right now at 11:00, it is coming down hard in some places. storm ranger tracking the rain as it falls across the bay area and the storm is also moving toward the sierra. let's spring down, you can see all the slick roads, what it looked like on third street in san francisco just a couple of hours ago. you can see steady rain falling there. you can see rain drops as the storm starts to move east. is the wet weather going to stick around all weekend? >> we are seeing heavy pockets

coming down. for anybody who needs to be out and about, keep this in mind. here is what our storm ranger is picking up. we have some lightning strikes moving in through modesto, the sierra as well. a tricky commute to the sierra. we have dangerous conditions in there through. but i want to turn your attention. if you look at the key, light to heavy. we are picking up heavy pockets along 280 right now. if i kind of zoom this in closer toward fremont down to the south bay and the santa cruz mountains we have a decent cell moving in. we have a good amount of rain expected to push through. within the next hour or so. headed in toward the sierra. we have a lot of snow expected to come down. a warning is in effect that will remain in place all the way through sunday, this is a colder system which is the reason why we are also seeing the instability. that could bring more thunderstorm activity tonight

mitchell. >> reporter: oakland's next chief. mayor sheng thao announced it friday morning. >> he is a strong leader, a smart crime fighter and more so than that, delivers results. >> reporter: mitchell said in a statement he looks forward to working with residents, businesses, city leadership, and the police commission to build a stronger and safer oakland. he still has to clear certain state requirements including a test. >> he has not taken the test quite yet. we wanted to make sure the community knows this is oakland's next chief. >> reporter: it follows more than a year of no permanent chief after the mayor fired chief armstrong weeks after the department would have completed its federal oversight program after 20 years. it is still under that oversight and has had 12 police chiefs in the past two decades including ann kirkpatrick. >> he has the judge, the officers, everybody is not online. and that will be something we

have to bridge very quickly. >> reporter: her advice, make himself available. >> come to the table with being a peacemaker and he will do well. >> reporter: mitchell comes to the east bay after four years. when i asked him to describe the union's relationship with the chief, he said it had its ups and downs. mitchell resigned as chief last september and a reason was never disclosed. texas department surveys show criticism over his leadership with more than 50% of respondents who felt mitchell was out of touch with the needs of their departments. other calls of concerns says mitchell's military background and former policies. >> we know folk that's come to law enforcement from the military come with a lot of stress and trauma that gets compounded by going from being in the military to being in the police department.

a lot of times that shows up as violence. >> reporter: the local chapter welcome it is new chief. they want him to tackle public safety first. >> he will do the job and we'll be happy. >> reporter: gia vang, nbc bay area news. >> former opd chief armstrong who filed a wrongful lawsuit against oakland announced a statement welcoming the new chief saying quote i send my best wishes to floyd mitchell and offer any assistance he may desire. this is my hometown, i want everyone safe and i will do everything in my power now as a private citizen to assist in that goal. let's take you to the south bay, we know who will temporarily replace the san jose police chief anthony mata. he is retiring at the end of the month. he has been with the department nearly three decades. this is the man that is going to be replacing him at least

for now. acting as appointed acting chief. former assistant chief paul joseph. he has been with the department for 30 years. he has picked a consulting firm. once candidates are finalized, the city council will confirm its new top cop. well, just in tonight, the federal government has entered a partial shutdown after congress failed to pass the government funding package earlier. the house voted this morning to pass the $1.2 trillion spending bill. it would fund the departments of state, defense, labor, and homeland security along with a bunch of others but the senate was unable to pass it before the deadline this evening. shutdown expected to be brief, though, senate leaders say they are close to a deal and will vote on the bill early tomorrow morning. the president says he will sign it into law. royal watchers are still reeling tonight after a stunning announcement from kate middleton, the princess of wales earlier today. after months of no public

appearances, the 42-year-old mother of three announced she is undergoing cancer treatment. >> it has been an incredibly tough couple of months for our entire family but i have had a fantastic medical team. >> the princess revealing her health struggle in a video message released by the palace. the future queen of england says after having abdominal surgery in january, doctors found cancer had been present. kate says she is now undergoing chemotherapy. she also explained her silence saying it took time to explain the diagnosis to her children. we spoke to dr. manana, an oncologist at ucsf. she says kate's announcement is an importance of the reminder of screenings. >> if a royal with access to health care, with privilege in the world as she is, can get cancer, any of us can. >> kate has not specified what type of cancer she has or what stage it is. the princess did thank the public for its support and

asked for time, space, and privacy while she completes her treatments. well, miss israel is in san francisco this evening and she was met with protesters. wet weather didn't stop the people's pageant. they carried signs carrying banners. demonstrators say they are in sup pert of the people of gaza and condemn what they say is the antipalestinian rhetoric on social media. okay, look at this photo. check it out. do you know this man? police in santa rosa ask you help to find him. they said he robbed the chase bank at sonoma avenue wednesday. the teller gave him an unknown amount of money and he took off. okay, they are getting good reviews despite a growing debate. we are talking about the new

