good morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm brent cannon. it's crazy stuff. it's crazy friday. want to check in with craig. >> good morning to you! he's doing some yoga. 50s out there, some fog and, yeah, this afternoon more sunshine. a great start to the weekend. a couple of 80s out there in some of the warmer spots and this will take us through sunday. it's not until next week we'll start to cool off a bit more, so be prepared for the upper 70s next week. meantime, laura, afternoon sunshine. back to you. a deadly pit bull attack leaves a family shattered and lands a relative of the young victim behind bars. nbc bay area's christie smith is live outside the contra costa county jail in martinez this morning with more on the charges he faces. good morning. >> reporter: good morning. the little boy's step grand father is inside the county jail here in martinez. he's 52-year-old steven hayashi.

he's been booked on child endangerment and possessing a mischievous animal that causes death or great bodily injury. now, detectives say he was the owner of the dogs. after spending most of the day at the concord police department yesterday, he was let out wearing a ball cap into a van and taken here to the county jail. now, police say hayashi's three pit bulls attacked and killed 2-year-old jacob bisbee. they say he was inside his concord home, he walked into the garage when the dogs were kept. that's when they attacked. he was not home at the time but two adults and another child were home. neighbors tell us they knew there were dogs at the trail creek court home, but not five of them. some say they barked viciously but everyone is stunned by the tragedy. >> god forbid those dogs would have gotten out. didn't know they had that many. i'm shocked to find this out. we're just finding all this out ourselves. >> reporter: now, all five dogs, there were five of them in the

home, they were all euthanized. the father, the boy's dad, was not home at the time and we're told the mother does not live with them. hayashi is being held here on $120,000 bail. he may be arraigned today. reporting live in martinez, christie smith, nbc bay area news. this morning a mother is facing similar charges in connection with the death of four children. she may get a step closer to getting out of jail. 23-year-old la tesetitia james fairfield will ask a judge to reduce her bail. she and another mother are charged with involuntary manslaughter and child endangerment after their kids died in a house fire april 28th. prosecutors say mothers were outside the house and left a candle burning inside that sparked the fire. the children were all between the ages of 1 and 4. the search is on now for a possibility-sized burglar in palo alto. police say a boy about 10 years old is involved in at least three robberies in the past week. they say he has been targeting

homes with unlocked windows and doors near embarcadero and charleston roads. police say the child is not operating alone. witnesses have reported seeing accomplices waiting outside. police say they are concerned now for the boy's safety. >> 10-year-old that is learning to do crimes that young, they're very impressionable. they'll do whatever makes the adult happy, and that is just not right. >> so far the boy has not taken much. the only thing that's really been reported missing is a skateboard. an unemployed san jose man is accused of impersonating a police officer. check this out. a central coast patrol officer noticed 27-year-old mark pilinni parked in a car and talking on a radio monday. hils car it turns out was outfitted with a dash cam, strobe lights, a siren, computer, and radios. police realized he was a fake after checking his i.d. >> our fear is he's been posing as a police officer and perhaps

making traffic stops or engaged in illegal conduct with our citizenry, and we're very interested in getting information from the public and determining whether we do have victims out there. >> police also found a loaded pistol, hand cuffs, multiple badges and a police baton in the car. two suspects who shot and killed a tourist from virginia may be linked to a string of robberies in downtown oakland. police say these photos of a man and a woman shown walking near the scene of the murder, we'll show them shortly hopefully, match the suspect descriptions given by a witness in the oakland crimes. now, you saw them briefly there. computer engineer, gene hong kang was here for a job interview when though asked for money on webster street late sunday night. these are the photos that police want to find. police say kang was randomly targeted and the motive was robbery. the suspects robbed the man of $17 before they pulled the

trigger. we expect to find out today when home-run champ barry bonds will go on trial for perjury. a federal judge will set the date later on this morning. bonds is accused of lying to a grand jury about steroid use in 2003. the former san francisco giant told the panel he never knowingly took steroids and never got testosterone or human growth hormone from his trainer. now, prosecutors claim that bonds allegedly tested positive for steroids three times between 2000 and 2001. but that evidence cannot be used in court because bonds' trainer has refused to testify. in the home loan business -- in the home-run race that is business, there are two heavy hitters, microsoft and apple, and many thought that apple could hit one out of the par >> i think so. historic rivals apple and microsoft. apple is a smaller company, when you measure it by market cap, because apple stock's been going

