a big provider of medical marijuana. let's go to anne makovec, she is in oakland where that city council voted last night to allow large growing operations. ann, good morning. >> reporter: good morning. yeah, big plans for where marijuana would be grown, processed and sold. right now it's for medical marijuana, but if that measure passes to allow the distribution of marijuana for recreational use in november, this could be expanded. the vote last night was 5-2, with one abstention. it would allow four farms bringing in a lot of money. each would pay an annual fee of more than $200,000, be subject to city oversight and devote up to 8% of growth sales to city taxes that could generate millions for oakland, which is of course in desperate need of cash. but a lot of people came to speak against the plan last

night in the name of smaller mom and pop pot shops saying these big operations would put them out of business but there wasn't a lot of concern expressed about pot in general. >> this is a very valuable medicine that many suffering people need and that it's right and proper that it be produced in a way that is legitimate and that is above board and is regulated. >> reporter: the plants wouldn't be limited in size. one grower is proposing a plant that would produce over 21,000 pounds of pot per year. the measure has to go before the oakland city council one more time before it is approved. that is expected to pass, though, on that final hurdle. oakland has long been positioning itself, it seems, as kind of a center for marijuana in california these farms will be isolated to an industrial area. >> thank you, anne makovec in oakland. san francisco supervisors last night voted for a new budget that would close a $483 million deficit.

the $6.5 billion budget includes money to restore funding for health and human services that had been in jeopardy. they include services for children and seniors, treatment for substance abuse and mental health, and hiv/aids care. supervisor chris daly was the only no vote in the 10-1 decision. the supervisors will have to vote again next week before the budget is final. a.c. transit official expect a third sickout by union bus drivers today. 250 called in sick yesterday and 200 the day before that. a spokesman says -- tells us they expect about the same number to skip work today. drivers are protesting a new contract imposed by a.c. transit after labor talks were deadlocked, including new overtime rules, a co-pay for healthcare and a two tiered pension plan. a hearing on the union's

request to block the contract is scheduled for july 30. the man suspected in a shootout with the california highway patrol in oakland is expected to enter a plea this morning. 45-year-old byron williams of tuolumne county was formally charged yesterday, including trying to murder four chp officers. the gunfire began saturday night as officers approached his truck after pulling him over on interstate 580. police now say that williams was drunk and was rambling about starting a revolution. >> we learned he was on his way on saturday night to two organizations, pulling called the tides, the other the aclu, with the sole purpose to kill people. usually these organizations are closed on sunday and his plans were to wait there until monday when they opened up and then to go in there and start shooting people. >> williams was treated for bullet wounds. williams is a parolee with if

convicted in the shootout, this will be his third strike, i would send him to jail for 25 years to life. marin county is on record of saying no thanks to pg&e and its smartmeters program. they said the utility should shut down the program until a study that shows the meters work is completed. some pg&e customers say their electricity bills have skyrocketed since the meters were installed. some also worry about possible health risks from electromagnetic fields associated with the devices. protestors rallied outside the state public utilities commission yesterday. that to give pg&e -- to get pg&e to stop installing the meters. the utility says the devise are safe and the vast majority of them work correctly. pest problems are forcing some california child care centers to turn to pesticides but the centers and the centers aren't telling the parents.

child care centers are allowed to use pesticides but regulations require those centers notify parents and the state. 90% of child care centers surveyed reported problems with ants, spiders, bees or wasps. but 24% of the daycare centers didn't notify parents that they use the pesticide. 35% did not post warning signs. it is 6:07. the tests continue in the gulf of mexico today. >> coming up, the latest on those small leaks near a capped oil pipeline and the new plan to plug that ruptured line. and president obama scheduled to sign a financial reform bill. what the legislation will be cracking down on. ,,,,,,,,

not a permanent fix though. bp is now exploring the possibility of sealing the well with a substance known as drilling mud. of course, they are still drilling the two relief wells, as well. scientists say that the seepage that was detected along the sea floor the last few days is actually coming from an older well that is no longer in use. the financial reform bill is on the verge of becoming federal law. president obama is expected to sign it today. it comes less than a week after the u.s. senate passed the landmark bill. the overhaul would give the federal government new powers to close failing banks and monitor consumer loans among other things. the purpose is to protect the nation from another financial meltdown. congress is a step closer to restarting unemployment benefits for 2.5 million americans who still can't find work. yesterday, senate democrats beat a republican filibuster to pass the extension. republicans say they would support it only if it didn't add to the nation's deficit.

