. right now at 11:00, the scott peterson murder case returns to court 20 years after his conviction. peterson appeared virtually in front of a judge just hours ago. the newly discovered evidence the los angeles innocence

project says supports peterson's claim of innocence. but first we begin with breaking news in the east bay. officials asking everyone to avoid the pacheco boulevard near plaza drive exit in martinez. this is due to a hazmat situation. we understand they're trying to identify something close to the scene. you see emergency personnel there. avoid that area because the road is closed in both directions. this is very close to the city's water treatment plant. we don't know the cause of the incident. of course you can continue to follow us both on air and online for the very latest. also want to say good morning to you and thanks so much for joining us for our midday newscast. i'm laura garcia. >> and i'm marcus washington. well, in the last few hours scott peterson appeared in a san mateo courthouse via zoom for a status hearing regarding the los angeles innocence project's request to review his case. >> nbc bay area's kris sanchez

was in the courtroom. she joins us now with a look at what happens next. >> reporter: hi there. so the hearing lasted just about one hour. there were three different motions at play. scott peterson appeared virtually from mule creek state prison. he was dressed in those prison blues. he was there via zoom. the attorneys for the los angeles innocence project were there as well as the stanislaus county district attorney's office. appearing before the san mateo county judge. the hearing was to set a schedule for three different motions. both sides will return to court on april 16th before the judge to determine whether discovery and dnaed. s there's another hearing in may to decide what's next for the additional dna and dna testing that the defense is asking for. and on july 15th the judge will make decisions about all non-dna evidence that the l.a. innocence project is asking for from the stanislaus county district attorney's office and law enforcement. the innocence project says that they requested information back

in november from the district attorney's office and they say it was just taking too long. for their part the d.a.'s office says they have not been told who of the witnesses -- who any of the witnesses are, the new ones. the l.a. innocence project says there's a reason that their names should not be made public. >> the identity of the witnesses whose names are redacted in the separation sentence mr. harris is referring to have stated that they are fearful of retaliation by the modesto police department if their names become known and have asked that their names remain sealed. >> peterson's brother and sister-in-law were in court with the l.a. innocence project attorneys, who took up peterson's case based on evidence they say was not presented in that initial trial. in their filing that includes photos of a burned-out van found near the petersons' modesto home around the timelacy peterson disappeared, which they say

could mean that laci peterson was live after scott peterson left home to go fishing. that was part of his alg bye. scott peterson's next three appearances will be via zoom and we can tell you the district attorney's office did not answer any questions. the l.a. innocence project only answered one and that was is this taking too long. and the answer was a simple yes. in redwood city kris sanchez, nbc bay area news. >> it will be interesting to continue to follow. thank you, kris. well, the governor's office is out with new numbers in the ongoing chp crackdown on crime in the east bay. primarily oakland. added officers in recent sting operations are being credited for 168 arrests in recent weeks and the recovery of 360 stolen vehicles. the rest are said to be tied to gangs, organized crime and carjacking rings. 16 guns were also recovered. and police are now saying a second arrest, this is in connection with the deadly shooting of a south bay tattoo artist. investigators are now charging

gerald williams with homicide-related charges. jose luis rodriguez die february 29th. police found his body inside of a car parked outside of park lane lounge. this is on moorpark avenue in san jose. another suspect, denzel brown, was expected to be in front of a judge earlier this morning for a hearing to revoke his parole. we are still awaiting to hear what happened in the courtroom. in contra costa county one woman is behind bars after she allegedly stole a car with a 2-year-old child inside. >> nbc bay area's bob riddell explains cell phone technology actually helped lead to her arrest. >> reporter: the suspect, the stolen car, most importantly the child were located through a stolen cell phone. this crime was krafrmted on surveillance camera video. you can see this happened yesterday afternoon around 1:30 along california avenue in san pablo. as you see in this video the suspect was getting in the driver's seat of the car she stole. it's not clear if she knew the 2-year-old child was also inside the vehicle. the car belongs to the mother of

the child, who told us off camera that she left the driver's door open and the car running so she could quickly drop off something at her mom's house. police located the stolen car within 20 minutes in the city of richmond. >> incredibly unnerving and we're extremely thankful that in this particular incident, you know, the child wasn't harmed. >> reporter: as you heard, the child was unharmed and reunited with her family. the suspect, 35-year-old joy taueshs, she allegedly stole the victim's cell phone which helped police locate her. she's now booked in jail in contra costa county facing vehicle theft and kidnapping charges. bob redell, nbc bay area news. >> thank you, bob. well, a new report card is out grading assisted driving systems for major carmakers. let's just say there is still a lot of work to be done. >> nbc bay area. ginger, what should anyone in the market looking for an autopilot system know?