gangbusters. some analysts thought that apple would jump ahead on microsoft on sales. ceo steve ballmer from microsoft got on the phone with analysts last night and said, nope, microsoft beat apple one more time. it made a ton of money, in fact, people buying lots of new computers, nearly $6 billion, profit, brent and laura, on $16 billion revenue, but microsoft stock continues to just sit still. la languish. and apple's stock is taking off. there's some question about how long steve balmer will stay at microsoft, gates left and balmer came in and not a whole lot happened. we'll watch it. saving more than 100 police officers is behind the push to change rules surrounding how many officers have to be on the force. this is in oakland where the oakland city council got an earful on the $19 million city fund generated through taxes. it was passed six years ago. in order to use the funds police staffing has to be at a certain

level. the move to lay off 80 cops last week disqualified the city from using some of that money. >> if we don't pass this, we lose another 122 beyond the 80. if we do pass the change with measure "y" that allows us to keep collecting it, we'll only have to lay off another 22. >> one man whose home was recently burg larized accused city leaders of sqawndering funds. >> where were the police? they were called immediately. did they respond immediately? no. because we don't have enough police. why? because we're paying the public works assistant $165,000 a year. >> the city council says another 122 officers could be laid off if measure "y" is not amended. in the meantime, the city could -- the feds could help keep oakland streets safe. 80 officers were laid off because of budget cuts but the

department needs help with gangs and drugs. so, the chief says that's where the feds come in. >> we're not going to ask them to come in and cover a beat, but what we'll ask them to do is long-term investigations to dismantle criminal enterprises takingplace. >> a two-day summit is set for august where federal agencies will talk about tackling the problems in oakland. it's 5:08 how are we looking? >> pretty good. the bay bridge traffic has picked up, the caltrans workers get to start their weekend. the lower deck, continues for half an hour getting out of san francisco. but clear views from san francisco to the oakland side. the travel times from the maze to oakland. 24 looking at the limit as you're coming out of the caldecott tunnel. and the commute directions moving smoothly through the city of oakland. we'll watch because things will

get much more crowded. we're in a pretty good weather pattern. the weather's pretty mild overall. not too hot or cold. looking good, craig. >> it's really nice. we could be talking about 100-degree temperatures or fire danger, but we don't have to deal with it. we've got 50s and plenty of cloud cover and fog.rine layer where it was yesterday. hot air to the east that will come our direction a little bit. most of it will stay in the central valley this weekend but it will give us a couple of 80s across livermore, concord and walnut creek and the santa clara valley, and the cooler air comes back in next week so we'll continue with the mild conditions. highs 64 in san francisco. 83 for a high in gilroy. p and 79 in sonoma and 69 in oakland. we talked about dog day at the park. bring your dog to the oakland game, to the a's' game.

might be needed in gilroy. a city dropped pricey employ employees. and a storm sends cleanup crews scrambling in the gulf. we'll find out how long it could put the cleanup efforts on hold. in the meantime, a live look outside in the south bay this morning. pretty mild temperatures. especially for this time of year. should make way for a nice weekend. and some great things to do in the bay area. we'll be right back.

crews are very busy this morning near the deepwater horizon rig as tropical storm bonnie has begun to move into the gulf. workers inserted a temporary plug on the rig to prevent the storm damage and crews along the florida coast are now pulling the protective booms out of the water. forecasters say that storm will most likely not become a hurricane but it's still going to be strong. >> yes, it moved into the gulf it looks like by saturday night that's when we start to see it moving towards that oil-slick area and it will bring some winds probably gusting around 50, maybe even 55 miles an hour. >> and after the storm leaves it could take 10 to 14 days to restart operations on killing the well. the tropical storm is a serious consideration for haiti. the national hurricane center said the storm is packing winds

up to 40 miles an hour. many haitians are still living in makeshift camps you see there after the januariered quake. in most cases the camps do little to shelter residents from the stormy weather. forecasters say this hurricane season which ends november 30th could be one of the worst on record. new this morning, three leaders in a small town are under fire and have sparked a statewide investigation because of their astonishing salaries. overnight those city employee s resigned. gin gin combined they make $1.6 million. the chief administrator earned more than $787,000 per year which is almost twice what president obama makes. the police chief makes nearly half a million dollars. 50% more than l.a.'s police chief. and the assistant city manager earns just under $400,000 a year. meanwhile, 17% of the 40,000

