>> no chopper yet. not right now. but in half moon bay they are continuing to pave on 92 just east of half moon bay. one way traffic control in effect for another hour or so. and they are doing it every day this week from pilarcitos creek and main street. also in san mateo county, got some roadwork going on here as well until 6:00, southbound 280 between edgewood and farm hill boulevard. actually a little slow traffic on our sensors there. but if you are crossing the san mateo bridge, you're good to go in either direction across the span. what are you laughing about? >> john is making me laugh! >> what's so fun? i? >> he is having a little trouble with his mic and all the cords and battery packs and everything. >> we are kind of robots here. >> it's a little comical. our forecast won't be comical, it's nice. but starting with cloudy skies. areas of low clouds will be in the bay as well as along the

coastline. and maybe even a little drizzle this morning, so you may have to hit those windshield wipers from time to time. take a look at the highs. upper 80s from the mid-90s to the upper 80s. so mid-60s expected around the bay, upper 50s for the coast and temperatures by thursday, friday and saturday the lower 90s back in the forecast. those temperatures are slightly more seasonal especially inland. mid-60s around the bay, that's still cooler than average and the coastline, no major shifts just near 60 degrees for a daytime high. all in all, another nice day, another summertime day expected. >> i like it. we all settled in now? >> i'm settled. >> working on it. [ laughter ] >> back to you. >> thank you. a.c. transit is warning passengers there could be more service disruptions today. anne makovec is in, checking on the chances that some drivers might be calling in sick again today. anne, good morning. >> reporter: will they or won't they? at this point we are not sure.

but, of course, passengers who depend on a.c. transit wonder if they will have a ride to work. yesterday over 200 a.c. transit bus drivers called in sick or didn't show up. that's 20% of the bus drivers in the system, leaving passengers depending on the east bay's largest bus system either stranded or inconvenienced. service across the dumbarton yesterday, for example, was cut in half. the driver's union denies this was a true sick-out but says new work rules and interim account that went into effect on sunday changes driver's schedules and they weren't ready for their assignments. those new rules are the latest chapter of an ongoing dispute between a.c. transit and the union over pay and benefits. on friday the judge ordered both sides to enter binding arbitration but then that interim contract went into effect on sunday. today the union is going back

to court trying to get those work rules repeeled. so we'll see -- repealed. so we'll see what happens. but the main question is, will bus drivers show up for work? it's something you won't know until they start getting those sick calls and figure out how they are going to run the buses. >> i know a.c. transit has apologized for the action, nothing they can do at this point, but people who ride a.c. transit better make alternate plans just in case. anne, thank you. >> reporter: some of those riders as they show up at the stops this morning, we'll speak to them. >> thank you, anne makovec in oakland. two dogs that attacked people in golden gate park have been put down. no one came forward to claim the dogs after the attacks on july 1. san francisco animal control officials decided the dogs were too vicious for adoption. so the dogs were euthanized last week. the dogs were held for 10 days to make sure they didn't have rabies. they were a male pit bull believed to have attacked three

people and a female mixed breed that was probably following the pit bull. a father of three who was robbed and killed in oakland was in the bay area for a job interview. it happened late sunday night near the corner of 19th and webster streets. the man from fairfax, virginia had just had his teeth cleaned by a friend he knew from church in preparation for a job interview at google. the two were walking to the victim's car when a man accosted them. he had $17 with him, the victim did. he gave it to them but he was shot anyway. there is no description of the suspect. and the man arrested for a freeway shootout with the healthcare healthcare is talking to investigators while he recovers from his gunshot wounds. the fbi is investigating 45- year-old byron williams as a possible domestic terrorist. they are checking the book he had with him for potential targets. williams has a rap sheet that

includes two bank robberies and two duis. and earlier this month, he was arrested for driving with a suspended license. the "three strikes" law means williams could be locked up for life if convicted for the shootout that closed interstate 580 in oakland on sunday. it was a heated but troubled free showdown in -- trouble-free showdown in walnut creek at a rally for former bart officer johannes mehserle. [ yelling ] >> about 300 people showed up, some in support of mehserle and some who feel he should have been convicted of a more serious crime than involuntary manslaughter. oscar grant of hayward was shot to death last year as mehserle tried to detain him in oakland. mehserle says he intended to use his taser but pulled his gun by mistake. >> i think it's unbelievable that people would come out and take to the streets to support somebody who took a human life, whether you thought it was an accident, by negligence, or you thought it was on purpose.

