this is cbs5 eyewitness news. a suspect shot dead in the street by officers. both oakland and b.a.r.t police involved in the case and both agencies are trying to sort out exactly what happened. don knapp has a look at how a

tighter budget for the oakland police is spurring more citizen accident but first to linda yee with the latest on the investigation into today's shooting. >> reporter: people that live on the street say they did see the suspect running down the street taunting officers as they were chasing him down. just after 8:00 a.m. this morning shots rang out. people told their children to hit the deck for cover. in the meantime, oakland police are explaining why b.a.r.t was also involved. >> reporter: oakland police were quick to point out b.a.r.t officers were called in because the suspect armed with knives was seen walking towards the b.a.r.t station. >> both bart and oakland police officers fired shot? >> we believe so yes. >> the suspect was walking on east 12th street. >> early report from a witness was he was yelling shoot me when the b.a.r.t officers first made contact with him. >> reporter: the man took off

and b.a.r.t officers chased him and then oakland police stepped in. we tried to tase him. it is not effective and he continues to flee. >> reporter: the suspect kept running. at least five officers chased him onto 33rd avenue. >> the man then turns towards one of the officers who has tased him or attempted to tase him. knife in hand charges the officer. at that point other officers on scene who are there to protect the officer who has the taser in hand discharges their firearm striking the suspect who then falls to the ground and did not survive his wounds. >> it was really fast like that. >> she said the shots scared her. a neighbor saw it all. >> the police officer told him stop, stop, stop. and he went this way, that way and that way. >> reporter: families in this neighborhood say the violence here is not new and with 80 police officers laid off because of budget problems it makes them even more nervous. >> it is just unreal now when we see something like this. >> we are really scared, ma'am.

>> reporter: this is the third officer related shooting for the oakland police department this year. the second involving a death. now, people may be worried that they may see fewer officers on the street but they may be getting some help from a well known citizen's group. for more on that part of the story let's go to don knapp live on lake merit. >> certainly that's the question. how will oakland cope with crime with fewer police officers? well, the guardian angels are stepping in. armed only with their eyeballs, ears and two way radios. >> we would be -- there was at least one to two to three police officers. >> the guardian angels say they will help to fill the gap. oakland police will not respond to calls that are lower priority. starting sunday they will have 30 volunteers in red, white and black. >> we can be a deterrent and if there is a crime going on and

they see us they will think twice about it. >> reporter: two years ago after a string of restaurant takeover robberies terrorized customers and restaurant staff the guardian angels claiming credit along with the chp in helping oakland police ends the robberies. >> i have no fear. i should but i don't. it is my community. it is my steve. i have children going up in this city. and i want to be a part of it. i don't want to sit back and complain about the problems. >> reporter: the reverend kerry says he is yet to see the guardian angels in his neighborhood. >> i have never seen them. >> reporter: ministry members today wrapped up their 31st annual block party and health fair. he said people came in large numbers. cutting services and programs is not way to fund a police officer. >> we love them and appreciate

what they do for the city but we have to all give back. everybody has to give back. >> reporter: the guardians angels say they will hit the streets in oakland tomorrow. >> we are here to help and we are volunteers and that's what we do. >> reporter: the guardian angels want to flood the neighborhoods with volunteers. >> so they are volunteers. do they all live in the city of oakland and are they looking for more people to sign up that they can train? >> yes and yes. they don't all live in oakland. they have a headquarters house here where they will sleep in dorm style and they want volunteers to come and join up. they want lots of people on the streets. >> they look for local people who they train and then set up their own headquarters. >> absolutely. they do look for local people. they do have a headquarters here in oakland. and they are trying to bunk those people in oakland. keep them here all the time getting people from out of state, out of the area coming in to help out. >> don knapp in oakland, thank you. well, in stockton two people are dead and five others

wounded in what appears to be a gang shooting. police say all of the seven victims were hispanic men. two died at the scene. investigators say although the shooting seems to be gang related they have not been able to confirm gang connections to the victim. they have no suspects in custody. >> a cliff hanger race for the june primary election has finally been decided by a slim margin of about 16,000 votes. the secretary of state declared state assemblyman the winner in the republican race for insurance commissioner. he will face democrat dave jones in november. voter turn out final numbers for that primary. only one third of eligible california voters went to the polls and the numbers also reflect a growing trend in the way people vote. almost 58% of the voters cast their ballots by mail. a business that is booming in this recession. an east bay couple's dessert

millions of americans who have lost their unemployment benefits could soon get them back. on tuesday, senate democrats hoping to break a republican fillibuster. they believe they will have the votes as soon as the new democratic senator from west virginia is sworn in. economists say small businesses hurt in a down economy. here is a company with success. >> reporter: meet kate. kate makes cup cakes. in her secret kitchen with her