people who live in bell are in poverty. unemployment benefit checks on the way to millions of californians in desperate need of help. congress extended the benefits through november but the president and democrats in the house and senate may have used up so much political capital to get it passed they are now giving up on a comprehensive energy bill that includes taxing big polluters. >> unfortunately this time we don't have a single republican to work with. >> actually, not every democrat supported it either. analysts say the unpopular carbon tax deal -- carbon tax rather was a deal breaker because it threatened jobs. instead democrats will move forward with a smaller bill holding bp accountable for the oil spill and investing in natural gas. so, did that change hurt the silicon valley in scott mcgrew joins us with more on that. >> it's hard to say because so much was theoretically, it hadn't passed through congress. had democrats stuck with it, programs it would have.

any time you take a high carbon tax going against coal you're making solar and green more popular and certainly that's what's going on in silicon valley. we make a lot of solar energy technology and fuel cell technology, too. remember that big launch of that bloom box fuel cell company a couple of months back? so, the valley is definitely keeping a close eye on the new scaled-down energy bill. all right, from bloom box to black box. the inventor of the so-called black box has died of old age. david warren was 85. now, the australian man lost his father in a plane crash many, many, many years ago which explains his passion. the black box, of course, is not black, as everyone knows, it's orange so it can be more easily found and actually there are two of them. you've got the flight data recorder and the cockpit voice recorder. one was discouraged at every single turn. he was told if this was such a marvelous invention, the americans would have made it and the australian government

wouldn't take part in it and pilots hated it and pilots still to this day do not like the recorders. they talked about putting video recorders in the cockpit to see what pilots are doing minutes before a crash and pilots to this day have said no. >> it's the crux of most investigations. >> and it saves thousands of lives because we've learned so much. >> thanks a lot, scott. interesting. the latest electric car making a little bit of a buzz in the bay area. check it out. it's an electric racer, pretty cool looking thing. it can reach 60 miles an hour in 3 seconds and it has top speeds of 150 miles an hour. it made stops in san francisco and silicon valley as part of a tour from alaska to are a gentlemen tina. the 16,000-trip will hem raise awareness about green technology. the car was built by students from london's imperial college. race on down to the south bay and follow your nose. can you smell it already? the 32nd annual gilroy garlic festival gets started today.

from gourmet alley to the famous cook-off and all the food in the booths in between it's really gilroy's signature event. seems most of the city down there plays a part and all the money goes to local charities. the annual party defines the people and the plant that put gilroy on the map. >> the whole community comes together. we all take stuff, like i've got a barn. we store stuff in there. people have sheds, warehouses, garages, so it all comes together in the three-day party that we throw. pretty cool. >> the festival will permeate the air through sunday. >> we'll be taking a look. >> and then some. >> later on in the morning there for you in gilroy. the giants will try to inhale the sweet smell of success and make it two in a row against the diamondbacks possibly. matt cain pitched a gem. he threw eight innings and gave up four hits. and then torrez hit his ninth home run and the giants went on to win that. the final score was 3 -- here's the home run. i lied.

anyway, they won 3-0. the a's host the white sox. the first pitch scheduled for 7:05. you can get there early for a pup rally, you can bring your dog to the game. it's a benefit for the trivalley animal rescue. hope the dogs get along. it starts at 5:30 outside the coliseum. check out this major league meltdown in baltimore. it was tie winnington who went crazy after the ump called j.j. hardy safe. he was out. wigginton was tossed and he had to be restrained by his manager. >> you want a piece of me? >> and juan samuel gets mad and he needs restraining and let's see, i believe he gets the heave-ho as well. is there anybody left to play the game? baltimore not doing well. pittsburgh loves its football even when it comes to baseball. fans getting a little bit of a treat here. check it out.