toll lanes on highway 101 on the peninsula. the express lanes are touted as a way to reduce traffic and encourage car pooling but some say the fast lines are helpful. but others say it is unfair having to pay an extra $20 a month to cruise the lanes. and there is another issue, too. toll cheaters who use the lanes when they shouldn't. transportation leaders say they might get some help on that soon. >> the mtc is conducting a pilot program with an app that helps determine the occupancy of a vehicle. and you know, we are very eager to see if that pilot is successful. >> now in the meantime, transportation leaders say they have to rely on the chp to catch cheaters. solo drivers are allowed to use the lane along with car poolers of three people or more. march madness is here and we have a couple of home teams representing the bay area in

both the men's and women's ncaa tournament. that include it is stanford women's basketball team. fans on the farm are celebrating after the cardinal defeated the norfolk state spartans. jocelyn moran was there. >> we have an amazing team down the road. they are so good an easy to root for. it is march madness. this is one of the best sporting vents in the country. >> reporter: the stanford women's basketball team advances to the second round of ncaa tournament. the cardinal beat the norfolk state spartans by 29 points. though the beginning of the game had fans feeling a little nervous. >> they looked a little sloppy at the beginning like maybe they are nervous. >> reporter: but for the rest of the game, they were pretty much in control. kiki and cameron led the team with 17 points each. players that young fans can look up to. raina and angela are in the

eighth grade and play basketball. >> it was really fun. and seeing stanford play is really cool. >> i always come here to watch the games and they never disappoint me. >> reporter: it has been a historic season for the women on this team. the head coach became the coach with the most wins in college basketball history and cameron was just named to the ap women's basketball all american first team this week. adding to her list of honors. so, fans have a good feeling about this tournament. >> how far do you think you will make it? >> all the way. >> good confidence? >> you got to believe. >> reporter: sunday, the cardinal will face iowa state as they try to get that second round redemption. at stanford, jocelyn moran, nbc bay area news. >> heavy rain coming down for this evening commute as the cold front passes through. the winds have diminished but there will be a break. there will be timing, totals,

it shows a bay area police officer shooting an armed man in the back. but whether it was justified or a bad shooting is not as clear. senior investigative reporter bigad shaban takes a closer look. >> hands up. drop the gun, drop the gun, drop the gun. drop the gun. i'll shoot you! >> reporter: a napa county sheriff's deputy warned he would open fire and less than two seconds later, he did. hitting an 18-year-old man in the back. who law enforcement accused of running through this vallejo neighborhood armed with a gun. >> it was about 20 police cars around here, man. >> reporter: kenneth penn has lived in the area for 34 years and says that chaos back in january all started with a car chase. the man ultimately shot was riding with someone else when police tried pulling them over for a traffic violation. but they didn't stop. and instead, drove through this neighborhood and crashed into a fence. that's when security cameras on the block caught one of the men trying to get away on foot.

>> the police are doing their job trying to apprehend the guy and they did. but i wish they would have just caught him without shooting him of course. >> reporter: the man survived and has since pled guilty to a number of charges including the illegal possession of a gun. but in watching the video, penn says he is torn on whether the deputy was justified in shooting the man in the back. we reviewed the napa county sheriff's office's own policies and found the use of deadly force is allowed when deputies fear for their safety. or that of the public. >> he had a gun in his hand. i don't know what the policeman was thinking. maybe he was fearing for his life. >> this comes down to a decision made in a matter of miliseconds. >> reporter: mike milinger is a former police officer and analyst. he believes the deputy had every reason to shoot. >> you are in a residential neighborhood and it appears to me the suspect is running directly toward someone's house. and, if that subject were to get into the house, you have a

hostage barricade situation. you had people that are injured. shot. >> reporter: but cody salvin, a former firearms instructor who works as a defense attorney argues the shooting didn't have to happen. and says the suspect appears to throw away one gun and then another. just before he is shot. >> the fact someone had actively fleeing from law enforcement doesn't necessarily in and of itself give rise to justification to use deadly force. the fact that someone is armed doesn't necessarily give rise to the officer's use of deadly force. we have to look at the totality of the circumstances. >> reporter: the napa county sheriff's office says it is still investigating. i'm bigad shaban. >> if you have a story for bigad shaban, you can call 888- 996-tips or visit our website, nbc bay area.com/investigations. a high school substitute teacher is among six men arrested for trying to have sex

