damage control now under way. this is "today in the bay" streaming live on roku, amazon fire, apple tv and online. and here we go wednesday morning. i want to say good morning to you. i'm marcus washington. >> and i'm laura garcia. we'll check in with mike and get a check of the commute. first the forecast. kari tracking incoming rain. it was nice to get that sunshine yesterday but was chilly. everyone was bundled up going for the walk. there will be more clouds coming in. this is what we are seeing across much of the bay area to start out our wednesday morning. as we go into late morning, the sun just kind of peeking out from behind the clouds and we're only headed for the mid to upper 50s today. here is the next rainmaker that's going to be coming in. we can see it dropping in fairly quickly and this out ahead of a cold front that's just going to continue to make it very chilly out there.

as far as the time line at 6:00 we're starting to see the rain filling in on the radar for parts of the north bay and then as we go into about 10:00 to 11:00 and moving into san francisco and parts of the east bay for the south bay it's not until around midnight when that rain really picks up. and then can you see by 2:00 to 3:00 in the morning for the most part it's out of here. we are going to see this coming through while most of us are sleeping, at least i'll be sleeping hopefully. we will see some changes ahead going into the forecast. and, mike, you are saying there's maybe a problem for the inbound ace train? last check i saw on the ace rail report they were coming no fremont but they have not yet gotten to that station. delayed getting into free month and that portion of track just prior to fremont is niles canyon. it does look like that train may be stopped right now. 15 to 20-minute delay. no update from ace train. we're trying to find out from

crews, all not having any updates. ace train number 1 delayed. the other b.a.r.t. system, again, here in the niles canyon area where folks were stranded because of mud on the tracks. the rest of the bay flows smoothly. the rain makes its return as participates parts are still in cleanup mode. >> "today in the bay's" pete suratos where crews are still working to clean up the landslides. pete, i would imagine that incoming rain we've been talking about, they'll have to work quickly. >> reporter: they had two landslides in the span of two days. you can see the road is still closed. they have made good progress moving off a lot of that debris. trees fell down off the hillside when the landslide took place.

hopefully what we expect to be a fast moving storm later today doesn't impact more of that hillside. but, again, we see this storm across the entire bay area. in the south bay here is video of roofers trying to fix any of those leaks before this rain arrives. you know it looks like it will probably happen closer to the evening some of that heavier rainfall. still they're trying to work on those roofs over there. also pg&e, those power line issues with the gusty winds we saw in the south bay and really across the entire bay area. let's go over to sunol. as mike mentioned there are some delays when it comes to the ace train this morning, so service will resume today. but there was that landslide that hit that train yesterday. it impacted more than 200 passengers who were stranded for hours. >> well, we were going through niles canyon, it was reduced speed and hit a bump. the train jittered, they came to a stop and said we hit a tree. there was a bunch of dirt and so

forth that came down along with it. >> reporter: in san francisco they have been dealing with this flooding issue for quite some time when it comes to the cleanup, complaints of sewage water really following the flood that took place on new year's eve. a lot of issues there for those businesses. mayor london breed announced recently businesses could be eligible for flood relief assistance so the aim is to help small businesses and they could receive up to $5,000 in relief. of course every dollar counts when we talk about fixing those issues. the information is on our website at nbcbayarea.com. live here in oakland, pete suratos for "today in the bay." >> thanks so much, pete. with the saturated ground, fallen trees are also a big concern. check out this damage from this tree that toppled in los gatos. that truck is also a total loss. and a nearby home also sustained some heavy damage there. 6:04. in the marina district there are

growing concerns over rising crime. last night police chief william scott, d.a. brooke jenkins and supervisor catherine stefani met with the community at the marina middle school. the main reason for the meeting a series of car windows being smashed in the area on sunday night. chief scott said hundreds more officers are needed citywide and d.a. jenkins addressed those who disapprove of the current city response. >> what i recognize is we are in a state where nobody believes there are any consequences for their actions, and i am working day and night to make sure they understand -- >> at the end of the meeting the main agreement was that there needs to be another town hall to address the issues. lawyers for the ex-police officer who killed george floyd in 2020 are expected to ask for a new trial. derek chauvin is asking to have his sentence thrown out on the grounds his high-profile case was tainted by publicity and