good morning to you. 5:25 friday morning getting ready for the weekend and we'll start off with the live shot over san jose looking out toward the fremont hills, look at that up above not a lot of fog but a little bit of haze closer to this side of your screen coming down to the south from the peninsula and from the golden gate. so we're getting the fog coming through. a cool start to the morning. this afternoon we're still on the mild side. 50s right now and a couple of 60s places like sunnyvale. 64 in san francisco. a lot of the wind. notice the southwest winds moving right down into the south end of the bay making it down to

the south end of the bay. concord west winds at eight miles per hour and gusty through the trivalley area and fairfield. a lot of heat over to the central part -- southwestern part of the u.s. and starting to come our direction. it stays over southern california if you're going to los angeles or the desert this weekend, pretty hot. same for the central valley. some of the moisture will give us afternoon thunderstorms in yosemite or kings canyon or kern county mountains. this system giving us stronger winds is moving off to the west a little bit, so we'll not see many of the 70s that we've seen over the past several days. we'll have a couple more 80s. a few more degrees warmer bit still running close to average or just below that today and tomorrow, and then next week we'll see more of the 70s. we've been talking about this all morning. dog day at the park for the a's' game. they're taking on the white sox tonight, if you want to check out the game and bring your dog to it. it will be fun. 80s today. more of the 70s and 80s tomorrow. as we go through the weekend,

we'll wake up to the cloud cover. 54, san francisco right now. 55 in livermore. your daily planner, 70s and 80s from noon to about 5:00 this afternoon. we'll stay with this through sunday and then over next week is when we cool back down a bit more. a 2-year-old concord boy is dead and his step grandfather is in jail after three pit bulls attacked him. steven hayashi was not home when the pit bulls attacked and killed the boy. animal control officers put down the three pit bulls as well as two others in the yard. >> didn't know they had that many. i'm shocked to find this out. we're just finding all this out ourselves. >> police arrested hayashi for child endangerment and owning mischivious animals that cause great bodily harm. he's in jail on $120,000 bond. this is not the first deadly pit bull attack in the bay area.

in 2005 a san francisco woman was charged with child endangerment after her 12-year-old son was mauled to death by both of the family's pit bulls. the jury deadlocked in favor of acquittal for marijuaureen fabi. and two pit bulls attacked sean jones that ripped at his face and arms but he recovered after a year in the hospital. the search is on for a possibility-sized burglar in palo alto. a 10-year-old is involved in three robberies in the past week. they say he's been targeting homes with unlocked windows and doors near the embarcadero and charleston roads. police say he is not operating alone. witnesses have reported seeing accomplices waiting outside. police say they are concerned for the boy's safety, but so far he hasn't taken much, only a skateboard has been reported missing. an unemployed san jose man is accused of impersonating police. 27-year-old mark pilinni was parked in a car talking on a

radio monday. the car was outfitted with a dash cam and siren and computer and radios. the real cop realize heed was bogus when his i.d. didn't pan out. police believe there may be victims in santa clara county. more than 150 hotel workers are free this morning but they spent part of last night in hand cuffs. they protested outside the san francisco hyatt on stockton treat. protests backed up traffic in the city's busy union square area for hours during rush hour. the workers are upset over a contract stalemate. at issue is their contribution to health care benefits. the hyatt chain wants employees to contribute more money to their health care coverage. police took them to a station after their arrests and released them later. iconic planes could soon take to the skies and they'll take their place in history as well. nbc bay area's bob redell is live at the hiller aviation museum in hayward. the planes helped make air

travel popular in the 1930s. they're used around the world today. they're very iconic, aviation -- they're important to history. you better take over. >> reporter: yeah, yeah. talking about the dc-3, brent, and you recognize this, i think most people recognize the planes. they're celebrating their 75th anniversary and there's only a few left in california. this one here stored at budfield aviation at the hayward executive airport. belongs to the hiller aviation museum what they're doing later this morning actually within about half hour, they'll turn the propellers and take off and go to oshkosh, wisconsin, where there will be a reunion of sorts. we've got steve hiller here. this is his baby. how are you? good morning. >> i'm fine. good morning. >> reporter: i guess for the younger people like myself who don't remember, you, too, don't remember flying these. how significant was this plane back then? >> it was a -- this is the aircraft that kind of revolutionized for-hire

