right now at 11:00, could he get a new trial? scott peterson is back in court and back in the headlines. we are hearing from his former defense attorney. >> i am cautiously optimistic that no one knew the evidence better than i did and i will tell you there was nothing that i thought was compelling, let alone beyond a reasonable doubt. max got peterson appeared virtually today. his new attorneys are hoping to uncover different evidence, new evidence that they say could prove he did not kill his wife and their unborn child. >> this story has gripped the bay area for 20 years and now, a new chapter in the saga. joslin joins us now. he represented peterson in 2004. >> reporter: he is paying

attention. he says he's helpful that this could break the case. scott peterson has maintained his in his hands and the l.a. in his's project is trying to access evidence like a mattress recovered near his home. today's hearing shows a lot of work to be done to us. all eyes are back on scott peterson 20 years after he was convicted of murdering his wife and their unborn son. the county courtroom had scott peterson appearing from prison in his status hearing. >> can you see and hear the proceedings, sir? >> reporter: insert the court room where his attorneys with the los angeles innocence project. they want to review evidence that did not make it into court. we spoke with the attorney who represented got peterson in his 2000 for trial. he says he's cautiously optimistic.

>> i'm also a little bit angry. it's true -- if it's true that the police, meaning the d.a.s office, modesto pd, were sitting on some of the evidence and did not turn it over. >> the l.a. innocence project focuses on a house where a burglary took place and a burned-out fan with a stained mattress in modesto the morning after lacey disappeared in december of 2002. >> i've been waiting 20 years to find some of these police report and audio recordings and video recordings. >> reporter: attorneys want the mattress tested for dna and they think it could make the difference. >> if the van, if the dna is reserved, if the dna has not degraded, if the dna is still available to be tested, that, to me, is game changing but game over. >> reporter: the los angeles

innocence budget director said they filed motions in january asked the court to order further discovery of evidence of allowed new dna testing to support the investigation into peterson's claim of innocence. the hearing today was the first step in a long process. prosecutors disagree and in court argued against motion made by attorneys, saying these are not new issues. >> we also believe a lot of these items have been raised as part of the initial appeal and litigated as part of the first pbs. >> neither prosecutors nor defense made comments after trial. >> the project made a strong showing to the court and i think that's why you saw the court that involved and they both sides need to get to work. >> the judge said the next the hearing were the 16th on the 29th and pointed out that the innocence project wants an order. >> they want their filings under seal so it's not available to the public in

. police in nevada were saying it now what they originally feared, but members of the mosque are all rattled. >> reporter: last night, a man who is wanted on another matter was walking by the islamic center. he was invited in to learn about ramadan, but the piece of the celebration was shattered. >> one of our congregation members notice he had a firearm bag and you can see at and due to some of the things we've seen in the world, in mosques and other places of worship, he was concerned that something might happen. >> zachary says the member tried to grab the bag when the suspect turned violent. >> he assaulted one of our congregation members, punched in , pepper sprayed him, and fled.

police say has a prior felony conviction, is in jail, held on a quarter million dollars bond. nbc bay area news. disruptive and dangerous, light rail stations across south they are at risk because of thieves ripping off copper wire. the sheriff's office is this an uptick of theft. two dozen, so far, this year. there's been $500 in damage so far. deputies arrested two in connection with copper wire theft. the sheriff's office is the theft interrupt train operations and can disable warning light. >> we are noticing the last couple of trends, it's occurring during daylight hours , so these bad actors are getting more brave and actually stealing in broad daylight.

oakland city leaders are plotting new numbers, released by the governor's office about the ongoing crime crackdown. the chp made aggressive recoveries, of stolen cars is part of the undercover sting operation. the suspects connected to gangs, organized crime and carjacking. city council hopes the increase in support continues. >> we need that relationship to keep going because we continue to have the robberies, the assaults, and we need all the help we can get. >> the mayor's office on the released numbers that show a decrease in crime around oakland, compared to last year, including a decrease in auto burglaries in the downtown area. >> cracking down on retail

theft, high on the to do list. we know it's a problem across the bay area. our partners got exclusive access is a targeted organized crime rings that steal merchandise and sell it online. here's courtney reagan. a convoy of law enforcement is about to descend on an unlikely place, a mansion in san diego county, complete with its own vineyard and chapel. police believe is also the headquarters for a lucrative theft ring that steals items from retailers and resell them on amazon. as we pull up, authorities say they have the suspected ringleader in handcuffs. her name is michelle mack and she is accused of giving a dozen women across the country a list of stores and merchandise to target. these products then end up on an amazon digital storefront at deep discounts.