deprived him of a fair trial. chauvin was convicted and sentenced to 22 1/2 years in prison. he and three other officers were arrested after he was recorded holding floyd to the ground and pressing his knee to his neck. after nearly nine minutes floyd lost consciousness later dying. president biden continues to ignore questions over the handling of classified documents. >> however, white house officials are speaking up as a special counsel investigation is now under way. "today in the bay's" brie jackson is live in washington. the white house is facing intense criticism regarding its handling of the matter. >> reporter: that's right, good morning, laura, marcus. the white house is deflecting criticism it is with holding information about president biden's handling of cls fid documents and accusing republicans of faking outreach.

president biden remaining tightlipped about classified documents found at his former office and private residence in delaware, leaving the white house to do damage control. >> the president and his team rightfully took action when they learned the documents exist. >> reporter: a law enforcement official tells nbc news they have not told the white house they cannot talk about the facts of the case. still, the white house is only providing limited details amid greg calls for transparency. mr. biden's attorney found the documents a week before midterm elections but the discovery was not revealed publicly until recently. >> why did we not find out about it until 60-plus days later and then only because of an investigative report? >> reporter: with even more documents found just last week republicans are drug comparisons to the documents fbi agents seized from former president trump's mar-a-lago estate.

>> were the same amount of agents investigating this that are investigating president trump? is the same push behind it? it just does not seem fair. >> reporter: some lawmakers want to review the process of packing sensitive government records. >> we have to review how departing presidents and vice presidents are going about organizing the archiving of their documents both classified and unclassified, because this can't go on. >> reporter: questions remain including the total number of classified documents found at both locations. and white house officials told reporters that the administration is releasing information as it deemed it appropriate, but even some democrats are calling for more transparency on this issue. marcus, laura? >> one we will be watching. brie, thank you. it is 6:08. let's take a live look outside, watching the skies. a beautiful live look overlooking san francisco this morning. kari has been enjoying the sun

but tracking some incoming rain headed our way, but not this morning. not this morning and the commute looks good as you get ready to head out. to emeryville with a live look. we don't need the windshield wipers for the morning commute or the evening commute for the most part. we will have chilly temperatures. we're only in the low 40s right now and we'll see the sun peeking out more in the morning compared to what we will see in the afternoon as the next system moves in and we've been talking about how it will bring in some additional rainfall. i'm also monitoring our reservoirs that are still running quite high with a lot of them over 100% of capacity for the south bay reservoirs and lake sonoma at 80% of capacity and then for the lexington reservoir over 100% of capacity. so we're going to talk about how much rain is headed our way for tonight. that's in the forecast coming up as well as what's ahead for the weekend. first, mike, you might want to stop at the gas station.

in fact, you'll probably need to. we just heard an update regarding ace rail service. first, we'll start with the gas prices. in sunnyvale national petroleum on old san francisco road edged out the others at $3.84. solano county is the best in vallejo with marathon on sonoma boulevard $3.65. and our low on the chart is concord super stop on willow pass road at $3.59. now as we look at the roadways, we do need to call out the fact on the rails we got the update. train number one is stopped. monitoring it before you get to the fremont station in the niles canyon area. there's debris on the track. probably the same area. prevents them from reaching the fremont station. right now we're on hold for ace train which is on hold. 84 is closed for the roadway. we're watching that entire stretch. the backup is building at the

as you get ready to step out the door on this wednesday morning in martinez, it is in the upper 30s. it is chilly all around the bay area. and we'll start out with a few clouds and then see more clouds move in as our temperatures reach the mid to upper 50s. rain arrives tonight. we'll talk about the time line and impacts coming up. the drive into fremont, both directions of the nimitz is fine. so is 680. the ride ace rail number one train is stopped before it gets to fremont station. it looks like the same area as yesterday. we're following that story on the rails and roads. well, good morning. happy wednesday to you. stocks took a bit of a beating tuesday after goldman sachs