passengers, carrying passengers. and so it was -- with the number of seats and the configuration of the aircraft, the airlines were born and actually could make money in, you know, carrying passengers cross country. >> reporter: i can get used to the reclining in the back when you start off because you have the rear tailwheel where, you know, it starts and you get level eventually. and this actually, i'm surprised as old as it is, this is a nice setup. i mean, it beats 727s. you got legroom. you've got nice appointments here in the entiinterior. >> it's awful comfortable. when you're flying everything settles down, you can talk at normal levels. you don't have to raise your voice. you can get up and walk around. >> reporter: what's the life like being a pilot? >> it's a heavy airplane. but very, very stable. and structurally when they built it, i don't think they used a

lot of calculations. they just overbuilt it so it's strong as an ox. >> reporter: i don't know if i want to hear that as a pilot. they didn't use a lot of cal cuelations building my airplane. but she's proven herself at 75 years old. you're going to be turning the engines and be taking off shortly? >> yes, we will. >> reporter: brent and laura, you may remember this plane, laura? >> i used to fly those in the old days. >> reporter: i figure. did you train with these with the parachutes? you were in korea, i always get mixed. were you part of the greatest generation -- >> it was the great war, wwi. >> he will put on his uniform, you better watch out. >> reporter: see you gives in a little bit. >> all right. thanks a lot. staggering fines for a computer maker, high-tech pioneer shamed. scott mcgrew joins us with more. >> do you know what else it is? michael dell, the founder of dell computer and his company took payments from intel to use

only intel chips in dell computers. and that's not illegal. but the securities and exchange commission said the executives at dell then pretended as if those payments were actual sales and misrepresented that income to dell investors. in fact, a major, major part of definitely's profits each quarter were really just intel payouts. the dell company based in texas will pay a staggering $100 million fine. michael dell himself will pay $4 million, though neither mr. dell nor the company admits wrongdoing. they do promise, though, never to do it again. now, intel often pays companies no to do business with a competitor. sunnyvale's vages sunnyvale's microdevices is the biggest competitor. it raises anti-trust issues. indeed intel has been the focus of several government investigations, both here and in europe. but dell investors who thought all this time that this company

was doing so well, found out, no, it was all just a payout. >> thanks a lot, scott. well, so much for a cheaper ride on b.a.r.t. b.a.r.t. directors had considered a plan to temporarily reduce fares by 3% because of budget surplus. b.a.r.t. directors they shelved that item yesterday after approving a controversial project that would link the oakland airport to the coliseum b.a.r.t. station. b.a.r.t. now plans to get the money from state funds, a federal loan and the b.a.r.t. reserve fund and they'll use some of the surplus to deep clean railcars and replace some seats and freshen things up, febreze it so to speak. >> i think it's interesting when they asked thein consumer, whato you want temporary cheaper fare or clean seats? they said give me the clean sets and they'll do that. >> designer b.a.r.t. >> 42 trains and no delays for the system as it currently stands, good news as well. we'll take you out to pleasanton to the sunol grade northbound

680 at bernal, reports of a minor accident between a tractor-trailer and the dodge neon, it's not lit up there. watch out for that but no major slowing. a live look over the grade. we'll show you the volume of traffic through the construction zone, a pleasant drive, but haze is in the air as the sun is giving light to the area, we notice there's a little bit of haze hanging around. we'll track it and let you know if there's issues. so far, so good. >> not too bad. nice temperatures. >> it's nice this time of year. sometimes we get the 100-degree readings not the case. 50s right now, some of the fog that mike was talking about, pretty high up, not affecting visibility at all. there's a little bit of heat over the desert southwest that will come our direction, but it will only give us a couple 80s. notice the "l," the spinoff to the left side of your screen, it's giving us a little bit of sea breeze for the afternoon. it's keeping us mild. 70s and 80s tonight and tomorrow

work to choke off the oil well spewing into the gulf of mexico is at a standstill this morning. ships had to evacuate ahead of tropical storm bonnie. the storm is expected to enter the gulf by the weekend. kristen dahlgren is watching things from new orleans with us. she joins us now with the latest. good morning. >> reporter: they made the decision to evacuate late yesterday, and a couple of concerns with that. first of all, that means that the ships and the personnel

