[ laughter ] [overlapping speakers] >> trying to make the segue to traffic creeping along. it wasn't working. >> i see. okay. traffic may be creeping along in san mateo. we have a little bit of roadwork northbound 101 between third and brought way. also the third avenue and peninsula off-ramps are closed. this roadwork should be wrapping up shortly but the off- ramp at 92 is expected to be closed until 7:00 this morning. various lanes closed on the guadalupe parkway also should be wrapping up in the next hour. that's the traffic. for a non-creep over forecast. >> it was creepy yesterday, a whole lot of clouds and not a

lot of sunshine. fog at the coast. low clouds, fog and drizzle. even a little drizzle in the bay this morning with low clouds and fog. and areas of low clouds inland. conditions ranging from the lower to the mid-50s. more sunshine expected later on this afternoon but also more cool temperatures. we are continuing to see below average temperatures around the bay area today. we'll warm up ever so slightly thursday, friday and saturday but don't get used to t temperatures will be cooling down all over again for the beginning of next week. back to, uhm, creepy -- creeping... >> i am going to be watching my step all morning long. >> needs a little coffee. then he will be back on track. thank you very much. oakland is on its way to being a big provider of medical marijuana. let's go to anne makovec. she is in oakland where the city council voted last night to allow what they call large growing operations. anne, good morning. >> reporter: they are saying this could be the dawn of big

box stores for pot here in oakland on a vote of 5-2 late last night with one abstention, the oakland city council approved a measure to allow four marijuana factory farms bringing in a lot of money for the city. each farm would pay an annual fee of more than $200,000, be subject to city oversight and devote up to 8% of sales to taxes. that could generate millions for oakland, which is desperate for cash. but a lot of people came to speak against the plan in the name of smaller mom and pop pot shops saying these big operations would put them out of business but there wasn't a lot of concern expressed about pot in general. >> this is a very valuable medicine that many suffering people need and that it's right and proper that it be produced in a way that is legitimate and that is above board and is regulated. >> reporter: the plants

wouldn't be limited in size. one grower is proposing a plant that would produce over 21,000 pounds of pot per year. the measure has to go before the oakland city council one more time before it is approved. that is expected to pass, though, on that final hurdle. oakland has long been positioning itself, it seems, as kind of a center for marijuana in california potentially in the u.s. we'll take a look at that background coming up here in the next half hour, sydnie. >> we have also got a ballot measure in november, too. >> reporter: of course. >> to legalize it. so we'll wait to see what happens there. but obviously they are getting ready. anne, thank you very much, anne makovec in oakland. the man suspected in a shootout with the california highway patrol in oakland is expected to enter a plea this morning. 45-year-old byron williams of tuolumne county was formally charged yesterday, including trying to murder four chp officers. the officers had approached his

truck after pulling him over on interstate 580 in oakland on saturday night. none of the officers was hurt, but williams did have to be treated for bullet wounds. police now say williams was drunk and was rambling about starting a revolution. >> we learned he was on his way on saturday night to two organizations, pulling called the tides, the other the aclu, with the sole purpose to kill people. usually these organizations are closed on sunday and his plans were to wait there until monday when they opened up and then to go in there and start shooting people. >> williams is a parolee with two previous bank robbery convictions. if convicted in the shootout, this will be his third strike, i would send him to jail for 25 years to life. a.c. transit official expect a third sickout today by union bu

drivers. drivers are protesting a new contract imposed by a.c. transit after labor talks were deadlocked, including new overtime rules, a co-pay for healthcare and a two tiered pension planned saving millions. a hearing on the union's request to block the contract is scheduled for july 30. san francisco supervisors last night voted for a new budget that would close a $483 million deficit. the $6.5 billion budget includes money to restore funding for health and human services that had been in jeopardy. they include services for children and seniors, treatment for substance abuse and mental health, and hiv/aids care. supervisor chris dalyy was the only no vote in the 10-1 decision. the supervisors will have to vote again next week before the budget is final. it is 5:06. did a police officer go too far while arresting a bay area

woman? that's what the san francisco police department is trying to determine as it reviews a video taken over the weekend. the officer appears to push a handcuffed woman to the ground face first after she allegedly cursed at police and resisted getting into the car. police say she was drunk. they tried to arrest her because they thought she was a suspect in an assault. in the police department the officer owned up to -- in a police property, the officer owned up to using excessive force. child care centers are turning to pesticides but those centers aren't telling parents. that's according to a new survey from uc-berkeley. child care centers are allowed to use pesticides but regulations require the centers to notify parents and the state. 90% of child care centers surveyed reported problems with average, spiders, bees -- ants, spiders, bees or wasps. 24% of the daycare centers did