>> if 12 people found him involuntary manslaughter, then let him go do his time and leave it alone. so in my heart, i believe he needs a little support. >> about 300 police dressed in riot gear were on hand, but the event ended with no problems and no arrests. bp is keeping the cap on its broken oil well and keeping watch for possible leaks. the cap stopped the oil from flowing out of the well last week. there is some oil and gas still leaking but it's a relatively small amount. so the government has backed off on its call to siphon oil through the cap to ships on the surface. >> all seepages right now don't indicate a threat to the well bore. >> the next move is uncertain. one possibility is pumping heavy drilling mid and cement into the well now that the cap

has eased the pressure. and bp is still working on the permanent solution, drilling relief wells, to take the pressure off the one that's been broken. 5:08. bart has a lot of money. we'll tell you how should the transit agency spend it. passengers are saying not on a fare rollback. how they really want that money to be spent. could be an economic boon to the bay area. how much money could be generated and how many jobs created if the americas cup comes here. the promotion starts now. ,,,,

of the bart schedule and a look at other bay area roads plus some roadwork still going on in the south bay. that's all coming up. there is a new survey out of bart users that finds that more than three-quarters are opposed to a temporary reduction in fares. bart directors are considering the rollback because they have a budget surplus of more than $4 million due to an unexpected allocation that came from the state. but now a majority of riders survey says that they would prefer to see the extra money going toward extending service hours and cleaning the cars. directors will vote on how to use the surplus on thursday. billions of dollars and thousands of jobs, that's what the bay area could get if next americas cup race is held here. larry ellison's bmw oracle racing team and the golden gate yacht club decide where the next race will be since they won this year's event in spain. a study prepared for the city

of san francisco says the regatta could bring $1.4 billion to the bay area and create nearly 9,000 jobs. the next americas cup will be in 2013 or 2014. from rehab to jail, today actress lindsay lohan is set to turn herself in and begin serving a 90-day jail sentence. >> a judge handed down that sentence after lohan violated terms of her probation from a 2007 drug and drunk driving case. lohan, though, doesn't seem to be taking things too seriously. they said she was tweet-joking about her prison term, writing, the only bookings that i'm familiar with are disney films. never thought i'd be booking into jail. i tried to pull it up. but apparently somebody thought i was a member of twitter and i couldn't get to her page. >> do you think that's actually -- she's actually tweeting that? >> i don't know. never thought -- that's so dumb

if you are an amounts of c transit bus rider, we have been -- if you are an a.c. transit bus rider, we have been warning people to expect delays. there was a sick-out yesterday due to labor disputes. some riders were reporting half hour to hour long delays on the bus system so the same thing could happen today. we are kind of watching and waiting checking their website to see what's going to happen today. in the meantime on the roads in oakland, this is the nimitz nimitz, still light past the coliseum and heading into downtown oakland. 15 minutes is your drive time there in those northbound lanes. southbound traffic moves well too. one way traffic control still in effect in half moon bay. they have been doing some paving work in this area until 6 a.m. expecting delays both directions of 92. one way traffic control in effect in that area between

bay. mid-70s in los altos, 74 sunnyvale, 76 san jose, 80 campbell and los gatos. the lower to the mid-70s in union city, fremont and milpitas. these temperatures are slightly cooler than yesterday. mid-60s in berkeley, oakland, as well as in alameda. the 80s today, the lower to mid- 80s, that's quite pleasant in pleasant hill, danville, van moan, 82 dublin, and the -- san ramon, 82, dublin. 80s in brentwood, which was mid- 90s yesterday. north bay cooling off, as well. 74 napa. 73 novato. 73 kentfield. cool along the coastline with 59 in stinson beach. 60 bodega bay. 63 sausalito and 60 degrees in san francisco. our seven-day forecast, so, we will have similar conditions today, tomorrow as well as thursday. still that ongoing threat of some drizzle along the coastline, still got fog along the coast. but otherwise things pretty much on the same page friday,

good morning! it's tuesday, the 20th of july. >> good morning, everyone. it is 5:30. get up and at 'em and out the door. we'll take a check of our weather. but first a look at our commute with elizabeth. the marin county commute southbound 101 looks good, so top speeds all the way down southbound 101. we have a camera in san rafael near the 580 interchange. headlights are southbound traffic. actually looks good all the way towards corte madera through the waldo grade and a live look at the golden gate bridge where traffic is moving fine across the span. plenty of room to stretch out. actually it's about 22 minutes from novato down into san francisco. from the north bay down towards the south bay, quiet here as well out of downtown san jose. northbound 280 fine along the peninsula. mass transit is all on time, though we are watching for possible a.c. transit delays due to those labor dispute. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. >> today we're coining the

phrase on the cooler said because that essentially sums up what's going on weather- wise. average daytime highs this time of the year, we picked four location. santa rosa at 82. 68 it typically feels like in san francisco. 87 in concord. 84 degrees in san jose. well, today it's going to be on the cooler side. 85 in concord, 76 in san jose, 60 in san francisco, and 77 degrees in santa rosa. these temperatures anywhere from two to five to eight degrees below average. so we are going to continue to see temperatures in the same ballpark for the next few days. then we'll warm up again. inland will stay warm. along the coast still cool with more clouds expected. that's a look at your weather. back up to you. a.c. transit with an apology and a

