tape. and sting sings. ♪ every thing she does is magic ♪ the pop legend rocks our plaza on "the early summer concert series" early this friday morning, july 16th, 2010. captioning funded by cbs it's quiet now. won't be so quiet in an hour or so from now. good morning, everybody. i'm harry smith. >> i'm erica hill. some people sleeping in on a friday. not a lot of sleeping in happening, though, in washington, d.c., this morning. breaking news this morning for you out of washington where 3.6-magnitude earthquake hit the capital this morning. cbs' tara mergener is in washington for us this morning with the latest. good morning. >> reporter: good morning, erica. well, that earthquake hit at about 5:04 this morning. as you said it was a 3.6-magnitude, and that is the largest ever recorded within 30

miles of washington, d.c. now, the epicenter, we understand, was about 20 miles from here in rockville, maryland and we also understand that you could feel the earthquake also in parts of maryland virginia west virginia and pennsylvania. now, in 1990 we had a 2.6 earthquake here. that was the previous record. now, we understand this morning there is no damage reported yet, but we hear people saying things like they heard an explosion, they thought it was a plane or a truck, and we each hadven had one of our own photographers call in and say that he was shaken out of bed all his neighbors were flooding to the street this morning. nobody had any idea what happened before the news reports started coming out. so erica, this is a pretty big deal for these parts. again, the biggest one ever recorded within 30 miles of washington, d.c. >> and a lot of people keep talking about that today. tara mergener in washington thanks. harry? okay erica, now to the latest in the disaster in the

gulf, where there is reason for hope this morning that oil has finally stopped gushing from that blown-out well. but the next 36 hours of testing the new containment cap will tell the whole story. cbs news correspondent kelly cobiella is on the gulf coast in grand isle, louisiana. kelly, good morning. >> reporter: good morning, harry. this is what gulf coast residents have been both pleading and praying for for nearly three months now, stop the flow of oil. well, that flow has now been stopped for more than 19 hours, and using this new, tighter fitting cap system. if you look at those cameras a mile down on the ocean floor, there is no oil coming from that well this morning. engineers are still checking the pressure. they're checking it every six hours. high pressure means the well is holding. low pressure means there is a leak. now, bp vice president ken wells says that so far it looks like the pressure is good inside that new cap.

no signs so far of any leaks under ground but this is really just the beginning of the test. now, ideally, the test will go on for another day and a half or so. if there are no glitches then they'll finish up around saturday afternoon. until then all of the activity on the spill site has been on hold been put on hold the drilling of the relief wells included. and of course, those are considered to be really the permanent fix. this capping system is just containing the oil for now. harry? >> kelly cobiella thanks. physics professor micho kaku is one of the world's most recognized scientific experts. he joins us in the studio this morning. good morning. >> good morning. >> this is good news, right? >> we can almost break out the champagne bottles. the moment of true is arriving. this weekend will determine almost everything. >> let's talk a little bit. we have a wonderful animation set up. this is the mothership, as it were. and what does it drop down into the gulf of mexico here? >> this is the cap.

a lot of hopes rest upon this. we hope to plug up this blow-out preventer right here which is leaking up to 60,000 barrels per day. >> all right. >> here is the cap and these are siphons that also siphon off the oil. >> and here's the thing, this thing is like a blow-out protector jr., right? in has a lot of the same mechanisms in it correct? >> right. it has two valves here ones that open and shut and the third is like a dimmer shift. you can adjust it so a lot of hopes are resting on this cap. >> this is all the way closed now. so when we look at that picture, we see no oil coming out of here, but what's most important is what's down here. this is what all the testing is about. tell us what they're trying to test for. >> the worst-case scenario is that by sealing this up it puts pressure down here and you can burst a pipe. these pipes were damaged by the original explosion three months ago. they're damaged. and if one of these things ruptured, you could have many leaks all over the place. that's the nightmare scenario. >> the nightmare scenario being