with underaged children. investigation was part of a sting in contra costa county back in february. for five days, officers posed as children to try and find sexual predators online. authorities say 37-year-old joseph martinez, a substitute english teacher at hayward's tennison high engaged with officers he thought were 13- year-old girls. >> this is a really good time for parents to talk to their kids about smartphone usage. about how to stay safe on the internet. it is important for parents to educate their kids to learn more about these platforms to keep them as safe as possible. >> the school district says once it heard about martinez's arrest, he was fired. investigators say they found child porn on electronic devices of several of those men arrested along with martinez. a fremont restaurant reopened today after thieves

broke in and stole their safe and cash. this is what the owner says she saw when she walked in yesterday morning. window of the door was shattered. pieces of glass everywhere. safe full of money, cash register, a box of blank checks all gone. customers say they are heartbroken for the owner of skillet's and want to support them however they can. >> i come here every morning. these people become your family. so when your family gets broken into, it hurts. and when your family hurts, you want to be there for them as much as you can. >> it just hurts to know that somebody would come in and do something like this. because they really care about their community. >> owner says she appreciates the community showing up for them and is looking forward to restaurant week which kicked off this evening. all right, new financial relief for some bay area counties impacted by last month's powerful storms. today, governor newsom expanded the state of emergency to 11 counties across california including san francisco, alameda, sonoma, and santa cruz

counties. they requested a presidential major disaster declaration that will make federal funding available to help communities affected by widespread flooding and landslides. caltrans will also get money for repairs and they will need it more because we are continuing to get this wet weather. we certainly are. and we are seeing a lot of it coming downright now. just as the model runs show the heaviest of the rain moving through the evening, but we will catch some breaks and i want to show you where the wind speeds are right now. because as that cold front swept through, we saw the winds gusting. now we are seeing that has definitely backed off. changed directions. we had winds from the south. now we are seeing winds from the northwest, nice and calm there. temperatures in the 50s but i want to show you satellite radar as well. let's get right to that micro climate forecast where i can show you where the center of the low is. we have the nice rotation here. and yes, that is lightning stretching into parts of sacramento and the lake tahoe area. let's use our doppler radar to

get a closer look at where the heavier rain is now. i will zoom this in closer. parts of fremont as well. we are seeing the widespread white to moderate. stretching into gilroy. if you had plans to travel to the sierra, hold off please, look at how heavy the rain is now. not only that, but we are also seeing lightning strikes. so that instability will continue. we will see a chance for thunderstorms. not only for tonight, but also tomorrow. there is a winter storm warning all through sunday morning. we are talking about the possibility of two to three feet for the higher ridges but the snow levels drop lower heading into saturday night especially. when is the break? if you notice overnight, this is around 2:00 a.m., the next

hour-and-a-half or so, we will catch a brief break. by 6:00 a.m., we get a line of showers that pushes through. and that sort of continues on and off scattered through about 10:00, 11:00. then we get the trough behind it by around 1:00, 2:00. it becomes much more widespread. that is going to continue and linger into saturday evening and into early sunday morning as well. so even though the winds have tamed, i want to give you a look at the totals, notice a lot of the major red zones are in the coastal areas and the coastal mountains. and that is really taking it all the way not only through friday, but also in through parts of sunday as well. for tomorrow, we will only be in the 50s and the 60s because it is a colder storm. we are going to see only daytime highs. about 61 degrees. that chance for thunderstorms on sunday. on sunday, about 6:00, 7:00 at night. we will see that diminish so the evening plans should be okay. but the cooldown will be felt.

closer look at united airlines after that series of mechanical issues involving its boeing jets. in a memo to employees, united said federal investigators will be on site to review its work procedures. the manuals and its facilities. this comes after several incidents just this month including an external panel that blew off a flight. that plane landed and no one was hurt. all right, you may remember earlier this month, one of united boeing's planes headed to japan, lost its tire after taking off from sfo. it was diverted to los angeles where it safely landed. united says it welcomes engagement from the faa as it works to assure customers that its planes are safe. forget about being a millionaire. how does being a billionaire sound to you? no winner in tonight's 977 million-dollar megamillions drawing. no one has won the game's jackpot since december 8th. so now it sits at $1.1 billion.

well as the warriors. let's start with the dubs. they were at home hosting the indiana pacers warriors started strong taking a lead into the locker room at the half. but then in the third quarter, the pacers ran away with the game outscoring golden state by 15 points. indiana went onto win 123-111. the warriors' next game is sunday against the minnesota timberwolves. switching to college basketball as we told you earlier, the stanford women's basketball team had a first round ncaa tournament game at home against norfolk state. that game was never in doubt as the cardinals beat the spartans 79-50. stanford's next game is sunday against iowa state. it is not what bay area fans want to hear, but the gales of saint mary lost to grand canyon. the antelopes blew the game wide open in the second half. saint mary's finishes the season with a record of 26