reported financials. we get retail sales data today. the federal lawsuit trial in san francisco for tesla gets under way. microsoft is going to cut jobs. cnbc says a lot of these cuts come from within the engineering departments. microsoft has laid off recently but we've never been able to get a good handle on the numbers. today's could be as big as 5%. now businessed on published employee numbers that's 11,000 people. we'll talk about how to survive a layoff after the next break. updated prices for you on that twitter auction which continues through this afternoon. twitter selling off stuff from its offices. the light-up bird is now $22,500. here is a nice chair that's currently $1,400 plus a 20% auction fee. several people pointing out you can just buy this chair new, get it delivered from a furniture store for less money than that. hey, it wouldn't be from twitter. surprises on the best

airlines. delta is number one. maybe not a surprise necessarily. a lot of people like delta. take a look at the number three spot, southwest airlines. delta, then alaska followed by southwest, united and allegiant. "the journal" points out the data their list uses like ontime records, lost baggage, wait times date back before december, so the southwest meltdown is not included when they consider their ratings. it's fair to say southwest will not likely appear so high in next year's list. back to the list. sixth place american, spirit, frontier and jetblue, which comes in last. i think some people would be surprised they scored so badly because a lot of people like jetblue. the problem is with jetblue, and we were talking about it earlier, it's mostly based in the northeast, the new york/boston area, which is a terrible place to try to run airlines in the winter. a lot of their planes get stuck

phones add it to that or take away from that? >> they do like to disconnect but psychologists say that a smartphone and social media with them growing in trends, so many have been connected to depression. a lot of teens are dealing with depression. so much access, i think it is. some teens tell us that flip phones help them be more present with friends. >> maybe put down the phone and you would be even more present, too. trending a new jersey grandpa charming the internet with his wholesome surprise for all of his grandkids. a now viral tiktok video, presenting each of his 11 grandchildren with a neatly wrapped gift. it's clear ryan is expecting a big reaction and his family delivers. take a look. >> wow! >> okay, if you can't make it out the kids erupt into excitement because they realize

raining yet? >> he's his own storm ranger. we're starting out with a clear sky now, so i know it's not raining yet, but it will be later on this evening. all of the water recently still draining down into the low-lying areas. we have a coastal flood advisory as well as some low-lying areas still dealing with the runoff from the rain and increasing that threat of flooding, but then along the coastline more flooding expected as we get our extremely high tides over the next five days. so what happens here? we have the sun align with the moon, both very close to the earth and that gravitational pull makes the waves come up higher and they're push further inland. we also have extremely low tides during the afternoons. so we are watching out for that possibility of coastal flooding and you know those usual spots, we see that late morning starting tomorrow through the next several days. as far as temperatures today,

it's chilly. it's only reaching 57 in san jose. 56 in gilroy. and for the east bay, 53 in martinez as well as pleasanton and 57 in san mateo. in san francisco outer sunset reaching 55 degrees and 54 in mill valley. 52 in clear lake today. now look at the temperatures we'll wake up to tomorrow morning. we're going to have to get used to this because the next several mornings at least for the next week will be like this. mid to upper 30s, frosty conditions, even freezing in parts of the north bay. we'll see that behind this cold front that will be sweeping through and makes it into the north bay. mostly late in the evening. we see the rain picking up there. for the south bay it's at about midnight to 1:00 in the morning when the rain is pouring. it's only going to bring us about a tenth to a quarter inch of rainfall and most of it

coming once again while we're sleeping. a lot of sunshine. it will be cold so we'll need sweaters as well. mike, you are flagging a couple areas for the commute. >> the taillights are building. a standard flow. yesterday a big commute around the bay. we expect a nice slow drive. looking at restrictions, king tides and earlier flooding. only one lane open this morning just like yesterday. the rest of the commute already. that's also once again ace train number one is stopped before it gets to fremont. there is debris on the track.

the growing crisis after recent storms that once again renewed the dangers of those without shelter. a live report on the action now being considered. this is "today in the bay" streaming live on roku, amazon fire, apple tv and online. and a good wednesday morning. thanks for allowing us to be a part of your morning. i'm marcus washington. >> and i'm laura garcia. we start with a look at the forecast. we enjoyed the sunshine. rain making a comeback. it will roll through later on tonight, so most of our day is dry. we're waking up heading out for the commute with chilly temperatures. a look at our east bay commute with a live look at emeryville cameras. at least we're not dealing with turning on the windshield wipers and hitting puddles but you do need to turn the heater on, bundle up as you walk out the door and also those temperatures headed for the low 50s today. now here is the next system we're talking about. ahead of the cold front there's some rain but it is sweeping through quickly. we start to see it impacting the north "today in the bay" 5:00 to