if there really is a rupture down here, you could have a crack in the sea bed, literally, while there were tons and tons of cement poured down to there. it could be leaking all over the place. >> that's right. >> and you could end up with a larger disaster than they have right now. >> irreversible damage. you could be even worse than where you first left off. remember, the pressure is enormous 8,000 pounds per square inch. take a mack truck and put it on every square inch of the pipe. that's the pressure inside. >> man. it's kind of hard to fathom -- fathom is kind of a good word because you're talking about 5,000 feet below the surface, 8,000 pounds per square inch coming up this way. all this pressure down here. phenomenal low temperatures and difficulties in dealing with all of this stuff so that they've got this done is in its own small way an engineering marvel. >> that's right. and we're going to cap the top and choke the bottom. it's going to be a one-two punch. that's how we're going to tame this monster. >> right. in the end, though, what they're talking about doing, though

once these tests are done is opening this up again, having a pipe that will be connected here, and then the oil will all be sent to the surface. >> that's right. realize that this is just a temporary fix. >> right. >> the gold standard is the relief wells that are being drilled down there. that works almost all the time. >> all right. professor kaku thank you very much for joining us this morning. we do appreciate it. it's nice to have a little good news for a change. >> that's right. my pleasure. >> all right. now here's erica. >> harry thanks. turning now to politics. president obama set to sign a sweeping package of financial reforms on wednesday. by a 60-39 vote yesterday, the senate passed it's another legislative victory for the president. his poll numbers, however, are worse than ever. joining us now, cbs news chief washington correspondent and host of "face the nation," bob schieffer. bob, good morning. >> good morning, and can i report first that i'm safe? i made it to high ground and rode out this quake. >> well, that's good. then you saved me the first question. that gives us more time for glad to hear all is well after

that 3.6-magnitude quake. >> they actually did find it they did hear it here at our bureau downtown, erica. >> really? >> some of the fellows that got in here little bit early. i'm so old, i don't feel anything anymore, so but some people even said it was like the subway going by or something like that. >> there you go. or as dave price said maybe this will wake up some of the folks in washington. >> exactly. >> let's take a look this morning. the three major pillars, basically, of president obama's platform here we're talking financial reform the stimulus package and now health care reform. something passed in all of those at this point, yet his numbers, as we mentioned, now at a 44% overall approval rating. where is the disconnect there? >> well i think it all goes back to this economy. i mean, people are in just such a bad humor. when the economy is bad when people are worried about jobs when they're worried about making their house payments it just colors their thinking on everything. and you know this happens again, and you're absolutely right. every time the president gets

something done that he promised to do during the campaign it seems to have the opposite effect. but i think it again, it all is rooted in this economy. and until this economy starts to look better and gets to the point where people actually feel like it's better i think he's going to continue to have these problems. >> so, then, does the white house need to work on its message that it's getting out or does it need to work on the message that the american people are sending and it's listening to that message? >> well there is no question that people are frustrated and upset. but i think this is a matter of what's happening out there more than it is a message of problem with how they're packaging what the president says. people have come to feel that the government can't get out of its own way and that the government is unable to deal with these problems. i think the fact that you've had this thing going on down in the gulf, which i don't think anybody can say that's the fault of the president, that this pipeline broke down there, but again, it's just something, they

see it every day on television. they say can't anybody do anything about this stuff? and i think the frustration that grows out of that, people tend to, you know blame on people who are in office if not directly, at least indirectly. >> it definitely comes with the territory. some democrats have said after press secretary robert gibbs basically said look it's possible that the gop could take over the house, they're saying this is not the kind of support that we need right now as we're heading into this election season. but in the end, could losing the house ultimately be good for the president because it certainly helped bill clinton? >> you know erica, i don't think it is ever good to lose. i think you're always better off when you win, but i'll tell you this, i think unless this economy begins to look a lot better, i mean robert gibbs was just stating the obvious, that if things don't get better with all that anger and frustration out there, a lot of democrats are going to lose their seats. a lot of democrats, especially in the house, didn't like to hear that because the way they see it and the way they hear it