>> even every day you are physically handing them the cup cakes and the reward of them enjoying it and being happy to see you in that moment. >> reporter: they have a very loyal following. >> it is like one of the best cup cakes i have ever had. >> reporter: but nothing is truly tested until it is kid tested. >> very tasty. >> reporter: on the streets of berkeley, brian yewen, cbs5. walnut creek is celebrating a project that came in on time and under budget. the new civic park library grand opening was today. the 42 thank you square foot project cost just under $40 million and that's nearly $6 million under budget. among the features of the new library are 90 public computers. a children's area and workspaces for local artists. >> there is now a bit more of yosemite for campers to enjoy this summer. all camp ground sites are now open including one that's been

closed since 1997. it was inaccessible for the past 13 years because a flood destroyed a bridge leading into it. all campsites that can be reserved were already taken but people who want to chance a spot in the first come first serve camp grounds should arrive early in the day. digging and finding fossils up to 10 million years old. plants and animals that once lived in the east bay have already turned up. scientists expect to find even more with the giant boring machine that will start digging deeper. camels, horses. when we come back heat relief. lawrence on the midsummer cooldown headed our way. up all 48 floors of the transamerica

these guys are fit. bay area firefighters huffing and puffing their way up all 40 floors of the transamerican building this morning. they were raising money for three local organizations that work on the treatment and recovery of burn victims plus raising money for their own toy drive. they were in full gear during

the climb which adds about 50 pounds. it wasn't about speed. they just wanted to make sure they could return tomorrow to work with only minor pain. a lot of tylenol tonigh recovering. >> lawrence's brother is a firefighter. >> how hot was it in san francisco today? >> not that hot here in the city but we are talking near 100 degrees in some spots inland. in the city pretty good. but fog and low clouds out there, folks, out towards the beaches and we head to the valleys and you get all that sunshine. today a beautiful summer's day outside as we have mostly sunny skies. just about everywhere you went except right out at the coastline. fog and low cloud were hanging out and that's where you saw some big differences in temperature. outside right now still looking nice and clear most spots inland. you see monsoonal moisture making its way off the sierra nevada. out toward the coast we are

socked in with low clouds and fogs and just a few people out at the beaches. >> if you're headed around the bay area this evening not a bad evening just a little cloudy and grey out at the coast and cool temperatures there. get inside the bay and start to warm up a little bit. mostly clear. now extending from the golden gate. clear skies. nice and warm still. temperatures in the 70s and also 80s. tomorrow again going to be hot in spots. into the upper 90s in some of the hottest spots well inland. you can see temperatures well into the 90s. inside the bay you'll find 60s in near oakland. looking at some 80s towards the santa clara valley. 50s and 60s out toward the coastline. fog the real story over the next five to seven days. high pressure will hold on but start to weaken somewhat. low clouds and fog will continue to creep onshore. temperatures for today. 95 degrees in concord. only 59 degrees though in pacifica.

over a 30-degree difference in temperatures in a very short time period. inside the bay 70s and 80s. now, traveling around the state you'll still find some hot stuff. how about 100 degrees in sacramento tomorrow. 104 in fresno. 97 degrees in yosemit. going to keep that heat on i think in places inland. but toward the coastline. low clouds and fog still seeing that seabreeze and that's keeping the temperatures down. valley heat will continue for at least another day. fog will persist along the coastline keeping those temperatures cool but we will see some changes as this ridge of high pressure begins to weaken over the desert southwest. increase in low clouds and fog. lower burnoff and cooler temperatures heading into the middle of this next week. tomorrow morning starting out with a lot of clouds but by the afternoon we will start to clear out a bit. patchy fog out toward the coastline. 70s and 80s inside the bay. 92 in morgan hill. brentwood 96. 93 degrees livermore. northwest nosh northbound

race today and as kim coyle reports it was an accomplishment. >> reporter: he had great potential but just before the season started his life changed forever one december night in 2001. >> in 2001 i was in a car accident in sacramento and as a result i became paralyzed from the waste down. >> reporter: now 30 dominique has a renewed sense of life and purpose challenging himself in ways he never managed. he started a nonprofit organization called try for others. >> we help injured rugby players because that's the community i came from. i would get a lot of calls from players that had been injured in rugby and we would offer them advice and help them with their final needs right after their injury. the ultimate goal is to have