good morning. first accident of the morning actually or at least since 5:00, westbound 580 approaching airway boulevard involving a van and bobtail truck. it's already out of lanes. but we are seeing a little bit of slow traffic in the area. so chp on scene now. most of the activity is off to the shoulder, but yeah, looky- loos, spectator traffic, just causing afew extra delays through the dublin interchange.

sunol great is grade. south bay top speeds through downtown san jose and out of downtown san jose 280 still light. they should have picked up that roadwork on northbound 280 in woodside. that was expected until about 6:00 this morning. various lanes were blocked there. 880 the nimitz freeway, looks great past the coliseum and up into downtown oakland. but again, reminding if you're a bus rider a.c. transit users, we are expecting a third day of pretty big delays, again another possible sickout day for bus riders. they are protesting changes to work rules in the east bay so, yeah, watch out for that. hit the roads, use bart. as you can see, everything is quiet past the coliseum. at the bay bridge, no metering lights yet. that will likely change here very soon. but just a small, small delay there in one of the cash lanes but otherwise, looks good up the incline and all other mass transit by the way is on time. remember our radio partners, kcbs 740-am and 106.9-fm. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. remember our well, we also have

production facilities goes up for a final vote next week. supporters say it will mean millions of dollars in taxes for oakland. san francisco supervisors voting 10-1 for a new budget plan after a day of negotiations with the mayor's office. the budget would restore funding for health and human services programs. it comes up for a final vote next week. and a.c. transit expects more bus drivers to call in sick today. those drivers are protesting the contract imposed on them sunday. a court hearing to consider revoking the contract is scheduled for july 30th. lifeguards will be on the job at state beaches in santa cruz county. state budget cuts had forced the parks department to close 10 towers and lay off lifeguards throughout the county. the group friends of santa cruz state parks stepped in raising $60,000 to cover the last two months of the lifeguard budget. are they needed? lifeguards made six rescues at beaches in santa cruz county just last weekend.

senate is expected to approve a plan today that would extend unemployment benefits through the end of november to provide checks for millions of americans out of work for quite some time. it would cost $120 billion. so our question of the day, do you think the senate should extend unemployment benefits? brad emails us saying yes, it should be extended. the illegal get free welfare, food stamps, health and the list goes on and on. at least this country can do for us -- the least that us country can do for legal americans is to support us. >> facebook ramon says yes absolutely if they could stop playing political football we wouldn't need to be dealing with this question. it just makes common sense. >> and beth also on facebook says, yes, they voted to bail out the banks. now they should spend our tax dollars on us. it's 6:25. >> a then i should day of delays for people who take the -- a a third day of delays for people who take the bus in

the way? slightly warmer. thursday, friday and saturday we will have temperatures going up ever so slightly but they don't stick around long. we'll see temperatures cooling back down sunday, monday and tuesday. so the mild weather will continue across the bay area for today. that's a look at your weather. back up to you. oakland is on the way to beeping the first city in the nation to allow big pot farming plants. anne makovec is in oakland. that's where four large pot growing operations were approved last night. good morning, anne. >> reporter: good morning. they could be massive but it's kind of funny, when you think about this, this debate if it was going on around many other places in the country, the debate would be more about pot and how it leads to the demise of society, things like this. but here in oakland it was the typical wal-mart debate that we have reported on in the past, the big box versus mom and pop store debate. but it was approved last night. these factories could be huge. there is no limit on size. they could take up hundreds of thousands of square feet and