the president's trying to divorce himself from them and sort of leaving them out there on their own where, you know he can say, you know it's their fault if they get beat. it doesn't have anything to do with me. but again, i think this is just a symptom of the greater problem, and that is until this economy gets better everybody in elected office better look out because they could be in trouble. >> be very careful. no one is safe at this point, except for bob schieffer, who is safe in the washington bureau this morning. bob, thanks for coming in. >> thank you erica. >> and of course you can see bob this sunday on "face the nation." he'll take a look at arizona's new immigration law and will be joined by arizona u.s. senate challenger j.d. hayward as well as former new mexico governor bill richardson. harry, over to you. than and the record the record $550 million settlement by goldman sachs. the government had accused the wall street giant of misleading investors into buying subprime mortgage securities just as the housing bubble was about to

burst. cbs news business and economics nomics correspondent rebecca jarvis is ca here to explain. we remember this because this was in the news for weeks, it seemed like.eks, it this was that whole abacus thing? >> yeah. back in april there was a lot of >> talk about a transaction where on goldman sachs misled some some investors. those investors were banks.ose they were not your average person. and now what goldman sachs has concluded is that it will pay $550 million. sounds like a massive number, doesn't it harry?e number >> in theory it does sound like a lot, unless you look at their earnings. >> right. it's a very small portion of >> it's what this company is making $13.4 billion in a single year. >> right. >> and there are some firms out there that estimate goldman irms sachs could make $550 million in the span of one week.$550 so, it's a small settlement for it's a sma them, but it is a big settlement for wall street. l >> and certainly good news for tainly g the stocks. the and if you're inside the y building at goldman sachs, you t might be saying we got away saying, pretty cheap. >> well, yeah absolutely. in terms of what goldman sachs is paying it's a small amount t's for the company, like we said any, but but also for investors.

what people out there should know, th know is that this is a company is that is in many retirement accounts. man chances are it's in your 401(k).ances are it's chances are, it's in your i.r.a. and the news that they'll be paying this relatively small sum has responded positively for the stock. the stock is actually up on that news. >> yeah just overnight. in the larger picture, though, ure, as we look at something like this als this, is this also -- we talked alked a little bit about the housing foreclosures and everything else else -- is this part of the final sweeping up of that whole financial mess that everybody rybody has gone through the last couple of years? >> well you might want to call it a sweeping under the rug of some of the financial mess because this company is essentially turning the page on that something that really could have damaged its reputation and this his country is trying to turn the page and we're in the process ofhe that and this is a component of th it. >> all right. rebecca jarvis thank you so much.ca do appreciate it. >> thanks, harry. >> lots more news this morning. betty nguyen is at the news s desk. good morning, betty. >> good morning, harry. we and good morning to you at home. we begin in northern iraq this morning where four in americans are among those killed

westbound 4 seeing slower

[ bleep ] whore, gold digger all true. you [ bleep ] proved it to me! >> reporter: it's the fifth telephone rant released by radaronline. the l.a. sheriff's department is now investigating gibson for domestic violence. gregorieva has accused him of these things. >> we will begin the process of reviewing them analyzing them. >> reporter: but gibson's lawyers alleged the phone calls have been edited. >> there's a great example right there. >> reporter: forensic expert frank piazza agrees. >> this file that i'm hearing definitely has edits, deliberate edits. >> reporter: mel gibson, once reportedly worth close to $1 billion, now says he's in a financial bind. he blames gregorieva and her music career he helped bank roll. >> i spent too much [ bleep ] money on you, and my wife knows!

>> how much money do you spend on me? you don't spend more money on me than anybody else. >> i spent more than $5 million on you! >> reporter: gibson has eight children, seven with his wife of nearly 30 years who is expected to get a huge divorce settlement. in a letter to the court, robin gibson says the actor never abused her and was a good father, but his own words caught on tape may be hard to explain. >> i will never forgive you for what you've done to me! you [ bleep ]! >> reporter: the increasingly nasty custody battle between the two is due back in court next week. ben tracy, cbs news, los angeles. >> and joining us now from los angeles, cbs news legal analyst lisa bloom. lisa, good morning. >> good morning. >> give us an idea these tapes ben just outlined, some of the latest for us and also what mel gibson's attorneys are saying but what role ultimately could they play? >> i think they would have a huge role in the case erica if they are allowed into evidence

