learned about banko's final moments. terry mcsweeney. >> still hurts. i can't even, express like that feeling, just to even know my baby is gone. >> reporter: terry brown talking to us with his 4-year-old son tru in the back seat, about the loss of his oldest child, 24-year-old banko. >> kind person, hard worker, loving, caring, genuine person, activist. >> reporter: brown recalls receiving the phone call of the tragedy the evening of april 27th. >> it was unbearable. i didn't believe it. >> reporter: but brown had to believe it when the coroner told him what banko said as he lay dying. >> call my dad and gave my number. that's how they knew he was my child. >> reporter: the video of the

shooting released to the public by district attorney jenkins, brown has not seen it. >> as a father, i can't look at that. you just feel so helpless to even look at something like that, knowing you can't protect your child. >> reporter: even without seeing this video, terry brown does not hesitate saying who he thinks is to blame for the killing. >> the guard. can't hold nobody else responsible but the guard and walgreens for hiring him and letting him do that stuff to civilians. >> reporter: d.a. jenkins says the motive was self-defense. anthony told investigators brown repeatedly told him he had a knife, none was found. brown has thoughts why his transgender son was killed. >> because of the gender, what my son represented. why else would you do a person like that, no arms, not carrying

officers made an arrest in connection with the robbery and they're committed to finding the others as well. a disturbing threat against a bay area congressman, apparently from a former member of the 49ers. eric swolwell posted this message appearing to come from former fullback bruce miller. would you rather guantanamo or execution, and it included the word traitor with an expletive. his family and staff are deeply disturbed and reported the threat to capital police, we reached out to them, have not gotten a response. bruce miller had a troubled tenure with the 49ers. they cut him in 2016 after he was arrested for punching a 70-year-old man at fisherman's wharf. he pled no contest to a misdemeanor domestic violence

charge in 2015. it's unclear if miller was specifically behind the threat, we haven't been able to contact him yet. facing tough questions, antioch's police chief answering the questions about the racist text messages in his department. the teenagers in antioch say they've experienced harassment by cops. more on the investigation and the interviews that began today. >> reporter: police chief dressed down for the occasion, the audience at genesis church. they asked us not to show the youth, but they asked why the officers were still on paid leave and asks who holds officers accountable and more. six or seven raising their hands when asked if they had a negative experience with police. the chief says he understands the anger and is working to

change the department he inherited a year ago. they were among the crowd. >> i felt liberated by the youth talking and asking questions. he did answer some questions but i felt like it was more a lot of repeating himself. i feel like it could have been a little better, but i respect he came out and decided to answer questions. >> i do feel we need to give him that grace, allow him to work on behind the scenes to bring forth the change. we have to start somewhere. >> the two things we're focusing on wholeheartedly, community engagement and making sure we rekindle the relationship with the external public, in particular the young people, the most impressionable and the future. >> reporter: the doj is about to arrive in two weeks to investigate. the external investigation by the state's attorney's office

began yesterday. a close call at a south bay high school, a tip, then a takedown that may have helped prevent a tragedy. police say the school district got a report of someone with a weapon on the campus of willow glen high in san jose. a school resource officer was able to confront the student and tackle him. they confiscated this ghost gun. the high and the nearby middle school were put on lockdown. >> i was eating, they told me to go to my classroom because somebody had a weapon. >> they also had to shelter in place yesterday because of reports of a weapon. the dodgers decision to disinvite a group as an

institution in the lgbtq of san francisco, the sisters of perpetual indulgence, founded in the bay area. you spoke to them. >> i spoke with sister roma from the san francisco chapter. they were all proud of their sisters in l.a. for earning the community hero award but now shocked and worried about the impact this announcement could have on the lgbtq plus communities. the sisters of perpetual indulgence, a worldwide nonprofit with roots in san francisco. >> i was so disappointed and shocked that they would cave so quickly. >> reporter: tonight a sister is speaking out after this major announcement, the dodgers are dropping the sisters from pride night and its list of honorees, due to quote, the strong feelings of people who have been offended by the sisters.

>> none of these people know or care to know who the sisters are. >> reporter: this is days after senator marco rubio sent this letter, asking if the league wanted to be welcoming to cristians. if so, why is he allowing an mlb team to honor a group that insults them. stressing like lewd catholic nunns. >> we do a lot of the work that religious nunns do for their parish, except we go into the community and work with the community. >> reporter: the hope for the sisters is for the l.a. dodgers to reconsider. >> the dodgers have a lot of fans, queer fans, transgender fans, also a lot of cis white male/female fans. for their favorite sports team to support the queer community sends a great message and has a

chance to unify people. >> reporter: until that happens, they're looking ahead to oracle park, planning a special night in memory of a legendary drag performer. >> they're going to make it a special night for the community. >> pride night at dodger stadium is scheduled for june 16th. in san francisco, giants pride night is june 10th. back to you. this could be a summer of change for the warriors, starting at the very top. "the athletic" is reporting that general manager bob myers and the warriors have had no substantial contract talks in months and both sides are bracing for his departure. they're also reporting a competitive offer might not be enough to convince him to sign an extension. the 48-year-old who grew up in the east bay is considered the architect of the dynasty, helping guide the warriors to four nba titles.