moving off site now, they are leaving the cap on, though. they think that that will continue to hold back the oil, but it's going to now be unmonitored for a time. this morning the live feeds are still up from some of the robotic subs. officials say those will be the last to leave, also the first to return. they'll come back after the storm passes to make sure that there weren't any breaches, weren't any leaks while nobody was watching that. it's also pushed back the timeline on getting this permanent leak killed. they were very close to getting the casing complete in that first relief well, and now they've had to obviously stop work on that, and it could be between a week and two weeks before they're able to get everything back onto the site, make sure that the wellbore and everything is still stable, and then once again resume drilling on that for the relief well and also for the new static kill that they plan to try. and then officials worried about where the storm will blow the

oil that's already in the gulf. so, a lot of concerns, everybody here watching this very closely. bonnie's not expected to become a hurricane, but that really doesn't matter at this point because either way, it means we're looking at this delay, and at least another week or two before they get that well permanently killed. laura? >> all right, we'll see. hopefully it won't do a lot of damage. two people are dead after a typhoon made landfall in southern china. it hit with winds up to 70 miles an hour and torrential rains. the two deaths happened when the storm knocked offer a wall. this morning the storm has moved north. it's now downgraded to a tropical storm. apologies are coming from everywhere for former u.s. usda worker shirley sherrod. but the biggest i'm sorry of all came from the president himself. president obama personally called sherrod yesterday and urged her to come back to work for the federal government. the president said sherrod should take back her job, to use the experience as a teachable moment.

sherrod was forced to resign from her post at the usda on monday because of racial comments taken out of context at an naacp meeting. she hasn't decided whether she will accept the job offer, but she says she does accept the apologies. go ahead, take over. time now is 5:46, we're brent and laura. you're watching nbc bay area morning news. we'll look at your freeways and forecast coming numb a second. but first an east bay family struggling to deal with the violent death of a 2-year-old boy. two family dogs mauled him to death and now police are blaming a relative. christie smith is live in martinez this morning. she's been following this story and has a look at what happened in that attack. christie? >> reporter: good morning to you. i can tell you the little boy's step grandfather is inside the county jail here in martinez. he's 52-year-old steven hayashi. he was booked on child endangerment and possessing mischiefious animal that causes

death or great bodily injury. detectives say he was the owner of all five of the dogs. now, after spending most of the day at the concord police department he was let out wearing a ball cap and into a van and taken to county jail. i spoke this morning to two men who were released from jail. they tell me they were in a holding cell with him, and the story came on the news, and shortly thereafter he asked to be moved to a cell by himself. now, police say hayashi's three pit bulls attacked and killed 2-year-old jacob bisbee, they say. the little boy was inside his concord home, walked into the garage where the dogs were kept when they attacked. hayashi was not home at the time but we're told two adults and another child were. neighbors tell us that the dogs -- some of them knew that there were dogs there on the trail creek court home, some didn't, but they say certainly they didn't know there were five of them. some say that they bark eed viciously. everyone stunned. all five of the dogs were

what you have is a prototype from a company called absolutely new. they're the same company that made the water hose thing i was showing you where it measures the water flow. the flow. and they also made the weighted dog leash where you carry two dog leashes in your hands and you can exercise them at the same time. so, they sent this cool invention. the idea is that it detects motion if it sees you walking through the dark house in the middle of the night. >> the doughnut lights up. >> the doughnut lights up and it works as a door handle. >> if it lights up on the door -- >> yes. >> -- i mean, i'm trying to figure out how you open the knob. >> it's a very good question. when we filmed it we hung it like this, it's actually supposed to hang like this, it fits in the door -- >> if you have the handle thing. >> i have the paddle handles at home. >> would that work or not with that? >> not so much. so, there you go. about 20 bucks. not on the market yet. total prototype, but kind of an interesting idea. and, boy, it's a weird-looking

we're looking at some folks who are now picking up their work. the on and off-ramps that the were affected by construction overnight should all be cleared. 101 the slowing around 880 is starting to clear as well likely, again, because of the equipment in the area that might have been messing around with our sensors. but we isn't seen major issues through the south bay this morning other than the construction. this will be a major issue, the garlic festival going on. chris mall hill park off of miller and off of 101 and 152 will have major congestion all weekend long starting, of course, today. but you can smell it coming, so, folks, you'll know when you're in the area. way back up north heading to the oakland coliseum where 880 is moving smoothly through the coliseum, haganberger, it's nice. you can bring your dog to the park tonight for the a's game, but one goes on the grill and one doesn't. keep that in mind. the maze, things are moving smoothly.