6:00 this evening. we're only in san francisco by 9:00, 10:00 and in the south bay it's getting heavier as we approach midnight. we are going to see once again one more round of rain, and that will be out of here early tomorrow morning. i'll be tracking that and talking about the impact. mike, you are still looking at the impacts of all of the rain we've had. we haven't had 84 reopen for roadway travel. like yesterday the problem with ace train, there's debris on the tracks again through niles canyon. so inbound trains coming into the south bay and the bay area we're looking at it stop shy of the station. three and five heading into the area on time until they get to this approach so that will be a problem. if you hit the roadways, traffic building. nothing dramatic but it's there. a smooth drive off the dublin interchange. you can take to the roadways. we're standing by for more

updates. the roads are moving pretty smoothly as expected for a wednesday. back to you. thank you very much, mike. breaking overnight at least 17 people are dead including ukraine's interior minister after a helicopter went down outside of kyiv. this is new video of the fiery scene following the crash which happened near a kindergarten. at least four children are also among the dead. 22 other people were hurt. the cause of the crash is not immediately clear, but it comes as ukraine's war with russia approaches the 11-month mark. president volodymyr zelenskyy is calling the incident a terrible tragedy. vallevallejo's first homici under investigation. a man shot near richardson drive around 7:30 last night. he was taken to the hospital but later died. police are with holding the man's identity. the santa clara county water authority will discuss what to do to keep unhoused people from

living in creek beds. we know this comes after we've been seeing all month long the serious dangers during the heavy rains. >> that agency isn't the only one looking into the problem. "today in the bay's" kris sanchez joins us with the action expected today. kris? >> reporter: hi there, marcus and laura. the water in the creek beds and riverbeds are receding now. we saw that very real danger as the water levels came up and the water was moving swiftly for folks living near river banks and creek beds all around the bay area. in the south bay we saw during the first rounds of that really heavy rain, valley water, the water authority, san jose police and san jose's new mayor himself going along creeks and rivers urging people to leave. many people did relocate and found shelter at warming shelters but that was temporary. valley water will hold a discussion on a long-term

solution. the meeting is at noon on almaden expressway. you can find a zoom link if you want to attend virtually at valleywater.org. there's a similar discussion happening in oakland regarding the wood street encampment. the city wanted to clear unhoused people there and get them to safer places. however, there is still a temporary restraining order barring them from doing that. before anything changes, there is a zoom meeting that has to happen and that is scheduled for february 3. the break in rain definitely expect that we will see authorities going out asking them to get to safer ground. >> remember, president biden visits tomorrow. the white house is still not saying where he plans to go, but one heavily djed location, the

wharf in capitola will be closed for a year. one business damaged by the storm made that announcement on social media. huge waves, some approaching 40 feet, battered the wharf leaving a huge chunk missing. fema has added monterey county to the major disaster declaration. president joe biden approved last week. check out the flooding that happened in the ag fields of salinas. the damage between $40 million and $50 million. the declaration will open federal assistance to people and businesses affected and this comes as president biden is expected to visit the central coast tomorrow to tour the damage. and we will bring you live coverage of the president's visit starting tomorrow morning on "today in the bay" and we will be streaming on roku, amazon fire tv, apple tv and online. it is 6:36 on your wednesday morning. look at that. a live look at palisades tahoe.