and i know that mel gibson's side will fight very hard to keep them out on the grounds that they're edited that they're not authentic and on the grounds that he didn't consent to be taped in california where it's a two-party state, but if they are allowed in under the crime exception because oksana was trying to preserve evidence of a crime and she can overcome the arguments about authenticity, they're going to have a huge effect because he rants, he raves, he threatens her, he allegedly admits to assaulting her when she's holding the child in her arms. so, they're relevant not only to their dispute, but to this child custody issue. >> but if they are proved to be edited in some way or perhaps if she was maybe trying to draw things out of him, does that mean they could still be admissible or would that then pull them out of the running in terms of evidence? >> it doesn't necessarily mean that they're inadmissible. if they are edited the tapes can be chopped up. let's say that there are ten segments that have all been edited together, they can be chopped up into those ten segments. the judge can be -- the judge can understand that each segment should be considered separately.

but i think they could still come in. i think they are such powerful evidence of the rage coming out of mel gibson of the anger of the alleged violence that the judge is going to want to hear them. they may just be given less weight if they've been altered in some way. >> tmz is reporting this morning, saying it has hard proof that oksana gregorieva tried to get more than $10 million from mel gibson by saying in turn she would keep these tapes quiet. what would that do to the investigation in the case if that turned out to be true? >> well that's a very important allegation, and i would assume the hard evidence would be some kind of letter from oksana's attorney demanding money. keep in mind that in high-profile cases involving celebrities, when settlements are being discussed, we always hear this extortion claim, and it's rarely proved. nevertheless, if there is hard evidence of some kind of extortion, then i would expect a second investigation to be closely looking at that and her attorney would be investigated and she would be investigated. >> also, i want to get your take on this. we got a statement yesterday from mel gibson's ex-wife,

robin, who said -- and i'm quoting here -- "mel never engaged in any physical abuse of any kind toward me before during or after our marriage." does that come into play? how much weight does it carry? >> well first of all i would expect that as a part of their multi multimillion dollar divorce settlement that she is not permitted to bad-mouth or denigrate him in any way. so her choices are to either say something positive or nothing at all. i also notice she uses the term physical abuse, that there was never any physical abuse. it seems to be silent on the issue of verbal abuse, and if you listen to those tapes, which i have several times, we're talking primarily about very tough verbal abuse. i wonder what she would have to say about that. >> do you think ultimately mel gibson could be facing jail time here? >> i do erica. we're talking about potentially criminal threats. that's punishable by up to three years under california law. if they're considered felony threats. and when you look at the tapes in their totality he is angry. he himself uses the word

broken bp well that's finally been capped. no oil is leaking but it is a temporary fix. cbs news correspondent kelly cobiella is in grand isle, louisiana. >> reporter: this is what gulf coast residents have been pleading for for three months now, just stop the flow of oil. it has now been stopped for more than 16 hours with this new system now in place. but engineers still need more time to test it. they are checking the pressure every six hours. high pressure is good. that means the well and the system are holding. low pressure indicates some sort of problem, possibly a leak in the system or in the well itself. bp so far says no problems yet but they are not ready to declare victory. >> the next step is actually we have to complete these relief wells. we have to actually go in with the relief well and seal this well off so it can no longer flow. so that activity will continue until this well no longer has the capability to no longer flow

again. >> ideally if there are no problems along the way, testing will continue a day and a half until saturday afternoon. until then all other operations at the spill site will be on hold, including the drilling of those relief wells. kelly cobiella cbs news grand isle, louisiana. this morning, president obama reacted to the latest news from the gulf. cbs news senior white house correspondent bill plante has that. >> reporter: the president welcomed the possibility that the new cap could completely cut the flow of oil, but he also seemed to be cautioning people not to get their hopes too high. >> well i think it's important that we don't get ahead of ourselves here. one of the problems with having this camera down there is when the oil stops gushing, everybody feels like we're done and we're not. >> reporter: and the president said that if the new cap can't completely control the well there are ships on the surface that can pump almost all of it

up, 80,000 barrels a day. he said that bp would begin paying fines. that hasn't started yet. he said he would be making a trip to the gulf in the next few weeks. bill plante, cbs news the white house. >> law enforcement officials are asking journalists for interviews they did with people who say they saw missing 7-year-old kyron horman. the little boy vanished from a science fair june 4th. his stepmother said she dropped him off at skyline. kyron's father told the judge he believes she's involved in his disappearance. there's more. he's asking a judge to evict the stepmother from the home. he said she tried to hire someone to kill him. the ruling will be later today. there's extra security around an italian court for an appearance of george clooney. he's a witness against defendants charged using his name for a clothing line.