>> we're told they should really do their homework and check out findings from the u.s. insurance institute for highway safety. that report tested 14 systems and found when it comes to tesla's autopilot system and other assisted driving systems there is no evidence of it providing real world safety benefits. now, of the 14 only one earns an acceptable rating. two are rated marginal. and 11 are rated poor iihs president david harkey says, "most of them don't include adequate measures to prevent misuse and keep drivers from losing focus on what's happening on the road. the president of another road safety advocacy group says the u.s. department of transportation needs to set minimum standards to ensure driver and passenger safety. >> the new iihs report sheds a critical light on the inadequacies of some of the advanced driver assistance systems. we weren't particularly surprised, considering there are no minimum federal safety

standards. so auto makers can put any systems that they want in the cars. >> well, the iihs looked at systems from bmw, ford, gm, genesis, lexus, mercedes-benz, nissan, tesla and volvo. here are the areas they looked at. meanwhile, here are what the marks look like for tesla's autopilot system for its 2021 to 2023 model 3. the overall rating is poor, as is driver monitoring, attention reminders, acc resume, et cetera. it received more positive marks for emergency procedures and lane change. now, while these results are worrying, the silver lining we're told is in easy and quick fixes that can be made sometimes as easy as a software upgrade. guys, back to you. >> all right. ginger, thank you. speaking of cars, new at 11:00 for you, new finding from the "new york times" indicate that the bay area is leading the way when it comes to new drivers of electric vehicles. the paper indicates that the evs accounted for nearly 40% of new

auto registrations in san jose area last year. in san francisco that number was about 34%. and according to the paper, that is the highest anywhere among major u.s. cities. for comparison for you, evs accounted for nearly 10% of new registrations in new york area and 3% in detroit. california still has a way to go to ensure women are getting equal pay in the workplace. that's a takeaway from an announcement this morning by first partner jennifer siebel newsom. she's been involved with efforts to close the pay gap and foster more diversity in large corporations. it is part of the state's equal pay pledge. today siebel newsom says the state has made, quote, serious progress. but she says the gender pay gap is still an issue. data shows in california women on average make only 89 cents to every dollar that men make. the numbers get worse for latinas and black women. >> keep in mind that as a

breadwinner or co-bred winner in most households financial insecurity also hurts our community and the economy. and that continues far beyond a woman's working years. >> she points out most women retirees have only 70% of what men have saved for retirement. despite usually living longer than men. siebel newsom also announced her non-profit the california partners project has developed a free resource guide for companies to help develop strategies that can close the pay gap. turning now to decision 2024, vermont senator bernie sanders is put his support behind san francisco supervisor dean preston. this comes amid preston's re-election campaign. in a post on x senatorerved as member of the city's board of supervisors since 2019.

preston's opponent, mahmoud, is a technology entrepreneu and huf residents in lafayette have power again. this is after a large tree fell overnight. but the headache is not completely over. yeah, it happened around 10:00 last night on spring hill road. this is near pleasant hill road. most of that tree is gone at this point but spring hill near marino road remains blocked and there is no eta for the debris to be cleared. nearly 300,000 customers lost power during the peak of that outage. that tree also damaged a jeep. witnesses also say that a second car was also damaged. let's take a peek outside this midday overlooking san jose. kind of a cloudy start. a little drizzly this morning. vianey is here with a look at our forecast. things going to clear up from here? ? they are. they're going to improve. we have a couple of showers left as far as radar goes and temperatures are also going to change but i think you're going to enjoy it and it's going to be for the better. let's take a look at some of our live cameras in san jose, oakland and -- is that a bird on

well, the former special counsel who investigated president biden's retention of classified documents testified before congress this morning. >> both sides certainly frustrated we know with robert hur. republicans don't like that he didn't press charges. democrats don't like why. >> that's exactly right. good summary. hard for him to find a friend in the house judiciary committee this morning. to remind you, robert hur, a republican, was assigned by donald -- by the department of justice to investigate why joe biden kept some classified documents after leaving the job of vice president. key points the investigation found, biden did keep classified documents. we don't know if that was by accident or intention.

but we also know he realized he at some point had classified documents because he's on tape mentioning it to his ghostwriter. but prosecutor robert hur in his report said the evidence did not rise to the court's standard of beyond a reasonable doubt. compounding that, hur thought if biden were put on trial the prosecution would lose because the jury would find biden to be a kindly, well-meaning elderly man with memory problems. so when that report came out with those words, democrats were furious about the description. republicans were disappointed biden wasn't prosecuted. so a lot of this morning's questioning was republicans trying to parse the report that doesn't charge biden. but was there a crime in the end? >> but that doesn't have anything to do with the actual elements of the crime. that has to do with getting a conviction at trial. correct? >> well, congressman, part and parcel of a prosecutor's