warning. that after hundreds of bus drivers called in sick yesterday. anne makovec is in oakland. there is a labor protest. i guess the union just won a court decision. now they are forcing its hand? >> reporter: yeah. there's been an ongoing labor dispute. i'll give you some details on that in a minute. but today we are wondering if this will affect this morning's commute. so far we haven't heard from either a.c. transit or the union on the plans for today. but we do know that yesterday, more than 20% -- actually almost 20%, it was 18% specifically, of the bus drivers for a.c. transit did not show up for work. many of them simply called in sick. now, the union though denies there was even a sickout yesterday, just some confusion, they say, over a new schedule. but there is undoubtedly a dispute here between the company and the union. here's a little background. on friday a judge ordered both sides to enter binding arbitration. but in the meantime, a.c. transit has imposed an interim

directors will vote on how to use that surplus on thursday. this morning about 50 activists in san francisco are occupying the second floor of a building in the mission district. they have been there since last night to protest reductions in the city's housing budget. they call their group, direct action to stop the cuts. the activists vow to stay in the abandoned space at 20th and mission streets until they are forced out. the same group took over a homeless shelter and duplex earlier this year. a -- [ pause ] >> -- teenaged boy who fell to his death from a cliff in marin county may have been distracted by his cell phone. the boy and his family were on vacation from pennsylvania. the 17-year-old was hiking with his family along the coastal trail near muir beach when he fell yesterday. investigators say fell between 400 and 500 feet. they don't know why he fell, but they say the teen may have been texting on talking on his

republican filibusters. but today, democrat hart goodwin will be sworn in to replace the late senator robert byrd of west virginia. goodwin is expected to provide the 60th vote that democrats need. about 2.5 million unemployed americans have seen their jobless benefits expire since early june. republicans say they are open to another extension as long as it does not add to the deficit. elena kagan is expected to take another step toward the u.s. supreme court today. the senate judiciary committee is set to vote on president obama's nominee. so far, no democrat has announced opposition to kagan and no republican has announced support. but democrats do hold a 12-7 edge in the committee so kagan is likely to clear that hurdle. she is also expected to get approval from the full senate, which is likely to take up the issue next month. former illinois governor rod blagojevich is expected to testify today at his corruption trial. blagojevich was impeached amid allegations that he offered an

appointment to barack obama's old senate seat in exchange for campaign funds or maybe a cabinet post. the ex-governor's brother, who is also charged, took the stand yesterday in chicago. robert blagojevich said that he had no part in the alleged scheme. both brothers have pleaded not guilty to all charges. 5:39. oil is seeping again from the well in the gulf of mexico this morning. but it appears to be seeping more slowly than previously thought. tara mergener now on why some say there is no reason to worry. reporter: bp's containment cap is staying put for now. >> we do not believe this is consequential at this time. >> reporter: the government official in charge of the spill insists there is no cause for alarm, even though the 75-ton device is leaking oil and gas. two miles away, something is also seeping from the sea floor. >> the small seepages we are finding right now do not present, at least at this point, any indication that

there is a threat to the well bore. >> reporter: bp engineers will continue keeping a close eye on the well, watching for any new leaks. pressure readings are slowly climbing, a good sign. but government scientists are still trying to figure out why they are so low. bp wants to keep the cap in place until relief wells are completed. but the government has asked the company to draw up plans in case the cap needs to be opened. >> if there is any indication of a precipitous drop in pressure, or any reason why we might need to do something about it, we would need to have to vent immediately to relieve the pressure on the well. >> reporter: but that would allow millions more gallons of crude to gush into the gulf for at least a few days. bp is considering another option to shut the oil flow known as static kill, much like the failed top kill method. it would involve pumping heavy drilling mud and cement into the well. company executives believe the plan may have a chance now that the well is capped. still, they stress the idea is only in the planning stages and

good morning. it's maybe another day of a long wait at a.c. transit bus stops. officials warn of another day of possible delays. yesterday more than 200 drivers called out sick due to concerns over their new contract. so some riders are not happy. they reported up to half hour or hour long delays yesterday throughout the day. hopefully we went see a repeat of that today. it could happen, we're watching and calling a.c. transit officials so we'll let you know once we hear about possible delays but for right now on the roads it looks good across the nimitz freeway. that's northbound traffic. taillights heading towards the high street bridge. it actually moves fine up into downtown oakland. no problems there. bart might be a good alternate, as well. other roads in the east bay, eastshore freeway live look at conditions through berkeley looking good down from the carquinez bridge towards the macarthur maze. and at the bay bridge toll plaza, not much of a delay here

nomination of elena kagan. democrats hold a 12-7 edge at the committee. she will get approval there as well as full approval from the senate next month. there is a gel that can block the transmission of hiv in women. researchers found a gel spike with an aids drug can cut in half a woman's risk of getting hiv from an infected partner. it was tested on women in south africa. the gel would have to be at least 80% effective though to be licensed here in the u.s. researchers say, though, it can be improved. foster city-based gilead science donated the gel. they are going to be distributed free in poor countries. the number of cases of pertussis have prompted the state to declare an epidemic. as a result, california's department of public health says seniors and women of childbearing age should also get the shot. immunity decreases over time so