really work? do they get their point across. >> yeah they get their point across. >> we want to bring early show contributor dr. jennifer hartstein, a child and teen psychologist. yes, they get their point across he says. >> yes, they do get their point across. it does make the kid know exactly what the message is. >> that message really can be harmful. let's take a look at the top three things we should never say to our kids. the first one being, because i said so. also up there with because i'm the mommy. >> this is a tough one. you say it because it ends the conversation. kids are going to hear things like, clearly you don't want to know what i have to say. clearly my input doesn't matter. the fact is this statement alone is a conversation ender. sometimes that's really what you need sometimes. >> what you need. >> what you need. you might want to think how to say it differently. look, i understand that's what you want. the answer is no.

let's move on and be done. >> end of discussion as opposed to as i said so. i can work with that. number two here what were you thinking? >> we have all heard this. how many times have we heard this. that capacity operated, how could you do that, what were you thinking? what kids are going to hear is what's wrong with you? how dumb are you going to be? the fact is you are going to make mistakes. kids are in the moment. teenagers are especially in the moment. they don't know what they are thinking. you're not going to get an answer that's satisfactory. you really want to say this seems like a really irresponsible or bad choice. can we talk about why you made that choice so i can understand it. you're going to have dialogue then, not really low, turned in i'm not going to talk to you teens. >> which is really half the battle at that age. i want to talk to you in a second. the third phrase never to say is what do you know? you're just a kid.

>> i know more. i'm a parent. if you think about that without it being you, you're going to realize how harsh that is to say to your kid. your kid is maybe i don't know anything. maybe i don't have anything to offer. maybe imreally dumb. the fact is think about all the things kids today know more than their parents. >> anything technological. >> internet, text messaging. you need your kids. you can't pick and choose when that's going to be. you want to validate they have something to bring to the table. >> keep that dialogue open. the number two phrase saying what were you thinking? these come into play when you are wanting a discussion with your teen or preteen because it's a sensitive age, tough to get it out of them. what are tips bringing them out? >> you want to be aware of what their needs are. you want to listen first and talk second. we're so quick to jump in and solve the problem and fix it that sometimes we miss what they are really trying to say and we

overtalk. stop and listen first. you want to also be firm and clear with what your limits are but warm and accepting of maybe some negotiation, understanding where they are coming from and really validate their feelings. >> when you say, too, the listening part. how important is it to say i'm looking you in the eye. i need you to listen to me and then i'll listen to you. does that really help? >> yes it does. you need to give your kids your undivided attention. all the stuff now with all our technology, we're not paying attention. your kids are missing out on the best moments of you. you need to stop and make the time. if they come and say, hey, mom, can i talk to you for a second and you say give my five minutes. go find them in five minutes and talk to them or stop what you're doing because that's a great moment. >> if you're texting put the blackberry down. thank you for being with us. i noted the three phrases. i'm going to do my best because you said so. big brother saboteur the

sixteen days into the new fiscal year, and still no budget from the stat good morning. it's 8:25. in the headlines this morning, it is 16 days into the new fiscal year and still no budget from the state legislature. the assembly speaker says democrats and republicans are about $7 billion apart in negotiations. there is a hearing today on how to pay state workers without a budget. oakland police hope to get help identifying 15 people in photographs or -- or people in 15 photographs. they are pictures taken last thursday night during the looting and rioting in downtown oakland following the involuntary manslaughter conviction of johannes mehserle. there is $1,000 reward for helping in identifying those suspects. at 10:00 this morning, apple is holding a news conference to address this week's speculation about a potential recall. that's after users of iphone 4 have been complaining that when

they hold the phone a certain way, calls are dropped. traffic and weather right after this.

avenue. northbound 880 still not looking too good either of in those northbound lanes as you heard up past the coliseum. they were able to get that broadway exit though re-opened because there was late running roadwork towards downtown. and just got word of this new crash in marin. southbound 101 in san rafael approaching lincoln. there was a two-car crash, glass all over the road. once you get past there, closer to the 580 interchange, traffic is moving okay. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. our forecast, boy , looking pretty good. looking from our mount vaca cam, we have plenty of sunshine there. and we also got plenty of sunshine around the bay area today. high temperatures 100 degrees inland, mid-70s around the bay with a mix of sun and clouds. and the lower 60s along the coast. we'll continue to sizzle inland through the weekend, with cooler lower temperatures next week.