a lot of snow. this is the top of the lift. more snow is on the way as well through today and tomorrow they could see up to 11 inches. nice, clear skies. no doubt it's really cold. very cold. we've seen single-digit temperatures. it will be like that the next several days. the snowpack has been amazing. palisades is reporting they've had over 350 inches of snow, and that puts the sierra snowpack at 251% of its normal amount of snow for this day with the best in the southern sierra that's nearly triple its normal amount. we could still end the season with above normal snowpack heading through april 1st. it would be nice to get a little bit more but we do need it spaced out and we're dealing with cold temperatures here talking about single digits there. we're in the upper 30s now and this cold weather will be here

to stay for quite a while. we'll see more mornings like this at about 35 right now in santa rosa. 36 in dublin and 37 in san jose. and then our temperature in the mid to upper 50s for this afternoon reaching 55 in dublin as well as fremont. novato reaching 53. 53 in santa rosa. we've been talking about one more shot of rain coming in here. we are going to see that arriving tonight. i'll have that time line coming up in a few minute. mike has been tracking the roads and the rails. looking at the roadways, the big backup as you expect. we haven't seen this for a couple months. we had vacations end of the year, school returning, all the rain and now folks yesterday and today really filling in the bay bridge toll plaza right on schedule. metering lights turned on 5:40 this morning. we have a slower drive across that span and typical spots like richmond in the east bay and building for highway 4. looking at the rest of the bay, a pretty standard pattern.

getting more traffic this week than the past couple of months. drier roadways are just fine. we do have a problem with the tracks and the roadways closed through niles canyon. the tracks, too, just got word from ace rail that one and three are on the tracks held up before fremont but five and seven are canceled for today. they apologize for any inconvenience. we'll track that so you are not inconvenienced before you leave the house. more coming up. new for you this morning, a new satellite is now in orbit. >> three, two, one, engines full power, and liftoff. >> that is spacex launching its fourth rocket so far this year and, yes, only 18 days into the year. the rocket went off at 4:24 our time from cape canaveral as part of the u.s. space force. the satellite that went up in today's rocket was named after amelia earhart.

6:43. happening today a live look at the capitol where mayors from across the bay area are gathering this morning for the annual conference of mayors. among them san francisco mayor london breed along with newly elected mayor sheng thao of oakland and matt mahan of san jose participating in panels and discussions on homelessness, the opioid crisis, public safety, jobs and global climate challenges. they're saying it will not negotiate over the debt ceiling. >> and scott mcgrew joins us now. for years you've compared the debt ceiling to credit card payments but you have a new analogy. >> the hand grenade, metaphorically. everyone agrees about putting the pin back in the grenade but one side may see an opportunity to negotiate first. a failure to raise the debt ceiling could have explosive results on the economy hurting

the stock market, maybe a run on the dollar, mistrust, of course, in the full faith and credit of the united states. america has never failed to pay her debt. for those reasons the white house says it will not negotiate. the white house press secretary saying the debt ceiling is a basic item congress has to deal with and should be done without condition. and in the past it mostly has been because the spending in question has already happened. not new spending. it's covering the spending you've already done. speaking of congress, george santos of new york, marjorie taylor greene have been awarded committee assignments. santos lied about where he went to high school, where he went to college, where he worked, his religion, among other things. greene has been assigned to homeland security, the committee set up after the 9/11 attacks which at one point she suggested were faked. she has since clarified that. >> i also want to tell you 9/11

absolutely happened. i remember that day, crying all day long watching it on the news. and it's a tragedy for anyone who say it didn't happen, and so that i definitely want to tell you i do not believe that it's fake. >> an interesting report in "the wall street journal" this morning. the doj considered adding fbi agents to help in the search of president biden's private homes after the biden team announced it had found confidential documents and turned them over to national archives. the report, which nbc has not confirmed, says the decision was made not to add agents because they weren't necessary. rather answering speaker mccarthy's question you are about to hear. >> were the same amount of agents investigating this as investigating president trump? is the same push behind it? it just does not seem fair. this is why the american people get so upset and distrust their government when they see that the law is not applied equally.

that's a long time getting up in the middle of the night. >> "today in the bay," you see this face right here. >> congratulations. >> well, thank you. i didn't expect you to sneak that in. >> i know. happy anniversary. >> thank you. thank you very much. we're going to give you a little bit of sunshine today. people have been asking for rain. we'll give you that, too. whatever you want in this forecast, laura, we'll just change it up every few minutes. >> thank you. >> we'll start out with sunshine for this morning and it's really a nice but chilly start. we're in the upper 30s as you head out the door. we'll be at 40 degrees at 7:00. you can see the trend, a very slow warm-up and we only make it into the mid-50s. we'll be closely watching our coastal areas and also those low-lying areas still dealing with the run-off from all of the recent heavy rain. we do still have a coastal flood advisory for these areas shaded in green until about 4:00 today.