produce massive amounts of marijuana, tens, even hundreds of thousands of pounds of pot per year but would also be subject to heavy regulation and be forced to pay a lot of money to the city, more than $200,000 in fees plus up to 8% of gross sales in taxes. now, the main concern expressed during this debate, unfair competition for small growers, those that helped build the industry to begin with. >> 5,000-square-foot. we are going to be looking at doing a vertical grow here, a vertical modular grow towards the palletized system, a high- end security facility with infrared cameras, motion sensors, on-theft guard and 24- hour monitoring of the facility. >> reporter: now this passage last night is the latest in a long line of pro pot moves by the city of oakland. it was the first to regulate medical marijuana dispensaries. there is oaksterdam university,

an entire city district dedicated to the marijuana trade. oakland allowed one of the first large-scale retail centers and was the first to levy a special tax on marijuana. and, of course, there is that ballot measure coming up in november that could tax and regulate marijuana for recreational use. and this move would certainly put oakland in the running to become a center for making a lot of money off of that trade if that comes to fruition. >> i never thought that until the interview mentioned about the security aspects of all this, if they have all that pot in one area, you know -- >> it contempting for crooks. >> you know people are going to try something. all right. anne, thank you very much. anne makovec in oakland this morning. san francisco just one vote away from having a budget that would close a $483 million deficit. it's a $6.5 billion budget that

good morning. we have big problems in livermore. westbound 580 this motorcycle accident they changed the location closer to airway boulevard. this actually is our second accident reported in this same area in just the last half hour. right now, all lanes are blocked due to this wreck. an ambulance and chp are heading to the scene but check out the delays. a long line of red and really slow speeds, traffic backed up into the altamont pass. according to some members of the kcbs phone force, they say that traffic is really jamming up. you are only able to get by right now on the shoulder. alternates, chp says first street would be a great exit. you can use stanley boulevard from there. if you commute this every day, city streets get backed up

quickly. highway 84 you can use to connect through the sunol grade or there is always ace in the area, as well. what's interesting is you can see that bottleneck caused by that accident is actually causing traffic to be really light as you approach the dublin interchange. this is where we have a camera closer to tassajara so obviously a lot of people are stuck in the backup closer to airway boulevard. it sounds like a serious injury crash and all lanes are blocked again. they issued a traffic alert meaning that lanes are likely going to be blocked for a while. checking the travel times for that area, westbound 580 now up to 25 minutes already. it's a big delay for this time of the morning. taking you from the altamont pass towards the dublin interchange. so again we'll continue to watch that. in the meantime i'm going to toss it over to tracy with a check of your forecast. >> hey, thanks, elizabeth. here we are along the coastline this morning where we have plenty of clouds even some drizzle. and the way the camera's moving there you might think it's windy but it's not. southwest winds ranging from 5 to 10 miles an hour. here's a look at our daily planner. we kind of stretch it out based

and there is a breeze. this is one of the coolest summers on record according to the national weather service. in the last 40 years this ranks as one of the coolest summers. we are talking about the mid- 70s here in san jose. it's not what you would expect for this time of year especially not compared to the rest of the country, not what they would expect. we just talked to bill visiting from galveston, texas, where it's about 95 right now with 60% humidity. >> i'll take it and i'll be here until friday so i'm going to be out here every morning checking it out. >> reporter: you timed it just right? >> yes, i did. >> reporter: now, the reason for the cooler-than-normal temperatures is we are expecting a low pressure system now according to the national weather service that's sort of like a bubble that's sitting over the bay area that's keeping the warm temperatures from the desert from sifting in. i guess i should keep my microphone next to my mouth there. but it's keeping the temperatures from sifting into the bay area. keeping things cool. energy use, because people aren't using their air- conditioning systems as much,