judgment as to whether or not a conviction is the probable outcome at trial is assessing how the evidence identified during the investigation lines up with the elements and what proof can be offered to a jury during a trial. >> sure. but his well-meaning elderly old man has nothing to do with the underlying elements of the crime. >> well, it certainly has -- >> presentation to the jury. >> it certainly has -- >> yield back. >> the gentleman can respond. >> it certainly has something to do with the way a jury is going to perceive and receive and consider and make conclusions based on evidence at trial, congressman. >> now, as you well know, former president trump is being prosecuted for retaining classified documents, and that has republicans saying no fair. >> but the thing about that from my understanding, those two have a lot of differences. >> there are a lot of differences. trump said he didn't have the documents repeatedly until a search warrant found them in boxes at his home, some of which according to witnesses and a videotape were moved shortly before that warrant was served. one legal analyst kind of

compared it to a library book. you know, one person found a library book. perhaps he had forgotten about because he was old and forgetful and returned it to the library. but having the library call and say we know you have the book, no, i don't, and then moving it from the bookshelf, that's a different level of intent. >> interesting. thank you very much, scott. well, happening today, san francisco's supervisors will consider a resolution supporting a state proposal to track the presence of opioids in wastewater. it's part of an effort to understand the flow of narcotics into communities and reducing overdoses from drugs including fentanyl. san francisco and marin already are experimenting with a similar strategy. an embattled school district picks up its search for a new superintendent tonight v tonight. two members of the sunol glen school board facing a recall after voting last year to ban the flying of a pride flag on campus. superintendent moll yeen barnes was the only trustee to vote

against the ban but last night she announced she was retiring citing stress tied to the district controversies. recall supporters are planning to attend tonight's board meeting. berkeley leaders today will vote on a resolution urging state regulators to halt cutting the cord on all land line services. the company's requesting to discontinue its obligation as the state's default land line provider citing little demand for land line services. state law requires at&t to provide voice communications for anyone who wants or needs it in their service area. opponents argue cell service in some places is spotty at best. a group of california house lawmakers recently asked the cpuc to put its foot down, arguing the change could threaten public safety. all right. let's take a look at what's happening outside. i know we started out this morning with some rain. is it still going on right now? >> well, we had some scattered activity, but it's definitely moved its way out for the most part of the bay area. so that cold front that we're going to see sweep through is now going to pack a punch with

the winds. but let's show you what it looks like right now. live look at san jose. 59 degrees. sure, we have some cloud cover. but that rain that fell this morning, trace amounts really in through parts of the city. we've got some clouds but peeks of sunshine at times. 57 degrees right now. and let's show you what our storm ranger is scanning. our mobile doppler radar is still showing some areas of some light rain in through the east bay, but also of course that tahoe stretch. so check the travel conditions. there is a winter weather advisory for certain parts of the sierra because of the gusty winds even though we're not expecting heavy accumulations, a combination of some snow paired with some gusty winds could make for difficult travel. i do want to take you through the timing of this. look at your hour-by-hour forecast. this is at around 9:30 tonight. by 9:30 all of the rain will pretty much have made its exit at that point. but we will see cloud cover left behind into early tomorrow morning as well. some areas of fog expected in through the early morning hours. and then watch what happens in that time stamp.

this is around 11:00 a.m. fast forward to about wednesday afternoon, thursday. these are clear conditions from our model runs and that's exactly what we're seeing. as far as your wind speeds go, santa rosa, san francisco we're talking 30 plus, but also stretching down through san jose for this evening you'll notice some breezy winds at times out and about today. well, here's a closer look at your daytime highs. we're going to max out in the mid 60s. but around 1:00, 59 degrees in livermore, 60 degrees in fremont. by about 3:00, 3:30 peak temperatures will be in the mid 60s and this is just the beginning of what's going to be a warmer stretch. we're going to see that low pressure system make its exit to the east. and here comes high pressure. this is going to dominate over the entire state of california, keeping us not only dry but also warming us up significantly, especially heading into the weekend. and this brings me to the temperature outlook. this is showing us, look at the key right up there, either above average or well above average over the next ten-day stretch. if you look at california, we're talking above average but also

well above average. so how does that play out into our seven-day forecast? it plays out beautifully. because starting on thursday that warm-up really packs a punch. we're talking 70s for san francisco but also inland areas. mid 70s by the weekend. we could see some upper 70s as we head toward your sunday. >> thanks, vianey. happening now, doctors are expected to reassess steph curry's ankle injury. but coach steve kerr late yesterday said he does not expect curry to play tomorrow against dallas. now, the warriors did just fine without steph curry last night, avenging the weekend loss at home with the spurs. jonathan kuminga actually scored a team high with 22. his big finish put the warriors up by 12. now, late in the game the then rookie tracy jackson davis posterized rookie victor wembanyama. you're talking basketball. i'm talking football.