[ applause ] >> i think everybody is doing well because you're here. >> i wrote that song in new york city about 25 years ago or more. >> and it holds up beautifully. so what was it that inspired you, because these are, as we mentioned, 12 fan favorites on your cd. you wanted to give them new life? >> i think it's a little bit like buying your wife a new dress. it looks a million dollars. it keeps everything alive and fresh. >> how is it different. because you're on now with the philharmonic orchestra. how is different from a band? >> you can't improvise with an orchestra. with a small band you can change things as you do it.

you have to forewarn and write it down. they are pretty adaptable. >> i would think you don't like to be confined by that because you're innovating and trying new things. >> that's what we do. surprise and novelty are the keys to music. you need to surprise every eight bars. >> you have six kids. a couple have followed you into the music world. did you encourage that or maybe this isn't the best career? >> i encouraged them to practice and to believe music is its own reward. you don't need to be successful. you can play to three people the cat or the dog. >> so many people look to you as an inspiration. clearly you are an icon. when you look at new music out there today, is there anything that really speaks to you or stands out to you? >> yeah my kids. >> that's a great answer. >> my kids. they are great. >> when you think about what's next, or i should say how often do you think about what's next? >> constantly. i have no idea what's next.

i have no idea what i'm doing. >> where do you do your best thinking? >> my best thinking is when i'm walking in central park. >> an englishman walking in new york. so as you're walking there through the park through new york city, where do you take your inspiration from? is it the seasons, the people on the street music you hear in the park? >> i can read a book or see a movie or a story someone tells me in a bar. you see people's faces, they have a story. i'm looking for stories the whole time. >> and you found quite a number of them. i know all different types of music are obviously important to you. you have listened to classical music from a young age, as i understand it. is there something that stood out for you, as a child, that really drew you into music even if you did come to it later in life. >> i think the first classical piece i heard was my mother playing beethoven's moonlight

kohara, with your c-b-s five headlines... it is 8:55. good morning, everyone. i'm sydnie kohara with your cbs 5 news headlines. oakland police hope to get help identifying people in 15 photographs. these are pictures taken last thursday night during the looting and rioting in downtown oakland following the involuntary manslaughter conviction of johannes mehserle. there is a $1,000 reward for those who help identify these suspects. more than 80 firefighters have filed a federal labor lawsuit against the menlo park fire protection district. the suit contends they should get overtime for time they spent on work-related tasks before their shifts begin. those tasks include going to other fire station to pick up uniforms and equipment. and in just about an hour, apple will be holding a news conference to address this week's speculation about a potential recall. that's after users of the iphone 4 have been complaining

that when they hold the phone a certain way, calls are dropped. traffic and weather right after this.

good fright morning. first new accident westbound 580 approaching north livermore. traffic is beginning to back up and this is still slow in oakland on northbound 880. the coliseum is there off to the right side of your screen. and it just remains stop and go

like this into downtown oakland. westbound highway 4 is a hotspot most of the morning. we had an earlier crash. that's long since cleared but just really jammed coming off the antioch bridge, remains sluggish towards pittsburg. they did clear that earlier accident in san rafael southbound 101 at lincoln. so just looking better through that area and across the span of the golden gate bridge, despite some fog it looks good in all lanes. that's your traffic. for your friday forecast, here's tracy. >> best part of the whole forecast, it's friday! boy, we have some fog to contend with this morning at the coast and well into the bay. how will that impact your forecast? more importantly, your temperatures? well, let's take a look. lower 60s at the coastline today, mid-70s at the bay and up to 100 degrees inland. yeah, that fog will not in any way change the temperatures well inland. still hot over the weekend with temperatures cooling down a bit next week.