not notify parents that they used pesticides. 35% didn't post warning signs. not a pleasant flight for some people on united airlines. >> i saw at least two people hit the ceiling. >> 30 passengers hurt, one in critical condition. what happened before that emergency landing in denver. also ahead what some people in one bay area city say about paying a higher vehicle registration fee that to improve transportation. ,, ,,,,

some fog to start off your san mateo bridge bridge commute. a full look at your traffic in six minutes. >> we'll see you then. it is 5:10. pretty bumpy ride across kansas forced a united flight to be diverted to denver. 26 passengers and four crewmembers were hurt when the flight from washington, d.c. to los angeles hit some heavy turbulence last night. that plane was about at 34,000 feet when it hit a few bumps and then things got worse. >> then all of a sudden, our plane dropped probably, you know, 20, 30 feet. i saw at least two people hit the ceiling. the girl in front of me, two rows, he saw her hit the ceiling and slam back down. >> 21 of the injured were rushed to five hospitals, one is in critical condition. most of the other passengers were put on another plane to

l.a.x. and got there about midnight. a new poll shows san francisco voters favor a new vehicle license fee. people will vote in november o adopting the $10 vehicle registration fee but more than 60% already say they favor the fee according to a poll by the san francisco transportation authority. this measure is expected to generate some $5 million every year to improve transit operation, street conditions and pedestrian networks. today the u.s. senate is expected to approve a plan to extend unemployment benefits through the end of november. that bill would provide weekly checks to 2.5 million americans and cost about $120 billion. and that's the topic for our question of the day. do you think the senate should extend unemployment benefits? send your response to mornings@cbs5.com. we're also on facebook and twitter. facebook and if you like fog, the weather outlook is just for you. tracy? we have several areas of roadwork. at 92 at alameda de las pulgas, one way traffic in effect for the next 45 minutes or so near the stretch near main street. so again that's highway 92 in both directions in or out of half moon bay. as far as accidents go, we are quiet, good on that end. so if you are coming down the carquinez bridge we can show you live traffic conditions. everything is moving well on westbound 80 into crockett and continues to be fine into hercules through pinole. this is the nimitz freeway, 880

through oakland by the coliseum. those taillights are moving northbound. looks great on the freeways. again we're warning of a third day of a possible sickout by a.c. transit after some labor disputes so yesterday again riders saw delays of anywhere from half hour up to an hour long delay on some routes so watch out for that. use bart or hit the roads instead because they are fine up into downtown oakland. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. more fog again this morning. here's a look at your daily planner and this is what we're expecting. at least for the morning. and that's going to be low clouds, fog and drizzle along the coastline. a little bit of the same around the bay and a few areas of low clouds inland, as well. later on this afternoon, what about today? sunshine, mild temperatures ranging from the mid-70s to the mid-80s. sun and low clouds around the bay yesterday, a whole lot of low clouds, did not completely clear out for parts of the bay area especially the closer to the coast. more of that expected today

with temperatures from 60 to 73 degrees. and low clouds, cool with drizzle stuck in there along the coastline. here's a look at our clouds throughout the day, we start to see some clearing well inland after 10 a.m. things won't clear out at the coast. clouds in the forecast at the bay and the coast. cool temperatures, upper 50s in daly city and pacifica, mid-70s in palo alto, 70 mountain view, 75 sunnyvale, 76 san jose, 80 morgan hill, from 85 yesterday to 80 today. upper 60s in hayward as well as in union city. we continue to see cool temperatures in berkeley, 63. 65 oakland. lower 80s in pleasant hill, 80 san ramon. these temperatures pretty mild. lower to the mid-80s in pittsburg, antioch as well as in brentwood.

north bay locations, the 70s? yeah. the mid-70s as highs. 75 santa rosa. 74 napa, close to 10 degrees below average. 65 san rafael, 69 kentfield and similar in sausalito with 62. 60 in san francisco. so similar temperatures today as what we enjoyed yesterday. we will see temperatures begin to rebound as early as tomorrow. we'll take those slightly warmer conditions into thursday, friday and saturday. but they won't stick around for long. cooler air moves back into the bay area and we'll see cooler temperatures sunday, monday and tuesday. that's a look at your weather. back up to you. >> thank you. some of the stories we're following this morning. the oakland city council voted last night to allow large marijuana growing operations. the plan to license four pot production facilities goes up for a final vote next week. supporters say it would mean millions of dollars in taxes for oakland. a man suspected in a shootout with california

