumstances of her death. >> reporter: minneapolis police officer, muhammad noor was one of two officers who responded to the 911 call saturday night. investigators haven't disclosed details on what happened after police arrived. multiple eyewitnesss say damond approached the police cruiser in her pajamas, according to a law enforcement source, she was standing at the driver's window,

when officer noor opened fire from the passenger seat, the bullet passed in front of his partner and went through the open window fatally striking damond. according to the city, noor joined the police department in 2015, as its first somali american officer, in a statement noor's attorney says his client extends his condolances to the family and anyone else who has been touched by this event. damond relocated to minneapolis from sydney, australia, about three years ago. both officers were wearing body cameras during saturday's shooting but they were off, despite a policy requiring the cameras to be on when responding 92 to 911 call-- to 911 calls. police went door to door to see if anyone's camera captured the encounter. cbs news, minneapolis. the two officererize on administrative leave-- officers are on administrative leave. parts of the bay area are dealing with a particularly

liked about the animals. luckily, for sonya who is fostering these two, the babies rarely spray, important because the entire wild care staff and its volunteers have had to step up to the plate this year. >> kind of amazing, we are having a major boom of skunks this year, we are seeing it at wild care but i suspect it is consistent across the bay area. >> reporter: spokesperson allison says usually wild care gets 40-60 skunk as year, already this year they passed the total with 75 and no sign of stopping. with that many orphaned, everyone plays a part in helping. >> i have them old enough, apparently they can spray but it hasn't helped yet. they don't know me, but they understand the routine. they know when i am coming and i open their cage, they are used to associating that habit with eating. >> reporter: wild care thinks the spike was caused by the wet

winter, which made skunk food sources thrive, bugs and rodents fall into that category. while the species is infamous for their one odorous defense mechanism, wrield care says they make-- wild care says they make great neighbors. >> the things that dig in your lawn, eat your flowers, the skunk is eating all of those and the rats and mice that run through your yard. if you have a skunk in your yard or in your neighborhood, he is actually doing a really, really, really good service for you. >> reporter: when they are rescued thiyoung they start on formula and-- this young they start on formula, then real food once about this size. eventually wild care teaches them to forage before reintroducing them to the wild. while babies are cute, ultimately they are wild animals. if you find baby skunks, you are more than welcome to bring them to wild care. emily turner, kpix 5. new low-cost flights are coming to san jose international airport. they start at $29 one way.

frontier airlines will be a non-stop service from sjc to denver on october 5, vegas on november 1, and austin and san antonio starting next spring. san jose city and business leaders join frontier airline official wheres the announcement today, they say they are excited to add service to destinations that are popular with bay area travelers. >> we think that there is a great opportunity to connect, you know, the booming environment and growing economies of the silicon valley, san jose area, to similar communities in austin, denver, las vegas, san antonio as a start. we are excited that if we get support from the community to continue to grow our service. >> frontier is the 16th airline in residence once the service of san antonio starts, you can get from sjc to 42 different destinations nonstop. a new craze is gaining popularity around the bay area, people are painting rocks and

hiding them in neighborhoods. kpix 5 reporter julia goodrich is live in livermore to explain. what is going on? >> reporter: hi, there, i know, we wanted to find out what is going on. you will see a bunch of adults and kids carrying baskets around and they are basically collecting rocks, painting rocks, finding rocks, kind of like poke'mon go meets easter egg hunting but with rocks. check it out. from painting... >> i will paint a rolly pollee on this rock. >> reporter: to hiding, to finding... >> the mustache and the bug one and the flower one. >> reporter: do you have a favorite? >> all of them. >> reporter: livermore has taken on a new name, livermore rocks. >> i painted this one. >> reporter: chavez used to put painted rocks in front of her bath shop downtown and then she noticed they were disappearing. only to be rehidden and

discovered somewhere else. >> i did this on a camping trip, just for inspirational, if someone runs into it, they can fill a little uplifted. >> reporter: the craze has taken off with thousands of people posting photos on a livermore ca rock facebook page, in fact, that is one way to get clues as to where rocks are hidden. >> actually have seen a couple of rock painting parties downtown. >> reporter: even the livermore police department had a rock delivered on its front steps. >> how many rocks would you say you have painted? you are up to 50 now? >> 50 or more. >> reporter: we decided to get in on the fun as well. here is my rock, i am at an undisclosed location in livermore, it is up to you footo figure where i am and where i have hidden the rock, the only clue this aerial footage from sky drone 5. there is a courtesy rule. >> if you find one and absolutely love it, you can keep it, but the deal is if you do you are to paint another one and rehide it. >> reporter: you get to keep
