12:00 pm
hi, everyone. and thank you for joining us. i'm savannah sellers.
12:01 pm
>> i'm kate snow. "nbc news daily" starts right now. tuesday wednesday, april 5th, 2023. breaking news, deadly storms. the areas hit hardest and where this powerful system is headed. unsolved mystery. a high profile tech executive stabbed can killed in san francisco. what investigators are revealing about his final moments. >> trump troubles. the former president on the defensive following his historic arraignment in new york city. what's next for mr. trump's legal case and how it might impact the 2024 race. and battling with bach. a los angeles subway station cranks up the classical music. who they're trying to keep away and how critics are responding. search and recovery efforts are under way right now in south eastern missouri. a deadly tornado tore through earlier today in bolinger county about 100 miles south of st.
12:02 pm
louis. >> authorities say five people were killed but the number of people injured is still unknown. you're look at the destruction in that area. >> and that strong line of storms is charging east now. more than 60 million people in the path of severe weather. joining us now meteorologist angie lassman and nbc news correspondent maggie vespa. what have we been able to learn about what's happening in missouri search efforts there. >> reporter: savannah, those search and rescue efforts started earlier this morning and highway patrol leading this effort, swarming that area of bolinger county. this is small community. we're not talking about a population hundreds or thousands but dozens of people. a couple hours south of st. louis people telling us they barely had time to take shelter once they heard that tornado tearing through their town. take a listen.
12:03 pm
>> when the lightening struck i seen some stuff flying through the air. >> yeah, emotionally it's hard to take. this whole town, i mean i grew up here. glen allan will never be the same. there's no doubt about it. >> and again that tornado swept through early this morning. at this point we're hearing it's one of 11 reported tornados from this latest system that came through early this morning, much of the midwest and south. we also had another severe system that rolled through last night and you guys know this has been an exhausting year with a series of severe storms. 478 tornados so far to date in 2023. that is twice the average for this time of year. >> so much happened in just this one week. angie, how long is this going to last and who needs to hear if they're at risk right now? >> it's going to last through the afternoon, guys. we've made some improvements as
12:04 pm
far as the location, seeing some of these watches coming down and shrinking a bit, but we're definitely not done with the threat through the rest of the day today. this tornado watch that stretches into parts of indiana, ohio, michigan has been slimmed down. that's going to last until 5:00 p.m. including the tornado watch. still a threat to see tornados and the ingredients are already there. we have added some severe thunderstorm watches that now include parts most of really ohio and stretching into tennessee, kentucky, and into portions of of arkansas and mississippi. we're going to be watching that through at least 8:00, 9:00. that's when those are set to expire and we've got those to deal with here as we go through the rest of the afternoon, guys. >> thank you both. now to the new fallout today following the historic arrest and arraignment of former president donald trump.
12:05 pm
>> the former president is back in florida now. last night he gave a speech at mar-a-lago after pleading not guilty to those 34 counts of falsifying business records. >> there are still a lot of unanswered questions about the case against former president trump including what the basis is for charneling him with those felonies. >> of course the political implic. trump is running for president again and is the current front runr for the nomination. >> let's dig into all of it with nbc news national correspondent gabe gutierrez and legal analyst danny suvolose. we got this unsealed indictment but there still doesn't seem to be in blank and white why he's being charged with these felony counts, what the basis is for those counts. does that matter? >> it's because prosecutors don't need to. the statute does not require it. the prosecutors do not need to charge him separately with the
12:06 pm
crimes they're using as a predicate to take what is otherwise a misdemeanor and bump it up to a felony. the statute only requires that the false statements and the business records be made with the intent to defraud, but if in addition they are also in furtherance of a crime, and it can be virtually any crime, there are a list of the crimes but it's not an actual list. it's a very broad definition of what constitutes a crime. so the state doesn't need to actually plead and prove additional crime as a separate count. they just need to allege it, put some proof about it, but they don't need to commit to it right now. as long as they have a crime, they can get to felony land. what's really interesting is that the crimes they're referring to, a misdemeanor. you have the misdemeanor falsification of business records and then, for example, misdemeanor, interference in new york with an election. well, actually, it's technically promotion of an election. and those two misdemeanors make a felony.
12:07 pm
the math at least the defense will say won't add up. >> all right, gabe, let's talk about information. two sources are telling nbc news a judge and his family have actually received threats since the hearing. >> we're just getting information in. two sources familiar with the matter say the judge in this case has received unsubstantiated threats since the hearings. >> since yesterday. >> yes, since yesterday. now, you'll recall d.a. alvin bragg has been getting unsubstantiated threats for several weeks. there has been extra security asiebed to the d. a. now officers are also looking at providing security to the judge and they're already doing so. the latest is that the judge in this case has received unsubstantiated threats in the arraignment yesterday. and this, you know, could be
12:08 pm
concerning because of the charge rhetoric that the judge incited during the arraignment as well. >> the judge yesterday said, he said please, everyone, trump team and prosecutors don't say anyone publicly that might incite violence or harm someone. i want to play a little bit of the things he said in mar-a-lago and his attorney on the "today" show. >> i have a trump hating judge with a trump hating wife and family. >> it's not an attack on the judge or certain lay his family. no one is suggesting anything should happen to the judge or his family. president trump's comments did not in any way, shape, or form incite violence. >> how's the judge going to deal with that? >> let's be honest if this was one of my clients or someone's clients nobody had ever heard of the judge would take a much harsher view and have no problem
12:09 pm
bringing in that defendantant and either reading the riot act or sanctions him. i think the judge here did probably what i would have done, which is you don't want to get into gag order land. you don't want to start entering protective orders or preventing the presidential candidate from speaking. that can get very thorny very quickly because arguably almost everything going to come out of the former president's mouth is political speech that is very protected in our country that just isn't elsewhere. not surprised he wins the unofficialsi admonishment route. and trump misbehaves, you can bring him back, educate him again. and if he's threatened, go out and arrest him and charge him with a new crime. >> thank you both so much. a political earthquake has rocked wisconsin. liberals will control that state's supreme court. it's the first time in 15 years that's happened.
12:10 pm
judge janet defeated her rival. it was a bitter fight. here's some of what both candidates said last night. >> wisconsin voters have made their voices heard. they've chosen to reject partisan extremism in this state. >> i do not have a worthy opponent to which i can concede. this was the most deeply, deceitful, dishonorable, despicable campaign i have ever seen run for the courts. >> let's bring in nbc news washington correspondent yamiche alcindor and how she's been following this. i feel like i keep butchering the judge's name.
12:11 pm
i apologize for that, yamiche. why does this have such political implication snz. >> it's a name we're going have to get to know better so we're all learning it together. this is pretty big victory which will allow the state's new liberal majority to determine the future of several pivotal issues the bench is likely to decide in the coming years. those issues include abortion rights, the state's gerrymandered legislative maps and election administration which could impact the 2024 race in the united states. on abortion rights this is a huge, huge issue because states are now the key places where access to abortion care are being fought out. in this race the judge made her view on the issues very clear throughout her campaign. this win shows the strategy continues to work for democrats after we saw wins for supporters of abortion rights in other states like michigan, kansas, and kentucky. so this could be a blueprint for other states, kate. so we're going to get to say her name together because this could