highway patrol officers on 580 in oakland is expected to enter a plea this morning. investigators say 45-year-old byron williams of tuolumne county has a beef with left- leaning politics. they say on saturday, he was on his way to open fire at liberal organizations in san francisco. the chairman of the federal reserve board is set to give congress an update on the nation's economy today. ben bernanke is expected to down play the possibility that the economy will fall back into recession. lindsay lohan in orange? we'll tell you how long she is expected to be behind bars. and some very unusual items associated with elvis up for auction. but

good morning! it's wednesday, the 21st of july. >> good morning, everyone. let's get you out the door and to work. it is 5:30. elizabeth, how's it looking with traffic? >> it looks okay. we don't have any big problem spots but we have a small delay at the bay bridge toll plaza in some of the cash lanes. so you can see a few cars there. get your fastrak. you can avoid any delay at all. but yeah, elsewhere, marin county the commute looks great. we have our camera right there in san rafael at the 580 interchange. those taillights are southbound traffic towards corte madera. looks good except for fog across the span of the golden gate bridge. quiet there. south bay same thing, still seeing top speeds. roadwork is picked up between oakland road and guadalupe parkway. down 280 quiet until you get to woodside and there is a little bit of roadwork blocking one lane near farm hill boulevard. but not causing any big delays.

that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. well, it is staying cool. let's take a look. average daytime highs, 82 in santa rosa, 87 concord, 85 san jose, 68 degrees in san francisco. here's a look at what we're expecting today and these temperatures are cooler than average. 60 degrees in san francisco. 28 degrees in82 in concord. for many of you well inland especially in the east bay were you dealing with near triple- digit highs late last week so you're probably really enjoying these 80s. 82 fairfield and concord. 76 san jose. closer to the bay chilly. 65 in oakland, 60 in san francisco. 65 in san rafael and 58 degrees in pacifica. today's mild weather will warm up as early as tomorrow. we'll take those slightly warmer conditions into friday as well as saturday. but they don't stick around for long. they are a little noncommittal sunday, monday and tuesday. we'll see temperatures cooling

back down to below average temperatures. that's a look at your weather. back up to you. >> thank you. oakland is on the way to being the first city in the nation to allow big pot plants as in factories that will probably have big pot plants. anne makovec is in oakland, where four large pot-growing operation are in the works. good morning, anne. >> reporter: good morning. lots of big pot plants, john. it's kind of funny because in this debate in many areas of the country it would turn into a lot of concerns about drugs and debauchery. but here in oakland it was the typical wal-mart debate that we have reported on in the past, the big box versus mom and pop store debate. these factories could be huge. there is no limit on size. they could take up hundreds of thousands of square feet and produce massive amounts of marijuana, tens, even hundreds of thousands of pounds of pot per year but would also be subject to heavy regulation and be forced to pay a lot of money

to the city, more than $200,000 in fees plus up to 8% of gross sales in taxes. now, the main concern expressed during this debate, unfair competition for small growers, those that helped build the industry to begin with. people wondering how they could compete with an operation such as what this next grower is planning. >> 5,000-square-foot. we are going to be looking at doing a vertical grow here, a vertical modular grow towards the palletized system, a high- end security facility with infrared cameras, motion sensors, on-theft guard and 24- hour monitoring of the facility. >> reporter: now this passage last night is the latest in a long line of pro pot moves by the city of oakland. it was the first to regulate medical marijuana dispensaries. there is oaksterdam university, an entire city district dedicated to the marijuana trade. oakland allowed one of the first large-scale retail centers and was the first to

that began july 1. supervisors will have to vote again next week before that budget would be final. and then mayor newsom can either sign it or veto it. for the third day in a row, a.c. transit riders can expect some more delays. 250 drivers called in sick yesterday, 200 the day before. more are expected to call in sick today. drivers are protesting a new contract imposed by a.c. transit after labor talks deadlocked. a hearing on the union's request to block the contract is scheduled for july 30. >> passengers and bus we have to cram up everybody in this bus. you know, they would for sure have passengers standing up. >> a.c. transit is running buses on all lines but there have been delays because of the sickout. the contract imposed on the drivers includes new overtime rules, co-pay for healthcare and two tier pension plan aimed