energy use is down 4% compared to last year. that's good news for the state's power grid. and one other note. according to the "mercury news" this morning, the rest of the globe is experiencing the warmest temperatures on record. so we are certainly unique here in the bay area. i'm matt bigler live in san jose for cbs 5. >> thank you, matt. >> you see people on the east coast, they are just sweltering! and they -- you know, if it is a little cool, you can't open your windows because there are so many bugs. so we have really got it good in california. >> humidity too is just unbelievable. plenty of black ink now as a bay area company -- it's a good thing, bay area companies are coming out with their earnings reports. >> and congress hears from the fed head today. let's go to jason brooks with kcbs and cbsmoneywatch.com. jason, good morning. >> good morning, john, good morning morning, sid any. we just heard from wells fargo. and they reported a decent profit increase of 12%. that beat expectation. revenue of about 21.4 billion

pretty much in line with expectation. some of the keys with wells fargo is that it saw improving business with both commercial and corporate lending and also did see improvement in the amount of loan losses it's had to cover and slowing growth of delinquent loans that could possibly signal a turnaround in the mortgage market. also, apple reporting its numbers. another blockbuster from a.m. we really shouldn't be surprised by that. it's revenue of $15.7 billion was $1 billion more than expected. strong sales across all of its lines except for the ipod but in particular with the ipad about 3.3 million iphone sales of 8.4 million and even mac sales of over 3 million. the best quarter for mac sales and showed the ipad didn't cannibalize those numbers. yahoo's numbers were higher than expected but analysts a little concerned that yahoo did not improve its sales as much and that its profit growth continues to come from cost- cutting. we are seeing the reaction to

the markets to all of those things right now. apple shares are higher by 4%. wells fargo up 4 1/2. yahoo shares down over 8%. over at markets, dow up 4, nasdaq down 3. s&p up 1. ben bernanke goes before congress today for a semi- annual meeting today on monetary policy. we'll look closely what he says about the economy. in the fed's latest meeting in june they showed cooling on what they expected for economic growth. will he give slower economic reports with the debt crisis in europe or touch on anything the fed can do it stimulate the economy? they have already fired most of the bullets they have in their magazines, not much left for the fed to do to help the economy at this point. >> still struggling. >> jason, thank you very much. much, much, much jason brooks with kcbs and cbsmoneywatch.com, thank you. the financial reform bill is on the verge of becoming

financial law. president obama is expected to sign that today a week after the u.s. senate passed the landmark bill. the overhaul would give the federal government new powers to close failing banks and monitor consumer loans among other things. the purpose is to protect the nation from another financial meltdown. good news for a lot of people out there. congress a step closer to restarting unemployment benefits for 2.5 million americans who can't find work. democrats beat a republican filibuster yesterday to pass the extension in the senate. republicans say they would support it only if it didn't add to the nation's deficit. the democrats got the crucial 60th vote when cart goodwin was sworn in as an interim senator from west virginia. he was replacing the late robert byrd. this bill, though, still needs to pass the house before going to president obama. >> that is the topic for our question of the day. do you think the senate should extend unemployment benefits?

oakland just one step away from being america's first city to approve large marijuana growing operations. the city council voting 5-2 for those pot plants last night. the final vote is expected next week. san francisco supervisors having afinal vote next week on a budget for the fiscal year that began july 1. the board voted 10-1 last night for the budget plan to restore threatened health and human services funding. and that sickout by some a.c. transit drivers, unfortunately, is expected to continue today and possibly through next week. the unofficial job action is to protest a contract imposed on the drivers. another third day, possible delays for a.c. transit. in the meantime we are following a nightmare commute through livermore. the good news is that a couple of minutes ago they were able to open all lanes now westbound 580 approaching airway boulevard.

there was serious injury motorcycle accident there. actually the second accident of the morning in the same area there near the airport for about 20 minutes or so traffic only able to get by on the shoulder so that's why we are seeing really long backups extending on the altamont pass. a tow truck had a problem get there is because of the gridlock. they are still keeping this traffic alert because of all the gridlock in the area. first treat is an alternate to connect stanley boulevard. expect delays on city streets. highway 84 looks good towards the sunol grade. as might be a good option. let's check the travel time in the area. still not looking too good westbound 580, 35 minutes from the altamont pass to the dublin interchange. but a couple of minutes ago they were able to open all lanes of westbound 580 approaching airway boulevard. that is your traffic. for your forecast, here's