a florida woman is being extradited to california, accused in the death of a popular kim kardashian look alike model. the suspect was found on social media. they met in a hotel room, san francisco airport marriott, then gomez administered silicone injections, she had a bad reaction and died a few days

later. gomez caught a flight back to florida and was arrested at the airport there. >> one should never allow anyone to inject anything into their body that's not medically approved. think about it, hotel room at the airport? common sense was lost in this case and a life because of it. >> gomez is facing accounts of manslaughter and practicing medicine without a license. b.a.r.t. has settled a $4.4 million lawsuit for the police shooting of a 17-year-old suspect three years ago. investigative reporter has obtained the exclusive body cam footage that may explain why they're paying the money to a young man who was disabled. this is graphic. >> i do think about it a lot, every day. because it changed my life. >> reporter: cyrus green said he

was different in 2020, 17 when b.a.r.t. confronted him. he admits he was armed and on juvenile probation for a gun and theft case, but he said he was running away and didn't pose a threat at the time the officers shot him. after seven months in the hospital and three surgeries, he still has trouble walking and using his left arm and hand, and there's a bullet lodged in his jaw. >> i was into sports every day all day before this happened. can't do that. i have a daughter now, can't pick her up and throw her, none of that. >> reporter: our investigating unit has obtained the footage of the day of the shooting that shows how it played out. just before 2:00 p.m. on a saturday in february, two b.a.r.t. officers respond to a call at the el cerrito del norte

station. a man had a gun in his waistband while in a heated argument with a woman in the train. the officers spot green and he starts running. one officer chases green through the b.a.r.t. train. >> stop right there! >> reporter: the other runs alongside the train yelling. >> you're going to get shot. >> reporter: green jumps down to the track and the rest unfolds in seconds. >> hey, you're going to get shot. >> reporter: green is shot on the track and airlifted to a local hospital. on the day of the shooting, b.a.r.t. police chief alvarez said deadly force was justified. >> the officers challenged the individual who ran off the train onto the track way, at which point a gun was produced by the suspect and officers ultimately shot. >> reporter: when you slow down the video, green and his attorneys say it tells a

different story. it's hard to see in real time. the body camera video shows after green jumps on the track the gun falls out of his pants. he turns back to pick it up. as he turns to run, both officers opened fire. >> it was a stupid decision on me running. >> reporter: when green picked up the gun, he said he grabbed it by the barrel. when the officers fired, green said he had already turned to run again. >> i picked it up, but that's not justifiable to shoot me. i didn't point at it them or nothing, i was running while i was shot. how do you feel endangered if i'm running away from you? that doesn't make sense at all. >> reporter: b.a.r.t.'s attorneys argue the shooting was reasonable because of the imminent threat green posed when he went to get the gun. >> the fact he survived is

unbelievable. >> reporter: green's attorney says b.a.r.t.'s case fell apart when he showed the officers the slowed down version of the video. in a deposition, he asked the lead officer, all the shots were fired at mr. green after he picked up the gun and turned to run away from you, correct? the officer replied, correct. >> our view was cyrus did not threaten anybody, did not point the gun, take any action consistent with pointing the gun. >> reporter: after a judge refused to dismiss the case, b.a.r.t. agreed to settle for $4.4 million but never discipline the officers. in a statement, b.a.r.t. told us the officers were seeking to lawfully arrest green for an assault on the train. in fear for their safety and safety of nearby patrons, two b.a.r.t. officers fired their weapons. b.a.r.t. continues to deny wrongdoing but believes the settlement is a fair resolution

overall, still warm weather but numbers will be cooling off a few degrees. we're already starting to see the cooling right now, primarily for the inland valleys. livermore is 11 degrees cooler. microclimate forecast. thursday morning. here we go again. that fog is back with us here through the bay area, patchy low clouds inland, chance of drizzle at the coastline, clear it back to sunshine in the afternoon. simple as you get to work, kids to school, doesn't matter where you are, numbers start off in the 50s, similar to the bay area. that's 53 in the peninsula. east bay, low 50s, north bay at 51. daytime highs tomorrow with the cooler system moving a little bit closer to the west coast, going to drop off five to ten degrees. 75 in milpitas, still beautiful, and 78 in los gatos.

east bay, 68 in oakland, way out to antioch and brentwood, in the mid-80s there. peninsula, is 74 in palo alto to 58 in half moon bay. san francisco, 65 in the mission, 55 in the marina. blustery winds in san francisco, and north bay. 75 in napa. going up to the sierra, watch out for thunderstorms. rain totals will be half to over 1 inch. on top of that historic snow melt continues so there are flood watches for the sierra. advise extra caution headed to the mountains this weekend. seven-day forecast, 60s for highs, morning fog, afternoon sunshine. inland valleys, the best seven-day trend we've seen, 70s, then 82 on sunday.