at reducing costs by nearly $16 million. one person is in critical condition from a rough coast-to- coast flight on united airlines. more than two dozen other passengers were hurt. wendy gillette on what happened on flight 967 from washington, d.c. to los angeles. >> reporter: emergency workers wheeled some of the 30 people injured on stretchers through denver international airport. they were all on board this united airlines jet en route from washington to los angeles that briefly hit severe turbulence tuesday night. >> all of a sudden, our plane dropped probably you know 20, 30 feet. i saw at least 2 people hit the ceiling. girl in front of me two rows, saw her hit the ceiling and slam back down. >> reporter: the plane carrying 255 passengers and 10 crewmembers was diverted to denver after the incident. emergency vehicles rushed to the airport to meet the

jetliner when it landed. 21 people were taken to five local hospitals. some of them shielded by sheets from the media. most of the injuries were not serious. but one person was critically hurt when the turbulence disrupted an otherwise normal flight. >> couple of oxygen masks dropped down, drinks went flying, it was all over in about 2, 3 seconds. so we were weightless for probably a second or two. >> reporter: the federal aviation administration says the plane was over kansas when the turbulence hit. passengers say at the time, there was bad weather both below and above the plane. wendy gillette for cbs news. 26 of the 30 people injured were passengers. the other four were flight attendants. it's 5:38. congress a step closer to restarting unemployment benefits for 2.5 million americans who still cannot find work. >> affirmatives, the motion is agreed to. >> yesterday, senate democrats

beat a republican filibuster to pass the extension. republicans support it only if it didn't add to the nation's deficit. democrats got the crucial 60th vote earlier in the day when cart goodwin was sworn in as an interim senator from west virginia. the bill still needs to pass the house, expected to do so before going to president obama. elena kagan a step closer to become the newest supreme court justice. yesterday, the senate judiciary committee approved president obama's nominee. republican lindsey graham voted in favor of kagan, the only committee member to cross party lines. next step a vote by the full senate which is expected to confirm her before the august recess. federal reserve chairman ben bernanke set to give congress an update on the nation's economy today. he is expected to downplay the possibility that the economy will fall back into recession. but he is also likely to say the fed is ready to take action

if the economy worsens. during his last economic report back in february, bernanke said he was confident the recovery would endure. president obama is expected to sign the financial reform bill into law today less than a week after it passed the senate. the plan would give the federal government new powers to close failing banks and monitor consumer loans among other things. the purpose of the overhaul is to protect the nation from another financial meltdown. the united states will impose new sanctions on north korea's communist government. that is the word from secretary of state hillary clinton, who spoke today during a visit to south korea. the u.s. will freeze assets as well as prevent some businesses and individuals from traveling abroad. the u.s. will also collaborate with banks to stop illegal financial transactions. clinton says the sanctions are part of a series of measures to

stop nuclear proliferation. pressure test on bp's's broken well will continue. scientists say the seepage is coming from an older well that's not in use and they are not worried about the cap on the newest well buckling or giving way. >> very small drips i would say. we don't consider them consequential to involving the integrity of the well head. >> the cap has successfully stopped the oil from flowing into the gulf for five days. not a permanent fix, though. bp is now exploring the possibility of sealing the well with drilling mud. >> they put mud -- >> and cement. just plug it all up. it is 5: 41. still to come, a pizza in hand, a knock on the door. >> what a deliveryman did to help the husband of a panicked woman. also ahead, what has allowed the water of santa cruz beachers to be a lot safe they are summer.

some stories we're following right now... you can see there is mostly green on all of our sensors which is great news if you are hitting the road but a.c. transit is warning of a third possible sickout. some riders saw delays up to an hour. bart would be a good alternative or if you do drive everything is quite down the eastshore freeway. those taillights are westbound 80 there towards emeryville. and once you reach the bay bridge toll plaza, all those backups we saw short backups in some of the cash lanes in the far left cash lanes, just next to the carpool ladies and gentlemen. they opened another cash tollbooth and so that got rid of those delays. now everything is good to go on all lanes as you approach the pay gates and quiet still at the incline all the way into san francisco. live look at the nimitz near the coliseum. so far, so good all the way

critical condition. the flight from washington to los angeles made an emergency landing in denver. oakland is one step away from being measure's first city to approve large marijuana growing operations. the city council roting 5-2 for those pot plants or pot warehouses last night. the final vote is expected next week. and president obama is expected to sign the landmark reform financial -- financial reform bill into law today less than a week after it passed the senate. the plan would give the federal government new powers to close failing banks and monitor consumer loans among other things. lifeguards will be on the job at state beaches in santa cruz county. state budget cuts had forced the parks department to close 10 towers and lay off lifeguards throughout the county. well, the group friends of santa cruz state parks stepped in, raised $60,000 to covet last two months of the lifeguard budget.