we'll see if that gets extended once we get more rain tonight. and we're also going to see coastal flooding because of king tides over the next few days. and this is when we see especially during the wintertime when the sun is at its closest point to the earth and the moon is also at its closest point to the earth that gravitational pull makes the waves come up higher, and we'll see it also pulling that water further inland, so there could be coastal flooding in the usual spots but also we have extremely low tides during the afternoon. so today we're headed for the mid to upper 50s reaching 55 in milpitas and los gatos reaching 57 degrees. we'll see some mid-50s also for the east bay from walnut creek to hayward reaching 55 degrees. 56 today in palo alto and mid-50s in san francisco. for the north bay cooler. the clouds roll in sooner so 52 in clear lake today. so here is the next system that will be coming in just one more

shot of rain. this one is not connected to an atmospheric river. it's out ahead of a cold front and will sweep through quickly and make it even colder the next few mornings. looking at the time line, we're at 7:00 seeing the rain covering the north bay, moving into san francisco at about 10:00 to 11:00 tonight. for the south bay it's more like midnight when you start to hear the rain hitting the roof and then it's out of here before you head out tomorrow morning. most of us will get light amounts of rainfall, about a tenth to a quarter inch of rain, maybe higher in some spots. then dry weather in the forecast. we get to take a break and get a breather with sunshine. it will be so cold especially in the mornings. mike, you are tracking several issues for the commute. drama on the rail. this is all ace train related. inbound train number one stopped in the niles canyon area. debris reported on tracks.

welcome back. we're moving you forward with a look at the top stories on "today in the bay." first the rain making a return to the bay area as parts of the region are still trying to clean up following weeks of wet weather. >> "today in the bay's" pete suratos is in oakland hills this morning where crews are still work to go clean things up from the landslides. pete? >> reporter: that's right, marcus. we're here along st. andrews road, two landslides in the span of three days. the road is closed. a lot of mud but they have cleared out a majority of that debris so that is good news. we'll see how much progress they make before the rain arrives. other parts of the bay area, in sunol crews, as mike has been

mentioning, they're still cleaning out the debris that's affecting that ace train between that pleasanton and fremont area. if you recall yesterday morning a landslide hitting a train there. they expect service to resume. as mike mentioned there will be some delays because they have to clear out that debris so that's a big concern in that area. now let's pop over to san francisco where flood relief assistance could be on the way for eligible business owners. they were, of course, hit hard by the flooding the past few weeks dating back to the new year's eve storm. the mayor, london breed, could receive up to $5,000 in grant money for assistance. we'll have that info on our website, nbcbayarea.com. pete suratos for "today in the bay." we'll get an update from mike in a moment. there are growing concerns over rising crime. last night police chief william scott, d.a. brooke jenkins and

catherine stefani met at the middle school. car windows had been smashed sunday night. hundreds more officers are needed citywide. the main agreement was there needs to be another town hall to address the issues. in just a few hours the santa clara county water authority will discuss what to do to keep unhoused people from living in creek beds. today valley water district will hold a discussion on the long-term solution. the meeting is at noon at the boardroom on almaden expressway in person. you can find a zoom link at valleywater.org. valley water, police and the mayor himself went along creeks and rivers urging people to leave. many people did but it was a temporary solution. >> and more rain is on the way but not for this morning. we do have a little bit of time but we're still watching

out for the impacts of more flooding as well as mud slides and it's only about a tenth to half an inch of rain further to the north but with it moving through on the wet ground, we'll have to watch out for those impacts. >> it will make it tougher for the cleanup for ace train. the latest update, pete was talking about yesterday's problems, stopped in the same area. train number three, fortunately, they've been able to hold it back at pleasanton. the rest of the trains for the day are canceled. b.a.r.t. is an option for you. no delays reported there. folks hitting the roadways will be met with a lot of congestion. yesterday, too, we saw traffic returning from vacations, folks rotated through, and folks who have to take ace trains need to take the roadways. we'll have a local news update in about half an hour to keep you posted on everything that's always changing around here. before we go, congratulations to laura for 23 years here at nbc bay area!
